S. CONGREGAZIONE DEI RELIGIOSI
DECRETO

RIGUARDO AGLI ORDINI MENDICANTI

; '/DECRETUM'' :

1 :I De eleemosynis colligendis gravis quaestio, quae iam anteactis saeculis non semel agitata fuit, hodie praesertim, ob peculiaria rerum ac temporum adiuncta, in praxi maiores ac frequentiores praesefert difficultates. Quibus ut occurreret, S. Congregatio Episcoporum et Regularium, omnibus mature perpensis, die 27 Martii 1896 promulgavit decretum Singulari quidem, quo colligendarum eleemosynarum ministerium opportunis pro hodierna humanae societatis conditione communiebatur cautelis. Attamen mulierum dumtaxat respiciebat Sodalitates. Quo autem et virorum Institutis religiosis melius provideretur, eidem sacrae Congregationi, in plenario consessu die 8 Maii anni 1908 habito, visum, est pro his quoque nonnullas apponere quaestuationum normas ; quas, ex Secretaria supradictae Congregationis Episcoporum et Regularium acceptas, sacra Congregatio Negotiis Religiosorum sodalium praeposita, de mandato SSmi Dñi Nostri Pii divina providentia PP. X, publici iuris facit.

QUOAD ORDINES MENDICANTES

13.° Superiores regulares, graviter onerata eorum conscientia, ne omittant quaestuariis suis normas agendi, quas prudentia suadet, opportunas praescribere.

S. Congregation of Religious.
S. CONGREGATION OF RELIGIOUS
; 'DECREE' :

1 :I The grave question concerning the collection of alms, which has been agitated more than once in centuries past, presents today especially, on account of the peculiar circumstances of affairs and times, greater and more frequent difficulties in practice. In order to meet these difficulties, the S. Congregation of Bishops and Regulars, having carefully weighed all matters, on 27 March 1896 promulgated the decree Singulari quidem, by which the ministry of collecting alms was provided with suitable safeguards for the present condition of human society. However, it regarded only the Associations of women. But in order that the religious Institutes of men might also be better provided for, the same sacred Congregation, in a plenary session held on 8 May of the year 1908, deemed it fitting to add for these also certain norms of solicitation; which norms, received from the Secretariat of the aforesaid Congregation of Bishops and Regulars, the sacred Congregation placed in charge of matters of religious sodalities makes public by the mandate of our Most Holy Lord Pius by divine providence Pope X.

CONCERNING THE MENDICANT ORDERS

2 1. Regulars, who are called and are Mendicants, by the institution of the Apostolic See with the sole permission of their Superiors are able to seek alms in the diocese where the convent is established. The permission of the Ordinaries is to be considered necessarily given in the very act by which they gave consent to the foundation of the convent.

3 2.° If however the same Regulars wish to solicit alms outside the diocese where they have their convent, they have need of the permission of the Ordinary of that diocese, obtained in writing through their Superiors.

4 3.° The Ordinaries, especially those of neighboring dioceses, should not deny this permission without more serious and urgent causes, if some convent is in no way able to live from solicitation in the sole diocese where it is established, as is wont to happen in small dioceses.

5 4.° This permission is understood to be habitual, namely until express revocation; which revocation, as is fitting, is to be made only for legitimate causes, and only so long as these persist.

6 5.° In order that Mendicants may enjoy the aforesaid right, they ought to collect alms through themselves, and not through persons external to the Order. 6.° Regulars soliciting alms must always carry with them authentic letters, by which it is evident that they have the due faculty and that the office of solicitation has been entrusted to them. These letters they are bound to exhibit willingly to parish priests; and also to Ordinaries, whenever they are required by them.

7 7.° It is not permitted for Regular Superiors to send for this work any but Religious of mature age and disposition; never those who are still engaged in studies. 8.° Religious about to collect alms should not go alone but in pairs, especially outside the city or place where they have their convent, except in case of grave necessity; in which case the solicitor ought to be publicly known and altogether commended by age, virtue, and the esteem of the faithful.

8 9.° Moreover, those soliciting outside the place of convents should lodge with parish priests or with other secular or regular clergy, or, if these are lacking, with some pious benefactor, conspicuous for Christian honesty and virtue.

9 10.° They should not remain outside their own house for more than a month, if they are seeking alms in their own diocese; not more than two, if in another; nor should the same ones be sent again, unless after they have spent one month, or respectively two months, living in common according to the rule and constitutions in the convent, as they ought to have lived outside the cloister for one or two months. 11. Those who collect alms in the very place where the convent is situated shall in no way remain outside their own house at night.

