Constitutions on the Roman Curia and the Audientia contradictarum

Constitution of Pope Martin V ·

advocates and procurators. — 35. Concerning the publication of these laws.

1 Martin, bishop, servant of the servants of God, for perpetual remembrance of the matter.

2 Placed in the watchtower of apostolic dignity over the Lord's flock, albeit unworthy, and bound to execute the office of apostolate committed to us from above, we willingly direct the attention of our consideration, with the help of the Lord desiring it, to those matters which regard the utility and advantage of the commonwealth, so that, through the assistance of our provision, vices may be uprooted, virtues planted, iniquities destroyed, and good things rebuilt, and that crooked things may become straight, and, deformities removed, the splendor and beauty of due reformation may shine forth, whence may proceed the increase of all equity and justice.

3 § 1. Indeed, although our predecessors of blessed memory, Pope Clement XXII, Benedict XII, and Gregory XI, Roman Pontiffs, established constitutions concerning the matter...

4 ...of our office, and also by apostolic mandate certain auditors of the office of contradicted apostolic letters, and finally Geoffrey of blessed memory, bishop of Chalon, and Peter then elect of Viviers, auditors of the said office, drew up in praiseworthy fashion certain constitutions and ordinances concerning the administration and governance of the officials and offices of the Apostolic Chancery and Penitentiary, as well as of the aforesaid contradicted office and causes of the audiences of the Apostolic Palace and other judges or commissioners in the Roman Curia, and their notaries, as well as of the consistorial advocates and procurators in the aforesaid audience; yet because, with such wickedness increasing, these were afterwards either weakly observed or are known to require useful additions; we therefore, intending to provide in this matter laudably and usefully, as we are bound by the duty of the pastoral office committed to us, albeit unworthy, by the tenor of these presents, renewing the aforesaid constitutions and ordinances (which we wish to be held as expressed here) by apostolic authority, and commanding them to be firmly observed with the additions inscribed below, by the same authority we establish and also ordain.

5 § 2. If apostolic notaries and their abbreviators and others in the justice and also grace of apostolic letters shall have demanded excessive fees for their minutes, and also if apostolic letters shall have been excessively taxed, recourse shall be had to the vice-chancellor concerning such excesses, or by his mandate, or, he being absent, to his locum tenens or president in the aforesaid Chancery; who, having deliberated with the abbreviators assisting the same vice-chancellor in the expedition of apostolic letters in the Chancery, and others whom he shall see fit in this matter, shall reduce the aforesaid excesses to due moderation, and moreover shall exact from the writers or abbreviators who shall have demanded it, as well as from the taxers of those letters who shall have taxed them so excessively, what they shall have excessively demanded, to be converted to the uses of the chapel of the aforesaid writers, or other pious works. And that the aforesaid notaries may receive for the minutes of letters of provision of patriarchal, metropolitan, and other cathedral churches and any monasteries made consistently, since other letters do not pertain to them, as is paid more or less for common service by the same, namely for the first hundred florins of common service beyond five, and for each other similar hundred florins, if there be more, beyond one; and if such service shall not amount to one hundred florins, for each ten florins of such number beyond half a florin they shall in no way receive or exact, under any pretext whatsoever, otherwise we will that each of them incur the penalties declared below, imposed on abbreviators of the said letters exacting more than is due from the minutes which they make, by that very fact. If by their fault or that of any other abbreviator letters, which they have made into minutes, and for which they receive salaries or emoluments, shall need to be rewritten, let them be rewritten at the expense of those who were or was at fault, under the penalties stated below. And moreover, since the aforesaid notaries ought to have skilled and sufficient abbreviators, sometimes they receive in the art of abbreviation those less skilled, from which sometimes losses and damages have resulted, we establish that none of the said notaries shall be able or permitted to receive anyone as his abbreviator unless he shall first have been found by the assistants to the vice-chancellor in the expedition of apostolic letters and others whom he shall see fit, to be skilled and sufficient in the minutes to be formed over them concerning justice, and also approved.

