Apostolic Constitution on certain prelates of the Roman Curia and their various ranks
APOSTOLIC CONSTITUTION ON CERTAIN PRELATES OF THE ROMAN CURIA AND THEIR VARIOUS ORDERS. PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER
1 To the increase of the dignity of the Apostolic See, how much the Roman Prelature has contributed and continues to contribute to this day, no one is ignorant who has either known the history of its former times, or has himself beheld with his own eyes that great force of honor which the various orders of Prelates bring to the performance of splendid ceremonies and sacred functions, especially in those most solemn rites which, with Us standing by or even with Us Ourselves celebrating, are carried out with such majesty. In this matter there appears indeed to be something wonderful in the counsel and wisdom of Our Predecessors, who assigned distinguished roles to these Prelates in the very ministry of pontifical liturgy, to whom they had entrusted chiefly the office of administering justice, which is likewise the most noble priesthood. Hence it is that as We look down from the Pontifical Throne, with you turning toward the sacred things, from among these excellent magistrates some clothed in the vestments of lesser ministers, sitting at the very steps of the Throne, there is seen symbolically expressed that perfect constitution of government, which is founded in justice: "Justice is the foundation of kingdoms."
2 We, however, considering the most grave responsibilities in the governance of the Church entrusted to those Prelates who either sit in the Sacred Roman Congregations or serve as secretaries, and who are therefore called either Assessors or Secretaries of the same Sacred Congregations, after the Cardinal Fathers, in order that their dignity, which ought to be estimated from their collaboration so close to the Roman Pontiff in the governance of the Church, may be honored with ever greater marks of honor, just as by decree of the Sacred Congregation of Ceremonies issued on 31 December 1930, We granted them the title of Most Reverend Excellency, so now We will that these same, by reason of their office, be honored with special privileges, and moreover in sacred and solemn rituals to be performed before the Supreme Pontiff or with the Pontiff himself celebrating, even if they lack the episcopal character, they shall henceforth have by office a special and most honorific place; which We likewise say of other Prelates to whom, on account of the dignity of the office which they hold, by the same decree mentioned above We grant the same title of Most Reverend Excellency.
3 And Our estimation and the sense of Our paternal affection towards those venerable orders of Prelates as well, who constitute the Colleges of Prelatures properly so called, are increased in Us whenever We call to mind in thought the outstanding testimonies of observance and piety towards the Apostolic See, by which their history shines forth abundantly. We speak of those first Notaries of the Church who have been constituted irrefragable witnesses of the greatest acts and deeds of the Roman Pontiffs, whether in Councils or outside them. We then commemorate Our Familiars, who, gathered in the most noble College of Judges of the Sacred Roman Rota, have shone forth as true heirs through so many centuries in Roman wisdom in the administration of justice, which is illuminated by Christian justice. We also commemorate those Prelates of the Apostolic Chamber who administered the treasury of the Apostolic See for the utility of the Roman Church and the sustenance of the poor, so that to them the temporal government of the Pontifical Principate was once entrusted. We speak finally of the Votaries and Referendaries of the Apostolic Signature, who formerly, when petitions were presented to the Roman Pontiff dealing with grace and justice, discerned what ought to be granted and what ought to be denied, and in more recent times have been called upon to assist the Cardinals with their votes concerning matters committed to the Sacred Rota, and also, sometimes, concerning the pronouncements of the Rota itself. From these Colleges indeed — which, according to the norm received in Our Curia, We have enumerated in order, having regard to the priority by which they were constituted into a College and admitted to Our Chapel — the Auditors of the Roman Rota and the Votaries of the Signature, inasmuch as they are more intensely occupied with matters of justice, have also a closer part in the Pontifical Liturgy, some as other Subdeacons, others as Apostolic Acolytes; but a conspicuous part falls also to the others, as We mentioned from the outset, in the processions and in the pontifical sacred rites. Since these things are so, it is not surprising that Our Predecessors, to whom it was well known that these excellent duties were duly fulfilled by these faithful ministers, granted them a certain singular familiarity; inasmuch as they shared with them a part of their care and solicitude in conducting