Decree on the observance and avoidance of abuses in manual Mass stipends

FROM THE SACRED CONGREGATION OF THE COUNCIL
1 DECREE concerning what is to be observed and avoided in the fulfillment of manual masses. In order that the celebration of manual masses may be carried out with due diligence, that the dispersal of alms and the neglect of assumed obligations may be avoided, and that many other matters may be properly regulated, the Sacred Congregation of the Council has in recent times established several provisions. But in the great instability of our age's affairs and fortunes and in the growing malice of men, experience has taught that even greater precautions must be taken, lest the pious intentions of the faithful be defrauded, and lest this most serious matter among all be carefully and holily preserved. For this reason the Eminent Fathers of the Sacred Congregation, having taken counsel together once and again, judged that certain matters ought to be established, which our Most Holy Lord Pope Pius X carefully weighed, approved, and ordered to be made public, as follows.
2 The Sacred Congregation declares first of all that by manual masses in the present decree are understood and held to be all those masses which the faithful request to be celebrated upon offering a manual stipend, to whomever and in whatever manner, whether by brief hand or in wills, they deliver this stipend, provided that they do not constitute a perpetual foundation, or one so long-lasting that it ought to be held as perpetual.
3 Likewise, those masses are to be reckoned among manual masses which burden the patrimony of some private family in perpetuity indeed, but are established in no church, and for which masses satisfaction can be made anywhere by any priests, at the discretion of the head of the family. But those are to be in the manner of manual masses which, being established in some church or annexed to benefices, cannot be applied by their own beneficiary or in their own church for this or that reason; and
4 DECREE therefore either by law or with an indult of the Holy See must be entrusted to other priests so that satisfaction may be made for them.
5 Now concerning all these matters the Sacred Congregation decrees: 1. That no one is able to seek and receive more masses than he can probably celebrate within the time limits set forth below, and through himself, or through priests subject to him, if it be a matter of a diocesan Ordinary, or a regular Prelate.
6 2°. That a suitable time for fulfilling the obligations of manual masses is one month for one mass, six months for one hundred masses, and another longer or shorter space of time more or less, according to the greater or lesser number of masses. 3°. That it is not lawful for anyone to assume so many masses that he cannot probably satisfy them within a year from the day the obligation was undertaken; always saving, however, the contrary intention of those offering, who either explicitly or implicitly demand a shorter time for the celebration of masses on account of some urgent cause, or grant a longer time, or of their own accord give a greater number of masses.
7 4°. Since in the decree Vigilanti of 25 May 1893 (1) it was established "that henceforth all and each beneficiaries and administrators of pious causes everywhere, or in any way obliged to fulfill the burdens of masses, whether ecclesiastical or lay, at the end of each year shall deliver to their own Ordinaries the burdens of masses which remain and for which they have not yet satisfied, according to the manner to be defined by them"; in order to remove ambiguities the Eminent Fathers declare and establish that the time fixed by these words is to be understood thus, that for masses founded or annexed to some benefice the obligation of depositing them runs from the end of that year within which the burdens ought to have been fulfilled: but for manual masses the obligation of depositing them begins after a year from the day the burden was undertaken, if it be a matter of a large number of masses; saving always the prescriptions of the preceding article for a smaller number of masses, or a different intention of those offering. Upon the complete and perfect observance of the prescriptions which have been established both in this article and in the preceding ones, the conscience of all to whom it pertains is gravely bound. 5°. Those who have an abundant number of masses, concerning which it is lawful for them to dispose freely (without prejudice to the intention of founders or offerors [[fn:Cfr. Acta S. Sedis, vol. XXVI, pag. 36.]] as to the time and place of celebration of masses), are able to give them, besides to their own Ordinary or the Holy See, also to priests well-disposed toward them, provided they are certainly and personally known to them and beyond all exception.

