Sollicitudo pastoralis
Bull on the institution of archives in the Papal States
130.
Institution of archives of documents in whatever cities and places of the Ecclesiastical State, excepting the nourishing City and Bologna, and the erection of the office of regent of the said archives, with the assignment of jurisdiction and privileges 1 Sixtus, bishop, servant of the servants of God, to the perpetual memory of the matter.
1 The pastoral solicitude of the office, laid upon our shoulders, though unequal to it, by divine disposition, continually strikes and moves our heart, so that we may direct the keen attention of our vigilance not only to those things which regard the salvation of souls of the universal Christian flock committed to us from on high, but also to those things which pertain to the utility, peace, tranquility and perpetual security of the peoples subject to our temporal dominion and that of the Apostolic See; and especially we may provide in some fitting manner for those harmful things which, through insufficient and not sufficiently exact diligence in preserving both public and private documents, we understand to arise frequently and flourish among our subjects, with grave trouble to us and to them and with loss and damage to their fortunes.
2 § 1. Since therefore from diligent custody of documents themselves, frauds and falsities, which for the most part provide a way for lawsuits, discord and dangers of this sort, are prevented, domains, possessions and families themselves are preserved, and justice is finally administered with certainty of mind and with equal balance for the public and private utility of all. And accordingly public archives, 1 which not only in Europe but also in many other parts of the whole world, even barbarous, which have maintained the common good of their subjects and indeed the bond of human society among themselves by this means especially, have been carefully instituted; it is indeed worthwhile and fitting that what is recognized to redound to all as an example of more wholesome governance and administration of public affairs, this very thing should be healthfully introduced into our Ecclesiastical State, to which in the preceding centuries, on account of the military tumults by which that region and almost all of Italy then burned, so much benefit of public peace could not be afforded, but now at last through the ministry of our provision should be introduced.
3 § 2. Therefore we, in the manner of a pious father and mindful of our pastoral care, wishing to bring about such quiet and universal utility to our subjects, for the preservation, faith and security of the aforesaid writings, to prevent their loss and falsification, and to remove all disputes, discord and other dangers, by our own motion, not at the instance of any petition offered to us on this matter, but from our certain knowledge and mere deliberation, and from the fullness of apostolic power, in the whole Ecclesiastical State subject to us and the Apostolic See mediately and immediately, saving only this our beloved City and the County of Bologna, that is to say in whatsoever provinces, cities, towns, fortresses, villages and other places of the same State, even in whatsoever metropolitan and cathedral or other churches, even monasteries, abbeys and others, even those subject to regular and pious places, public and general archives, in which instruments, as well as receipts, chirographs, handwritings and other writings, both public and private, which may happen to be made in any manner on the occasion of whatsoever contracts, from which action or reception even for a time may result, even by notaries and chancellors or notaries called curial notaries and whatsoever officials, even by our Camera or by us or our predecessors as cause, even with onerous title, having, and by whatsoever other private persons, of whatsoever dignity, office, status, degree, order and condition they may be, even if they enjoy clerical or any other whatsoever, even with onerous title, indult and privilege, already made and henceforth under whatsoever name and title for the time being to be made, requested and stipulated, as well sales, exemptions, loans, debts, inheritances and whatsoever other obligations, partnerships, associates, rents, leases, liveries, agreements, compositions, transactions, whatsoever sentences of any kind, compromises, awards, donations, exchanges, cessions, releases, delegations, payments, gifts even unpaid, and gifts both between the living and by reason of death, inventories, revocations, mortgages, pledges, even judicial, whatsoever mandates, ratifications, peaces, substitutions, divisions, confessions of debts, both in court and outside, emancipations, arrogations, adoptions, renunciations, insinuations, wills in writing and nuncupative, codicils, additions and repudiations of inheritances, trusts, substitutions, prohibitions, possessions of goods containing, as well as whatsoever other contracts, named and unnamed, between whatsoever ecclesiastical and of any Order regular and secular persons, holding whatsoever ecclesiastical or secular or temporal or worldly dignity, even ducal preeminence, as well as universities, churches, chapters, colleges, convents, monasteries, hospitals and whatsoever other pious and non-pious places, and their universal and particular persons, as well as of churches and monasteries of this kind, and whatsoever other prelates or priors for the time being entered into and celebrated, under the manner and form in the chapters which through our beloved son Henry, cardinal of the title of St. Pudentiana, presbyter Caetanus, our and the Holy Roman Church's chamberlain, and of the said Camera treasurer, dean and clerics, presiding, or through him or those who by us or our successors the Roman Pontiffs shall be appointed for the time being over the administration and governance of the said archives, are to be established and declared, to be carried away and respectively received, noted and diligently perpetually preserved and guarded, by apostolic authority, by the tenor of the present, we perpetually erect and institute.
4 § 3. And if in any provinces, cities and other places aforesaid, by virtue of all and whatsoever faculties on this matter, even of memoranda, granted by us or our predecessors the Roman Pontiffs or the Apostolic See's legates, vicelegates, presidents, governors or officials, or even by the Apostolic Camera, and by those acting for it whatsoever of the communities, universities, colleges, chapters or others even of particular persons and officials and chancellors and others aforesaid of the provinces, cities and places of this kind, for whatsoever cause or occasion, and even from onerous title, any archives or anything in the manner of them should at present be found or ought to be erected, all and singular of them to the archives through the present erected and instituted, and through the force of the same present to be instituted and established, we also perpetually aggregate and incorporate. With modifications however and limitations and declarations in the said chapters, according to our mind declared to the same Henry chamberlain and the clerics of the Camera aforesaid, and other declarations, even in future times, both by us and granted by others.
