SÄGMÜLLER, JOHANNES BAPTIST. - One of the best-known modern canonists and legal historians, b. at Winterreute (Württemberg) on 24 Feb. 1860, d. at Tübingen on 22 Oct. 1942.
Ordained priest on 28 July 1884, he attended university courses at Tübingen and Rottenburg and took his doctorate in philosophy (1888), but in 1893 he turned to teaching history at Tübingen, where in the period 1896-1926 he was professor of canon law and of pedagogy. He also collaborated in the drafting of the CIC.
His first works are on ecclesiastical history: Die Papstwahlen und die Staaten von 1447-1555 (Tübingen 1890); Das staatl. Recht der Exklusive in der Papstwahl (ibid. 1892, Mainz 1895); Zur Gesch. des Kardinalates (Rome-Freiburg im Br. 1896); Die Entwicklung des Archipresbyterats und Dekanats bis zum Ende des Karolingerreichs (Tübingen 1898); then he turned toward legal studies: Lehrbuch des kath. Kirchenrechts (Freiburg im Br. 1900-1904; the 4th ed. ibid. 1925-1934 adapted to the CIC, but left unfinished); Kirche und Staat (Stuttgart 1904); Trennung von Kirche u. Staat (Mainz 1907); Die Bischofswahl bei Gratian (Cologne 1908); Wissenschaft u. Glauben in der kathol. Aufklärung (Essen 1910); Unwissenschaftl. und Unglauben in der kirchl. Aufklärung (ibid. 1911); Der rechtl. Begriff der Trennung von Kirche und Staat (Rottenburg 1916); Papst, Völkerrecht u. Völkerfrieden (Rottenburg 1924); Staat u.
