Operante divinae
Bull approving the rule of the Trinitarian Order
1 By the working of divine providence's mercy, established in the watch-tower of the Apostolic See, we ought to support pious desires with affection, and those which proceed from the root of charity, to bring to effect; especially where what is sought is for Jesus Christ, and the common utility is preferred to private advantage. Indeed, when you, beloved in Christ, son and brother John the minister, came formerly to our presence, and took care humbly to signify to us your purpose, which is believed to have proceeded from divine inspiration, seeking your intention to be confirmed by apostolic protection; we, that we might more fully know your desire founded in Christ, beyond whom no stable foundation can be laid, directed you by our letters to our venerable brother the bishop and beloved son the abbot of Saint Victor in Paris; so that through them, as those who knew your desire more perfectly, instructed concerning your intention, and the fruit of your intention and the institution of the order, and the manner of living, we might be able to impart our assent to you more securely and effectively. Since therefore, as we have learned clearly from their letters, you appear to seek the gain of Christ more than your own, wishing that apostolic protection should be present to you, we grant to you and your successors by the authority of these presents, and ordain that it remain inviolate forever, the rule according to which you ought to live, whose tenor the said bishop and abbot transmitted to us in their letters along with those things which we deemed should be added concerning our disposition and your petition, son minister. The tenor of which, that it may be expressed more clearly, we have ordered to be noted below.
2 § 1. In the name of the Holy and Undivided Trinity. The brothers of the house of the Holy Trinity, under the obedience of the prelate of their house, who shall be called minister, shall live in chastity and without property. Let all things, from whatever source they come lawfully, be divided into three equal parts, and insofar as two parts suffice, let works of mercy be carried out from them, with moderate sustenance of themselves and those who necessarily serve them. But let the third part be reserved always for the redemption of captives who are imprisoned for the faith of Christ by pagans, or for the redemption of pagan captives, giving a reasonable price for their redemption, or for the redemption of Christian captives, so that afterwards by reasonable exchange and good faith, a Christian may be redeemed for a pagan according to the merits and status of persons. When money shall have been given, or anything else, even if it be given specially and properly for something, always by the consent of him who gave it, the third part shall be separated, and it shall not be received otherwise, except for lands, meadows, vineyards, woods, buildings, livestock and such things. For the fruits coming from them, deducting expenses, namely half removed for expenses, shall be divided into three equal parts; but those which receive few or no expenses, shall all be divided. When cloth or shoes, or small things of this kind, which it is necessary to use, which it is not expedient to sell or preserve, shall have been given, or they shall have obtained from themselves, let them not be divided, unless it seem expedient to the minister of the house and the brothers. Concerning each of these things on Sundays, if it can be done, let deliberation be made in chapter. If however the aforesaid things, such as cloth, lands, livestock, or small things were to be sold, the price coming from them shall be divided into three parts as above.
3 § 2. All churches of this order shall be entitled by the name of the Holy Trinity, and shall be of plain work. Brothers may be in one dwelling, three clerics and three laymen, and besides one who shall be procurator; who, not procurator, but minister, as has been said, shall be named, as brother N. minister of the house of the Holy Trinity, to whom the brothers are bound to promise and render obedience. Let the minister faithfully administer to all his brothers as to himself. Let vestments be woolen and white; and let it be permitted to them to have single furs and breeches, which when lying down they shall not remove. Let them lie in woolen things; so that feather pillows or mattresses, except for those laboring in sickness, in their own houses they shall by no means have. But let them have a pillow for moderate support. In cloaks let signs be imposed. Let not horses be ascended, nor even be had, but let it be permitted to ascend only asses, given, or loaned, or taken from their own livestock.
