Bull confirming the Third Order of St. Francis (Tertiary Rule)

Bull of Pope Leo X ·

1 Among the other matters committed to our governance, those things which render us especially solicitous are those by which, with the lusts of the world and the flesh restrained, the tranquil state of original innocence and peace sent from heaven is known to be restored to its pristine origin.

§ 1. For indeed, by the grace of God, our predecessor of happy memory, Pope Nicholas IV, confirmed and approved the Third Order of the Blessed Francis, which he called the Third Regimen of the Blessed Francis, by which the loving Confessor, filled with the Spirit of God, strove to save all the faithful of both sexes in his spirit.

2 ROMAN YEAR C. 1521

3 § 2. But because in the course of time, not only married men and inhabitants of this world, but also innumerable virgins, whom the aforesaid Third Rule of the Blessed Francis had been given, assumed under our authority three essential vows and even the enclosure, and many monasteries were constructed, not without manifold fruit and edification of the militant Church, subjected their necks to the yoke of the aforesaid Third Order.

4 § 3. And because in the said Third Rule certain things are accommodated to the married state, but to the celibate and virginal state less fittingly, for which reason those serving the Lord in this Third Rule, admonished by the zeal of chaste affection and, according to the will of the Lord, separating the precious from the vile, we do anew confirm and approve the same Third Rule, distinguished in the manner which follows, and transmit it to be observed by you and your successors, whose tenor follows, and is as follows.

Concerning the entrance of novices. Cap. I.

5 Brothers or sisters to be received into this Third Order ought to be faithful Catholics, not suspected of heresy, firm in obedience to the Roman Church, not bound by matrimony, free from impediments, sound in body, prompt in spirit, stained by no common infamy, reconciled with their neighbours. And concerning all these things, before they are received, they are to be diligently examined by him who has the faculty of receiving them.

Concerning those things which brothers and sisters ought to promise in profession of this Third Rule.

Cap. II.

6 Brothers and sisters, after they shall have borne for one full year the habit of probation

7 of the brothers and sisters and the form of profession;

8 silence, confession and communion;

9 rule;

10 (which is to be of cheap cloth, at the discretion of the visitor), if their conduct shall have been praiseworthy, they shall be received to profession of the said Order at the convent in which one or another shall have worn the habit of probation, by the counsel of the discreet members of the said convent. In which profession let them promise to keep the commandments of God, and to make satisfaction for transgressions which they might commit in the future against this Third Rule, wherever required by their prelates, living in obedience, without property and in chastity.

Concerning fasting.

Cap. III.

11 Brothers and sisters, in perpetual times, on Monday, Wednesday, Friday and Saturday (except the feast of the Nativity of the Lord) shall not eat meat. And from the feast of All Saints until the Resurrection of the Lord, they are bound to fast on every Wednesday and Friday. And likewise, on every Friday of the whole year. Also, from the feast of St. Martin until the Nativity of the Lord, let them fast daily; in the universal Lent of the Church, until the Resurrection of the Lord, which however they ought to begin from Quinquagesima. But on days on which they do not fast, let them eat twice in a day only, except that from the feast of Easter until the month of October, those labouring with heavy or grievous labour may be refreshed three times a day, always excepting the days of fasting. But those travelling, the infirm, the weak, in time of necessity, may be released from fasting. Concerning the divine office and prayer.

Cap. IV.

12 The brothers and sisters in the church shall observe silence, especially when Mass is celebrated or the word of God is proclaimed. In other places, however, they shall observe what shall have been ordained for them concerning silence by their superiors. They ought also each day in the evening to reflect within themselves and before God what they have done, said, or thought. Each day, moreover (if they are able to do so conveniently), they ought to hear Mass. And they ought to take care that they have a religious man who shall propose the word of God to them on certain days and lead them to penance and virtues. Those, however, who know how to say the canonical hours by themselves ought to recite the canonical hours according to the use of the holy Roman Church. Those, however, who do not know how to say the canonical hours, shall say twelve Our Fathers for Matins, and for each of the other hours seven, with the Glory be to the Father added at the end of each Our Father, and also the Creed and Have mercy upon me, O God added at the beginning of the first hour and Compline. And whoever shall not know the aforesaid shall say three Our Fathers for penance. Whenever, moreover, they take a meal or food, they ought to give thanks to God. Concerning sacramental confession and receiving holy communion, they shall observe the ordinance of Nicholas, Pope the Fourth, that they confess and communicate three times a year, or also according to the statutes ordained by their superiors concerning this matter.

Concerning the ordination of prelates and offices. Cap. V.

13 Each house, if it shall be a monastery of brothers, shall have a superior of this fraternity, who shall be called the local minister of the brothers, elected by their own convents or appointed by their provincial superiors or the general visitor. If, however, of women, she shall be called mother. And they shall be elected by their own convents or appointed by their provincial superiors or the general visitor of the Order of Friars Minor of Blessed Francis. In such a way, however, that no one shall be perpetual, but for a certain time. These ministers and mothers shall obey in all things that pertain to the present Rule, the provincial ministers of the Order of Friars Minor of Blessed Francis and the visitors appointed by these ministers, as long as they shall be in the said offices. As to other offices within the house, they shall observe their own statutes. Concerning the manner of living inwardly and outwardly.

14 Cap. VI.

15 Since the brothers and sisters of this fraternity are said to be dedicated to Penance, it is necessary for them to abstain from all curiosity, both in garments and in all other things whatsoever. And, following the salutary counsel of the apostolic prince, the blessed Peter (1), having set aside certain vain ornaments of this world, they ought to wear no bodily ornament, except only the simple and necessary covering of their body. They ought also to beware entirely from access to the courts of princes, lords or ladies, where the soft things of this world are had (the Lord bearing witness); nor should they at any time attend dances, games, jests, and other vanities of players. They ought also to be sparing in words and speech, which are rarely multiplied without sin. And, above all things, they ought to beware from all falsehood and any oath whatsoever, according to the commandment of the Lord, except for the sake of peace, faith, calumny and bearing witness. And every day in the evening, among other things, they ought to examine themselves whether they have told any falsehood or sworn any oath, and for each one they ought to say three times the Our Father.

2 ROMANO An. C. 1521

Cap. I.

Cap. IV.

Cap. III.
