Declaration of nullity of the articles of the recent Peace of Germany prejudicial to the Catholic religion

Bull of Pope Innocent X ·

CXVI.
Declaration of the nullity of the articles of the recent peace of Germany prejudicial to the Catholic religion, the Apostolic See, churches, and other pious places, and to ecclesiastical persons and rights in any manner whatsoever. Innocent, Pope X, for perpetual memory of the matter.

1 With zeal for the house of God continually stirring our soul, we apply ourselves diligently to this care in particular, that the integrity of the orthodox faith and the dignity and authority of the Catholic Church be preserved everywhere intact and unharmed 1, and that the ecclesiastical rights, whose defenders we have been constituted by the Lord, suffer no detriment from the deed of those who seek their own things rather than the things that are God's, and that we, about to render an account to the supreme judge of the stewardship entrusted to us, be not accused of negligence in the administration committed to us.

2 § 1. Indeed, with deep sorrow we have learned that through several articles of one peace of Osnabrück, on the sixth day of August of the present year 1648, entered into respectively between our most beloved son in Christ Ferdinand, elected King of the Romans and Emperor, with his confederates and adherents on the one hand, and the Swedes with their likewise confederates and adherents on the other hand, and of another peace of Münster in Westphalia, on the twenty-fourth day of October of the same year 1648, entered into respectively between the same Ferdinand, elected King of the Romans and Emperor, with his likewise confederates and adherents on the one hand, and our most beloved son in Christ also Louis, Most Christian King of the French, with his similarly confederated parties on the other hand, most grave prejudices have been inflicted upon the Catholic religion, divine worship, the Apostolic See, and the Roman and inferior churches, the ecclesiastical order, and the jurisdictions, authorities, immunities, liberties, exemptions, privileges, things, goods, and rights of those. For by the pacts partly of the one and partly of the other of such peace, among other things, ecclesiastical goods, formerly occupied by heretics, are assigned to them and their successors in perpetuity, free exercise of their heresy, which they call the Augsburg Confession, is permitted to heretics in very many places, and the assignment of places for building temples for this purpose is promised, and they themselves together with Catholics are admitted to public2

Articles of the peace of Germany prejudicial to the Catholic religion and the Apostolic See.

3 duties and offices, and to certain archbishoprics, bishoprics, and other ecclesiastical dignities and benefices, and to participation in the primary prayers granted to the same Ferdinand, king elected emperor by the aforesaid Apostolic See, are admitted. Annates, rights of the palace, confirmations, papal months and such like rights, and reservations in the goods of the ecclesiastical confession of Augsburg are excluded. Confirmations of elections, or postulations of pretended archbishops, bishops, or prelates of the same confession are attributed to secular authority. Many archbishoprics, bishoprics, monasteries, prepositions, bailiwicks, commendams, canonries and other benefices and ecclesiastical goods are granted to heretical princes and their heirs also, with the ecclesiastical denomination removed, in perpetual fief under the title of secular dignity. Against such peace, or any article thereof, no rights, canonical and civil, common or special, decrees of councils, rules of religious Orders, oaths, or concordats with the Roman Pontiffs, or any other statutes, whether political or ecclesiastical, decrees, dispensations, absolutions, or other exceptions are to be heard or admitted. The number of seven electors of the Empire, once fixed by apostolic authority, is increased without our and the aforesaid See's consent, and an eighth electorate is instituted in favor of Charles Louis, count palatine of the Rhine, a heretic, and many other things, which it is shameful to relate, are decreed as most prejudicial and harmful to orthodox religion, to the aforesaid See, and to the Roman and inferior churches, and to the other matters aforesaid. § 2. And although the venerable brother Farnese, Bishop of Neocastro, our and the aforesaid See's nuncio extraordinary to the treaties of the Rhine and elsewhere, in execution of our mandates, made open protest in our name and that of the same See that such articles are null, void, unjust, and rashly contracted by those not having power, and are to be held as such by all; and it is well known by law that any transaction or pact in ecclesiastical matters made without the authority of the aforesaid See is null and of no force and moment: § 3. Nevertheless, that the indemnity of the aforesaid matters may be more effectively provided for, wishing to provide, as the duty of the pastoral office committed to us from on high demands, and having the tenors of the instruments of both such peace, and of all things contained in them, and of others also necessarily to be expressed and inserted here, even the more accurate ones, and the dates, as if they were inserted word for word, considered by these presents as fully and sufficiently expressed and inserted, by our own motion, and from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, we decree the aforesaid articles of one or both such peace, and other things contained in the said instruments, which bring, or can bring, or are said to be able to bring, or to be understood to bring, even the least injury or prejudice to the Catholic religion, to divine worship, to the salvation of souls, to the same Apostolic See, to the Roman and inferior churches, and to the order and state of the Church, to their persons, members, things, goods, jurisdictions, authorities, immunities, liberties, privileges, prerogatives and rights whatsoever in any manner, to be by the law itself null, void, invalid, unjust, unjustly condemned, reprobated, vain, and wholly devoid of force and effect, and to be perpetually so, and that no one 3 is bound to observe them or any of them, even if they are fortified by oath, nor has anyone acquired from them any right, or action, or colored title, or cause of prescription, even if the longest and immemorial time of possession, or quasi-possession, should follow, even without any interpellation or interruption, nor is it to be acquired, nor can it at any time be acquired and belong, nor shall any statute make or have made it, and, just as if they had never emanated at all, they are to be held perpetually as non-existent and not made, by the tenor of these same presents we decree. And nevertheless, for more abundant caution, and insofar as it is necessary, the aforesaid articles, and other matters aforesaid, as is set forth, prejudicial, by motion, knowledge, deliberation and equal fullness of power, we condemn, reprobate, annul, quash, nullify, and vacate of force and effect, and we protest against them, and concerning their nullity, before God. And, insofar as it is necessary, we restore, replace and fully reinstate the same Apostolic See, the Roman and inferior churches, and any pious places and any ecclesiastical persons against them in their entirety, and to their pristine state, and to that in which, before the aforesaid, and any other asserted or pretended prior transactions, pacts, or conventions concerning the aforesaid made anywhere in any manner whatsoever, they were.