5 lius or others to do so by us or our successors the Roman Pontiffs, if it shall seem good to them, and at their discretion, as many times as it shall please them, to be made and established and reformed.
6 § 4. Moreover, the faculties of erecting and instituting archives, or anything pertaining to their institution, granted perhaps to others, as is aforesaid, as well as privileges, indults, immunities or exemptions whatsoever, even by title of burden, and under whatsoever forms and tenors of words they may have been granted, the tenors of all of which, as if they were inserted word for word in the present document, we wish to be held as expressed, we likewise perpetually annul and invalidate.
7 § 5. And moreover, that for the happy governance and administration of the aforesaid archives, some person apt and suitable for this office be appointed as prefect of the archives of the whole aforesaid Ecclesiastical State, or under whatsoever other title pleasing to us, and by us declaring, and under a certain form, etc., and may have full, free and absolute faculty, power and authority in such archive in all and singular provinces, cities, lands, towns and other places aforesaid of the same State, in which it shall be deemed necessary to establish it according to the form of the said chapters, as many times as it shall seem good to him, through himself or another or others to be deputed by him for this purpose, to constitute and establish, and to remove, transfer, separate, aggregate and incorporate them, and to do, manage, exercise and execute all and singular other things in the premises and concerning them necessary or in any way opportune, etc. And for the more salutary direction, succession, governance and administration of the same archives, all and singular things by one of the said Camera's clerks, to be drawn by lot as president or annual prefect, according to the institutes of the same Camera, through the Camera itself or otherwise to be chosen and deputed.
8 § 6. Who with supreme authority and royal hand, notaries, chancellors and other aforesaid officials, and whatsoever other persons, both ecclesiastical and secular, as well as communities, universities, churches, chapters, colleges, convents, monasteries, hospitals and other also pious places, and their universal and particular persons, as well as of churches and monasteries of this kind, and whatsoever other prelates and superiors, holding whatsoever ecclesiastical dignity, or mundane and temporal, even ducal or marquisal honor and preeminence, that they bring and carry to the archives thus erected and instituted, instruments and other writings aforesaid according to the form of the said chapters; communities moreover and universities of cities and places of this kind, their priors and our and the aforesaid Camera's officials, that they assign suitable and apt dwellings for the preservation of the aforesaid writings and instruments, and other things to be established and declared in the said chapters to observe and fulfill, may compel and constrain; and causes, both civil and criminal, mere and mixed, even if obligations of whatsoever kind2 shall have intervened in them, on occasion of archives of this kind, and depending in any way from them, emerging, annexed and connected, even by reason of terms or payments on occasion of subcontract or lease, against whatsoever persons and between whatsoever private archivists, and between him or them and whatsoever communities, colleges, universities and other persons proceeding, and also other causes and differences upon the understanding, declaration and amplification of the present, and upon all things exclusively as to all other judges, ordinary and extraordinary, both in the City and without, and in the whole Ecclesiastical State, even summarily, simply and plainly, and without noise and form of judgment, etc., may know, hear, decide, and end with due conclusion, to be governed, ruled and administered, we establish and ordain; and moreover to the aforesaid archives and the persons holding them in hand, establishment and stability, as well as to the governance, rule, administration for the time being incumbent upon their labors and salaries, all and singular rights, revenues, emoluments and other regalia to be specified in the said chapters, we likewise perpetually apply and appropriate, etc.
9 § 7. Decreeing moreover that these same present letters can never at any time be noted, impugned, infringed, invalidated, or recalled into question or controversy on account of the vice of subreption or obreption or nullity, or of our intention or any other defect, but that they shall always perpetually be valid and efficacious, and shall obtain their full effects, and thus by whatsoever judges, even auditors of causes of the Apostolic Palace, and the said Camera's clerks, and the cardinals of the same Holy Roman Church, with all faculty and authority of judging or interpreting taken away from them, ought to be judged and defined; and also null and void if otherwise in any way, by whatsoever authority, knowingly or unknowingly, it shall happen to be attempted.
10 § 8. Notwithstanding the foregoing, and notwithstanding any contrary provisions regarding not taking away acquired rights, and the letters of happy memory of Pius, our predecessor, the fourth of that name, issued under date namely the eighth day before the Ides of August, in the sixth year of his pontificate, disposing among other things that perhaps similar graces within a certain time then expressed should be presented and registered, provided at least that within two years from the date of these presents they be altogether registered, and by other constitutions and apostolic ordinances, as well as of the provinces of the Ecclesiastical State of this kind, and of whatever cities, places, districts thereof, as well as of monasteries, churches and other pious and non-pious places, even those confirmed by oath, apostolic confirmation, or any other firmness, statutes and customs; privileges also, indults and apostolic letters, exemptions, immunities, even with burdensome title, as much from the Camera as from us or our predecessors in any manner whatsoever, even those, and their legates, vicelegates, governors, judges, notaries, chancellors and other aforesaid whatsoever communities, universities, our Camera and its auditor general and fiscal officer, and other also persons, under whatsoever tenors and forms, and with whatsoever clauses and decrees, even by similar motu proprio, even consistorially, and otherwise in the contrary in any manner whatsoever made and granted and to be granted in the future, all of which, even if special, specific and express mention of them and of their whole tenors should have to be made, these tenors being held by us as sufficiently expressed in these presents, otherwise remaining in their force, on this occasion only, specially and expressly we derogate, and to all other contrary provisions whatsoever.
11 § 9. We will moreover that copies of these presents, etc.
12 § 10. Let it be lawful for no one whatsoever of mankind, etc.
