1 (formerly attributed to others.
Causes for erecting it, and for establishing a Vicariate perpetual.
Pope Paul V, for perpetual memory of the matter).
2 In the eminent watchtower of the militant Church, though with unequal powers, presiding by divine disposition, we turn the gaze of our meditation to all places of the world, especially those opened by the mercy of almighty God through Catholic kings and princes to the preaching and introduction of the Catholic faith, and, so that in such places Christian religion may be planted more each day and, once planted, be confirmed, and their inhabitants and residents, supported by the assistance and governance of their own pastors, may always make progress in faith and Christian works, we willingly extend effective aid and effort, as the devotion of those same kings demands, and we, having maturely weighed the circumstances of places and things, for the conservation and propagation of the orthodox faith, and for the salvation and advancement of souls, we salutarily determine in the Lord what we judge expedient.
3 § 1. Formerly indeed in the parts of the Eastern Indies a metropolitan church at Goa was erected by apostolic authority, and there was conceded and assigned to it, for the part of the diocese and clergy and people, the province or district of the island called Mozambique in the vernacular.
4 § 2. Since, however (as our most beloved son in Christ Philip, King of Portugal and the Algarves, has recently caused to be set forth to us), the archbishop of Goa existing at that time, on account of the distance of the said province or district of the island of Mozambique and the places written below, the inconvenience of the sea, and the difficult and costly navigation, cannot attend to the care, governance, and administration of his flock existing in that province or district and in such places, as his pastoral office 1 requires, not without loss to their salvation; and hence the inhabitants and residents of the said province or district and of such places can neither be conveniently instructed in the doctrine of faith nor in the precepts of pious living, nor, if they should commit any fault, be corrected by their archbishop; and therefore if that province or district of Mozambique with the same places were to be separated and dismembered from the aforesaid church of Goa, and that thus separated and dismembered were to be erected and established into a vicariate or spiritual administration of the province or district of the island of Mozambique to be named, for the first vicar or administrator in spiritual matters of the province or district of the island of Mozambique to be named, who would there have and exercise all spiritual and ecclesiastical and ordinary jurisdiction (not however in those things which pertain to the Order) both in the internal and external forum, from this certainly the province or district of the island of Mozambique would make progress with happier increases, and to the salvation of its clergy and people aforesaid, and to the profit and exaltation of the said faith, and to the increase of divine worship, and to the timely remedy of so many inconveniences and dangers to souls, would be provided;
5 § 3. Wherefore that same King Philip humbly besought us that we should deign by apostolic benignity to separate and dismember that same province or district perpetually from the church and diocese of Goa, and to erect and establish there the aforesaid vicariate or administration, and otherwise to provide opportunely in the premises;
6 § 4. We therefore, who desire with intent affections the cult and increase of faith, and the salutary direction of any places whatsoever together with the salvation and spiritual consolation of Christian souls, whatever other dismemberments of other provinces and places from the church and diocese of Philip, King of Portugal,
7 pref. M.
8 Separating it therefore from any jurisdiction of the Archbishop of Goa, having the aforesaid things hitherto done by apostolic authority as expressed in these presents, inclined to these supplications, to the praise and glory of almighty God and of his most glorious Mother Mary, and to the honor of the whole heavenly court, and to the exaltation of the Catholic faith itself, we perpetually separate and dismember the said province or district of the island of Mozambique, and the places which are contained from the promontory of Guardafui as far as the promontory of the Cape of Good Hope, as well as those which are called Mombasa, Zanzibar, Ampaza, and all other parts of that coast, and also those which are called Cabaceira, Sofala, Sena, Zete, and all other places of the river of Cuama, and the rest which in those parts are subject to the jurisdiction of the vicars of the Archbishop of Goa in the places of Mozambique and Mombasa, with their territory, towns, villages, places, and also the clergy, people and persons, and monasteries, churches, colleges and pious places, and ecclesiastical benefices both secular and of any of the regular Orders, from the church and diocese of Goa aforesaid, and from all jurisdiction, subjection, superiority, correction, visitation and power of the Archbishop of Goa existing for the time being, and of his vicars and officials, and from the payment of whatever rights owed to the same archbishop and to our beloved sons the chapter of the said church of Goa by the clergy, people and persons of the province or district of the island of Mozambique by reason of this subjection, jurisdiction, superiority, or visitation, and also of the diocese (so that henceforth the aforesaid Archbishop of Goa shall be able to exercise no spiritual jurisdiction, except in those things which are of the Order, and excepting those expressed below, in the towns, boundaries, territories, villages and places, and over the clergy, people, persons, monasteries, churches and pious places, nor the benefices which previously pertained to his collation, provision, institution, or any other disposition, to confer, or to provide for them, or otherwise to dispose of them, or to receive the fruits, revenues, proceeds, rights, perquisites and emoluments by him in the province or district of the island of Mozambique, in its boundaries, territories, towns, villages and places aforesaid, by reason of visitation or of diocesan law in any way), we also perpetually exempt and wholly free by the said authority;
§ 5.
