BARTHOLOMEW OF BRESCIA (Bartholomaeus Brixiensis). - Decretalist, b. in 1258. He studied Roman law at Bologna under the legist Ugolino dei Presbiteri and canon law under the decretalist Tancred. His output is for the most part not original, but work of adaptation. His originality, on the other hand, would appear in the important collection of the Quaestiones dominicales et veneriales (1234), a school work indicated by the days dedicated to the proposing and the discussion of the Quaestio.
He is known above all for his reworking of the ordinary gloss on Gratian's Decretum, due particularly to Johannes Teutonicus. In citing in this work of his (completed perhaps between 1240 and 1246, probably after 1245) the earlier decretals, he did not make use of the Compilationes antiquae, but of the Liber extra of Gregory IX. He added in his commentary the parallel passages and his own questions, and he used the writings of others. He also reworked the Casus decretorum, that is, the cases regulated in the legal texts of the Decretum; he likewise redid the collection of the Brocharda of Damasus, with notable additions.
He is also the author of an Ordo indiciarius written around the year 1236, which is a pure adaptation of the collection of his master Tancred.
