Supereminenti
Constitution on a Benefice for the Maronite Hospice in Rome
1 founded by Marcellinus a hospice of Maronite monks erected near that church, for so long as those same monks shall dwell in that hospice (1).
CLEMENT BISHOP
servant of the servants of God for perpetual memory of the matter.
2 Constituted, though with unequal merits, at the supereminent Chair of the Blessed Peter, Prince of the Apostles, and by divine clemency thus disposed, we willingly apply ourselves to those things by which hospices and regular houses constructed or to be constructed in our beloved City for the increase of divine worship may always be maintained, and we extend helping hands to their necessities and needs, as the qualities of places, times and persons, duly weighed, we perceive in the Lord to be wholesomely expedient, saving the derogation of contrary circumstances.
3 Preamble.
4 § 4. Formerly indeed our predecessor of happy memory, Pope Paul II, after certain of his predecessors, the Roman Pontiffs, through various constitutions of theirs, which they wished to endure only in their own time, had reserved to their collation and disposition whatsoever ecclesiastical benefices which their familiars and continual table-companions then held, that they should hold them during their familiarity, even if they had withdrawn from that same familiarity through the death of those predecessors or otherwise, and wherever they became vacant, with an irritant decree thereupon appended, since, when those predecessors were removed from the world and the vacancy of those same benefices occurred, it was uncertain whether such benefices on account of the aforesaid reservation and decree remained reserved and affected to apostolic disposition; to remove such ambiguity of doubt, by the edict of his perpetual and irrefragable constitution, he decreed and declared that all ecclesiastical benefices, as aforesaid, reserved and to be reserved in future by the Roman Pontiffs his successors canonically entering, and also in any manner becoming vacant and to become vacant in future through such reservation and decree, remained and shall always remain affected, and that no one of them, when it should first happen that they become vacant, could or can dispose of them except the Roman Pontiff, with an irritant decree also thereupon appended; and afterwards our predecessor of happy memory, Pope Innocent XI, in like manner reserved to his collation and disposition all ecclesiastical benefices which his familiars and continual table-companions then held, and should hold in future, during their familiarity, even if, as aforesaid, they had withdrawn from that same familiarity, then becoming vacant and henceforth to become vacant, decreeing that it should then be null and void if anything contrary to this should happen to be attempted concerning these matters by anyone whatsoever of any authority, knowingly or unknowingly.
5 § 4. Indeed, formerly our predecessor of happy memory, Pope Paul II, after certain of his predecessors, the Roman Pontiffs, through various constitutions of theirs, which they wished to endure only in their own time, had reserved to their collation and disposition whatsoever ecclesiastical benefices, which their familiars and continual table-companions then held, to be held during their familiarity, even if they had withdrawn from that very familiarity through the death of those same predecessors or otherwise, and were vacant in whatsoever places, with an irritant decree imposed thereupon; since, when those predecessors had been removed from the world, and the vacancies of those same benefices occurring, it was uncertain whether such benefices on account of the reservation and aforesaid decree remained reserved and affected to apostolic disposition; to remove the doubt of such ambiguity, by the edict of his perpetual and irrefragable constitution he decreed and declared that all ecclesiastical benefices, as aforesaid, reserved and to be reserved in the future by the Roman Pontiffs, his successors canonically entering, and also vacant in any manner and to be vacant in the future through such reservation and decree, remained and always remain affected, and that no one of them, when it should first happen that they become vacant, could or can dispose of them except the Roman Pontiff, with an irritant decree also imposed thereupon; and thereafter our aforesaid predecessor, Pope Innocent XI, in like manner reserved to his collation and disposition all ecclesiastical benefices, which his familiars and continual table-companions then held, and would hold in the future, during their familiarity, even if, as aforesaid, they had withdrawn from that very familiarity, then vacant and to be vacant hereafter, decreeing that it would then be null and void if otherwise concerning these things should happen to be attempted by anyone whatsoever by any authority, knowingly or unknowingly.