6 § 3. We have also decreed and ordained that if a letter shall be judged in the Chancery to require rewriting, and within three days from the day of the party's requisition the abbreviators' examination of letters to be rewritten, and the following, or the solicitor of the expedition thereof, he whose fault it shall be judged that the letter requires rewriting, shall be bound to rewrite or cause to be rewritten at his own expense without any other salary, however modest, even if offered freely, under penalty of suspension from the office of scribe of the aforesaid letters and from entry into the Chancery, if he shall be a scribe of the aforesaid letters for forty continuous days, and meanwhile the distributor or referendary of the same letters shall distribute to him no letter of any tax under penalty of excommunication, which if he knowingly act contrary to, he shall incur ipso facto, from which he cannot be absolved except by the Roman Pontiff, first having made real and effective satisfaction to the injured party for damages and interest, and having paid three ducats to be applied to the same chapel of scribes of the aforesaid letters as a penalty. But if he shall be an abbreviator, he shall likewise be compelled to cause the letter to be written within the aforesaid term, under penalty of suspension from his office and from his entry into the Chancery for three months, during which time of suspension, the vice-chancellor shall distribute nothing to him. But if the vice-chancellor inadvertently or otherwise distribute anything to him, and he himself receive it during the time of such suspension, he shall ipso facto incur the sentence of excommunication, from which he cannot be absolved in any way except by the Roman Pontiff, first having made satisfaction to the injured party for damages and interest, and until he shall have really paid three ducats to be converted as aforesaid; and for the repetition of the offense or excess there shall be place for the multiplication of penalty.

7 § 4. And that to none of the aforesaid scribes, who does not personally exercise his office of scribe of the aforesaid letters or is not able to exercise it, shall anything be distributed or any emolument from the same office be received unless it be on account of infirmity or some other legitimate impediment; in which case the aforesaid vice-chancellor may dispense with him by letters of the same containing the cause of distribution, first to be published in the Chancery itself, for such time as shall seem good to him. But henceforth no one holding such office of scribe of the aforesaid letters shall be able to retain the office of the Penitentiary, and if anyone presume to attempt this, let him be deprived of both ipso facto.

8 § 5. Those also who hold such office of abbreviator of the Chancery or of scribe of apostolic letters, or of scribe of the office of the Penitentiary of the aforesaid letters, shall be bound to relinquish such office of the Penitentiary or of scribe of the aforesaid letters within the tenth day next following. Otherwise, if they act contrary, they shall incur the penalty next mentioned.

9 § 6. Indeed, since it is fitting that the abbreviators of the aforesaid letters assisting the vice-chancellor or locum tenens or president aforesaid in such expedition of letters in the aforesaid Chancery should be sufficient and expert in the office of abbreviation of the same letters and also circumspect, prudent and upright, we have likewise decreed and ordained that henceforth no one shall be admitted to assist the aforesaid vice-chancellor or locum tenens or president in the expedition of apostolic letters unless he shall first have been examined by the said greater part of abbreviators continuing in the aforesaid Chancery, and shall be found sufficient for it and also approved.

10 § 7. That the aforesaid assistants shall come to the Chancery at the hour appointed by the aforesaid vice-chancellor on the days assigned for its operation, on each day on which the said Chancery is to be held, and when it shall have been opened, they ought to remain in it, nor in the meantime may they depart from it, ceasing any legitimate excuse, which they ought to express to the same vice-chancellor or his locum tenens or president, if they are present, or, in their absence, to the aforesaid assistants, or swear that they have a legitimate excuse, unless they shall have obtained special permission on this matter from the vice-chancellor or locum tenens. And that each of the aforesaid assistants who shall come after the third part of the aforesaid hour shall pay six, and similarly those who shall depart before the said Chancery is finished, six others, and those who on the same day shall not come to the said Chancery, twelve Tournois grossi on each day on which they shall commit this, to the chapel of the aforesaid scribes as a penalty for contempt of this our statute and ordinance, within three days immediately following; nor shall they be admitted to the prosecution of such an appeal in any way, unless first satisfaction shall have been made for the principal and expenses, if any shall have been incurred on that account. Similarly we wish the same to be observed by other sufficient abbreviators for continuing the same Chancery through the aforesaid assistants to be chosen from other abbreviators, as well as in the officials of the said Chancery, under similar penalties.