sacred matters, and they, bearing as it were the person of the Pontiff before the faithful in those things which pertain to their own office, gradually adorned them with conspicuous liturgical privileges; and they did this not only so that their labor might be followed by reward with praise, but also so that the external dignity, which they have from their office, might demonstrate to all the close connection with the person of the Pontiff himself. These privileges, repeatedly sanctioned by solemn Constitutions and Apostolic Letters, have grown with so many and such great additions, that it is not easy for all everywhere to acquire for themselves that perfect knowledge of them, which is altogether required so that their complete and peaceful use may be secure. Wherefore, as soon as Our most wise Predecessor Benedict XV promulgated the Code of Canon Law, whose canon 328 commands that the privileges, rules and traditions of the Pontifical Household be observed concerning these Prelates, the desire has often been proposed and the wish that this particular part of law also be reduced to a suitable order. We received these desired things the more willingly since already, God favoring, no small care falls upon Us to recall the various grades of the Pontifical Curia, which adorn it with royal variety, to their pristine splendor. Wherefore, with each College applying its eager labor, the matter having been carefully considered together with Our venerable brothers the Cardinals, His Eminences, who are placed over the Sacred Congregation of Ceremonies, We have determined in clear form and accommodated to the times to define, according to the general norms of common canon law which has already been wisely reduced into the Code, the constitution and privileges of each, which henceforth are to be used only in the manner and form which is set forth below, and in no way otherwise, with other provisions not contained in the present law being revoked and annulled, according to the norm of can. 22. On this occasion, as We have said, We have also thought it right to enumerate in order the special privileges which are to be granted to Prelates serving in the capacity of Assessor or Secretary in the Sacred Roman Congregations and others mentioned above. Therefore, from the fullness of Apostolic power, We establish and decree by these Apostolic Letters the following:
CONCERNING THE ORDERS OF PRELATES THEMSELVES
4 I. Among the Prelates of the Roman Curia, after the Prelates commonly called « di fiocchetti », the first place immediately obtain, by reason of office, the Most Excellent Prelates who serve in the capacity of Assessor or Secretary in the Sacred Roman Congregations, even though they lack the episcopal character. However, they do not constitute a true and proper College.
5 II. True Colleges of Prelates at the Roman Curia are numbered as four, which according to the order of precedence are described here, namely: 1. The College of Apostolic Protonotaries of the number of Participants;
6 2. The College of Prelate Auditors of the Sacred Roman Rota; 3. The College of Clerks of the Reverend Apostolic Chamber; 4. The College of Prelate Voters of the Apostolic Signature; to which College are added, although they do not constitute a true and proper College, the Prelate Referendaries of the same Apostolic Signature. By the Acts of Pius PP. XI. III. This order of precedence shall be observed not only by the Colleges themselves among themselves, but by the individual members of each College, namely in this manner, that he who belongs to a higher College shall precede all members of the lower Colleges, not excluding their Deans. In the Papal Chapel, however, the order of precedence and place to be assigned to individual members of these Colleges is determined by the Book of Sacred Rites of the Holy Roman Church as well as by Pontifical Bulls.
7 IV. In any College the Dean precedes the other colleagues, first among equals; the colleagues, however, maintain order among themselves according to the time of nomination by the Apostolic Letters given in brief form; but if they have these Letters on the same day, they maintain the order of the time when they were first co-opted among the Prelates universally, otherwise the order of reception of priesthood, or finally, if they were initiated into priesthood on the same day, they maintain the order of age.
8 V. Emeritus members of the Colleges of Prelates, of which mention is made in numbers XXVIII, LXXXII, CVI and CXXX, provided they have not been promoted to a higher dignity, immediately follow the ordinary members of their own College; among themselves, however, they maintain the order described in number IV.
9 VI. As regards the manner of precedence of Prelates in relation to other ecclesiastical or lay persons, this is determined by the privileges of each College; saving the right of precedence granted to the Most Excellent Assessors and Secretaries of the Sacred Congregations and certain others, as shall be stated below in numbers XIX and XXI.
