APOSTOLIC ERECTION OF THE DIOCESES OF NITERÓI, BARRA DO PIRAHY AND CAMPOS. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR THE PERPETUAL MEMORY OF THE MATTER

1 Elevated to the throne of the supreme Apostolic See by divine disposing clemency, among the very many and most grave cares by which we are pressed on all sides, we judge that those are to be embraced with pastoral affection of heart which are known to conduce more to the care of the souls of the Christian faithful in the Lord. In order that the spiritual good of his faithful might be provided for, our venerable brother Augustine Francis Bennassi, the present Bishop of Niterói, judged it necessary to divide his diocese into three parts, and to erect two other dioceses therein, and he humbly petitioned us for this. When his prayers had received a favorable vote from our venerable brothers the Apostolic Nuncio and the Cardinal Archbishop of St. Sebastian of Rio de Janeiro, the Metropolitan of this Church of Niterói, we benignly received them, and, having heard likewise the vote of our venerable brothers the Cardinals of the Sacred Congregation of Consistorial Affairs, we decreed that we should proceed to the desired divisions and erections. Wherefore, having supplied, insofar as it is necessary, the consent of those to whom it pertains or who may presume their interest to pertain, using the fullness of Apostolic power and also the faculty contained in the Apostolic Letters under lead Ad universas orbis Ecclesias, of the twenty-seventh day of April of the year of Our Lord one thousand eight hundred and ninety-two, reserved to this Apostolic See, we withdraw from the diocese of Niterói the following parishes, namely: Barra do Pirahy, Iguassù, Nova Iguassù, Pavuna, Marapicu, Itaguahy, Biberâo de Lages, Bananal, Mangaratiba, Itacurussà, Jacarehy, Agua dos Reis, Illia Grande, Bibeira, Jacuecanga, Mambucaba, Paraty, Paraty Mirim, St. John Marks, Rio Claro, Passa Tres, St. Anthony of Capivari, Bezende, St. Anne of the Tocos, Campo Bello, St. Vincent Ferrer, Vargem Grande, Barra Mansa, Holy Spirit of Barra Mansa, Guatis, St. Joachim, Amparo, St. Anne of Pirahy, Arrozal, Bores of Pirahy, St. Joseph of Turvo, Vatenga, St. Theresa of Valenga, Conservatorio, Ipiabas, St. Isabel, Vassoura, Paty do Alferes, Tingud, Mendes, Ferreiros, Parahiba do Sul, Encruzilhada, Besengano, Apparecida, Sapucaia: within the boundaries of which parishes we erect the diocese to be called Barrensis of Pirahy: and we establish its seat and cathedral therein in the city of Barra do Pirahy, from which the name of the diocese is derived, and we raise the mother church of St. Anne to the honor of a cathedral. We also erect a cathedral church to be denominated Camposina from the city of Campos, the principal city of the diocese, within the boundaries of the following parishes, which they call: St. Savior of Campos, Our Lady of the Tergo of Campos, Magdalena, St. Sebastian of the Heights, St. Francis of Paula, Macahé, Barreto, Neves, Guissamán, Carapebus, Conception of Macabù, Barra of St. John, St. Sebastian of Campos, St. Gongalo of Campos, Guarrilhos, Bores of Macabù, Saint Rita, St. Benedict, Morro do Coco, St. Fidelis, Ponte Nova, St. Francis of the Barra, St. John of the Barra, Padua, Monte Verde, Good Jesus of Itabapoana, Lagé of Muriahé, Nativity of Carngola, Miracema: which parishes we likewise withdraw from the diocese of Niterói, and we establish the seat and cathedral of this new Church in the city of Campos, and we raise the mother church of the Most Holy Savior to the honor of a cathedral. The boundaries of each diocese shall therefore be the same as the boundaries of the parishes by which they are constituted.

