Romanus Pontifex
Bull declaring the Mendicant Orders exempt from seminary contributions
1 and St. Francis, as well as the Hermits of St. Augustine, and the Carmelites, and the Servants of the Blessed Mary are truly and properly Mendicant religious Orders, even if they possess common goods, though immovable, and enjoy all their privileges. Pius, Pope V, for the record of the matter. The Roman Pontiff, the principal defender both of universal Christendom and of each of these religions, willingly meets all their inconveniences, for the sake of his pastoral duty, and is accustomed to provide for their indemnity with salutary declarations and other remedies suited to the exigency of the times and customs.
2 § 1. Indeed, although the beloved sons, the brothers of all these Mendicant Orders, are exempted by the decrees of the Council of Trent from the contribution to the seminary of clerics, to be erected in each city according to the form of that same council, and we, among other things, have exempted and freed the brothers of these Mendicant Orders themselves and each of them, by apostolic authority, both from such seminary contribution and from any subsidy whatsoever, as well as from any tithes and other burdens of this kind, and have decreed that they can never at any time be compelled and forced to contribute to all of these; yet we have not without displeasure of mind recently learned that some local ordinaries, and perhaps in provincial councils, perhaps under the pretext that the brothers of the Mendicant Orders can retain such stable goods by apostolic indult or dispensation, and for that reason are not truly Mendicant, have perhaps presumed, and presume daily, to compel them to contribution to the seminary, subsidy, tithes and other burdens of this kind, to the grave burden and not inconsiderable prejudice of these Orders themselves.
3 § 2. We, turning over in our mind that they bring forth from the fruits of such goods various utilities to Christian society, since from these they maintain various masters and doctors, from whose teaching their novice brothers, instructed and made learned afterwards, aid and feed the flock of the Lord by their preachings, counsels, confessions, prayers and other innumerable works of piety, and that their houses can be called seminaries no less than those which have been erected by ordinaries, and for that reason ought in no way to lose the name of Mendicant. Wishing therefore to cut away all matter of doubt, all and singular brothers of the Mendicant Orders of this kind, and each of them, from whatever excommunication, suspension and interdict and other ecclesiastical sentences, censures and penalties, whether by law or by man, in any occasion or cause whatsoever imposed, if they are bound by any of these in any way, for the purpose of obtaining the effect of these presents, we absolve by the tenor of these letters, and we consider them absolved; and likewise of all and singular litigations and causes, pending before whatsoever judges and in whatsoever manner and place, the status and merits, names and cognomens of the judges and litigants, as well as of whatsoever privileges, indults, exemptions and immunities of these Mendicant Orders conceded to the brothers in any manner heretofore, the tenors of which we hold as expressed in these presents, we also advocate the aforesaid litigations and causes, as aforesaid, pending to us by the tenor of these letters, and extinguishing them entirely, and imposing perpetual silence upon such litigants concerning the premises, by our own motion, not at the instance of the petition of these brothers or any of them offered to us concerning this, but from our certain knowledge and from the fullness of apostolic power, all and singular brothers of the four Mendicant Orders, namely of St. Dominic, and St. Francis, and of the Hermits of St. Augustine, as well as of the Carmelites, and whom we also wish to be reckoned, the Servants of the Blessed Mary comprehended in the names, their houses, monasteries and places, even if they possess in common their own goods, both movable and immovable and stable and whatsoever other things, we establish and declare by apostolic authority through these presents that they are able and ought to use the name of Mendicant and all and singular Mendicant privileges conceded to them in any manner, and that they cannot be molested concerning the premises at any time whatsoever, and we extend and enlarge both the Council of Trent and all and singular other decrees, statutes, ordinances, privileges and laws speaking of Mendicants to all and singular the aforesaid Orders and their houses and places, even retaining their own goods in common, and we declare that they speak of them also by the aforesaid authority, through these same presents.
4 § 3. And moreover to the same and to any others whatsoever, both ecclesiastical and secular, exercising any authority, in virtue of holy obedience and other penalties to be moderated by our judgment, we likewise command by these presents that, if anything during our time and that of our predecessor, whether by reason of seminary aid and tithes, or other burdens of this kind, was exacted by them, all of it shall be restored to the same brothers, with all delay and postponement set aside; strictly forbidding to the ordinaries of those places and to other persons, both ecclesiastical and secular, exercising any authority, and of whatever dignity, rank and condition existing, that they dare or presume to molest, disquiet or disturb the aforesaid brothers of the Mendicant Orders retaining such goods, on any pretext whatsoever, concerning contribution to seminary aid and tithes.
