Bull on the endowment of the Church of Baghdad (Babylon) in Persia

Bull of Pope Urban VIII ·

DGVI.
Endowment of the Church of Babylon in Persia1.
Pope Urban VIII, for perpetual memory of the matter.

1 Over all the churches of the world, by the disposition of Him who commands all things and to whom all things obey, we, though unworthy of such merit, are constituted; and we are gladly intent upon those matters by which the aforesaid churches, especially the cathedral churches, existing under the power of infidels, may be furnished with competent revenues for supporting their burdens, and with suitable sustenance for their prelates, so that those who are to be placed over them may undertake the yoke of the Lord and the care and governance of such churches all the more eagerly when they feel themselves supported also by temporal aids for this purpose; and we promote with a pious father's affection the vows of the faithful who generously expend their resources for this, and we foster them with special favors and graces.

2 § 1. Since, therefore, as we have learned, a certain pious woman, a Gallic by nation, led by zeal for the propagation of the Catholic faith, desires that six thousand Spanish doubloons from the goods bestowed upon her by the Most High be sent to Rome and be perpetually applied by us to one of the churches existing under the power of infidels, to be designated by our judgment, for the endowment of such church and for the suitable sustenance of its prelate:

4 URBAN

5 § 2. We, greatly commending in the Lord the pious desire of the same woman, and wishing to follow her with special favors and graces, and absolving her by the tenor of these presents from any excommunication, suspension and interdict, and from other ecclesiastical sentences, censures and penalties, whether by law or by name, imposed on any occasion or cause, if she is bound by any of them in any way, for the purpose of obtaining the effect of the present document only, and considering her absolved; by the counsel of our venerable brothers the Cardinals of the Holy Roman Church appointed to the propagation of the faith, we perpetually apply and appropriate the said six thousand Spanish doubloons, to be invested in as many places of the non-vacant mountains of the City of Rome as follows, to the Church of Bagdad or Babylon in Persia, which at present, as we have also learned, is destitute of a pastor's solace, for its endowment and for the sustenance of the future Bishop of Bagdad or Babylon in the future, who indeed ought to be born in Gaul, and is altogether bound to reside personally at such church under the penalties inflicted and threatened by the sacred Council of Trent against non-resident bishops, so that it may be lawful for the same bishop to receive, exact, collect, and convert to his own use and benefit the fruits, revenues and proceeds of the said six thousand Spanish doubloons or of the mountains to be purchased therefrom, and whatever other emoluments whatsoever may proceed therefrom in any way, without any license being required thereupon, by apostolic authority, by the tenor of these presents, perpetually.

6 § 3. Moreover, to the same woman for this purpose only, and thereafter perpetually to the right of the Roman Pontiff in future times, as often and in whatever manner the said Church of Bagdad or Babylon should happen to become vacant, we reserve and grant to our venerable brothers aforesaid the right of nominating in their congregation before us and before the Roman Pontiff existing for the time being, to the same church a suitable person, who nevertheless ought always to be born in Gaul and not elsewhere, as is aforesaid, to be instituted by us and by the Roman Pontiff existing for the time being as bishop of the said church, at this nomination, by the authority and tenor aforesaid.

7 § 4. Decreeing null and void whatever shall be attempted otherwise concerning these matters by anyone, of whatever authority, knowingly or unknowingly.

8 § 5. Notwithstanding the constitutions and ordinances of the Apostles, and the statutes and customs of the aforesaid church, even those strengthened by oath, apostolic confirmation, or any other firmness, and also privileges, indults and apostolic letters granted, confirmed, approved and renewed in any way to the contrary of the foregoing; all and singular of which, even if for their sufficient derogation there ought to be made mention of them and of their whole tenors in a special, specific and express and individual manner, and word for word, and not through general clauses importing the same, or any other expression, or if any other exquisite form ought to be observed for this, we having the tenors of these present as fully and sufficiently expressed and inserted word for word, which would otherwise remain in their force, for the purpose of the foregoing, on this occasion only specially and expressly we derogate; and to all other things contrary whatsoever.

9 ought itself the Baedatensem or Babylonian [see] to be vacant Datrix.

10 it shall come to pass, to our venerable brethren aforesaid, the right of nominating in their congregation before us and for the time being the Roman Pontiff existing, to be held at the same church a suitable person, who nevertheless ought always to be born in Gaul and not elsewhere, as is aforesaid, by us and for the time being the Roman Pontiff existing, to be instituted as bishop of the said church, at such nomination, by authority and in the manner aforesaid we reserve and grant.

11 § 4. Decreeing null and void whatever has been attempted against [this].

12 otherwise concerning these things by anyone whatsoever, by whatever authority, knowingly or unknowingly, it should happen to be attempted.

13 § 5. Notwithstanding the apostolic constitutions and ordinances, and the statutes and customs of the aforesaid church, even those strengthened by oath, apostolic confirmation, or any other firmness whatsoever, and also notwithstanding privileges, indults and apostolic letters granted, confirmed, approved and renewed in any way contrary to the foregoing; to all and each of which, even if for their sufficient derogation there should be required mention of them and of their whole tenors in special, specific and express and individual manner, and word for word, and not through general clauses importing the same, or if some other exquisite form should be observed for this purpose, we having the tenors thereof present as fully and sufficiently expressed and inserted word for word, which otherwise would remain in their force, for the purpose of the foregoing, on this occasion only specially and expressly do we derogate; and to all other things whatsoever to the contrary.

14 8 4. We will, however, that the said six thousand Spanish doubloons be invested in as many places of mountains of the chamber or communities not subject to vacancy from the aforesaid City for that purpose, and in the event of their extraction or extinction, as often as it shall happen, the monies arising therefrom shall be invested in other places of mountains similarly of the chamber or of communities not subject to vacancy from the same City and shall be invested; and meanwhile, until such investment be made, the same monies shall be deposited with the Monte Pietatis of the said City and shall not be removed therefrom except for the purpose of investing them as aforesaid, so that the said six thousand Spanish doubloons and the places of mountains from them redeemed, and all other fruits, revenues and emoluments arising therefrom, shall always and perpetually remain wholly and in perpetuity for the endowment of the said church and the suitable sustenance of its bishop, and cannot be converted to other uses on any pretext or for any reason; and § 7. That the said bishopric of Bagdad, or Babylon, and its bishop existing for the time being shall be immediately under the protection of the said venerable brothers our cardinals, yet so that they can do nothing concerning the said bishopric, nor concerning its endowment or its revenues, nor concerning the bishop existing for the time being unless in their congregation held before us and our successors the Roman Pontiffs.

DGVI.

9 debeat ipsa do- Baedatensem sive Babilomensem vacare Datrix. " .