4 § 3. Wine to be consumed by the brothers shall be so tempered that it may be drunk soberly. Let them fast from the Ides of September, on Monday, Wednesday, and Friday, and Saturday, unless a solemn feast intervene, until Easter; yet so that from Advent until the Nativity of the Lord, and from Quinquagesima until Easter, except on Sundays, they fast on Lenten food, and likewise observe other fasts which the Church is accustomed to celebrate. The minister, however, may sometimes relax the fast with discretion on account of age, or travel, and another just cause, or having inspected the resources, even increase it. It shall be lawful to eat meat given by those from outside, or taken from their own provisions, only on Sundays from Easter until Advent of the Lord, and from Christmas until Septuagesima, and on the Nativity and Epiphany of the Lord, and on the Ascension of the Lord, and the Assumption and Purification of the Blessed Mary, and on the feast of All Saints. Let them buy nothing for food, except bread, and pottage, namely beans, and peas and such like legumes, vegetables; oil, eggs, milk, cheese, and fruit. But neither meat, nor fish, nor wine shall it be lawful to buy, except for the necessity of the sick, or of children, or of the poor, or on great solemnities. It shall be lawful, however, to buy provisions, and to nourish themselves. When, however, they shall be on a journey or pilgrimage, it shall be lawful for them, but sparingly, to buy wine and fish in Lent, if it be necessary, and if anything shall have been given to them, let them live on that, and divide the remainder into three parts. Those who shall have set out on the way to redeem captives, whatever shall have been given to them, they ought to put the whole toward the redemption of captives except for expenses. In cities, in towns, or in castles, in which they have their own houses, let them eat or drink nothing whatsoever outside those houses, except perhaps in a house of religion, even if asked by anyone, unless perhaps water, in respectable houses; nor shall they presume to lodge outside such houses. Never shall they lodge, eat, or drink in taverns or in such disreputable places. Whoever shall have presumed to do this, according to the judgment of the minister shall be subject to severe punishment.
5 § 4. Let there be such charity among the brothers, both clerics and lay, that they use the same food, clothing, dormitory, refectory and the same table. Let the sick sleep and eat separately: for the care of whom some lay brother, whether lay or cleric, shall be appointed, who shall inquire into and minister those things which shall be necessary, as it shall be proper to minister. Let the sick, however, be admonished, that they not require rich or overly sumptuous food, but rather be content with suitable and healthful moderation. The care of guests and the poor, and of all coming and going, shall be entrusted to one of the more discreet and kind brothers, who shall hear them, and as it shall seem expedient, shall administer the comfort of charity. Let him, however, require of those whom he shall believe ought to be admitted, whether they wish to be content with those things which are set before the brothers. Truly, no one ought to be admitted to rich and sumptuous food. Whatever, however, is to be provided, let it be provided with cheerfulness, and let no one render curse for curse. If anyone, and especially a religious, shall have come to lodge, let him be received kindly, and charitably according to the ability of the house let provision be made for him. Oats, however, or something else in place of oats, shall not be given to guests, if they shall be in a city, or town, or where it may be found for sale, unless perhaps they shall be religious guests, or such as do not have it at hand, and cannot buy it. If, however, guests shall not have found it for sale, and it shall be found in the house in which they shall have been received, let it be provided to them suitably. No brother, lay or cleric, shall be, if it can be done, without his own office; if anyone, however, shall be unwilling to work, and shall be able, let him be compelled to leave that place, since the Apostle says: He who does not work, shall not eat 1.
6 § 5. Let them observe silence always in their church, always in the refectory, always in the dormitory. Concerning necessary matters, however, it is permitted to speak at other suitable times, and with lowered voice, humbly, and decently; and outside the aforesaid places, their speech everywhere shall be honest and without scandal. Similarly, let all their bearing, gesture, life, action, and all other things be found honest in them. The chapter, if it can be done, let the minister hold with his brothers in each house on each Sunday, and concerning the affairs of the house, and those given to the house or brothers, so that a third part be assigned to the redemption of captives, let the brothers render account faithfully to the minister, and the minister to the brothers. Not only to the brothers, but also to the household of the house, according to their capacity, similarly on each Sunday, if it can be done, let exhortation be made, and let they be simply admonished what they ought to believe or do. Concerning all matters and disputes in chapter let the brothers be judged. Let no brother accuse his brother in public, unless he can prove it well. Whoever does this shall undergo the penalty which the guilty party would undergo, if he could be convicted, unless the minister for cause wishes to dispense with him. If any commit scandal, or anything of this sort, or (God forbid) strike one another, according to the judgment of the minister, let them be subject to greater or lesser punishment. If one brother sin against a brother, that is, against a brother, that is, he alone knowing, whom the injury was suffered, let him bear patiently, even if he be innocent; and when the commotion of minds has quieted, let him admonish and correct him kindly and fraternally up to three times between himself and that one alone, and let him do penance for what was committed, and abstain from similar things in the future. But if he does not listen, let him tell the minister, and he shall correct him in secret according to what he sees expedient for his salvation—
—of faults.
