Bull establishing the faculty of theology at the University of Bologna
laws. — 5. Faculty of granting licenses granted. — 6. Concerning the form of granting licenses and conferring degrees by the bishop of the same city. — 7. Powers of doctors.
1 Innocent, bishop, servant of the servants of God, for the perpetual memory of the matter.
2 Like the tree of life in the Paradise of God, and like a shining lamp in the house of the Lord, the discipline of the faculty of theology is in the Holy Church of God. She, as a fruitful mother of learning, sending forth rivers from the breast of the Saviour to water the barren face of the world, brings back the human race, deformed by the blindness of original ignorance, to the way of justice and life through the infusion of truth, vivifies souls, and arms them with inexhaustible weapons for the exaltation of the Catholic faith and the extermination of heretical depravity and all infidels, and even against invisible powers, and constitutes them most mighty warriors.
3 § 1. We frequently turn over this matter in the meditation of our heart with solicitous mind, and weigh it with intent consideration, and for this reason all the more willingly expend our efforts and labours toward its advancement, inasmuch as we know that greater gains of souls proceed therefrom and the state of the universal Church is increased.

5 § 2. Indeed, while we joyfully recount the abundant fruits which the Studio of Bologna, which for very long ages has shone forth in itself like a resplendent star, and has shone far and wide with diffused brightness in canon law and civil law, and in the liberal arts, like a field which the Lord has blessed, has produced and produces with copious fertility, and we hope therefrom that the shoots of theology itself, if its study were there, would be propagated more abundantly, and while we carefully attend to the purity of faith and the exceptional devotion which our beloved sons, the people and Commune of the city of Bologna, faithful to us and to the Roman Church, have held toward us and the said Church and are known to hold, we deem it worthy and consider it fitting to equity that the city itself, which divine grace has illuminated with great gifts and graces, has endowed with the fruitfulness of many honours, and has adorned with no small pleasantness of location, should be enlarged with the duties of such a faculty of theological science.
6 § 3. Wherefore, benignly acceding to the devout supplications of the same people and Commune in this matter, we by apostolic authority establish and ordain that in the said city henceforth a general Studio in the same theological faculty shall exist and shall flourish in perpetuity for future times.
7 § 4. And let teachers and students there in the aforesaid faculty enjoy and make use of all privileges, liberties and immunities granted to teachers and scholars studying in the same in general Studios of the same faculty dwelling therein. We will, however, that masters and bachelors who have received the honour of mastership or bachelorhood in the Parisian or other famous Studios of the same faculty, and who are otherwise experienced and suitable, be newly assumed to teach and govern in the same Studio in such faculty of theology, so that the city itself, thus distinguished with so great an honour, may shine with gifts corresponding to the said honour.
8 § 5. Moreover, intending to honour the aforesaid city and Studio with greater honours on account of the public progress which we hope will proceed therefrom, we ordain by the same authority that if any in the same Studio in the course of time shall have attained the prize of the same science of the theological faculty, and shall have sought that a license to teach be granted to them, so that they may be able to instruct others, it may be granted, having been diligently examined there and in the same theological faculty, and they may be decorated with the title of mastership.
9 § 6. By apostolic authority establishing that whenever any persons in the same theological faculty in the same Studio are to be promoted to the rank of master, they shall be presented to the Bishop of Bologna, who shall be at that time, or to his sufficiently competent and suitable person, whom the bishop shall have specially appointed for this same purpose, or, the Church of Bologna being without a pastor, to the vicar general of the beloved sons of the chapter of that Church, who shall be at that time, who, with all the masters of the said theological faculty, in which such examination shall be made in the Studio itself, actually teaching at that time, being convened and present, shall strive diligently to examine them freely, purely and without reserve, and with all deceit and fraud and difficulty ceasing, concerning knowledge, eloquence, manner of lecturing and other things which are required in promoting to the honour of the mastership in the aforesaid faculty and its office, and those whom he shall find suitable, having sought the secret, pure and good faith counsel of the same masters (which counsel indeed, to the detriment and loss of those consulting, under the duty of an oath to be taken on this matter, we most strictly forbid to be revealed in any way by the bishop or vicar and by each of the masters), he shall approve and admit, and shall grant them the sought licence, and otherwise, setting aside the less suitable, admitting in no way by grace, hatred or favour, concerning which we burden the conscience of the aforesaid bishops, masters and vicar.
Power of granting licences given.
Concerning the form of granting licences and conferring the doctorate by the bishop of the same city.
10 § 7. Willing that those who in the aforesaid Studio shall have been promoted to the rank of master in the aforesaid faculty, in it and in other general Studios of the said faculty shall have free power of teaching and lecturing, without any other approval.
11 To no one therefore, etc. If anyone however, etc. Given at Villa Nova in the diocese of Avignon, on the 21st day of June, in the eighth year of our pontificate.
12 Given on 21 June 1360, pontificate year VIII.
