Bull reserving ecclesiastical benefices to the Apostolic See

Bull of Pope Benedict XII ·

1 BENEDICT XII (in the year 1335, at Avignon). To the governance of the universal Church, although unworthy, called thereto by divine disposition, we bear in our desires, as we ought, that through the study of our diligence suitable men be assumed for the governance of any churches and monasteries, and other ecclesiastical benefices according to divine good pleasure and the effect of our intention, who may preside over and profit the churches, monasteries, and benefices aforesaid committed to them. Having therefore been induced by preliminary consideration, and other reasonable causes persuading us, adhering to the footsteps of some of our predecessors, Roman pontiffs, we reserve to our ordinance, disposition, and provision (until the clemency of divine mercy shall grant us to preside over the governance of the universal Church), all patriarchal, archiepiscopal and episcopal churches, and also monasteries, priories, dignities, personates, and offices, as well as canonicates and prebends, and churches, and other ecclesiastical benefices with or without cure, secular and regular, whatsoever and of whatsoever kind they may be, even if persons have been accustomed or ought to be assumed to them by election or any other mode, now vacant at the apostolic see in any manner whatsoever, and hereafter to become vacant, as well as those made vacant by deposition or privation or translation, or suspension of the conferment of office, by our predecessor of happy memory, Pope John XXII aforementioned, or by his authority, and by us or by our authority hereafter to be made vacant anywhere; and also if perchance during the time of the said predecessor some have been elected or postulated in concord or discord, whose election has been quashed or postulation rejected, or renunciation made by them and admitted by the same predecessor or by his authority has taken place, or whose elections or postulations, and those hereafter to be made or postulated and renouncing, the election is to be quashed or the postulations rejected, or the renunciation admitted by us or by our authority at the aforesaid see or elsewhere anywhere; and also by the death of cardinals of the same Roman Church and officials of the said see, namely the camerlengo, vice-chancellor, notaries, auditors of letters contradicted, and auditors of the apostolic palace of the bulls, correctors, and writers of apostolic letters, and penitentiaries of the aforesaid see, and abbreviators, as well as commensals and any other chaplains of the same see, and also of any legates or nuncios, and rectors in the lands of the Roman Church, and treasurers, by the said predecessor John or by us specially deputed or sent hitherto, or to be deputed by us or sent hereafter, now vacant and hereafter to become vacant, wherever it shall happen that the said legates or nuncios or rectors or treasurers, before they shall have returned or come to the Roman curia, are removed from human affairs, as well as of any whatsoever coming to the Roman curia for any business whatsoever, or also departing from the same, if they shall have already died in places not distant from the said curia beyond two legal days, or it shall happen hereafter that they pass from this life, and also in like manner of any whatsoever curial officials departing to any places for pilgrimage, infirmity, or recreation, or any other cause whatsoever, if they, before they shall have returned to the said curia, in places not remote beyond two days from the same curia (as is premised), provided that their own domicile does not exist there, shall have already perhaps died, or it shall happen hereafter that they be removed from the midst, now vacant by such death, and hereafter to become vacant, again monasteries, priories, deaneries, dignities, personates, administrations, offices, canonicates, prebends, and churches, and other ecclesiastical benefices, secular and regular, with or without cure, whatsoever and of whatsoever kind they may be, even if persons have been accustomed and ought to be assumed to them by election or any other mode, which, promoted by the said predecessor or by his authority to the governance of patriarchal, archiepiscopal, and episcopal churches, as well as monasteries, they held at the time of the promotions made of them, now vacant, and which by us or by our authority hereafter to be promoted to the same governance shall hold at the time of such promotion, as well as also those which by peaceful acquisition of any priories, dignities, personates, offices, canonicates and prebends of churches, and other benefices by us or by the same predecessor John or by authority of our letters or of the said predecessor John collated and to be conferred hereafter, now vacant and hereafter to become vacant, (full deliberation having been had with our brothers on all and each of these matters, and mature deliberation having followed,) we reserve by apostolic authority to our ordinance, disposition, and provision (until the clemency of divine mercy shall grant us to preside over the governance of the universal Church), by the counsel of the same brothers, decreeing from now null and void, if otherwise concerning the premises and any of them by any whatsoever authority knowingly or unknowingly it shall happen to be attempted, notwithstanding any constitutions whatsoever issued by our predecessors, Roman pontiffs, insofar as they could stand in the way concerning the matters recounted or any or some of them. Let no man whatsoever be permitted to infringe this page of our reservation and constitution, or to contravene it with rash presumption. If anyone, however, shall presume to attempt this: let him know that he shall incur the indignation of almighty God and of the blessed Peter and Paul, his apostles. Given at Avignon, on the 3rd.

1 BENEDETTO XII. (ann. 1335. Avignone.)
