Apostolicae Sedis

Apostolic Constitution on the reform of censures (Apostolicae Sedis moderationi)

Apostolic constitution of Pope Pius IX ·

PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD

1 For perpetual remembrance of the matter.

2 "It befits the governance of the Apostolic See to retain in such manner those things which have been salutarily established by the authority of the ancient canons, that if the change of times and circumstances should suggest that something ought to be tempered by prudent dispensation, that same Apostolic See may provide the fitting remedy and providence of its supreme power. Wherefore, since We have long been turning over in Our mind that ecclesiastical censures, which by way of latae sententiae, incurred by the very fact itself, have been holily imposed and promulgated through individual ages for the sake of preserving the integrity and discipline of the Church itself, restraining and correcting the unbridled license of the wicked, have gradually grown to a great number: and some indeed, with times and customs changed, have fallen away from the purpose and causes for which they had been imposed, or from their former utility and opportuneness,* and for this reason not infrequent doubts, anxieties, and pangs of conscience arise both in those to whom the care of souls has been entrusted and in the faithful themselves; We, wishing to meet such inconveniences, have ordered that a full review of the same be made and proposed to Us, so that, with diligent consideration applied, We might determine which of them ought to be preserved and retained, and which ought to be moderated or abrogated. That review therefore having been completed, and Our Venerable Brethren the Cardinals of the Holy Roman Church, appointed as General Inquisitors in matters of Faith throughout the whole Christian Commonwealth, having been called into counsel, and the matter having been long and carefully weighed, by Our motu proprio, with certain knowledge, mature deliberation of Ours, and from the fullness of Our Apostolic power, by this Constitution, to endure perpetually, We decree that from whatsoever censures, whether of excommunication, suspension, or interdict, which by way of latae sententiae, incurred by the very fact itself, have hitherto been imposed, only those which We insert in this very Constitution shall have force therefrom, and in the manner in which We insert them; at the same time declaring that these same ought to receive their force not only from the authority of the ancient canons, insofar as they agree with this Our Constitution, but also from this Our Constitution itself, no less than if they had been first issued by it."

"Excommunications of latae sententiae specially reserved to the Roman Pontiff."

3 "Therefore We declare that the following are subject to excommunication of latae sententiae specially reserved to the Roman Pontiff: I."

4 "All apostates from the Christian faith, and all and each heretics, by whatsoever name they may be called, and of whatsoever sect they may exist, and those who believe in them, their receivers, supporters, and generally all whosoever defenders of theirs."

5 II.

6 "All and each who knowingly read without the authority of the Apostolic See the books of those same apostates and heretics defending heresy, as well as books of any author specifically prohibited by Apostolic letters, and those who retain, print, and in any way defend the same books 1."

7 III.

8 "Schismatics and those who pertinaciously withdraw themselves from or depart from the obedience of the Roman Pontiff existing at the time."

9 "All and each, of whatsoever status, rank or condition they may be, appealing from the ordinances or mandates of the Roman Pontiffs existing at the time to a future universal Council, as well as those by whose aid, counsel or favor the appeal shall have been made."

10 "All those killing, mutilating, striking, seizing, imprisoning, detaining, or hostilely pursuing the Cardinals of the Holy Roman Church, Patriarchs, Archbishops, Bishops, and Legates or Nuncios of the Apostolic See, or those casting them out from their Dioceses, Territories, Lands, or Domains, as well as those commanding these things, or ratifying them, or providing aid, counsel or favor in them."

Notes

  1. By this Article 2, a great abrogation of censures was made, and a simple principle was established, so that censures cease for books which have been listed in the Index of Prohibited Books, except for those which are mentioned in this article. Wherefore all other books listed in the said Index will indeed not be able to be read without grave fault, yet readers and others to whom the prohibition extends will not incur censures. Likewise excommunicated are those, with no excommunication reserved to anyone, who print—