7 Whoever truly moved scandal, and wishes to amend by himself, let him extend himself entirely before the feet of the scandalized one, asking pardon; and if once is not sufficient, let him do the same thing up to three times. But if this comes into public, whatever penance shall be secular, let this be first, namely, before the feet of the minister asking pardon with full extension of the whole body, and afterwards let it be amended according to his judgment. Let the general chapter be celebrated once a year. This ought to be done in the octave of Pentecost. If for the necessity of the house any debt ought to be contracted, let it first be proposed to the brothers in chapter, and let it be done with their counsel and assent, so that thus suspicions and murmurings may be avoided. If anyone bring violence against the substance of the house, and it should be necessary to refer it to a judge, let this not be done before he is first charitably admonished by the brothers, afterwards also by other neighbors similarly.
§ 6. Let the election of the minister be made by the common counsel of the brothers; nor let him be elected according to the dignity of birth, but according to the merit of life, and wisdom of doctrine. But he who is elected shall be a priest, or a cleric apt in orders, and let him be professed: but the minister, whether greater or lesser, shall be a priest. The greater minister can hear the confessions of all brothers of congregations of the same order. But the lesser minister shall hear the confessions of all brothers of his house; provided that the shame of repeated excess afford no occasion for confessing later to his superiors or less purely than is fitting. But let the minister carefully provide that he keep the precepts of the rule, just as the other brothers, in all things. After he has been elected, if he should deserve to be deposed on account of fault, let him be deposed by the greater minister, having convoked three or four lesser ministers, and another, who is worthy, shall be substituted in his place. But if the greater minister cannot do this on account of the removal of lands or another reasonable cause, let it be committed to the lesser ministers and the more religious; and what they shall do shall be ratified by the authority of the greater minister. But if the greater minister himself ought to be corrected or deposed on account of excesses, let this be done by four or five ministers of the same order, the more religious, who then ought to be elected by the authority of the general chapter for this purpose.
§ 7. If anyone wishes to be a brother of this order, let him first be for a year with expenses, three times besides food, his habit, and all his things retained, let him serve in the order for God, and after a year, if it seem good to the minister of the house and the brothers of that place, and the place has become vacant, let him be received. Nothing, however, shall be exacted for his reception. If, however, he gives something freely, let it be received; provided that it be such that no litigation to the Church seems to be imminent. But if concerning anyone's morals it seem doubtful, let a more prolonged probation be had of him. If before reception anyone shall have conducted himself intemperately, and impatient of discipline, and according to the judgment of the minister has not amended his morals, let there be granted to him modestly permission to depart with all that he brought. But in the order let no one be received before he seems to have completed his twentieth year. But profession shall be left to the judgment of the minister.
§ 8. Let them not accept pledges except for tithes and reasonable causes, and with the permission of their bishop, from the hand of a layperson. Let them not take oaths except in great necessity, and with the permission of the minister, or commanded by their bishop, or by another holding apostolic authority, and this for an honest and just cause. If any defect in a thing which is being sold be known, let it be indicated to the buyer. Let them not be permitted to receive a deposit of gold, or silver, or money. On the very day on which the sick person shall come, or shall be brought, let him confess his sins and communicate. On every Monday (except in the octaves of Easter, and Pentecost, and the Nativity of the Lord, and the Circumcision, and Epiphany, and except in the solemnities which are proclaimed to be observed), after Mass for the faithful is finished, let absolution of the faithful deceased be made in the cemetery. Moreover, on every night at least in the hospital before the poor, let common prayer be made for the state and peace of the holy Roman Church and of all Christendom, and for the benefactors and for those for whom the universal Church is accustomed to pray.
§ 9. In the regular hours let them observe the custom of St. Victor; unless perhaps the pauses, or other lengthy passages, or vigils, on account of labor and the fewness of servants, should be remitted by the counsel of pious and religious men. On account of their fewness indeed, they shall not be bound to make so many pauses in chanting, nor to rise so early. In the matter of shaving likewise let the clerics follow the order of St. Victor, but let the laymen not shave their beards, but let them permit them to grow modestly.
8 Let it therefore be permitted to no one at all to infringe this page of our concession and constitution or to dare to act contrary to it. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God, and of the blessed Peter and Paul his apostles. Given at the Lateran, on 16 January, in the year of the incarnation of the Lord, one thousand one hundred ninety-eight, in the first year of the pontificate of our lord Pope Innocent the Third.
9 Given on 17 December 1198, pontificate year 1

In cappis signa capitis permittantur.