2 Moreover, to these newly erected cathedral Churches and to their Bishops for the time being, we grant the honors, insignia, favors, rights and privileges with which other cathedral Churches and their Prelates in Latin America, by common law or legitimate custom, are endowed and enjoy. We constitute these cathedral Churches suffragans of the metropolitan Church of St. Sebastian of Rio de Janeiro, and we subject their Bishops for the time being to the metropolitan jurisdiction of the same Archbishop of St. Sebastian, with the faculty nevertheless reserved to the Apostolic See of freely decreeing a new dismemberment of these dioceses, whenever this shall seem opportune in the Lord.

3 Since, however, the circumstances of the times prevent the institution of a Chapter of Canons in each Cathedral at present, we command that, in place of Canons, Diocesan Consultors be chosen, according to canon 423 and the following canons of the new Code of Canon Law.

4 • We further command that, as soon as it can be done, at least a small diocesan Seminary, according to the provisions of the same Code and the rules handed down by the Sacred Congregation for Seminaries, be erected in each diocese; and we wish that, at the expense of each diocese, two chosen young men, or at least one for the present, be sent to the Pontifical Pius Latin American College of the City, without interruption of turn. As to the administration and governance of these dioceses, to the election of a Vicar Capitular or Administrator, sede vacante, to the rights and duties of clergy and faithful, and other such matters, we command that what the sacred canons decree be observed. As to the clergy, we decree that, as soon as the erection of the dioceses has been made, by that very fact the priests of the Church to which they are assigned shall be considered as such, in whose territory they legitimately exist. It shall be the duty of the Ordinary of Niterói to deliver all documents and acts concerning the new dioceses, as soon as it can be done, to their Chancery so that they may be preserved in their own archive. The episcopal table shall be constituted by the emoluments of the Curia and other offerings, which are accustomed to be provided by the faithful, for whose benefit the dioceses have been erected; besides those which have already been collected for this purpose. That which by these Letters, by Apostolic authority, has been decreed by Us, it is permitted to no man, at any time whatsoever, to infringe, or to oppose or in any way to contravene. If anyone, which God forbid, shall presume to attempt this, let him know that he will incur the penalties established by the sacred canons against those who resist the exercise of ecclesiastical jurisdiction. To carry these matters into execution we appoint the venerable brother Henry Gasparri, Archbishop with the title of Sebasteia, Apostolic Nuncio in the Brazilian Republic, granting to him the necessary and opportune faculties, even of subdelegating, for the purpose in question, any man constituted in ecclesiastical dignity, with the burden imposed upon him of sending to the Sacred Consistorial Congregation, as soon as these Letters are received, an authentic copy of the execution accomplished. We finally decree that these present Letters shall be valid, notwithstanding any contrary provisions whatsoever, even those worthy of particular and express mention. 4 • Mandamus insuper ut, quamprimum fieri poterit, saltem parvum Seminarium dioecesanum, iuxta eiusdem Codicis dispositiones et regulas a Sacra Congregatione de Seminariis traditas, in unaquaque dioecesi erigatur; et volumus ut, uniuscuiusque dioeceseos sumptibus, duo electi iuvenes, aut saltem unus in praesenti, in Pontificium Collegium Pium Latinum Americanum de Urbe, non intermissa vice, mittantur. 1 Elevati al supremo soglio della Sede Apostolica dalla divina clemenza, tra le molteplici e gravissime cure che da ogni parte ci opprimono, riteniamo che debbano essere abbracciate con affetto pastorale del nostro cuore soprattutto quelle che si riconoscono condurre maggiormente al bene delle anime dei fedeli cristiani nel Signore. Affinché potesse provvedersi a questo bene spirituale dei suoi fedeli, il venerabile fratello Agostino Francesco Bennassi, attuale Vescovo di Nictheroy, ha ritenuto necessario dividere la sua diocesi in tre parti e erigervi due altre diocesi, e ciò ha umilmente chiesto a Noi. Poiché alle sue suppliche ha aderito il voto favorevole dei venerabili fratelli Nunzio Apostolico e Cardinale Arcivescovo di San Sebastiano del Rio di Janeiro, Metropolita di questa Chiesa di Nictheroy, le abbiamo benignamente accolte e, ascoltato parimente il voto dei venerabili fratelli Cardinali della Sacra Congregazione Concistoriale, abbiamo deciso di procedere alle desiderate divisioni ed erezioni. 2 Inoltre a queste neo-erette chiese cattedrali e ai loro Vescovi pro tempore attribuiamo gli onori, gli insegni, i favori, i diritti e i privilegi di cui godono e fruiscono le altre chiese cattedrali e i loro Presuli in America Latina, per diritto comune o per legittima consuetudine. Costituiamo queste chiese cattedrali suffraganee della chiesa metropolitana di San Sebastiano del Rio di Janeiro, e i loro Vescovi pro tempore li sottoponiamo al diritto metropolitico dello stesso Arcivescovo di San Sebastiano, riservata tuttavia alla Sede Apostolica la facoltà di liberamente decretare una nuova smembrazione di queste diocesi, tutte le volte che ciò sarà sembrato opportuno nel Signore.

