Bull prohibiting transfer of Capuchin friars to other orders
208 b » i ult. Melevitanae • 751 a » H «-U. Melevitanae continua™ pontificatus
1 URBAN VIII. URBAN VIII CONSTITUTIONS
2 From the sixth year of his pontificate and thereafter. Exordium.
3 That brothers of the Capuchin Order of St. Francis shall not pass over to a more lax Order without the licence of the Apostolic See, and to the Carthusian Order only without the licence of the Minister General. Urban, Bishop, for perpetual remembrance of the matter.
4 The duty of the apostolic office entrusted to us demands that, exercising paternal care toward religious men who, having spurned the vanities of this world, have bound themselves to the service of the divine majesty under the sweet yoke of religion and the rules of stricter observance, we should diligently attend to those parts of the same office by which their prosperous and happy state and direction may be opportunely provided for, as we perceive it to be wholesomely expedient in the Lord.
5 1 Paul V granted to these brothers that they might carry their own cross in processions, in Const. ccxxix, Pastoralis, vol. xii, p. 411. And you have it more fully in Clement VII, Const. xxiv, Religionis, vol. vi, p. 113. Pius V had also prohibited transition from the Capuchin brothers to the Minim brothers of St. Francis of Paula and conversely, Const. lxvii, Sedis, vol. vii, p. 617. Bull. Rom. — Vol. XIV. 1
6 § 1. Since, therefore, as our beloved son the Procurator General of the brothers of the Order of Friars Minor called Capuchins recently caused to be set forth to us, certain religious of the said Order, having obtained no licence from the Apostolic See or their superiors, have presumed and do presume to be able to transfer themselves to other Orders or Congregations, not without grave detriment to the observance of regular discipline and disturbance of the said Order:
7 § 2. We, for the duty of our pastoral office, having taken precautions as far as is granted to us from on high, wishing to prevent this and to provide for the prosperous state and peace of the said Order, being inclined by the supplications of the said Procurator General humbly presented to us in the name of the Order on this matter, decree that henceforth in perpetuity no religious of the said Order shall, without our special licence and that of the Apostolic See, transfer to a more lax Order, and to the Carthusian or any other Order or Congregation only without the written licence of the Minister General existing for the time being of the said Order, under any pretext whatsoever or from any cause, however legitimate and privileged it may be, under the penalties of apostasy and perpetual infamy. Since many brothers of this Order presume to be able to transfer themselves to other Orders, the Pontiff has forbidden this transition to a more lax Order without the Apostolic See, and to the Carthusian without the written licence of the Minister General.
8 Concerning the preservative decree:
9 added.
10 dare to or presume to pass over in any way, by apostolic authority, by the tenor of these presents, we forbid and prohibit, with the penalties of apostasy and perpetual infamy, as well as excommunication and deprivation of active and passive voice to be incurred by the very fact without any declaration.
11 § 3. Decreeing that these present letters shall always and perpetually be valid, firm and efficacious and shall obtain and secure their full and complete effect, and shall be inviolably observed by all to whom it pertains and shall pertain in the future; and we decree § 4. Thus, and not otherwise, in the aforesaid matters, we command all ordinary and delegated judges, even the auditors of causes of the apostolic palace, that judgment and definition ought to be made, and it shall be null and void if anything contrary to these things shall happen to be attempted by anyone whatsoever, by whatever authority, knowingly or unknowingly.
12 § 5. Notwithstanding constitutions contrary to these, which we derogate.
13 Given at Rome, at St. Mary Major, under the Fisherman's Ring, on 9 August 1628, in the sixth year of our pontificate. Given on 9 August 1628, pontifical year vi.

1 URBANI VIII. URBANI VIII COSTITUZIONI