11 § 8. We have moreover established and also ordained that the seneschal of the said Chancery, who is called the keeper, shall take an oath in the hands of the said vice-chancellor at his primary reception to the office of seneschal of the aforesaid Chancery, and each year, concerning the faithful exercise of this office, and otherwise according to the form of the oath aforesaid newly appointed by us, and inscribed in the book of the Chancery hereinafter written, he is bound to take. And that he himself in whatsoever letters of grace shall write the day of their reception, on which they shall be presented to him in the said Chancery, and for such writing shall receive nothing even if freely offered, and the aforesaid letters according to the order of their reception shall present for expedition without fraud. Nor shall he conceal or hide letters, rolls and supplications delivered in the expedition of letters before or after the expedition of our letters in the said Chancery, or shall he maliciously retain the expedition of the same letters, or shall he defer or retard it through himself or another or others against the order written above. Which if he shall knowingly do to the contrary, by that very fact he shall incur the sentence of excommunication, from which he cannot be absolved except by the Roman Pontiff, except when constituted in the article of death. And that if the aforesaid seneschal shall be found to have done anything against this his oath by fraud or deceit, he shall be deprived of the said office by that very fact: and because concerning such and similar crimes, which are committed secretly, it can with difficulty be established, six of the aforesaid scribes or abbreviators not suspected, and of good fame and good name, shall depose that the same seneschal has exercised this his office illegally, and on this account also he shall be publicly defamed, he shall be deprived of the said office by that very fact, and unless provision shall have been made for him by the said chancellor within three days following, from then it shall be possible to provide from a sufficient abbreviator of the aforesaid letters (who shall similarly take an oath and shall be bound to fulfill all the aforesaid things incumbent upon the same seneschal). And moreover that no one other than the aforesaid seneschal shall place any letter of grace containing something to be expedited in the place of expedition.

12 § 9. Similarly we have established and also ordained that no constitution of the said Chancery shall be delivered to anyone, so that he may give faith to it in judgment or elsewhere, unless it shall first have been examined by the said assistants, and afterwards by two of them then present it shall be seen, and signed on the back, and by two of the abbreviators in due form it shall be heard with the aforesaid book, who shall subscribe themselves in the same, and then by the vice-chancellor it ought to be subscribed, and signed with his seal in due manner, and given to the party seeking it, for which constitution beyond four Avignon grossi, of which sixteen are worth one gold florin of the Camera, for the seal, sigil and writing, and otherwise by the secretary or chamberlain of the said vice-chancellor and the aforesaid seneschal or any others whatsoever shall in no way be received or even exacted.

13 §10. Furthermore, in order that letters concerning justice may be expedited without loss to the parties and more quickly, we establish and ordain that the Chancery of letters of justice, if such letters suffice for this, shall be held three times each week, as it was customarily held in antiquity; but if such letters do not suffice for this, it shall be held at least once each week; to which the notaries, who ought to be six in number, and others skilled in drawing up notes of justice, or in law sufficient abbreviators (whose names shall be inscribed in the register of abbreviators of the said letters), as well as the prelates and other famous and practicing doctors present in the said Curia, and first by the same prelates and doctors, with the customary oath taken, ought to be convoked, as has hitherto been laudably observed. And that in the same Chancery letters of execution upon sentences rendered in the Roman Curia, unless the style customarily observed in cases in the same Curia has been observed in order, as is customary to be narrated in the aforesaid letters according to the style of the aforesaid Chancery, or unless expenses incurred in the same cases have been notoriously relaxed excessively against the constitutions issued, until they have been moderated by the consent of the parties or the victorious party or otherwise juridically, in no way can and ought to be expedited. § 11. And moreover we establish and ordain that examiners in special grace, before they exercise such office, shall take an oath before the vice-chancellor in the maps of faithful exercise of it, and that they themselves thereafter diligently exercise such office by themselves. Let them rigorously examine those seeking letters, learning and fitness, and those seeking benefices having care of souls or jurisdiction, and let them receive careful information concerning life and morals, and let the examiners report the aforesaid sufficiency and

14 fitness in writing under their seal, for which writing, seal, salary and labor of theirs, beyond one Tournois gross, and the clerk making the aforesaid writing, beyond a quarter of a similar gross, they shall in no way presume to receive anything, even if freely offered. But if an examiner or clerk shall attempt the contrary, by that very fact they shall incur the sentence of excommunication, from which they cannot be absolved until satisfaction has been made.