6 The reason for the union is explained. § 2. Since therefore, as we have learned, in our aforesaid city of Rome a hospice of our beloved sons the Maronite monks near the church of SS. Peter and Marcellinus of the same city, which is a cardinal's title church, has been constructed for the habitation of the aforesaid monks, and, as we have also learned, a perpetual, simple and personal residence not requiring ecclesiastical benefice at the altar or under the invocation of the same Saints Peter and Marcellinus in the said church has been founded, which benefice the aforesaid Tiberius Quadri, clerk or priest, once a perpetual beneficiary in the said church, held while he lived, and by the death of the same Tiberius, who also, while he lived and held such benefice, was a familiar and continual table-companion of our aforesaid predecessor Innocent at the Apostolic See from the year of our Lord 1497, or at another more accurate time, closed his final day, has become vacant and remains vacant at present, and no one besides the Roman Pontiff could or can dispose of it on this occasion, the aforesaid reservations, decrees and declarations standing in the way, the said hospice for the maintenance of the monks dwelling in it for the time being does not have sufficient revenues, and therefore considering that, if the aforesaid benefice, after the prior suppression and extinction of its collative title, were perpetually united and incorporated to the aforesaid hospice by us, from this certainly the necessities of the said hospice would be provided for in some way; We therefore, who eagerly strive to provide, as much as we can with the Lord, for the preservation of regular houses and the maintenance of persons serving the Most High in them, the rector of the same hospice and the aforesaid monks now and for the time being existing, and their individual persons from any excommunication, suspension and interdict, and other ecclesiastical sentences, censures and penalties, from law or from man, by any occasion or cause incurred, if they are bound by them in any way whatsoever, for the purpose of obtaining the present effect only, by this document absolving and holding to be absolved, by our own motion, not at the instance of a petition offered to us by the hospice itself or its rector and monks aforesaid or another on their behalf in this matter, but from certain knowledge and mere deliberation of ours, and from the fullness of apostolic power, the aforesaid benefice, whose fruits, revenues and income, together with any annexed benefices, do not exceed the value of ten gold ducats of the Camera annually, according to common estimation, as we have likewise learned, whether by the aforesaid means or by any other mode whatsoever, or from the person of any other, or by free resignation of the said Tiberius, or of any other from it in the Roman Curia, or outside it, even before a public notary and witnesses freely made, or by the acquisition of another ecclesiastical benefice conferred by any authority, has become vacant, even if it has been vacant for so long a time that its collation according to the statutes of the Lateran Council has legitimately devolved to the aforesaid See, and the same benefice is specially or otherwise generally reserved to apostolic disposition, and a suit concerning it, whose status we wish to be held as expressed in the present document, is pending undecided between some parties, provided that its disposition pertains to us on this occasion, after the prior suppression and extinction of its collative title, together with such annexes and all rights and appurtenances thereof, to the said hospice, so that it shall be lawful for the rector of the same hospice now and for the time being existing to apprehend by himself or by another or others, in his and the said hospice's names, corporeal, real and actual possession of all the fruits, revenues, income, rights, goods, emoluments, appurtenances and benefits of the said benefice, and to retain it perpetually apprehended, and to lease, unleash, rent, exact, receive, collect and recover it, and to convert it to the common and religious uses, utility and necessity of the said hospice and of the monks dwelling in it for the time being aforesaid, no license whatsoever being required thereupon, provided nevertheless that the rector of the said hospice now and for the time being existing shall bear all and singular the burdens of the said benefice, by apostolic authority by the tenor of the present document we perpetually unite, annex and incorporate.
§ 3.