10 VII. The habit of prelacy, commonly called "di formalità", or to be used in sacred functions by all Prelates of the Roman Curia, of whom mention is made in the present Constitution, whether they belong to the aforesaid Colleges or not, is that which is used by the Domestic Prelates and consists of a long vestment of violet color made of wool or silk, according to the season of the year, with a train, never to be spread out; cuffs (paramano), the edges of the vestment as well as the small mantelletto cord (filettatura), buttons and studs shall be of silk and ruby color. The girdle with tassels shall be of silk and violet; the collar and stockings shall also be violet. The shoes shall be adorned with buckles. A violet-colored tassel shall be placed on a completely black biretta, and around the black skull-cap shall be drawn a violet cord with a tassel of the same color. The rochet shall be adorned with Phrygian work or lace (pizzo), and if anything is placed beneath it in the sleeves (trasparente), it must be of the same color as the cuff of the vestment. What, however, the violet color to be used shall be, is defined by a decree of the S. C. of Ceremonies issued on 24 June 1933, to which one must entirely adhere.
11 Apostolic Protonotaries use a black biretta with a ruby-colored tassel and a skull-cap with a cord likewise of ruby color.
12 When the Apostolic See is vacant, the vestments shall be of wool and black, of which color shall also be the collar, stockings, and girdle with tassels. The rochet shall be simple without Phrygian work or lace. The tassel of the biretta and the cord of the skull-cap shall not be changed.
13 VIII. In collegial functions and in Pontifical Chapels, the Prelates of the four Colleges, of which mention is made, namely Apostolic Protonotaries, Auditors of the S. R. R., Clerks of the R. C. A., and Voters of the Apostolic Signature, having laid aside the mantelletto, shall put on over the rochet a woolen cape with or without ermine furs, according as the season shall be winter or summer. In sacred functions in which the Supreme Pontiff himself solemnly celebrates, the Prelates of whom the above has been said, excepting the Assessors and Secretaries of the Sacred Congregations (n. XVIII) and certain others, of whom num. XXI, and Apostolic Protonotaries, shall put on a surplice over the rochet.
14 in civil matters only to be used, consists of a black long vestment without a cape (commonly called pellegrina), with a cord, buttons and studs of ruby color; the girdle with fringes (frange) shall be violet and likewise the collar, stockings and a long silk pallium (ferraio- lone) shall be violet. The shoes shall have buckles, the skull-cap a violet cord, with the provisions made above concerning Apostolic Protonotaries being firm. IX. The prelatic habit, commonly called in civil matters only to be used, consists of a black long vestment without a cape (commonly called pellegrina), with a cord, buttons and studs of ruby color; the girdle with fringes (frange) shall be violet and likewise the collar, stockings and a long silk pallium (ferraio- lone) shall be violet. The shoes shall have buckles, the skull-cap a violet cord. They may use a very ample violet long pallium (mantello or tabarro) without a cord but with a violet silk lining.
15 When the Apostolic See is vacant the long pallium shall be of wool and black.
16 X. In collegial acts of lesser importance it shall be at the discretion of the President of each College to choose between the prelatic habit and the cape.
CONCERNING THE MOST EXCELLENT ASSESSORS AND SECRETARIES IN THE SACRED ROMAN CONGREGATIONS.
17 XI. The first among the Prelate Officials who preside over the conduct of business in the individual Roman Sacred Congregations is called Assessor or Secretary: Assessor indeed if the Prefect of that Sacred Congregation is the Roman Pontiff himself, but Secretary if the Prefect is a certain Cardinal Father. Assessors and Secretaries are nevertheless equal in dignity, saving the order of precedence to be established in no. XIX.
18 XII. Assessors and Secretaries, of whom in the preceding number, by decree of the Sacred Congregation of Ceremonies issued on 31 December 1930, enjoy the title of Most Reverend Excellency; and therefore the title of each one is this: His Most Reverend Excellency N. N., Assessor (or Secretary) of the Sacred Congregation N. (In Italian: His Excellency Rev. Monsignor N. N., Assessor, or Secretary, of the Sacred Congregation N.).
