Bull on funeral fees and the privileges of regular orders

Bull of Pope Benedict XIII ·

1 serious harm and detriment to others, and is observed to furnish fuel for dissensions and contentions, especially among the ministers of God and the Church, whose duty it is to preach peace and to whom nothing is more frequently or more earnestly commended by the Lord than to love, moderate, and preserve peace and unity, and to interpose other parts of their pastoral office from above, as, the circumstances of matters, places, 1 and times being maturely weighed, it appears to Him to be salutarily expedient for the extinction of discord, the peace of ecclesiastical ministers, the salvation of the souls of the faithful, and the divine worship.

§ 1. Since many of Our predecessors, the Roman Pontiffs, considering the multiplication of such matters and the very great necessity of the regular Orders, which have at all times strengthened the militant Church with the strongest supports, namely with men distinguished by the holiness of their lives, the praise of their learning, and zeal for orthodox religion, and have added to her in heaven lights of singular splendor, have kindly adorned the same Orders and their professed members with very many and ample indults and privileges, and among other things granted to them that they should not be bound to pay to the parish priests the canonical portion or fourth part of funeral emoluments for persons who chose burial in their churches; and, for the greater firmness of such privilege, they have also not once most fully derogated from the sanction also issued by Clement V of happy memory, Our predecessor, in the Council of Vienne, and related in the Clementina Dudum de sepultur., as well as the decree of the Council of Trent related in cap. XIII, sess. XXV De Reform., which openly reserved the aforesaid fourth part of funeral emoluments to the parish priest; hence not only bitter complaints of parish priests, but also innumerable contentions and lawsuits between them and the regulars concerning the payment of the same fourth part have been stirred up at various times, which have been discussed before the Ordinaries of places, and then also in various tribunals of Our beloved City, especially in the audience hall of Our apostolic palace and in the Congregation of Our venerable brothers the cardinals of the Holy Roman Church, interpreters of the aforesaid Council of Trent, with great diligence of the parties and no less expense,

2 as we have learned, sometimes decided and determined in favor of the parish priests, but sometimes in favor of the regulars, according to the various circumstances of the cases and the varying judgment of those deciding. Moreover, this diversity of the judgments and sentences, since it has established no certain and determined rule to be observed in cases that arise, leaves great fuel and occasion, indeed spreads a wide path for further lawsuits and controversies between the aforesaid regulars and parish priests, from which those who ought to walk in the house of God with consent may soon be disturbed by new dissensions and burdened with new losses, with detriment to divine worship and scandal to many.

§ 2. Wherefore We, considering it especially expedient that such controversies and lawsuits be entirely removed from the Church of God, and moreover, although We regard all the regular Orders, namely in the Order of the Friars Preachers, in which We ourselves spent a considerable number of years, with special affection of fraternal charity, and have always held and do hold them, as well-deserving of the Catholic Church, the Catholic Faith, and the Apostolic See, in principal honor and esteem, nevertheless, considering that the exemption from the payment of the fourth funeral part granted to the aforesaid Orders by the said Apostolic See tends to the greatest harm of the parish priests, both on account of the multiplication of convents and monasteries of regulars, and also on account of the increased devotion and custom of the faithful choosing burial in the churches of the aforesaid regulars, and therefore judging it not only consonant but also necessary that the indemnity of the same parish priests, to whom moreover the sacred canons and the ancient discipline of the Church openly give support, be appropriately provided for, and that the aforesaid apostolic privileges be reduced to the limits of equity:

3 We, considering that such controversies and lawsuits should be entirely removed from the Church of God, and moreover, although we regard all the regular Orders, namely in the Order of the Friars Preachers, in which we ourselves have been engaged for a considerable period of years, with special affection of fraternal charity, and have always held and do hold them, as having deserved well of the Catholic Church, the Catholic Faith and the Apostolic See, in particular honour and esteem, nevertheless, considering that the exemption from the payment of the fourth funeral due granted to the aforesaid Orders by the Apostolic See is turning to the greatest prejudice of the parish priests, both on account of the multiplication of convents and regular monasteries, and also on account of the increased devotion and custom of the faithful in choosing burial in the churches of the aforesaid regulars, and therefore judging it not only consonant but also necessary that the indemnity of those same parish priests, to whom moreover the sacred canons and the ancient discipline of the Church openly give support, be appropriately provided for, and that the aforesaid apostolic privileges be reduced to the limits of equity:

§ 3.

4 Therefore it is from this that we, all privileges... and individual aforementioned privileges of the kingdom, examples of purchase from the payment of the funeral quarter, which to a solution by the Orders, congregations and institutes regularly from the Apostolic See, as aforesaid, whenever and in whatever manner granted, having these present for fully and sufficiently expressed, and concerning their tenor and substance sufficiently instructed and informed, by the counsel of certain of our venerable brothers, Cardinals of the Holy Roman Church, and also some prelates of the Roman Curia specially deputed by us for this purpose, with the advice also of bishops and other prelates of churches gathered in this present sacred council, and moreover by our own motion, from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, by this our constitution to endure perpetually, all the aforementioned privileges as to the funeral quarter only for the places hereinafter expressed we moderate, reform, reduce to the way1 of law, and, insofar as it is necessary, also revoke and abrogate, and we decree that it ought not henceforth to benefit or avail anyone.

§ 4.