3 Poiché però le circostanze dei tempi impediscono che in ciascuna Cattedrale si istituisca al presente un Capitolo di Canonici, ordiniamo che, al posto dei Canonici, si eleggano i Consultori Diocesani, secondo il canone 423 e seguenti del nuovo Codice di diritto canonico.

4 • Ordiniamo inoltre che, al più presto possibile, almeno un piccolo Seminario diocesano, secondo le disposizioni dello stesso Codice e le regole trasmesse dalla Sacra Congregazione dei Seminari, sia eretto in ciascuna diocesi; e vogliamo che, a spese di ciascuna diocesi, due giovani scelti, o almeno uno per il presente, al Pontificio Collegio Pio Latino Americano dell'Urbe, senza interruzione, siano inviati. Per quanto riguarda l'amministrazione e il governo di queste diocesi, l'elezione del Vicario capitolare o dell'Amministratore, sede vacante, i diritti e gli oneri dei chierici e dei fedeli, e altre cose di questo genere, ordiniamo che si osservino le cose che i sacri canoni decernono. Quanto al clero, stabiliamo che, non appena sia avvenuta l'erezione delle diocesi, per ciò stesso i presbiteri della Chiesa a quella ascritti si considerino, nel cui territorio legittimamente esistono. Sarà compito dell'Ordinario di Niterói trasmettere al più presto possibile alla Cancelleria di esse tutti i documenti e gli atti riguardanti le nuove diocesi, affinché siano conservati nel proprio archivio. Costituiranno la mensa episcopale gli emolumenti della Curia e le altre oblazioni, che dai fedeli, per il cui bene le diocesi sono state erette, sono soliti essere offerte; oltre a quelle che già sono state raccolte a questo fine. Che tutte le cose che con queste Lettere, per autorità Apostolica, da Noi sono state decretate, a nessun uomo, in nessun tempo mai, sia lecito infrangere, o ad esse opporsi o in qualsiasi modo contravvenire. Se qualcuno, che Dio non voglia, avrà osato tentare questo, sappia che si sarà reso obnoxio alle pene dai sacri canoni stabilite contro coloro che si oppongono all'esercizio della giurisdizione ecclesiastica. Per mandare ad esecuzione queste cose, deputiamo il venerabile fratello Enrico Gasparri, Arcivescovo titolare di Sebastea, Nunzio Apostolico nella Repubblica Brasiliana, attribuendogli le facoltà necessarie e opportune, anche di subdelegare, allo scopo di cui si tratta, qualsiasi uomo costituito in dignità ecclesiastica, con l'onere a lui imposto di inviare alla Sacra Congregazione Concistoriale, al più presto dopo la ricezione di queste Lettere, copia autentica dell'esecuzione compiuta. Decerniamo infine che queste presenti Lettere varranno, non ostante contrarie disposizioni di qualsiasi genere, anche degne di particolare e espressa menzione. Dato a Roma presso S.
