Bull against bigamous marriages under a false name

Bull of Pope Urban VIII ·

DLXXI.
Against those who, under a false name or surname, while the first wife still lives, proceed to a second marriage. Urban, Pope VIII, for perpetual remembrance of the matter.

1 Great is in Christ and in the Church the sacrament of matrimony, which is the legitimate and indissoluble union of life between man and woman, in which by equal consent each ought to give himself to the other; therefore those are to be corrected with grave and fitting penalties who, forgetful of the commandments of the Lord and disregarding the care of their own salvation, do not fear to violate the most sacred laws of such a sacrament.

2 § 1. Since therefore, as we have learned not without great distress of mind, there are found those sons of iniquity who, under a false name or surname, while the first wife still lives, dare to proceed to a second marriage:

3 § 2. We, desiring to repress according to the office of apostolic service committed to us from above, as much as we are able with the Lord, such wicked temerity of depraved men of this sort, having first imposed the penalty of anathema upon those saying that it is lawful for Christians to have several wives, which the Council of Trent decreed, De sacros. matrim., sess. xxiv, can. 2, and the same thing Innocent III asserts to be prohibited, cap. Gaudemus, § Nec ulli, De divortiis, VIII rr. 595 An. C. 1637, we, having deliberated this matter with our venerable brothers the cardinals of the Holy Roman Church in the whole Christian republic against heretical depravity with the general inquisitors deputed by this Holy See, by this our constitution perpetually valid, decree that such delinquents of this sort shall be condemned, beyond the penalties by which they are ordinarily wont to be punished, to the galleys in perpetuity: and if they shall be found unfit, they shall be publicly scourged and condemned to imprisonment in perpetuity; but if by reason of the quality and enormity of the crime they shall have merited graver penalties, they shall even be delivered to the secular court for punishment at the discretion of the aforesaid congregation of cardinals.

4 § 3. Decreeing that these letters, with the clauses prescriptive and protective and all and singular things contained in them, even from this, that whosoever having an interest in the foregoing or in any of them, or pretending in any way to have an interest, called and heard to them, and the causes on account of which these same letters were issued, verified, or otherwise sufficiently, or even not at all justified, at no time ever by the vice of subreptiousness or obreption, or nullity, or invalidity, or of our intention, or any other defect whatsoever be noted, impugned, invalidated, retracted, recalled into law or controversy, or reduced to the terms of law, or against them restitution in full, opening of the mouth, reduction to the way and terms of law, or any other whatsoever remedy of law, fact, grace or justice be obtained, or in any way granted, or obtained or granted that anyone use, or avail himself in judgment or outside be able, nor under whatsoever similar or dissimilar grants revocations, suspensions, limitations, or other contrary dispositions made and to be made for the time being in any way be comprehended, but always excepted from them, and perpetually valid, 1 Edit. 7 firm and efficacious to exist and to be, to obtain and to acquire their full and complete effects, and to be inviolably observed by all and singular, to whom it shall pertain in the future;

8 § 4. And thus and not otherwise in the foregoing all and singular by whatsoever judges ordinary or delegated, even auditors of the causes of the apostolic palace, and cardinals of the Holy Roman Church, even legates and nuncios of the side and others, exercising any authority and power whatsoever, the facility and authority of judging or interpreting otherwise being taken away from them and from each of them, ought to be judged and defined, and null and void, if otherwise concerning these things by anyone whatsoever, by any authority, knowingly or unknowingly, it should happen to be attempted. To those doing otherwise in any way whatsoever.

9 § 5. But in order that these letters and whatsoever things contained in them may be brought to the knowledge of all, and lest anyone be able to pretend ignorance of them, we likewise will and command, that these same letters by one or more of our couriers be affixed and published at the doors of the Lateran church, the basilica of the Prince of the Apostles in the City, and also of the apostolic chancery, and in the square of the Campus Florae, and, when they shall be removed from there, copies of them affixed in the same places be left behind, which thus published and affixed affect and bind all and singular, whom they concern, just as if to each of them personally intimated and notified;

10 § 6. And that transcripts of them, even printed, subscribed by the hand of some public notary, and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith be given, which would be given to these letters themselves, if they were exhibited or shown.

11 § 6. And that to their copies, even printed ones, subscribed by the hand of some public notary, and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given as would be given to the originals themselves, if they were exhibited or shown.

12 Given at Rome, at St. Mary Major, under the Fisherman's Ring, on 20 June 1637, in the fourteenth year of our pontificate. Given on 20 June 1637, pontificate year 14.

DLXXI.

2. E lo stesso proibisce Innocenzo III, cap. Gaudemus, § Nec ullì, De divortiis. Vili rr. 595 An.

7 ferme ed efficaci esistere e essere, sortire e ottenere i loro pieni e interi effetti, e da tutti e singoli, a cui spetterà in futuro, inviolabilmente osservarsi;

9 Manda § 5. Affinché però le presenti e tutto ciò che in esse è contenuto giunga a notorietà di tutti, e nessuno possa pretendere ignoranza di esse, vogliamo parimenti e mandiamo che le medesime presenti siano affisse e pubblicate da uno o più dei nostri cursori alle porte della chiesa Lateranense, della basilica del Principe degli apostoli in Urbe, nonché della cancelleria apostolica, e nella piazza del Campo di Fiore, e quando da lì saranno tolte, se ne lascino copie affisse negli stessi luoghi, le quali così pubblicate e affisse colpiscano e vincolino tutti e singoli coloro che le riguardano, come se fossero state loro personalmente comunicate e notificate;

10 affinché la presente pubblicazione, qualunque cosa ad essa riguardi, sia portata a notorietà di tutti in Urbe e, affinché nessuno possa pretendere ignoranza di essa, vogliamo parimenti e ordiniamo che le medesime presenti per mezzo di uno o più dei nostri cursori siano affisse e pubblicate alle porte della chiesa Lateranense, della basilica del Principe degli apostoli dell'Urbe, nonché della cancelleria apostolica, e nella piazza del Campo di Fiore, e, quando da lì saranno rimosse, i loro esemplari rimangano affissi negli stessi luoghi, le quali così pubblicate e affisse colpiscano e vincolino tutti e singoli coloro che le riguardano, allo stesso modo come se fossero state loro personalmente comunicate e notificate;