5 § 4. Decreeing also that these present letters can in no way at any time be noted or impugned on account of the vice of subreption or obreption, or of our intention or any other defect; nor be included under any revocations, modifications, limitations, restrictions and other contrary dispositions of similar or dissimilar favours, made and to be made in any way by us and also by our successors, and with whatever clauses, even derogatory of derogations and other more efficacious and unusual clauses, and irritant decrees, of whatever tenor they may be; but, those notwithstanding, they shall persist in their force and efficacy, and as often as they shall emanate, so often shall they be restored to their pristine state, replaced and fully reintegrated, and even under a date to be chosen anew by themselves granted afresh, and thus it is of our unchangeable will and intention; and to this end, that they may subsist with perpetual firmness, they ought to have the force of a valid and efficacious contract between the Apostolic See and the aforesaid brothers of the Mendicant Orders. And thus by whatever judges and commissioners, exercising any authority, even auditors of the causes of the Apostolic Palace, and cardinals of the Holy Roman Church, with the faculty and authority of judging and interpreting otherwise in any way removed from them and from each of them, they ought to be judged; and whatever is otherwise attempted concerning these matters by anyone, with any authority, knowingly or unknowingly, is also null and void.
6 § 5. Wherefore, to our beloved sons, the general auditor of the causes of the Apostolic Camera and the chamberlain, as well as to the deans, provosts, archpriests, archdeacons, treasurers and whatever others holding dignities in the same churches, whether cathedral or collegiate, existing anywhere and in whatever regions, lands and places, by these presents with like motive we command that they themselves and each of them, by themselves or by another or others, these letters and whatever is contained in them, where and when it shall be necessary, and as often as they shall be required on behalf of the said brothers or any of them, solemnly publishing, and permitting them to enjoy and possess peacefully in all the aforesaid matters, not allowing them or any of them to be molested in any way indebitably thereupon. Compelling whatever contradictors and rebels by sentences, censures and ecclesiastical penalties, and other appropriate remedies of law and fact, appeal being set aside. And nevertheless, with legitimate proceedings to be observed concerning these matters, even aggravating the said censures and penalties, invoking also to this end, if it shall be necessary, the aid of the secular arm.
7 § 6. Notwithstanding the constitutions of Boniface, Pope of happy memory, our predecessor, on the one hand, and of the general council on two matters, provided that no one be drawn to judgment beyond three matters by virtue of these presents, and other apostolic constitutions, as well as those issued in provincial and synodal councils, special or general; and any statutes and customs whatsoever, even those strengthened by oath, apostolic confirmation, or any other firmness; privileges also granted and apostolic letters, under whatsoever tenors and forms, and with whatsoever clauses, even derogatory clauses of derogations and other more efficacious and unusual clauses, irritant and other decrees, in general or in particular, even by similar motu proprio, and from certain knowledge, and by the fullness of apostolic power, and otherwise in any manner whatsoever, even granted, approved, confirmed, and frequently renewed in consistory. All of which, even if special, specific and express mention of them and of their entire tenors, or some other exquisite form to be observed for this purpose were required (these tenors, as if inserted word for word, with nothing whatsoever omitted, and the form transmitted in them observed, we having these presents for expressed), on this occasion only, we specially and expressly derogate, anything to the contrary notwithstanding. Or if to some, commonly or severally, it has been granted by the same See that they cannot be interdicted, suspended or excommunicated by apostolic letters not making full and express mention, and word for word, of this indult.
8 § 7. We will, however, that the transumpts of these presents, etc. And that these same presents be published by someone of our couriers at the Apostolic Chancery and the basilica of the Prince of the Apostles in the City, as well as in the field of the Campus Florae, and be inscribed among the extravagant constitutions to endure perpetually, and, after they have been published, make full and undoubted faith, and bind all and each those concerned by them just as if they had been personally intimated.
9 Given at Rome at St. Peter, under the Fisherman's Ring, on the 3rd of October 1567, in the 3rd year of our pontificate.