10 12.° Religious soliciting alms should always shine with that humility, modesty, and cleanliness which is fitting; let them beware of familiarity with seculars, especially women of whatever condition; let them entirely avoid places not at all suited to their profession; let them sincerely foster piety and faithfully fulfill according to their ability the spiritual exercises customary in their religion. 13.° Regular Superiors, with their conscience gravely burdened, should not fail to prescribe to their solicitors the norms of conduct which their prudence suggests as opportune.

11 14.° If however, which God forbid, Regulars soliciting alms have notoriously offended, have given scandal to the faithful, or have even dared to collect alms against legitimate prohibition, the Ordinary of the place shall order them to return to their own house and also, as a Delegate of the Apostolic See, shall admonish the Superiors, that they correct them and punish them according to the gravity of the scandal; and if they do otherwise, let them have recourse to the Holy See as soon as possible. <S. Congregation of Religious.

CONCERNING THE ORDERS OR RELIGIOUS INSTITUTES OF NON-MENDICANTS

12 1.° Religious of either Orders or congregations of pontifical right, who do not enjoy the privilege of soliciting alms either by force of their own constitutions approved by the S. See, or by force of an Apostolic concession, ought to obtain permission from the Apostolic See, in order that they may be able to institute solicitations; furthermore they are bound to obtain permission through their Superiors from the Ordinary of the place, unless perhaps the S. See has expressly and specially derogated from this to the right of the Bishop, which can never be presumed, but must be proved by undoubted documents.

13 2.° Religious, however, who are of diocesan right, shall in no way undertake the work of collecting alms unless they shall have obtained permission both from the Ordinary of the place in which they reside, and also, if they are about to go outside the diocese of their own residence, from the Ordinary of the place in which they desire to seek alms. 3.° The Ordinaries of places, if it shall have seemed opportune, can establish limits of begging for each house of any religious of their diocese belonging to an Institute, whether of pontifical or diocesan right, living by alms, and respectively see that they are observed, especially where there are convents of Regulars who are mendicants in name and in fact; nor shall they grant permission to such Religious who are not mendicants to seek alms, unless it be clear to them that there is a true necessity of the house or pious work, to which relief cannot otherwise be provided; and if the necessities can be provided for through begging in the place or district in which the Religious reside, or within the diocese, they shall in no way grant more extensive permission.

14 4.° The Ordinary, moreover, of that diocese to which these Religious from other dioceses come seeking alms, shall in no way permit collections to them, unless he shall first have recognized, through himself or through his delegates appointed for this purpose, besides the letters of obedience of their own Superior, the faculty of the Apostolic See if they are of pontifical right, or of their own Ordinary if they are of diocesan right, and shall have found it conformable to the prescriptions of this decree.

15 5.° Moreover, the Ordinary shall carefully observe whether those who seek subsidies for foreign missions, besides letters of recommendation from the Vicar or Prefect Apostolic respectively of the mission and letters of obedience of the General Superior of their own Institute, also have faculty from the S. Congregation of Propaganda Fide in authentic form recently given.

16 6.° Let the Ordinaries grant permission to collect alms freely and in writing, always noting (whether at the foot of the letters of obedience or in a separate document) both the names of the Religious who are designated to collect alms, and the name of the Order or Institute to which they belong, and the place and time for which the permission shall be valid. 7.° The Ordinaries shall in no way grant to such Religious licenses that are general as to place and time, but rather shall take care that neither those begging, nor under the pretext of begging remain outside their own house beyond a month, if in their own diocese; or beyond two months, if they seek alms in another; nor shall the same be sent again, unless after they shall have spent one, respectively two months, in their own convent, as they shall have remained outside for one or two months.

17 8.° In order that Religious may be able to use the faculty of the Ordinaries for collecting alms, they must do this through themselves, not through others. 9.° For these matters, let them themselves faithfully observe what above has been enacted for Religious of the Mendicant Orders, Part I, art. 6, 7, 8, 9, 11, 12, 13. 10.° Finally, in the case in which these Religious begging shall have collected alms against legitimate prohibition, or, which God forbid, shall have conducted themselves badly or been a scandal to the faithful, the Ordinary of the place, even as Delegate of the Apostolic See, shall restrain them with appropriate remedies according to the gravity of the offense and scandal, and shall remit them to their own Superiors to be punished.

18 Given at Rome, from the Secretariat of the aforesaid sacred Congregation placed in charge of the affairs of Religious societies, on the feast of the Presentation of the Blessed Virgin Mary, 21 November 1908.
