General Decrees for the Reform of Regulars of All Orders
CCLIII.
General Decrees for the Reform of Religious, both Monks and Mendicants, of whatsoever Order and Institute. Clement Pope VIII.
1 No one whatsoever, under the pretext of any privilege or superiority, even of a general, shall be considered exempt from the service of the choir, except for the time during which anyone is actually occupied in the duties of his own office. Superiors may, however, dispense with readers and preachers (on those days only on which it happens that they read or preach)1. They may likewise do the same with the sick and those legitimately hindered for the sake of studies. But upon those who shall have been negligent or disobedient, superiors shall impose salutary penance, according to the prescription of the rule and constitutions, and also by withholding sustenance, if it shall be necessary.
2 § 1. A reading of Holy Scripture or cases of conscience, twice in the week, on the prescribed days in each convent, shall be held, to which all the brothers shall come together; and when it is finished, they shall usefully exercise themselves in mutual discussion concerning the doctrine explained.
3 § 2. That the decrees of the Council of Trent concerning the observance of the vow of poverty be more faithfully observed, it is commanded that no one of the brothers, even if he be a superior, shall be able to possess immovable or movable goods, or money, revenues, rents, alms, whether from sermons or from readings, or for masses celebrated both in their own church and anywhere else, or from any other just labour and cause of theirs, and under whatsoever name acquired (even if they be subsidies from relatives, or pious gifts, legacies, or donations) as his own, or even in the name of the convent, but all these things shall immediately be handed over to the superior, and incorporated into the convent, and mixed with the other goods, revenues, monies and revenues thereof, so that common sustenance and clothing may be supplied to all from it. Nor shall it be lawful for superiors, whosoever they may be, in any way to grant to the same brothers, or to any of them, stable goods, even for usufruct or use, administration or commenda, even under the name of deposit or custody. Of those things which shall have been granted for necessity, let no one possess anything as his own, nor use it as his own. Whoever shall have transgressed in any of the foregoing matters shall incur not only the penalties prescribed by the Council of Trent, but also other much graver ones, to be imposed at the discretion of superiors. No dispensation of any superiors whatsoever, no licence, as far as movable or immovable goods are concerned, can excuse the brothers from being subject to the guilt and penalties imposed by the decrees of the same council, and incurred by the fact itself; even if superiors assert that they are able to grant such dispensations or licences, to which we are unwilling to give credence in that matter. § 3. The clothing and furnishings of the brothers shall be procured from common money, and shall be altogether uniform for the brothers and for any superiors whatsoever, and shall be suited to the state of poverty which they have professed, so that nothing superfluous shall be admitted, nor shall anything necessary be denied to anyone. Whatever clothes of the brothers, whether woollen or linen, and all other furnishings shall be brought to some convenient place of the convent, and there shall be carefully kept by one or two brothers appointed to this duty, so that from there they may be opportunely supplied at the discretion of the superior, as each one shall have need.
4 § 4. All superiors likewise, whosoever they may be, shall eat the same bread, the same wine and the same food, or the same, as they say, pittance, at the common table first or second, unless hindered by reason of infirmity; nor shall anything singular, which anyone might use privately for food, be brought in any way; if anyone shall have sinned in this matter, let him receive no sustenance that day except bread and water.
5 § 5. All superiors, even generals, who have revenues or pecuniary payments by reason of their offices, shall take care that their receipts and expenditures be faithfully and diligently noted in a separate book, nor shall they spend anything for uses other than those necessary by reason of their office. But when it happens that they dwell in some convent, they shall contribute that sum of money into the common fund, from which sustenance for themselves and those who are with them shall be supplied according to the prescription of the rule and constitutions.
6 § 5. All superiors, even general ones, who receive income or monetary payments by reason of their offices, shall take care that their receipts and expenditures be faithfully and diligently noted down in a separate book, and they shall spend nothing except for uses necessary by reason of their office. But when it happens that they reside in some convent, they shall contribute that sum of money to the common fund, from which their sustenance and that of those who are with them may be supplied according to the prescription of the rule and constitutions.