9 And the same province or district of the island of Mozambique, thus dismembered and separated, we erect into a vicariate or spiritual administration of the province or district of the island of Mozambique to be called thus, for one secular priest or of any regular Order, to be named vicar or administrator in spiritual matters of the province or district of the island of Mozambique, graduated in theology or in decrees, or otherwise (after previous examination or judgment of deputies of the senate of the royal conscience and of the military orders, in which very many men both secular and regular distinguished in the science of letters and virtue are found) approved as capable and suitable for teaching others, and by the same Philip and by the King of Portugal and the Algarves existing for the time being in perpetual future times, and at this first instance freely, no consent being required for this, even to be appointed and constituted for such time as shall seem good to him;
§ 6.
10 (By virtue of this deputation and constitution of vicar of this kind, without any other approval, confirmation, license or consent of the Roman Pontiff or the Archbishop of Goa for the time being existing or of any other person whatsoever, to have the care, governance and administration of the province or district of the island of Mozambique, and of the clergy and people both Christian and pagan, as well as of the towns, lands and places in that district, within the boundaries, limits and places aforesaid, and to preach there, and to cause preaching to be done, and to endeavor to convert the aforesaid pagans to the cultivation of the orthodox faith and to instruct and confirm the converts in that faith, and to impart to them the grace of baptism and the sacrament of confirmation, and to both those thus converted and to all other faithful in the province or district of the island of Mozambique, and in its towns, lands, villages, places, territories and boundaries, and in those aforesaid for the time being dwelling and resorting thereto, to minister and cause to be administered ecclesiastical sacraments and other spiritual gifts, not however those which are of Orders, as aforesaid, and to procure the same, and to confer whatsoever ecclesiastical benefices comprehended under this separation and dismemberment, and which previously pertained to the collation, provision, institution or any other disposition of the Archbishop of Goa himself, and to dispose of them and to institute in them, to consecrate and bless chalices, bells, vestments, corporals and other furnishings and ornaments, to reconcile churches, cemeteries and ecclesiastical places polluted or profaned by the effusion of blood and seed or otherwise in any way whatsoever by water blessed by him, and to visit those same churches and places comprehended under the province or district of Mozambique aforesaid and their persons, and to inquire into their state, governance, statutes, customs, life, morals, rites, offenses and discipline, both in the head and in the members, and (adhering to evangelical and apostolic doctrine and to the decrees and institutions of the sacred canons and general councils) whatsoever he shall find to require change, correction, amendment, punishment, revocation, and even entirely new enactment, to reform, change, correct, punish, and also to newly enact, and likewise to hear, decide and2, as the law shall require, terminate beneficiary, matrimonial and whatsoever other ecclesiastical and civil causes, and those pertaining in any way to the ecclesiastical forum, moved and begun, and meanwhile to be moved, with their incidents, dependencies, emergencies, annexes and connections, or to delegate those same causes to another or others suitable, in the manner and form aforesaid, with limited3 power likewise to be heard, decided and terminated by them, and finally to have full, mere and complete spiritual and ecclesiastical and ordinary jurisdiction, both in the internal and external forum, not however in those things which are of Orders, as aforesaid, and to exercise it, and all and singular other things which the Archbishop of Goa for the time being existing and in those parts hitherto ought to have had, to carry out, and4 to exercise, similarly and in like manner, and with no difference whatsoever, excepting however those things which, as has been said, are of Orders, as he shall find expedient for the increase of divine worship and the salvation of the souls of that clergy and people, to carry out, exercise, do and execute, with all and singular other privileges, faculties, exemptions, liberties, jurisdictions, preeminences, favors, graces and indults, by which5 the administrations erected in Ormuz and Mozambique, and Sofala, as well as Maluco6, and in other provinces and places, similarly having ordinary jurisdiction therein, as aforesaid, use, enjoy and possess, and are able and shall be able in any way to use, enjoy and possess in the future) by the authority and tenor aforesaid we similarly erect and institute in perpetuity.)7
