Bull on the nullity of parish appointments made without the Tridentine examination
Cited in 2 articles of the Encyclopedia ↓
Condemnation of any collation of parish churches not made according to the form of the Council of Trent, whether done hitherto or to be done shortly.
Pius, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 How much diligence ought to be applied in conferring ecclesiastical benefices, especially parish churches, upon worthy and capable persons who are able to reside in the place and to exercise the care by themselves, is testified by the constitutions issued by Alexander III in the Lateran Council, and by Gregory X in the Council of Lyons, and likewise by Innocent III and other Roman Pontiffs, our predecessors.
2 § 1. In order that this may be done more carefully and rightly, the synod of Trent also decreed in session vii, chapter xiii, that when a vacancy of a parish church occurs, whether generally or specially, even by virtue of an indult in favor of the Holy Roman Church, or otherwise reserved or affected in any way, the bishop, having received notice of the vacancy of the church, if it be necessary, shall constitute a suitable vicar in it, with an assignment of a portion of the fruits at his discretion, who may bear the burdens of the church itself, until a rector is provided for it. And then the bishop and he who has the right of patronage shall, within ten days or another time to be prescribed by the bishop, nominate some clerics suitable for governing the church to the examiners appointed according to the form of the same synod; and the church shall be provided for only by the same examiners through a competition with other examiners, and as more suitable by the bishop appointed and chosen, otherwise all provisions or institutions made outside the aforesaid form shall be considered surreptitious.
3 § 2. But since human affairs always tend to deteriorate unless someone restrains them and commits them to proper execution, and it must be provided lest, on account of the transgression of such constitutions and the non-observance of their form, the greatest abuses arise, we, to whose notice it has come not without grave distress to us that some of our venerable brothers, archbishops and bishops, when a vacancy of parish churches occurs, have conferred them with little or no examination observed, especially that which ought to be done by competition according to the Council of Trent, or even with examination duly observed, upon less worthy persons, following the affection of carnality or other human passion rather than the judgment of reason, and have provided for them, wishing, as much as we can with God, to meet such and also future dangers.
4 § 3. Strengthening the constitutions of those same predecessors of ours mentioned above, by apostolic authority, in the tenor of these presents, we annul, declare null, void and of no force or effect all and singular collations, provisions, institutions and any dispositions whatsoever of parish churches made or to be made in the future by the same bishops and archbishops and by any other collators, whether ordinary or delegated, even cardinals of the Holy Roman Church and legates or nuncios of the Apostolic See, made outside and against the form prescribed by the same Council of Trent, especially in the examination to be done by competition, and we grant no right or title, even colorable, to those provided to possess them, and we decree, determine and declare that such parish churches, as before such collations they were vacant, shall now be vacant; and we reserve all of them, being vacant in this manner for the time being, to the disposition of ourselves and the Apostolic See or of those to whom the right of conferring them belongs, except for bishops and archbishops, who ought to have the care of the said examination according to the decree of the council.
5 § 4. Furthermore, lest parochial churches remain even temporarily in suspension, to the greatest peril of souls, concerning the provision of any parochial churches, which become vacant at any time, it pertains and belongs to bishops, archbishops, primates and patriarchs and any other ordinary collators, in the months ordinarily assigned by our rules, to make provision and collation; and if these same bishops and ordinaries aforesaid, within the space of six months from the day of their vacancy, shall not have provided for them after a complete examination according to the form of the aforesaid Council of Trent, and also concerning those churches whose collations are reserved or assigned to us and the said See generally or specially and for any cause whatsoever, or belong to others by indult of the Apostolic See, to which, upon their vacancy occurring, the aforesaid bishops and archbishops shall not have chosen persons by examination, with mutual concourse held according to the form of the said Council of Trent, approved and more suitable, or having chosen them shall not have signified them to us or our successors or to those to whom the collation shall pertain, within the space of four months from the day of that vacancy, for obtaining the collation; and likewise concerning similar parochial churches which shall be of ecclesiastical patronage or of others or of clerics and laypeople together, if the person presented within the time fixed by law to the same patrons, after previous examination according to the form of the said council approved, is sought to be instituted, and this institution shall have been delayed for two months from the day of presentation, we reserve the collation, provision, institution and every manner of disposition to us and to the said See and to the persons holding such indult to confer, provide or institute respectively, yet giving in parochial churches of patronage right the option to the patrons themselves, so that if the institution shall pertain to the ordinaries, the ordinaries being negligent in making it and delaying beyond the said two months, they may, for obtaining such institution, have recourse to the metropolitan or the nearer ordinary or to the Apostolic See.
6 § 5. We also prohibit the same ordinaries from presuming or daring to extend beyond the other ten days the time of ten days fixed by the same Council of Trent to the same ordinaries and patrons for nominating suitable clerics before the appointed examiners.
7 § 6. We strictly forbid that anyone, even the Roman Pontiffs or others holding such indults as aforesaid, or whosoever be armed with authority in this matter, presume in any way to dispose of such benefices thus reserved (as aforesaid) or concerning them, even by way of exchange or otherwise, to make any innovation whatsoever.
8 § 7. But in order that parochial churches be conferred not only on worthy but more suitable persons found, according to the decree of the same council, we will and by the same authority decree that if a bishop shall have chosen one less able, passing over those more suitable, those who shall have been rejected may appeal from such bad election to the metropolitan, or if the one electing be himself metropolitan or exempt, to the nearer ordinary, as our and of the said See delegate, or otherwise to the Apostolic See itself; and may challenge the one pre-elected to a new examination before the same judge of appeal and his examiners, and if it be established that the first elector acted with unreasonable judgment, and that judgment be revoked, the parochial church shall be conferred on the more suitable one by the same judge of appeal by our authority (insofar as the collation pertained to the bishop from whom appeal was made), otherwise it shall be remitted to be conferred on the same more suitable one approved by the judge of appeal, to him to whom the collation, provision or institution shall pertain.
9 § 8. This appeal, however, being interposed, shall not meanwhile impede or suspend the election made by the ordinary in the first place, but it shall meanwhile be committed to due execution, and the person elected shall not be removed from the same church while this cause of appeal is pending.
10 § 9. And if anyone shall think fit to appeal from the sentence pronounced by the judge of appeal, he shall then appeal to the Apostolic See itself. If otherwise in all and singular the aforesaid matters, we decree that what shall have been done or attempted shall be null and void.
11 § 10. We will, however, that transcripts of these presents, subscribed by the hand of some public notary and furnished with the seal of some person constituted in ecclesiastical dignity, shall receive the same faith in judgment and outside of judgment as would be given to these presents if they were exhibited or shown.
12 § 11. And that these letters, published and affixed at the doors of the Apostolic Camera and Chancery and the Audience of the causes of the Apostolic Palace, and in the open space of the Campus Florae, copies being left there, shall affect and bind all in the same manner as if they had been personally intimated to them.
13 Let no one therefore, etc.