7 None of the superiors of places shall be able to have or exercise by himself the administration of goods, or the dispensation of other things, revenues and the remainder of his convent, even in the name of the convent; but the whole of this burden shall be entrusted by the general to three brothers of the same convent in such a way that one shall have the care of collecting and exacting goods, honours, and revenues, another as treasurer shall faithfully preserve the monies and other things collected and exacted by him, another shall provide for the monies and things received from the treasurer to the prior and brothers and the whole convent for necessities, commanding however the prior himself, not according to his own affection, but according to the rule of charity as a good steward: the confusion of such offices being entirely forbidden. Moreover these three, both as to expenditures and receipts, shall render account each month to their prior, with two or three of the more approved brothers of the same convent being present, and those experienced in the use of things; then they themselves again, with the prior and the aforesaid experts present, to the general when he shall have arrived, and finally the general himself in any next general chapter, at least before three judges constituted by the chapter for this purpose, shall be bound to render account of all their matters and of the whole of his administration both public and private; and an authentic copy of this shall be transcribed from the acts of the chapter, so that it may be transmitted to every mandate of ours or of the Apostolic See of Rome.
8 7. In each convent of brothers, only that number shall henceforth be constituted and retained in the future which can be conveniently sustained from those revenues proper to it, or from the customary common revenues of the convent, or also from the alms of individuals and any other whatsoever contributions to be made in common, as is aforesaid; but the revenues and all the aforesaid things shall be carefully preserved in a common and safe place.
9 8. Moreover to superiors, lest the prohibition of the Council of Trent, or these our decrees be declared, interpreted, or relaxed in any way, we entirely forbid and prohibit. Decreeing it null, etc. If anyone however shall presume to attempt anything against this, he by that very fact shall be deprived of every degree and office, and shall exist perpetually unable to hold them.
10 § 9. No one, unless he actually reads or preaches to the superiors and the lecturn, shall enjoy any privilege of his degree.
11 § 10. If to anyone from necessary cause, to be approved by the judgment of the general, a companion from the same Order who may minister to him is to be granted, he shall not be granted unless he has completed his twenty-fifth year, and he who is assigned to common service shall not be granted, and if it can conveniently be done, let him be a lay brother.
12 § 11. In order that all occasion of scandals and vagrancy may be removed, the enclosure of the convent shall be perpetually and diligently observed; and therefore a porter shall be appointed by the superior, who shall be especially commended for diligence and integrity of morals; he shall always assist in guarding the gate, and shall open it to none of the brothers unless he has obtained a companion and permission to depart.
13 § 12. No one from the convent shall dare to depart, except from cause and with a companion, and having obtained permission each time, and having received a blessing from the superior; who shall not grant it otherwise than upon cause being proved; and shall assign a companion to the one departing, not at the request of the one asking, but by his own judgment, and not the same one frequently. Moreover general permissions to depart shall be granted to no one whatsoever. Those acting contrary shall be punished with grave penalty, even imprisonment at the discretion of the superior; the porter also shall undergo the same if he shall knowingly have granted the faculty to depart. When however anyone returns to the convent, he shall again approach the superior to receive a blessing, who shall diligently inquire from the companion of the journey the account of the journey, and what has been done.
14 § 13. Superiors shall not permit any brothers to come to Rome unless they have first obtained permission in writing from the general or protector only. If anyone however shall presume to come to Rome without such faculty, he shall be deprived of active and passive voice for two years, and shall also undergo other penalties to be inflicted at the discretion of superiors. All these same things shall also apply against those who shall have admitted and received the aforesaid, without any exception.
15 § 14. Let the superior have a key made in such a way that when it seems good to him, he may open all the cells; and therefore no one shall close his cell, even at night, in such a way that it cannot always be opened by the superior.
16 § 15. In the middle of the dormitory let a lamp shine throughout the whole night in the dormitory.