7 We decree by these present letters, and all things contained in them, that at no time whatsoever, even for the reason that the causes on account of which they were issued have been examined, verified and approved before our Vicar in spiritual matters General in the same City and its district, or the Cardinal titular of the said church existing for the time being, or otherwise, and that any persons having or claiming to have an interest in the aforesaid matters and concerning them, who have not been respectively called to this, nor have consented to the same present letters, or otherwise for whatsoever causes, however legitimate and juridical, may be noted with the vice of subreptitiousness or obreption or nullity, or of our intention, or any other defect, impugned, retarded, called into question or controversy, reduced to the terms of law, or any remedy whatsoever of law, grace, or fact be obtained against them; nor may they be comprehended under whatsoever revocations, suspensions, limitations, or other contrary dispositions of similar or dissimilar grants, even of unions not yet obtaining their full effect, made by us or by our successor Roman Pontiffs, even on the morrow of the assumption of any of them to the summit of the Apostolic office, under whatsoever expressions and forms of words made for the time being; but as granted for the maintenance and utility of the said hospital and its increase, they shall always be excepted from them, and as often as they are issued, so often shall they be restored, replaced and fully reintegrated into their former and the state in which they were before in any manner whatsoever, and anew also under whatsoever later date to be chosen by the rector and monks aforesaid of the said hospital whenever they are granted, and shall obtain and secure their full and complete effects, nor shall anyone be bound to present these present letters of our motu proprio in the Chancery or Camera Apostolica according to the constitution of Pius, Pope of pious memory, likewise our predecessor, edited thereupon, whenever they are to be presented, sworn to, and registered, nor shall they on that account be null, but shall altogether be valid and availing, just as if the constitution of Pius our predecessor of this kind or any other contrary one had never been issued, and thus by whatsoever ordinary judges, or delegates exercising any authority and adorned with any dignity, even auditors of causes of the Apostolic palace, and Cardinals of the Holy Roman Church even as Legates a latere, Vice-Legates, and Nuncios of the aforesaid See, with the faculty and authority of judging and interpreting otherwise in any manner whatsoever being taken away from them and from each of them, it ought to be judged and decided, and it shall be null and void if otherwise concerning these things anything be attempted by anyone whatsoever, with whatsoever authority, knowingly or unknowingly.
§ 4.
8 Notwithstanding, insofar as it be necessary, our rule and that of the Apostolic Chancery of not taking away acquired right, and the most recently celebrated Lateran Council prohibiting perpetual unions, except in cases permitted by law, to be made, and concerning unions, applications and perpetual concessions to be committed to the parties interested whose concern it is, and other apostolic constitutions and ordinances, even in universal, provincial and synodal councils issued, whether special or general, and also privileges, indults, and apostolic letters of the said church, and of its Cardinal titular, and of the Senator, Conservators, and Roman people of the said city, and of whatsoever other persons, under whatsoever tenors and forms of words, and with whatsoever even derogatory clauses of derogations, and other more efficacious, most efficacious and unusual clauses, as well as irritant and other decrees in general or in particular and others in any manner whatsoever made to the contrary, approved and renewed, all and each of which, even if for their sufficient derogation special, specific, express and individual mention of them and their whole tenors should be had, or any other expression, or some other exquisite form should be observed for this purpose, we having the tenors, causes, forms, and occasions of all these as fully and sufficiently expressed and inserted word for word, which would otherwise remain in their force, for the most valid effect of the aforesaid matters on this occasion only, specially and expressly, by equal motu proprio, by the tenor of these letters, we derogate and will that they be derogated, and all other things whatsoever to the contrary.
9 § 5. We will moreover that in the event that the aforesaid Monks cease to dwell in the said hospital, the union, annexation and incorporation aforesaid shall be held as not made, and they shall be dissolved, and dissolved they are and shall be deemed to be by that very fact, and the said benefice shall revert to its pristine nature of its collative title.
10 § 6. Let no one whatsoever be permitted to infringe this page of our absolution, motu proprio, union, annexation, incorporation, decree, derogation and will, or to act against it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul.
11 Given at Rome, at St. Mary Major, in the year of Our Lord's Incarnation 1618, on the 9th day before the Kalends of June, in the eighteenth year of our pontificate.

1 Marcellini fondato ospizio di monaci Maroniti presso quella chiesa eretto, finché gli stessi monaci in esso ospizio dimorino (1).
CLEMENTE VESCOVO
