In supremo
Bull establishing three general assistants for the Conventual Franciscans
XLII1.
Three assistants of Germany, Gaul and Poland are constituted in the assembly of the Twelve Holy Apostles of the City of the same brothers Minor of St. Francis Conventual, as nuncios for the election of provincials, for the conduct of the business of the provinces.
Clement Pope XII, for perpetual memory of the matter.
1 In the supreme seat of the Church militant, although We sit with unequal faculties, by the ineffable abundance of divine wisdom and clemency, We turn Our attention to those things which, for the religious communities of men piously and holily established in the Church of God, and producing abundant and salutary fruits through the gift of Him from whom all good things proceed, We hope will be conducive, and We willingly apply the parts of Our pastoral office with propitious charity from above, as, having maturely weighed the quality of matters, times and persons, We judge it to be salutary in the Lord. § 1. Therefore, as Our beloved sons, Vincent of Comitibus, minister general, and the assistants of the Order of the friars minor of St. Francis called Conventuals, have recently caused to be set forth to Us, by the Constitutions Urban of the said Order, in cap. vi reg., tit. vi, it is expressly provided that in the convent of the Twelve Holy Apostles of the City, from whatever provinces both beyond and this side of the mountains, fathers and brothers who are conspicuous among the rest by integrity of life, composure of morals and wisdom, should be placed: they, setting forth for the good of the same Order and of these provinces, three new general assistants to be instituted, and therefore to be provided for opportunely by Us in the aforesaid matters and to be granted herein, they most earnestly desire. § 2. We, being willing to assent to the petitions of the same Vincent the minister and of the aforesaid assistants, as far as is granted to Us with the Lord, one from Germany and another from Gaul, the third from Poland, choosing in this matter, and absolving them and their individual persons from any excommunication, suspension and interdict, and from other ecclesiastical sentences, censures and penalties, whether from law or from man, imposed for any occasion or cause whatsoever, if they are bound by them in any way, for the purpose of obtaining the effect of these presents only, by the series of these letters, and considering them absolved, inclined by their supplications humbly presented to Us in their name on this matter, by apostolic authority, by the tenor of these presents, We establish and ordain, that henceforth one general assistant from Germany, from one of the provinces of Germany, according to the order in which the aforesaid provinces are found described in the Urban Constitutions, similarly another from Gaul, and a third from Poland respectively, shall be elected, so that each province in turn, from six years to six years, shall name three fathers constituted in the degree of perpetual definitors, acquired through the completed course of lectures, from whom the aforesaid minister general and he who shall exist for the time being, whom he shall have judged more suitable, shall be bound to elect. § 3. Whoever these new assistants thus elected are, they shall enjoy all the privileges and prerogatives of general definitors, and shall precede all others who are not general definitors, the order of their own seniority being observed among themselves; with respect, however, to the two ordinary assistants, namely the socius and secretary of the said Order, together with all prerogatives and rights, whether arising from the Constitutions or from custom, shall always and entirely be reserved to the same. § 4. And that moreover the same minister general existing for the time being, should he proceed to the visitation of any one of the aforesaid provinces existing beyond the mountains, besides the two ordinary assistants, the socius and secretary, shall also assume the national assistant. § 5. And finally, that to the aforesaid three assistants, and to their lay conversi and the burdens of their masses, while they remain at Rome, the convent of the Twelve Holy Apostles of the City shall be bound to supply food and clothing, just as if they were fathers of the house, provided however that they shall not be able to interfere in the administration of the aforesaid convent, nor in other matters and business, except those which pertain to their respective provinces, of which they shall be assistants; and the same three assistants shall apply masses for fulfilling the burdens of the same convent, and each nation or province shall contribute to each of their respective assistants whatever they shall have judged suitable for their more honest and more convenient subsistence, the remaining and residual expenses. § 6. Because however, according to certain letters of Our predecessor of happy memory, Pope Clement X, issued in similar form by Brief on the seventh of March in the year of Our Lord sixteen hundred seventy-four, the whole tenor of which We wish to be held as inserted and expressed, a fixed number of ten fathers is found in the aforesaid convent only; Notwithstanding any derogation.
CLEMENT
2 therefore, lest the dwelling of the aforesaid three assistants become narrow and inconvenient for others by reason of increase, we reduce the number of ten palms of this kind to seven by authority and in the manner aforesaid (so that, after the vacation of the first three positions, this order being observed among the assistants themselves, namely the first position which happens to become vacant, the assistant of Germany, the second the assistant of France, and the third the assistant of Poland shall obtain; and those who are in fact in the aforesaid convent as supernumerary fathers for the first position about to become vacant shall be preferred, and then shall have a place after the aforesaid three assistants shall have been added), and to the same minister general and ordinary assistants general now and for the time being existing, we grant by the tenor of these letters the faculty of deliberating upon any difficulty whatsoever which might arise in the execution of all these things.
3 § 7. Decreeing that these same present letters shall always be firm, valid and efficacious and shall have and obtain their full and complete effects, and shall most fully avail in all respects to those to whom it pertains and shall pertain for the time being, and shall be inviolably observed by them respectively; and thus in the aforesaid matters by any judges ordinary and delegated, even auditors of causes of the apostolic palace, judgment should be rendered and definition made, and null and void if otherwise anything contrary to these things shall happen to be attempted by anyone whatsoever, of whatever authority, knowingly or unknowingly.