15 § 12. Similarly we establish and ordain that the bullators of the said apostolic letters, for bullating the same letters, whether they contain grace or justice, beyond that which in antiquity, and before the last schism, namely in the time of Pope Gregory XI aforesaid, they received for similar letters, shall presume to receive nothing, nor from a duplicated letter, beyond four, and from a corrected letter again to be bullated, as well as from a letter upon a copy taken from the register, beyond eight, nor from letters otherwise bullated, and again to be bullated (not however on account of a defect of the parties), and to be corrected in the said register, beyond one Tournois gross shall they presume to receive or exact.

16 § 13. And we wish the same to be observed by the said re-registrars in all the aforesaid matters. And that the aforesaid registrars shall not cause registered letters, for the sake of exacting or extorting something from those pursuing them, to be registered more than is due, or maliciously find fault with them for poor expedition, but accuse them to the questor, or participate in the salaries of the clerks writing in the said register; but if they shall do the contrary, by that very fact they shall incur the sentence of excommunication, from which (except in case of death) they cannot obtain the benefit of absolution by any other than the Roman Pontiff, and moreover from such office, if this can be proved by witnesses, or otherwise presumptively, by that very fact they shall be deprived, and perpetually unfit to exercise any office if they exist in the Roman Curia 1

Registrars.

BULLARIUM ROMANUM An. C. 1418

17 And that the clerks writing in the said register, who shall not have registered the letters delivered to them within three days immediately following from then (legitimate impediment ceasing), shall be entirely removed from the said register, nor shall they be admitted to write there hereafter. Auditors.

18 § 14. And nevertheless since justice in contradictory judgment ought to be exercised purely, we establish and also ordain that henceforth no one shall be received as an auditor of the causes of the Apostolic Palace unless he shall be a famous doctor of law, and after receiving his doctorate shall have read in the same for at least a triennium, and shall be commended for life and honesty of morals, and other virtues, and from every office as from clean hands, and shall have good testimony, and shall have at least either in benefices, or in temporal goods two hundred gold florins of the Camera annually in portals, from which he may be able to sustain himself in the said Curia, so that in such manner

19 § 15. And that after it shall have been granted by some Pope to an auditor of the causes of the said Palace to be admitted, before proceeding further to his admission, the dean of the aforesaid auditors shall be bound to make a diligent inquiry into the aforesaid matters, and whatever he shall find through it, he shall faithfully report to the aforesaid vice-chancellor, who shall likewise be bound to lay this before the Pope, and if anything of the aforesaid shall be lacking, his admission as an auditor shall not proceed further, unless the aforesaid Pope should command otherwise. Disputano P„"

20 § 16. But if through such information it shall be established that the same person is renowned as a doctor in the auditors' office, and the other aforesaid matters are true, the same vice-chancellor, calling four of the said auditors, if he be a canonist, [shall call] a decretal, but if he be a legist, [shall call] a law, which within the space of one month from the day assigned to him, to be reckoned in the presence of the said vice-chancellor or his locum tenens (and for this purpose all the notaries of the said See and the aforesaid auditors and consistorial advocates then present in the same Curia being called; and also prelates and other renowned and

21 The duty of auditors, and what their manners and qualities ought to be.

22 LEARNED men, who shall then have been in the same Curia) shall be bound to repeat, and he who repeats shall be bound to hear each one who shall wish to argue, and that the four last of the auditors and four last of the aforesaid advocates then present shall be bound to argue.

23 § 17. That if the same person repeating in such a repetition shall have conducted himself in such a manner that he be deservedly commended, the said vice-chancellor, according to the report of the greater part of the notaries and auditors and advocates aforesaid, shall proceed further to his admission as an auditor: but if according to the aforesaid report he shall be found to be of diminished learning or judgment, a report being made on this by the said vice-chancellor to the Pope, he shall be rejected from such admission.