19 X. - Appointment and assumption of office XIII. Assessors and Secretaries of the Roman Sacred Congregations are appointed by the Supreme Pontiff through letters of the Cardinal Secretary of State, after giving notice to the Cardinal Secretary or Prefect of the respective Congregation.
20 XIV. Having received the Apostolic Letters in brief form of appointment, the new Assessor or Secretary shall first visit his respective Cardinal Secretary or Prefect, and from him shall hear when and how he ought to assume his office, observing the form which in the individual Congregations has long been customarily employed. Afterwards he shall visit the Most Eminent Cardinals of his Congregation.
21 XV. Let him seek an audience with the Supreme Pontiff as soon as possible to render thanks to the Blessed Father for his promotion; and likewise let him approach the Most Eminent Cardinal Secretary of State and, after having taken possession of his office, let him also visit the other Cardinal Fathers. But let him not fail to visit the other Prelate Assessors or Secretaries of the Sacred Congregations as soon as he is able.
22 XVI. What indeed are the duties and offices of these Prelates shall be drawn from canons 242-264 of the Code of Canon Law and from the laws and practice of each Sacred Congregation.
23 2. - Faculties XVII. Each Assessor and Secretary of the Sacred Congregations enjoys all the rights, privileges and insignia of Apostolic Protonotaries of the number of Participants listed below (nn. XLI-XLIX) (those excepted which pertain to the Protonotaries' College as a College) for the person during the term of office, even if they are not enrolled in this College.
24 XVIII. For Consistories and Pontifical Chapels henceforth they shall receive notice from the Prefect of Apostolic Ceremonies and shall be obliged to attend the aforesaid functions, and in them shall have a place, clothed in the cappa, immediately after the Prelates who are commonly called "di fiocchetti."
25 XIX. This degree of precedence above other Prelates, placed below the Prelates commonly called "di fiocchetti," even those shining with episcopal or archiepiscopal dignity, saving the right of the Metropolitan or Ordinary of the place in his territory, they shall have everywhere, even individually. When however all or several come together at the same time, Assessors and Secretaries who are adorned with archiepiscopal or episcopal dignity shall precede the others, and other things being equal, Assessors shall precede Secretaries, observing the order in force among the Sacred Congregations. XX. They enjoy these privileges only during their term of office; but when the office is laid down, unless they are raised to cardinal or another dignity which cannot be reconciled with the dignity of Protonotary, or unless something else is expressly provided, they immediately, by the law itself, become like Protonotaries, with all the rights and privileges attached to this dignity.
26 XXI. All things which are said in this chapter concerning Assessors and Secretaries of the Roman Sacred Congregations are to be understood, with appropriate adjustments, also of other Prelates to whom by the aforesaid decree of the Sacred Congregation of Ceremonies, issued on 31 December 1930, the title of Most Reverend Excellency was recognized and granted, that is the Master or Prefect of the Secret Chamber of the Supreme Pontiff, the Secretary of the Tribunal of the Apostolic Signature, the Dean of the Sacred Roman Rota, the Substitute of the Secretariat of State; who, saving the particular offices and places assigned to any one of these Prelates in the Papal Chapels according to this very Constitution, as is set forth below, have a place immediately after the aforesaid Assessors and Secretaries, observing among themselves the order stated above; if however any one of them is adorned with archiepiscopal or episcopal dignity, he precedes the others, but after Assessors and Secretaries.

CONSTITUTIO APOSTOLICA DE QUIBUSDAM PRAELATIS ROMANAE CURIAEETVARIIS EORUM ORDINIBUS. PIUS EPISCOPUS SERVUSSERVORUMDEI ADPERPETUAMREIMEMORIAM

5 II. I veri Collegi di Prelati presso la Romana Curia sono quattro, che secondo l'ordine di precedenza qui si descrivono, cioè: 1. Collegio dei Protonotari Apostolici del numero dei Partecipanti;
19 X. - Nomina e assunzione dell'incarico XIII.