17 § 16. No one, even a superior, shall have cells or rooms either in the cloister or elsewhere separated from the common dormitory, but each one shall be content with a single cell, the same as that of the other brothers joined together, with bare walls entirely, and with a humble bed and table, and uniform furnishings, as aforesaid, in the manner that befits religious. The general may nevertheless grant to some one of the superiors of convents, if he shall have ascertained that the necessity of their duty and office requires it, another cell as well. Cells or small rooms, which are separate outside the dormitory, shall be converted to workshops, or otherwise to the common use and convenience of the convent. Each one shall sleep in his own bed separately, nor shall two be able to sleep in the same bed anywhere, all of which shall be reduced to a certain form. In private cells no fireplaces shall be permitted, but all shall be blocked up immediately, with the hinges also torn from the walls, so that this matter may appear to be done not for a time, but to last perpetually, except the cells of the general, or of another superior and preacher.
18 § 17. All the windows of the convent, which look out upon public roads or into the neighboring houses of laypeople, shall be so blocked up with a wall that the view is entirely obstructed.
19 § 18. An infirmary shall be established in each convent in a certain and healthful place, which, according to the situation of the place and the number of brothers, shall be as convenient as possible, in which all brothers, when they shall be sick, shall be cared for, nor shall they be permitted to depart from there unless their health be recovered. Those who are placed in charge of the care of the sick shall apply their efforts with all diligence and charity, and shall take care that nothing at all be lacking to the sick which may serve for the recovery of health.
20 § 19. Care shall be taken by which, the licenses and faculties heretofore granted in any way being revoked, those dwelling outside the convent cloister shall be recalled to it as soon as possible; nor shall such faculties henceforth be granted, unless from a most grave cause approved by the Apostolic See.
21 § 20. No one shall henceforth be admitted to the habit or profession, unless in convents appointed by the Apostolic See in each province.
22 § 21. Let superiors take care that the constitution forbidding the bestowal of gifts, and prescribing the form of hospitality, be inviolably observed by all in each convent.
23 § 22. In order that all occasion for ambition in offices be cut off, let all beware of direct or indirect procurement of votes or suffrage, both for themselves and for others, both in the chapters of places and in others, especially in general chapters, or congregations, or elsewhere. Whoever shall act otherwise, besides other penalties and censures heretofore inflicted against such ambitious persons, which we wish to remain in their force, shall incur by that very fact the penalty of deprivation of the offices which they hold, and shall be rendered equally incapable for any future ones; concerning which no one can dispense with them except us or our successors, and according to the gravity of the faults they shall be punished more severely as well. Moreover, we extend all the aforesaid penalties to accomplices, and to those who simply know and do not reveal.
24 § 23. In all elections of superiors and officials, the form prescribed by the sacred Council of Trent and by the constitutions of the Order shall be inviolably observed, and let the electors swear that, according to the truth of each one's conscience, they will elect the more worthy and more suitable; and therefore, before proceeding to the election, first and before all things, the constitutions concerning the quality and requirements of those to be elected shall be read. To offices, ranks and prelacies those shall be elected especially who are able and accustomed to observe the rules of the Order and the constitutions, particularly those which pertain to the service of the choir, and to clothing and common food.
25 22. In order that all opportunity for canvassing offices may be cut off, let all beware of direct or indirect solicitation of votes or suffrage, both for themselves and for others, whether in the chapters of their houses or in other matters, especially in general chapters, at congregations, or elsewhere. Whosoever shall act otherwise, besides the other penalties and censures heretofore inflicted against those who canvass in this manner, which we will to remain in their full force, shall by that very fact incur the penalty of deprivation of the offices which they hold, and shall likewise be rendered incapable of any future offices; concerning which no one is able to dispense with them except ourselves or our successors, and they shall be punished more severely according to the gravity of their faults. Moreover, we extend all the aforesaid penalties to accomplices and to those who simply know of such conduct and do not reveal it.