24 § 18. And moreover that the aforesaid auditors, and those exercising their places, shall be bound to have at least the ordinary books of law continually with them, and shall personally see and examine the processes of the causes agitated before them, and shall examine witnesses in such causes if they be of weight (especially if any party shall have requested this), but in others shall cause them to be examined diligently by two notaries, and shall not believe in the relation of any notary or another; nor shall they proceed to the pronouncement of sentences in such causes without having seen and diligently examined the aforesaid registers by them, as is aforesaid. We also will that this be similarly observed perpetually by whatever judges and commissioners present in the said Curia. And nevertheless, that if any of the auditors shall have been noted for precipitation of justice, negligence, or lack of promptness in rights, on account of non-continuation of books, or otherwise, and especially for corruption and acceptance of gifts, or shall have been vagrant, or otherwise shall have conducted himself badly in the said Curia, by the aforesaid vice-chancellor or his vicar he shall be charitably admonished to abstain from these things and to amend himself, and to acquire good repute, and to persevere in it. But if he shall have neglected to amend himself, and s v I>P.

25 for three continuous months after such admonition, the same mark or infamy shall have been repeated, by the said vice-chancellor or his vicar commissions shall in no way be committed to him. And if for another three months he shall have been noted with like mark or infamy, and shall notoriously not have amended himself, then the aforesaid vice-chancellor or vicar with two auditors shall be bound to report the aforesaid matters to the Pope, who shall provide as it shall have been salutarily provided.

26 § 19. But if a cause should continue between the same persons and concerning the same matter, and a commission should be given to different auditors, he to whom the commission shall first have been presented shall remain the judge of the same cause. But if an exception of the jurisdiction of another shall have been given on the part of the adverse party, then whose jurisdiction it shall be shall first be known, and if one should proceed further before such knowledge, the process shall not be valid, and the judge shall be bound to the party for restitution of the expenses made therefrom, and his interest. But the notary who shall have dared to seek such contention for gain shall lose the writing and the whole cause, and shall be bound at his own expense to give to the party what was expended in such cause. But if the same auditor and notary shall have done otherwise, by that very fact they shall incur the sentence of excommunication, from which they cannot be absolved until they shall have made satisfaction on these matters, as is aforesaid. And we have deemed this also to be extended to whatever judges and commissioners and their notaries present in the said Curia for the time being.

27 [41] § 20. Furthermore we establish and also ordain in the matter of the notary, that no one of the notaries of any rank or of the auditors aforesaid shall lodge with him, and if perchance any one of them should wish to lodge with him, for the lodging of a house and expenses, beyond what is just and due, and a reasonable salary, let him not pay; and if for any cause whatsoever, true or feigned, with respect to office, he shall have given or paid anything to an auditor, the notary in giving and the auditor in receiving shall incur by that very fact the sentence of excommunication, from which they cannot be absolved except by the Pope, and double what the notary shall have paid beyond what is due and the auditor shall have received, by each of them in the uses of the poor by mandate of the said vice-chancellor distributed.

28 [44] § 21. And that no one shall be admitted as a notary of any of the aforesaid auditors, unless the notary shall have attained his twentieth year of age, and shall have previously exercised the office of notary, and shall be of good name and good repute, and sufficient and suitable for the exercise of the said office of notary of the causes of the said palace, and after diligent inquiry made concerning these matters, and his examination, and it shall be established concerning the aforesaid matters, let him be admitted.

29 [45] § 22. And that the notaries of the said auditors shall exercise their notarial offices personally by themselves, and if anyone (a necessary cause ceasing) shall have absented himself from the exercise of his notarial office for a month continuously, let him be deprived of the said office by that very fact, and concerning the necessary cause on account of which it may be necessary for him to exercise the said office through a substitute, and concerning its exercise through a substitute, let him seek permission from the said vice-chancellor, which the same vice-chancellor, after it shall be established with him concerning such cause, through his letters containing the cause itself, shall be able to grant for a time, as shall seem good to him.

30 [46] § 23. And moreover that the notaries shall proceed in decent habit and in becoming manner of a secular cleric.