4 § 4. We also declare these present letters, with all and singular things contained in them, even from the fact that the aforesaid and whosoever others, even worthy of special mention and expression, and having or in any way pretending to have interest in the premises or in some of them, have in no way consented to them, nor have been called upon, cited or heard regarding them, and the causes on account of which these same present letters were issued have been neither deduced, verified, nor in any other way sufficiently or justly justified,

5 to be able at no time whatsoever to be noted, impugned, invalidated, retracted, or called into question or reduced to the terms of law on account of any defect of subreption, obreption, nullity or invalidity, or of our intention, or any other whatsoever, however great, unforeseen and substantial defect, or from any other ground arising from law or fact, or statute, or custom, or from any other colour, pretext, cause and occasion; but that they shall always be valid and efficacious and shall produce and obtain their full and complete effects, and shall be inviolably observed by all and singular to whom it pertains and shall pertain in any way whatsoever in the future,

6 § 5. And thus and not otherwise in the premises by all and singular judges ordinary and delegated, even auditors of the apostolic palace, as well as cardinals of the Holy Roman Church, even delegated by the same and nuncios of the same See, and any others whatsoever exercising any authority, now and for the time being existing, the faculty and authority of judging, declaring and interpreting otherwise being taken away from them and from each of them, it ought always and everywhere to be judged and defined, and we decree that it shall be null and void if otherwise should be attempted in these matters by anyone whatsoever, with whatever authority, knowingly or unknowingly.

7 § 6. Notwithstanding the premises, and any apostolic constitutions and ordinances whatsoever, as well general as special, even those issued in ecumenical councils, and, insofar as it may be necessary, our and the apostolic chancery's rule concerning not taking away acquired right, and the constitution of Pius IV, our predecessor of happy memory, concerning any graces whatsoever concerning the interest of the apostolic chamber, to be presented and registered in the same chamber within a certain time then expressed therein, so that these present letters shall at no time need to be presented or registered in the same chamber, imperial and municipal laws also, as well as any statutes, uses and customs whatsoever, even immemorial, confirmed also by oath, apostolic confirmation, or any firmness, privileges also, indults, concessions and apostolic letters whatsoever to any places and persons, even those shining with imperial, royal, and any other, whether ecclesiastical or worldly, dignity, and otherwise qualified in any way whatsoever, and requiring special expression, even with like motu proprio, knowledge, deliberation and fullness of power, even consistorially, under whatsoever tenors and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious and unusual clauses, and decrees even irritant, and otherwise in any way whatsoever granted, issued, made, and many times and repeatedly confirmed, approved and renewed in contradiction to the premises; all and singular of which, even if for their sufficient derogation special, specific, individual mention or expression of them and their whole tenors, word for word and not through general clauses importing the same, or any other expression should be made or any other exquisite form should be observed for this purpose, we hold these tenors, as if they were inserted word for word, to be fully and sufficiently expressed and inserted in these presents and the form therein transmitted to be observed, and we specially and expressly derogate for the effect of the premises, and will them to be derogated; and all other things whatsoever to the contrary.

8 § 8. We will, however, that to copies of these same present letters, even printed, subscribed by the hand of some public notary, and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given everywhere and among all nations in judgment and outside of judgment as would be given to these same present letters if they were exhibited or shown.

CXVI.
