4 Quapropter certa scientia maturaque deliboratione Nostra^ deque Apostolicse auctoritatis plenitadinepartem Ülam superius memoratam Dioscesis MoQtereyensisjuxtadescriptos limites a Diodcesi prsedicta dividimus ac separamus, exeaqaeregioHepecuIiarem ac proprie dictam Archiepiscopalem Ecclesiam erigimns, ejusque Sedem in Civitate S.. Pope Pius IX. For the memory of the future.
1 We understand it to be necessary for the governance and care of the salvation of souls to divide Dioceses which appear to be contained within excessively broad boundaries.
2 Now indeed, although that part of the Diocese of Monterey, which pertains to the Mexican Republic, has recently been separated and committed to the Archbishop of Mexico to be governed under the title of Apostolic administration, that part is nevertheless known to extend most widely, so that the present Bishop of Monterey, and at the same time the Archbishops and Bishops of the United States of North America from the Baltimore Council have asked Us to take care that from the Diocese of Monterey that part be separated which is defined to the east by the Colorado River, to the north by the forty-second degree of latitude, to the west by the Pacific Ocean, and to the south by the southern parallel of the district of the village, commonly called Pueblo St. Joseph, and from that region thus divided by Us a Diocese shall be erected, whose See shall be established in the City of St. Francis. Since, however, other Archiepiscopal Sees are very distant, and it appears most useful to establish a new ecclesiastical Province in Upper California, therefore the aforesaid Prelates have requested of Us that We declare the new Church of St. Francis to be Metropolitan, as being more suitable on several counts, and to that Metropolitan Church We assign as suffragan the Episcopal Church of Monterey.
3 We therefore, having first deliberated on this matter with Our Venerable Brethren the Cardinals of the Holy Roman Church placed over the Propagation of the Faith: and having carefully weighed each point, for this reason that from the erection of this Archiepiscopal Church no small utility appears to be forthcoming for the spiritual governance of the faithful of Christ, We have willingly and gladly assented to the wishes of the aforesaid Prelates.
4 Wherefore with certain knowledge and mature deliberation of Ours, and from the fullness of Apostolic authority, that part above-mentioned of the Diocese of Monterey, according to the described boundaries, We divide and separate from the aforesaid Diocese, and from that region We erect a peculiar and properly so-called Archiepiscopal Church, and We fix and establish its See in the City of St. Francis.
5 Furthermore to that Church of St. Francis We will that all and singular the rights, privileges, honors, and faculties which are proper to Metropolitan Churches pertain, and to the same We assign as suffragan the Episcopal Church of Monterey.
6 This We establish and command, notwithstanding Our and the Apostolic Chancery's rule concerning acquired right not to be taken away, as well as the Constitutions of Our Predecessor of happy memory Benedict XIV concerning the division of matters, and other Apostolic and in Universal, Provincial, and Synodal Councils issued general or special Constitutions and Apostolic Ordinances, and all other things to the contrary whatsoever.
7 Given at Rome, at St. Mary Major, under the Fisherman's Ring, on 29 July 1853, in the eighth year of Our Pontificate.
8 For the Lord Cardinal Lambruschini, Jo. B. Brancaleoni Castellani.