9 XXXVI, fasc.
10 CDXXXI. FROM THE SACRED CONGREGATION OF THE COUNCIL 6°. Those who have delivered masses with their alms to their own Ordinary or the Holy See are to be relieved from all obligation before God and the Church.
11 Those who have received Masses from the faithful, or in any way entrusted to their faith, and have handed them over to others to be celebrated, are bound by obligation until they have obtained proof of the completion of the celebration; so that if the matter should come to nothing through the dispersal of the alms, through the death of the priest, or through any other cause whatsoever, even fortuitous, the one who committed it must supply from his own resources and is bound to satisfy the Masses. 7°. The Ordinaries of dioceses shall immediately record in order in a book, with the respective alms, the Masses which they shall accumulate from the disposition of the preceding articles, and shall take care with all their strength that they be celebrated as soon as possible, yet so that first the manual Masses be satisfied, then those which are in the manner of manual Masses. Moreover, in the distribution they shall observe the rule of the decree Vigilanti, namely "they shall first distribute the intentions of Masses among the priests subject to them, who are known to be in need of them; otherwise they shall then entrust them either to the Holy See, or to other Ordinaries, or even, if they wish, to priests outside the diocese provided they are known to them and are above all exception," the rule of article 6 always remaining firm concerning the obligation, until they have exacted from the priests proof of the celebration performed. 8°. It is absolutely forbidden to anyone to hand over Mass obligations and their alms, accepted from the faithful or from pious places, to booksellers and merchants, to administrators of newspapers and periodicals, even if they be religious men, nor to sellers of sacred vessels and vestments, even though they be pious and religious institutions, and generally to anyone whatsoever, even to ecclesiastical men, who request Masses, not specifically that they celebrate them either by themselves or through priests subject to them, but for any other purpose whatsoever, however excellent. For it has been established that this cannot be done except by conducting some kind of commerce with the alms of Masses, or by diminishing the alms themselves: which the Holy Congregation judged ought to be prevented entirely. Wherefore henceforth, if anyone shall presume to violate this law, either by knowingly handing over Masses as aforesaid, or by accepting them, besides the grave sin which he will commit, he shall incur the penalties set forth below.
12 DECREE
13 9°. According to what has been established in the article above, it is decreed that for manual Masses the stipend assigned by the faithful, and for Masses founded or attached to some benefice (which are celebrated in the manner of manual Masses) the alms according to the following articles proper to them, can never be separated from the celebration of the Mass, nor be changed into other things or diminished, but must be handed over in full and in its proper form to the one celebrating, with all declarations, indults, privileges, rescripts whether perpetual or for a time, granted anywhere, under any title, form or by any authority, and contrary to this law, being set aside.
14 10°. Therefore it is unlawful and absolutely prohibited to sell or buy books, sacred vessels or any other things whatsoever, and to enter into associations (as they are called) with newspapers and periodicals by means of Masses. This, however, applies not only if the matter concerns Masses to be celebrated, but also if it concerns Masses already celebrated, whenever this becomes a practice and habit and tends toward the support of some commerce. 11°. Likewise, without new and special permission of the Holy See (which shall not be given unless it has first been established that there is true necessity, and with proper and appropriate safeguards), nothing may be taken from the alms of Masses, which the faithful are accustomed to entrust to the more celebrated Sanctuaries, in order to provide for their decoration and ornament. 12°. Whoever shall dare to break the statutes established in the preceding articles 8, 9, 10 and 11, in any manner whatsoever or under any pretext, if he be of the priestly order, shall be liable to suspension from the divine offices reserved to the Holy See and incurred ipso facto; if a cleric not yet initiated into the priesthood, he shall likewise be subject to suspension from the orders received, and moreover shall become ineligible to attain higher orders; if indeed a layman, he shall be bound by excommunication latae sententiae reserved to the Bishop.
15 13°. And whereas in the constitution Apostolicae Sedis (1) it has been established that excommunication latae sententiae reserved to the Supreme Pontiff is incurred by "those collecting alms of greater value for masses, and making profit from them by having them celebrated in places where the stipends for masses are accustomed to be of lesser value," the S.C. declares that nothing has been detracted from this law and sanction by the present decree. 14°. However, lest sudden innovation be harmful to certain pious causes and religious publications, it is permitted that associations already begun by means of masses continue until the end of the year in which they were instituted. (Cfr. Acta S. Sedis, vol. V, pag. 287.
16 FROM THE HOLY CONGREGATION OF THE COUNCIL. Likewise it is granted that indults of reduction of the alms of Masses, which are found to have been granted to some for the benefit of Sanctuaries or other pious causes, remain in force until the end of the current year.
17 15°. Finally, as regards masses attached to benefices, whenever they are entrusted to other priests for celebration, the Most Eminent Fathers declare and establish that the stipend ought to be no other than the synodal stipend of the place in which the benefices are erected. For masses, however, founded in parishes and other churches, the stipend which is given ought to be no other than that which is found in the foundation or in the successive indult of reduction, perpetually fixed, saving always the rights, if any, legitimately recognized either for the fabrics of churches or for their rectors, according to the declarations exhibited by the S. C. in Monacen. 25 July 1874 (1) and Hildesien. 21 January 1898. For in Monacen, « having regard to the fact that the stipends of masses of certain legacies held in part the place of the congruous parochial stipend, the Fathers judged it to be licit for the parish priest, if he cannot satisfy it himself, to commit those masses to another priest, the ordinary stipend of the place being assigned, whether for read or sung masses ». And in Hildesien, it was declared, « in legacies of masses founded in a church, that portion of revenue which was assigned to them at the threshold of the foundation, or in another legitimate manner, can be retained in favor of the ministers and churches serving, independently of the special work to be performed for the fulfillment of the legacy ».
18 Finally, it shall be the duty of each Ordinary to ensure that in each church, besides a table of perpetual burdens and a book in which manual masses which are entrusted by the faithful are recorded in order with their stipend, there shall moreover be books in which the satisfaction of the said burdens and masses is noted. It shall likewise be their duty to watch over the full and complete execution of the present decree: which His Holiness orders to be inviolably observed by all, any contrary provisions notwithstanding. Given at Rome from the S. Congregation of the Council on 11 May 1904.

X accurate perpendit, probavit^ vulgarique iussit, prout sequitur.
3°. Nemini licere tot missas assumere quibus intra annum a die susceptae obligationis satisfacere probabiliter ipse nequeat; salva tamen semper contraria offerentium voluntate, qui aut brevius tempus pro missarum celebratione sive explicite sive implicite ob urgentem aliquam causam deposcant, aut longius tempus concedant, aut maiorem missarum numerum sponte sua tribuant.
14°. Attamen ne subita innovatio piis aliquibus causis et religiosis publicationibus noxia sit, indulgetur ut associationes ope missarum iam initae usque ad exitum anni a quo instituti) Cfr. Acta S. 17 15°.
