Licet de vitanda
Decree on papal elections (Licet de vitanda)
1 Although our Predecessors have sufficiently established manifest provisions for avoiding discord in the election of the Supreme Pontiff, nevertheless because the Church has often suffered grave schism after those provisions through the audacity of wicked ambition, we also, for the purpose of avoiding this evil, by the counsel of our Brethren and with the approval of the sacred council, have decreed something to be added. We therefore establish that if perchance, the enemy man sowing tares, full concord among the cardinals concerning the substitution of a pontiff cannot be achieved, and two parts being in agreement the third part is unwilling to agree or has presumed to ordain another for itself, he shall be held to be the Roman pontiff who shall have been elected and received by two parts.
2 But if anyone, relying on the nomination of the third part, because he cannot accomplish the matter, shall have usurped for himself the name of Bishop, both he himself and those who shall have received him shall be subject to excommunication and shall be punished with deprivation of the entire sacred order, so that even the communion of viaticum shall be denied to them, except only at the last, and unless they repent, they shall receive a portion with Dathan and Abiron, whom the earth swallowed up alive.
3 Furthermore, if anyone shall have been elected to the office of the apostolate by fewer than two parts, unless greater concord shall have intervened, he shall in no way be assumed and shall be subject to the aforesaid penalties, if he shall not humbly refrain. From this, however, no prejudice shall be generated to the canonical constitutions and other churches, in which the opinion of the greater and senior part ought to prevail, because what shall have come into doubt in them can be defined by the judgment of the superior. But in the Roman Church something special is constituted, because recourse to a superior cannot be had.