31 [47] Let them not frequent taverns, nor be concubinaries, since from this their office is debased, and they acquire bad repute; and if they shall have done otherwise, let them be deprived of their offices.

32 [48] § 24. And that each of them, if having been made a priest and having acquired a benefice or a dignity or a personage in a cathedral or collegiate church, or a parish church peacefully, shall altogether abandon this notarial office, and shall no longer be admitted to the exercise of such office in the said audience.

33 [49] § 25. And moreover, that a notary who shall have been noted or defamed that he shall have acted as notary carelessly, negligently, or through fraud, writing something other than what was conducted in the process or in judgment between the parties, or shall have been defamed that he writes in the causes of persons, being an acceptor, favoring one more than another, and delegating the secrets of the case to him, by that very fact shall be suspended from his notarial office; and by an auditor of the Chamber, to whom this shall be committed by the said vice-chancellor, inquiry shall be made summarily, simply and plainly concerning such infamy and the other aforesaid matters diligently, and if by such inquiry he shall be found culpable, or if purgation shall have been ordered to be made, and he shall not have duly purged himself, let him be deprived of whatever offices he held in the said Curia, and let him be perpetually proscribed from the same Curia, and moreover let him be condemned in five hundred florins of gold of the Chamber, to be actually delivered by him to the almoner of the Roman Pontiff, and to be converted to the uses of the poor; and we will that the same be observed inviolably concerning whatever notaries of whatever cardinals, judges and commissioners deputed in the Curia for the time being.

34 [50] § 26. And nevertheless that the said notaries from them in the exaction of their salaries for their processes and writings in such cause, shall be bound to observe the rates fixed on this matter by the said John XXII, and if they shall have sought or received anything beyond the said rate, concerning such excess let them have recourse to the vice-chancellor or the aforesaid locum tenens on this matter, who, with experts called in on this, shall reduce the aforesaid excesses according to the aforesaid rates to due moderation, and let them exact from the notaries the half of what they shall have excessively sought in the uses of the poor to be converted.

35 [51] § 27. And that for compulsory citations, and inhibitions, decrees to the parties, procuratorial instruments, remissions to the parties, examinations of witnesses, and whatever other writings twice written in the process, let them be taxed only once at most, nor let them be paid. Terms of consistorial.

36 [52] In consistory those conducting themselves badly.

37 [53] likewise superfluous, or extended beyond what is due, and whatever other superfluous writings shall be held as struck out, and clauses and dictions shall be taxed proportionately, as they could be written in the process, and that no notary, who shall have received twelve Tournois groats from the copy of the register of the definitive sentence, shall receive from the copy of the instrument made thereon, since there is a copy of the said note, except as from a copy reduced to public form, according to the constitution of the said John XXII. And if he shall have received similar twelve Tournois groats from the copy of such instrument, he may receive from such note of sentence as from a copy: which if he shall have attempted contrary, let him restore to the party what he shall have received beyond, and let him pay the same amount for the chapel of the aforesaid auditors or runners within eight days of the immediately following Monday in reality, otherwise let him be suspended from the exercise of his office for a month, which if he shall have thrust himself upon it, let him be punished more severely by the vice-chancellor, as it shall seem to him.

38 § 28. But since, as is required of judges, likewise the counsel, maturity and great circumspection of advocates is required, we moreover establish and ordain likewise that an advocate shall in no way be admitted, unless he shall first have observed those things which are observed in auditors. And that the same advocates, for each commission by them to be proposed for the sake of justice outside the consistory, shall be content with one florin of the Camera, nor shall they dare to be able to do anything beyond, which if they shall have done contrary, they shall be bound to restore to the parties what they shall have exacted beyond, and to give the same amount to the poor.

39 § 29. And that, if any advocate shall propose in consistory something which by its nature is injurious, and tends to the defamation and harm of another, although this shall not have been written in the commission or petition to be proposed by him, unless the principal party, in whose name it is proposed, shall be present, and shall say and assert that this is to be proposed for the purpose of accusing, or of assuming the part of malicious denunciation in the form of law, or his proctor shall have special mandate for this, or they are substantial matters of the case, he himself, by action of injuries, shall be bound and, against whom he shall have lent the organ of his voice, and in ten florins of the Camera