26 § 23. In the elections of superiors and officials, the form prescribed by the sacred Council of Trent and by the constitutions of the Order shall be inviolably observed, and the electors shall swear, according to the truth of each one's conscience, that they will elect the more worthy and more suitable; and for this reason, before proceeding to the election, the constitutions concerning the quality and requirements of those to be elected shall be read first and above all things. To offices, ranks and prelacies those shall be chosen especially who are able and accustomed to observe the rules of the Order and the constitutions, particularly those which pertain to the service of the choir, and to common clothing and sustenance.
27 § 24. Let there be chosen in the general chapter or provincial probation some grave and expert men from among the aforesaid preachers,* # and laymen, confraternity members of each province, at least [[fn:*]] ...
28 to be moved, three who are to be admitted to preaching, sacred orders, * of the word of God, or to hearing confessions even of the brothers themselves, and public readers shall diligently examine together, before they are approved and admitted to such ministries. It shall also be their care to examine and approve, both as to doctrine and as to morals, those to be promoted to any orders whatsoever; in which the decree of the Congregation of Interpreters of the sacred Council of Trent, recently issued and promulgated for this cause, shall be observed. | 25. Moreover, we admonish all superiors in the Lord, that they be mindful of the observance of the rules and discipline, which on the last day they are to render account for the flock committed to them, and therefore let them watch with all diligence, that all those things which in the rules and constitutions of the same Order concerning mental prayer, silence, fasts, chapter of faults, and other spiritual exercises have been prudently and piously ordained, be all and each observed to the letter; and let them understand that upon these foundations the buildings of all religions are to be constructed and enlarged; which that they may have an easier outcome, and produce more abundant fruit in the souls of the brothers, it will be very opportune if in each convent, every week, there be a sermon on religious discipline and regular observance.
29 § 26. But that all things may be done in order, let a table be hung in a conspicuous place of each convent, in which it shall be distinctly noted, what each brother ought to perform at each hour of each day, so that being forewarned by a certain signal, he may fulfill his duty with greater preparation of mind. Those constitutions of the Order which are not contrary to these decrees shall be kept inviolate.
30 § 27. To those chapters of these decrees for which a certain penalty is not prescribed, let it be inflicted at the discretion of the general or another immediate superior.
31 Penalty of the disobedient.
32 § 28. But that these decrees (until other reforms, which will make for the fuller reformation of the aforesaid Orders, are issued) may be observed by all, we strictly command the general and all other superiors whatsoever, to whom this pertains, that they take care and effect that all these things be reduced among the other constitutions of the same Order to perpetual validity, absolutely forbidding to each one the faculty of declaring them, and ever dispensing against them. Otherwise let them know that they have incurred the penalty of privation of the generalate and offices, and the time appointed for obeying.
33 Publication of the same.
34 Declaration concerning licenses to come to the City; and to those acting contrary the penalty of privation is inflicted.
35 CLEMENT of perpetual incapacity for other duties as well, by the fact itself and without any exception, respectively incurred.
36 § 29. But lest, under the pretext of delayed publication, their observance be deferred or hindered in any way, we will that after their publication made in the convent of St. Marcellus in the City, the general and other superiors of the Order, and all other brothers present immediately, the rest absent this side of the mountains within one month, beyond the mountains within three months' space, be bound as if they had been personally intimated to each one of them.
37 § 30. Moreover we command, that the general in each convent this side of the mountains within one month, beyond the mountains within three months' course cause the aforesaid decrees to be published, under penalty of privation of the generalate, and other penalties to be imposed at our discretion.
38 Given at Rome at St. Peter's, on the twenty-fifth day of the month of July, in the year one thousand five hundred ninety-nine. Dat. 25 July 1599.
Notes
- 1 Thus formed from Cherubino's Summary I did not change for the sake of compliance. But from § 28 and 29 it appears sufficiently clearly that this constitution is peculiar to the Order of Servants.

CCLIII.
