Bull promulgating the Clementine Constitutions

Bull of Pope John XXII ·

1 CONSTITUTIONS OF POPE CLEMENT V, PUBLISHED IN THE COUNCIL OF VIENNE. PREFACE.

2 John, bishop, servant of the servants of God, to his beloved sons, doctors and scholars of every faculty dwelling in Bologna[[fn:1)]], greeting and apostolic blessing! Since no sanction of law, however carefully weighed and deliberated, suffices for the variety of human nature and its unforeseeable machinations, nor does it attain to a clear decision of such knotty ambiguity; especially since scarcely anything is so certain and clear that, from causes arising (which laws, already established, cannot remedy[[fn:2)]], it is not called into question; and since also from youth human sensuality inclines toward evil, by which the subversion of morals in clergy and people frequently creeps in: the authority of a superior is necessary, both that through the aid of timely determination it may remove ambiguities, take away disputes, settle quarrels, and cut through obscurities, and that through the careful cultivation of a watchful gardener it may root out vices, implant virtues, correct excesses and reform morals. This indeed the blessed Pope Clement V, our predecessor of happy memory, prudently considering, and providently desiring to provide for the reformation of those who had fallen away, to resolve difficulties, and to promulgate sanctions consonant with questions and matters at hand, long ago not only in the Council of Vienne, but also before and after that council, published very many constitutions, in which he set forth many things useful and salutary, and decided certain doubts frequently encountered in judgments and outside them. And although he had decreed to send them, collected into one volume[[fn:3)]] and arranged under appropriate titles, and to give them in common to his subjects: nevertheless, constant occupation with great and arduous human affairs, which removed him from our midst, was the reason why he did not fulfill his purpose in this matter. We also, who, like him, though unworthy, have succeeded to the office of the apostolate by the permission of the Lord, ought likewise to succeed[[fn:4)]] in the fullness of affection in those things which concern the compendium of all[[fn:5)]]; yet from our very beginning in promotion we have been surrounded by so many great and difficult matters, that both from this and from other reasonable causes, which we have providently committed to silence[[fn:6)]], we have hitherto[[fn:7)]] been prevented from communicating to you the aforesaid constitutions. Now therefore, seizing the opportunity, we send them to you under our bull, commanding your university through apostolic letters, that you receive them with ready affection and eager zeal, and that, thus made manifest and known to you, you shall use them henceforth in judgments and in schools. Given[[fn:8)]] at Avignon, on the 8th day before the Kalends of November, in the second year of our pontificate.

Clement, Pope V, by nation a Frenchman, from the province of Gascony, diocese of Bordeaux, was created Roman Pontiff in the year 1305. He not only in the Council of Vienne, but also before and after that council published very many constitutions: which, both on account of constant occupation and death preventing him, collected into one volume and arranged under appropriate titles, he was unable to publish, as he had decreed, John XXII, his successor, published. John of Andrea of Bologna illustrated them with glosses. John, Pope XXII, by nation a Frenchman, from the region of Cahors, from the province of Aquitaine, was created Roman Pontiff in the year 1316. He, besides the constitutions of Clement V his predecessor, also published many of his own, to which Zenzelinus of Casani, whom others call Genzelinus, added copious commentaries.

1 COSTITUZIONI DEL PAPA CLEMENTE V, EDITE NEL CONCILIO DI VIENNE. PREFAZIONE.

/. 2. C. 2. qu. 8c. 11. X. de probat, c.3. /. profatus, de sent. et re iudic. in 6. De quo in Spec. de instrum. ed. /. restat.