11 § 1. Decreeing that these present letters at no time whatsoever, and for any cause, even though the aforesaid Archbishop of Goa or anyone else having interest in this matter should not have been called, shall be noted or impugned on account of the defect of subreptitiousness or obreptitiousness or nullity, or of our intention or any other defect, nor shall restitution in full, reduction to the terms of law, or any other remedy of grace or justice be able to be obtained against them, nor shall the causes8 on account of which the aforesaid things were granted be verified in the least, nor on that account lose their force, and shall in no way be comprehended under any revocations, limitations, suspensions, or other contrary dispositions of similar or dissimilar grants, even those emanating from us and the said See in any manner for the time being, even if derogating from or opposing them in whole or in part9; but shall always remain valid and entirely excepted from them, and as often as those shall emanate, or shall seem to be comprehended under them in any way, so often shall they be immediately restored, replaced, and fully reintegrated into their pristine state and condition in which they were before those emanated, and shall be deemed to be newly granted; and, in order that they may not be comprehended under those, by virtue of a valid and efficacious contract entered into and stipulated10 between us and the said See, and Philip and the aforesaid king existing for the time being, and having produced their full and complete effects at all times; and thus by whatever ordinary and delegated judges, even auditors of causes of the apostolic palace, even cardinals of the Holy Roman Church (the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them), it ought to be judged and determined, and it shall be null and void if anything contrary to these should happen to be attempted by anyone whatsoever, with any authority, knowingly or unknowingly.
12 § 8. Notwithstanding the aforesaid, and Derogation from contrary things. all apostolic constitutions and ordinances issued in provincial and synodal councils, general or special, as well as the statutes and customs of the said Church of Goa (even those strengthened by oath, apostolic confirmation, or any other firmness), and the foundation, erection and institution, privileges also, indults and apostolic letters granted to the same Church of Goa, and to its prelate existing for the time being, and to the aforesaid chapter and to any other persons, under whatsoever tenors and forms, and with whatsoever derogatory clauses of derogations, and other more efficacious and unusual clauses, and irritant and other decrees, in general or in particular, even by motu proprio, and from certain knowledge, and from the fullness of apostolic power, and also in consistorial or other manner, in any way converted to the contrary of the aforesaid, confirmed and renewed. All and singular of which, even if for their sufficient derogation it would otherwise be required that they, and their whole tenors, be inserted with special, specific, express and individual mention, and word for word, with nothing whatsoever omitted, and the form contained in them being observed, we, having these present for sufficiently expressed and inserted word for word, which would otherwise remain in their force, do on this occasion alone specially and expressly derogate from, and from all other things whatsoever to the contrary.
13 People of Mozambique § 9. We will, however, and decree and love that the clergy and people, and the inhabitants and dwellers, both under the province or district of the island of Mozambique already erected through the prearchbishop of Goa, and henceforth to be erected under the force of these presents in the vicariates or administrations aforesaid comprehended and to be comprehended, in those things which are of the Order, as is aforesaid, toward the aforesaid Archbishop of Goa existing for the time being, having nevertheless from their vicars or administrators letters dimissorial for this purpose, shall be bound to have recourse; the vicar of the same § 10. And that the province or district of the island of Mozambique and the vicars or administrators appointed for the time being under the force of these presents, by reason of their persons only, shall be subject to the visitation, correction, superiority and jurisdiction of the aforesaid Archbishop of Goa existing for the time being, and from definitive sentences only, or those having the force of definitive sentences, and from which the burden of grievance cannot be repaired by appeal from a definitive sentence, appeals may be interposed to the same Archbishop of Goa existing for the time being by the vicars or administrators themselves or their officials for the time being, and the causes of the same appeals may be known, decided, and terminated to their due end by him, as shall be according to law.
14 sonae. by reason of their persons only, shall be subject to the visitation, correction, superiority and jurisdiction of the aforesaid Archbishop of Goa existing for the time being, and from definitive sentences only, or those having the force of definitive sentences, and from which the burden of grievance cannot be repaired by appeal from a definitive sentence, appeals may be interposed to the same Archbishop of Goa existing for the time being by the vicars or administrators themselves or their officials for the time being, and the causes of the same appeals may be known, decided, and terminated to their due end by him, as shall be according to law.