5 Furthermore by motion, knowledge and power similar we enact, which we have established and command, that in Italy and adjacent institutes, from the day of publication of this present constitution henceforth, to the parish priests of the deceased, who shall be buried in the churches of any of the aforesaid regulars, there shall be paid and with effect delivered the fourth part of all torches and candles, by which the body of the deceased shall be accompanied on the way to the church of burial, as well as of all torches and candles which in the same church around the body or also on the altars on the day of the funeral shall be lit. From the aforesaid funeral quarter there shall be understood to be excepted and shall be the candles, which priests, even regulars, or brothers of pious confraternities, accompanying the funeral, shall carry lit by hand through the way. But if the funeral should not take place on the day of burial, but should be deferred to a different day or to another longer time, there shall nevertheless be assigned to the parish priest the fourth part of all torches and candles, which on the very day of the funeral performed in the church, where the deceased was buried, around the cenotaph or honorary tomb and also on the altars of the same church shall have been lit. All these things moreover shall take place and shall be exactly observed in the future, whenever the deceased shall be buried or exposed outside his own parish church, whether because he held a benefice in the church of burial or exposition, or because he had a family sepulcher there, or finally because he chose a sepulcher there. For the rest, under the aforesaid funeral quarter we do not intend to comprehend, but rather expressly except from it, bequests of masses and anniversaries, and similar pious legacies in favor of the church of burial or exposition disposed by the deceased; concerning which, and all and singular other matters, of which mention has not been made in this present constitution, the privileges granted to the aforesaid regular Orders by the Apostolic See, we will, decree and command to remain safe altogether, unharmed and inviolate perpetually, and to be observed by all, to whom it pertains and for the time whenever it shall pertain, firmly and irrefragably. But where legitimate approved customs, conventions, concordances or statutes should prevail, which would favor the aforesaid parish priests more, and would assign to them a richer portion of the aforesaid fourth of funeral emoluments, we by motion, knowledge and power equal sanction, command and order that these in those places in which they prevail be observed firmly by all.

§ 5.

6 We decree likewise that these present letters and whatever is contained in them, even on account of the fact that the superiors of the aforesaid regular Orders, or any others whatsoever having or in any way pretending to have an interest in the foregoing matters, have not consented to them, nor have been called and heard, or the causes on account of which these present letters have been issued have not been adduced, verified, or otherwise justified, or even on account of enormous, most enormous, and total injury, or any other pretext whatsoever, and from whatever ground, colour, and cause, even necessarily to be expressed, on account of the vice of subreptitiousness or obreption or nullity, or of our intention or any other defect whatsoever, may be noted, impugned, rescinded in whole or in part, retracted, invalidated, brought into question or controversy, reduced to the terms of law, or against them restitution in full, opening of the mouth, or any other remedy of law or fact, grace or justice may be sought, or if sought, anyone may use it or avail himself of it in judgment or outside of judgment in no way; but that they shall always be valid, firm, and efficacious and shall be, and shall obtain and secure their full and complete effects, and ought to be inviolably and immovably observed by all to whom it pertains and for the time being whenever it shall pertain; and thus and not otherwise in the foregoing matters by any judges ordinary and delegated, even auditors of causes of the said apostolic palace and cardinals of the Holy Roman Church, even legates a latere and nuncios of the Apostolic See, with the faculty and authority of judging and interpreting otherwise removed from them and from each of them, ought to be judged and determined; and if anything contrary to this shall happen to be attempted by anyone whatsoever, by whatever authority, knowingly or unknowingly, it shall be null and void.

7 § 6. Notwithstanding, insofar as it may be necessary, our and the Chancery's Apostolic rule of not taking away acquired right, and other apostolic constitutions, and those issued in universal, provincial, and synodal councils, general or special, as well as statutes and customs of any of the aforesaid Orders, even fortified by oath, apostolic confirmation, or any other firmness, and also privileges, indults, and apostolic letters granted by any of our Roman Pontiff predecessors to the same Orders, as aforesaid, and to their superiors and professors whatsoever, under whatever tenor of words and forms, and with whatever even derogatory clauses of derogations, and other more efficacious and unusual clauses and decrees rendering null, even by similar motu proprio and in consistory, and otherwise in any way contrary to the foregoing, granted, confirmed, and renewed; all and singular of which, even if for their sufficient derogation special, specific, express, and individual mention of them and of their whole tenors, word for word, and not through general clauses importing the same, or any other expression should be made, or some other exquisite form should be observed for this, we having all and singular of their tenors, forms, and occasions, and other matters also worthy of special expression, in these present letters for fully and sufficiently expressed, inserted, and respectively observed, on this occasion only, otherwise remaining in their force, for the purpose of the foregoing, specially and expressly derogate, and will that they be derogated; and all other things contrary whatsoever.

8 § 7. But in order that these present letters may more easily come to the knowledge of all, and that no one among them may be able to allege ignorance of them, we will that they or copies of them be affixed and published at the doors of the Lateran Church and the basilica of the Prince of the Apostles, as well as at the Apostolic Chancery and the general Curia on the Citatorio Hill, and in the Campo di Fiore of the City, as is the custom; and thus published and affixed, they shall bind and affect all and singular to whom they pertain, just as if they had been intimated to each of them by name and personally; and that copies or exemplars of these present letters themselves, even printed, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given both in judgment and outside of it, everywhere, as would be given to these present letters themselves if they were exhibited or shown.

9 § 8. Let no one whatsoever presume to infringe upon this page of our will, declaration, reformation, moderation, concession, assignment, precept, sanction, mandate, and derogation, or to contravene it with rash daring; if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Peter and Paul, his apostles. Given at Rome, at St. Peter's, in the year of the Lord's Incarnation 1725, on the fourth day before the Kalends of May, in the first year of our pontificate. Given on 28 April 1725, pontificate year I.

XIII pp. 149 An.
