Apostolic Constitution restoring the College of Protonotaries Apostolic to its original number and splendor

Apostolic constitution of Pope Gregory XVI ·

CLXI. CONSTITUTION
The College of Apostolic Protonotaries Participating is restored to its original number and splendor.
GREGORY PP. XVI.
for perpetual remembrance of the matter.

1 It is certainly hidden from no one that from the earliest times of the Church, when the cruelest savagery of the Gentiles raged against Christians, there existed men distinguished by piety, prudence and zeal for religion, who, appointed by St. Clement I to investigate the acts of the Holy Martyrs and to commit them to writing, first bore the name of notaries, and then, on account of the excellence of their office, the name of protonotaries. But as ages progressed, and peace was restored to the Church, when better and new days shone forth upon the Catholic world, this most honorable office, which was especially suited to fostering virtue in souls, was not only in no way removed, but was also deservedly increased with greater honor and dignity. For those who performed this office were employed by the Roman Pontiffs in conducting the more serious affairs of the Apostolic See; and indeed sometimes they were sent either to quell the disturbances stirred up by heretics, or to examine the manner of life of the sacred prelates, or to defend and restore the discipline of the canons.

2 Wherefore, from the judgment of Our predecessor Benedict XIV, it is to be esteemed that it happened justly and deservedly that the protonotaries, being the principal ministers of the Supreme Pontiff, were honored with illustrious testimonies of pontifical benevolence, and especially by Sixtus V of happy memory, who, when he found them designated as only seven, ordered that there should thereafter be twelve, and enriched them with more ample privileges and endowed them with certain special revenues, by which their dignity could be increasingly provided for. This most ample college of prelates, which was called the college of those participating, remained intact and unbroken until the beginning of this present century, when, on account of the changes of the times, never sufficiently to be lamented, so great a transformation of affairs arose. Yet when Pius VII of blessed memory returned to the City, and affairs were arranged by the common wish of all, although the said college had lost its revenues either entirely or for the most part, nevertheless it retained its noble office; it fully preserved the rights which pertain to the prelates co-opted into it; and it did not cease to receive those emoluments accruing to them from the exercise of the same office. But since in the course of time many of them have passed to their final day, and others have been elevated to greater dignities; and since, on account of so many most grave and bitter cares with which the supreme ministry of the Roman Pontiff has been pressed, no thought has yet been given to that college, it has come to pass, as the condition of human affairs demands, that it is now almost extinct. For the one who remains here in the City could not properly sustain the individual duties of his colleagues; to stand by the Roman Pontiff in the performance of solemn sacred rites, to participate in sacred councils, and to contribute his labor in the completion of the acts of the servants of God, as is their principal office.1

3 We therefore, being especially incumbent upon the defense and preservation of the majesty of the Apostolic See, lest the offices entrusted to the protonotaries themselves be interrupted, direct Our cares to this end, that the aforesaid college may not only be vigorous and intact, but also retain its former splendor and honor. By Motu Proprio and with certain knowledge and the fullness of Our power, derogating from the constitution of Sixtus V, by which it was prescribed that the college of apostolic protonotaries participating be composed of the number twelve, We restore the same college to its original institution; and therefore We command that henceforth it shall consist of seven men only, who, being most approved both by the praise of virtues and by distinguished merits in both sacred and public affairs, shall be selected by Us and by the Roman Pontiffs Our successors: and to those thus selected and announced We fully confer, adjoin and attribute all and singular the rights, privileges, indults, honors and emoluments with which the same apostolic protonotaries participating have hitherto been possessed by title of office. Decreeing that these present letters shall always be firm, valid and effective, and shall obtain and secure their full and complete effects, and shall most fully avail for those to whom it pertains and shall pertain in the future, in all things and through all things, and shall be inviolably observed by them; and thus in the aforesaid matters by any ordinary and delegated judges whatsoever, even the auditors of causes of the apostolic palace, it ought to be judged and determined, and null and void if otherwise concerning these things by anyone whatsoever with any authority, knowingly or unknowingly, should happen to be attempted.

4 Notwithstanding the aforesaid constitution of Sixtus V, and other apostolic constitutions and ordinances, and all other things to the contrary whatsoever. We will moreover that to copies or exemplars, even printed ones, of the same presents, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given as would be given to the presents themselves if they were exhibited or shown.

5 Given at Rome at St. Peter's on the sixth day before the Ides of February in the year one thousand eight hundred thirty-eight, in the eighth year of Our pontificate.

CLXI. CONSTITUTIO
GREGORIUS PP. XVI.
ad perpetuam rei memoriam.

1 Neminem certe latet, vel a primis Ecclesiae temporibus crudelissimo Ethnicorum saeviente in christianos furore, extitisse viros, pietate, prudentia studioque religionis spectatos, qui a s. Clemente I ad perquirenda Sanctorum Martyrum acta, eaque literis tradenda praepositi, primum notariorum, deinde ob muneris praestantiam protonotariorum nomen habuerunt.

5 Datum Romae apud sanctum Petrum sexto idus februarii millesimo o€tingentesimo trigesimo octavo, pontificatus Nostri anno octavo.

CLXI. COSTITUZIONE