4 § 8. Notwithstanding the aforesaid, and the constitution of the said Clement our predecessor concerning the number of ten brothers of the aforesaid convent, and our and the Apostolic Chancery's rule of not removing acquired right, and other constitutions and ordinances apostolic, and of the provinces and Orders aforesaid, even those strengthened by oath, apostolic confirmation, or any other firmness whatsoever, statutes and customs, privileges also, indults and apostolic letters granted, confirmed and renewed in any way contrary to the aforesaid; all and singular of which, their tenors being held as fully and sufficiently expressed in these presents and inserted word for word, while they would otherwise remain in their force, for the purpose of the aforesaid, on this occasion only, we specially and expressly derogate; and to all other things whatsoever to the contrary.
5 Given at Rome, at St. Mary Major, under the Fisherman's Ring, on the 22nd day of July in the year 1731, in the second year of our pontificate. Dat. 22 July 1731, pontif. year 2.

XLII1.
1 Nel supremo soglio della Chiesa militante, benché con forze ineguali, per l'ineffabile abbondanza della divina sapienza e clemenza sussistiamo, a coloro che nelle comunità di uomini religiosi, piamente e santamente istituiti nella Chiesa di Dio, si sforzano continuamente di produrre frutti abbondanti di buone opere, Dio, dal quale procedono tutti i beni, donando, speriamo che siano di giovamento, affinché siano rettamente e salutarmente indirizzati sulla via dei comandamenti del Signore, volentieri intendiamo, e le parti del nostro ufficio pastorale interponiamo dall'alto con propensa carità, come, mature considerazioni sulla qualità delle cose, dei tempi e delle persone, giudichiamo salutare nel Signore. § 1. Pertanto la cura, come i diletti figli Vincenzo dei Conti ministro generale e gli assistenti dell'Ordine dei frati minori di san Francesco Conventuali, detti Osservanti, ci hanno fatto esporre, per le costituzioni Urbane del detto Ordine, nel cap. vi reg., tit. vi, espressamente si stabilisce che nel convento dei Ss. XII Apostoli dell'Urbe da qualunque provincia, tanto oltre che al di qua dei monti, siano collocati padri e frati che per integrità di vita, composizione di costumi e sapienza siano conspicui tra gli altri: gli stessi esponendo per il bene del medesimo Ordine e di tali province tre nuovi assistenti generali istituire, e perciò opportunamente nei premessi da noi provvedere e come di seguito concedere sommamente desiderano. § 2. Noi, volendo in questa materia annuire ai voti del medesimo Vincenzo ministro generale e dei predetti assistenti, quanto con il Signore possiamo, e assolvendo loro e le loro singole persone da qualunque scomunica, sospensione e interdetto, e da altre sentenze ecclesiastiche, censure e pene, dal diritto o dall'uomo, per qualunque occasione o causa inflitte, se in qualche modo risultano vincolati, al solo effetto dei presenti, e ritenendo assolti per questa serie, inclinati alle supplicazioni loro presentate umilmente a noi in nome loro su questo, con autorità apostolica, per il tenore dei presenti, stabiliamo e ordiniamo, che d'ora innanzi un assistente generale dalla Germania, da una delle province della Germania, secondo l'ordine in cui le predette province nelle costituzioni Urbane si trovano descritte, similmente un altro dalla Gallia, e un terzo rispettivamente dalle province della Polonia siano eletti, in modo che ciascuna provincia per turno di sei anni in sei anni tre padri costituiti nel grado di definitori perpetui per il corso compiuto delle letture acquisito debba nominare, da cui il predetto e per il tempo esistente ministro generale, che lo avrà giudicato più idoneo, sia tenuto a eleggere. § 3. Chiunque siano i nuovi assistenti così eletti, fruiscano di tutti i privilegi e delle prerogative dei definitori generali, e debbano precedere tutti gli altri che non siano definitores generales, osservata tra gli stessi secondo l'ordine della propria anzianità la precedenza; rispetto però ai due ordinari assistenti, cioè il socio e il segretario del detto Ordine, insieme con tutte le prerogative e i diritti, che sia dalle costituzioni sia dalla consuetudine provengono, sempre e interamente a loro medesimi si ritengano riservati. § 4. E inoltre che il medesimo e per il tempo esistente ministro generale, qualora si accingesse a una visita di alcuna delle predette province oltre i monti, oltre i due ordinari assistenti, il socio e il segretario, debba anche assumere l'assistente nazionale. § 5. E infine, che ai predetti tre assistenti, e ai loro oneri di messe e ai conversi laici, mentre dimorano a Roma, il convento dei Ss. XII Apostoli dell'Urbe sia tenuto a somministrare vitto e vestiario, così come se fossero padri della casa, tuttavia in modo che all'amministrazione del predetto convento, né ad altre cose e affari, se non a quelli che alle proprie rispettive province, di cui saranno assistenti, appartengono, non possano immischiarsi; e i medesimi tre assistenti applichino messe per l'adempimento degli oneri del medesimo convento, e le singole nazioni o province a ciascuno di loro rispettivamente assistente, qualunque cosa per la loro più onesta e più comoda sussistenza giudichino conveniente, i residui e rimanenti spese debbano contribuire. § 6. Poiché però secondo alcune lettere di felice memoria di Clemente PP. X nostro predecessore su questo in simile forma di Breve spedite il dì vii marzo mdclxxiv, il cui intero tenore per inserito ed espresso vogliamo essere tenuto, il numero di dieci padri nel memorato convento soltanto prefisso si trova;
CLEMENTE
