DELLA EREZIONE DELLA PROVINCIA ECCLESIASTICA DI BELO HORIZONTE PIO VESCOVO SERVO DEI SERVI DI DIO A PERPETUA MEMORIA DELLA COSA

1 Al compito a Noi affidato dall'eterno Principe dei Pastori appartiene dividere ed erigere diocesi per il mondo, secondo che il bene spirituale del gregge del Signore richiede in base alle necessità dei tempi e dei luoghi.

2 Poiché dunque la città di Belo Horizonte, principale città dello Stato civile di Minas Gerâes e sede di questo Vescovo, tanto per la frequenza dei suoi abitanti quanto per il numero delle associazioni cattoliche e sociali, supera di gran lunga le altre città di quello Stato; il Metropolita della sua Chiesa, il venerabile fratello attuale Arcivescovo di Mariana, non ha dubitato di chiedere a Noi che elevassimo quella città a capo di una nuova provincia ecclesiastica, tanto più che la provincia di Mariana, alla quale la Chiesa di Belo Horizonte, come suffraganea, attualmente appartiene, è vastissima. Poiché inoltre alle preghiere del Metropolita Antistite si univano il Nunzio Apostolico della Sede Apostolica nella Repubblica Brasiliana e altri Ordinari dei luoghi, Noi, consultato in ciò il voto dei venerabili nostri fratelli Cardinali della Sacra Congregazione Concistoriale, abbiamo ritenuto di dover accogliere le suppliche presentate. Supplito dunque, per quanto occorra, il consenso di coloro che vi hanno interesse o si presume che vi abbiano interesse, dalla pienezza della potestà apostolica, sciogliamo la sede di Belo Horizonte dal diritto metropolitico della Chiesa arcivescovile di Mariana e l'eleviamo alla dignità e al grado di Chiesa Metropolitana. A essa pertanto attribuiamo e assegniamo a pieno diritto tutti e singoli i diritti, i privilegi e le prerogative di cui godono le altre sedi metropolitane nella Repubblica Brasiliana; e il venerabile fratello Antonio dos Santos Cabrai, che attualmente governa la sede di Belo Horizonte, lo onoriamo con il titolo, la dignità, i diritti e i privilegi di Arcivescovo, insieme con la facoltà di chiedere, affinché altri Arcivescovi, la Croce e il Pallio, precedentemente richiesti alla Sede Apostolica nel Sacro Concistoro. Parimenti eleviamo al grado metropolitano il Capitolo cattedrale della Chiesa di Belo Horizonte, e gli attribuiamo e assegniamo parimente i diritti, i privilegi, gli onori e le preminenze di cui godono gli altri Capitoli metropolitani nella Repubblica Brasiliana. Inoltre esoneriamo e sottraiamo dal diritto metropolitico della Chiesa di Mariana le diocesi di Aterrado, Guaxupé e Uberaba, che attribuiamo come suffraganee alla sede metropolitana di Belo Horizonte e i loro Vescovi per il tempo, insieme con il clero e i fedeli di quelle diocesi, costituiamo suffraganei dello stesso Metropolita di Belo Horizonte, alla cui giurisdizione, secondo la norma dei canoni, saranno soggetti.

3 Infine a Noi e alla Sede Apostolica riserviamo la facoltà di operare nuove circoscrizioni e dismembrazioni in questa provincia ecclesiastica, tutte le volte che ciò sarà sembrato opportuno nel Signore.

4 Quanto poi è stato da Noi decretato con queste Lettere per autorità apostolica, a nessun uomo, in nessun tempo mai, sia lecito infrangere, o contrastare, o in alcun modo opporsi. Se qualcuno, che Dio non voglia, osasse tentare ciò, sappia che incorrerà nelle pene stabilite dai sacri canoni contro coloro che si oppongono all'esercizio della giurisdizione ecclesiastica. Per l'esecuzione di queste cose deputiamo il venerabile fratello Enrico Gasparri, Arcivescovo titolare di Sebastopoli, Nunzio Apostolico nella Repubblica Brasiliana, al quale attribuiamo le facoltà necessarie e opportune, anche di subdelegare, per l'effetto di cui si tratta, un altro uomo costituito in dignità ecclesiastica, e di pronunciare sentenza definitiva su qualsiasi difficoltà o opposizione che si presenti: imponendogli l'obbligo di inviare alla Sacra Congregazione Concistoriale entro sei mesi, computati dalla data del presente, una copia autentica dell'esecuzione di questo Nostro mandato.

5 Decretiamo infine che queste presenti Lettere varranno nonostante qualsiasi cosa contraria, anche degna di particolare e espressa menzione. Dato a Roma presso San Pietro, nell'anno del Signore millenovecentoventiquattro, il primo giorno del mese di febbraio, nel secondo anno del Nostro Pontificato.

Si quis, quod Deus avertat, hoc attentare praesumpserit, sciat obnoxium se evasurum esse poenis a sacris canonibus contra obsistentes exercitio ecclesiasticae iurisdictionis statutis. ON THE ERECTION OF THE ECCLESIASTICAL PROVINCE OF BELO HORIZONTE PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 It pertains to the office committed to Us from eternity by the Prince of Pastors to divide and erect dioceses throughout the world, as the spiritual good of the Lord's flock according to the necessities of times and places requires.

2 Since therefore the city of Belo Horizonte, the principal city of the civil state of Minas Gerais and the seat of the bishop of this diocese, far surpasses the other cities of that State both in the frequency of its inhabitants and in the number of Catholic and social associations; its Metropolitan Church, our venerable brother the present Archbishop of Mariana, did not hesitate to petition Us that We should raise that city to the head of a new ecclesiastical province, especially since the province of Mariana, to which the Church of Belo Horizonte, as a suffragan, at present belongs, is very extensive. When, however, the petitions of the Metropolitan were supported by the Apostolic Nuncio of the Apostolic See in the Brazilian Republic and by other Ordinaries of the region, We, having sought the vote of our venerable brothers the Cardinals of the Sacred Congregation of Consistorial Affairs in this matter, deemed it fitting to grant the petitions. Having therefore supplied, insofar as it is necessary, the consent of those to whom it pertains or who may be presumed to have an interest, from the fullness of Apostolic power, We release the see of Belo Horizonte from the metropolitan right of the archiepiscopal Church of Mariana and raise it to the dignity and rank of a Metropolitan Church. To which accordingly We grant and assign in full right all and singular the rights, privileges and prerogatives which the other metropolitan sees in the Brazilian Republic enjoy; and We increase the venerable brother Anthony dos Santos Cabrai, who at present holds the see of Belo Horizonte, with the title, dignity, rights and privileges of Archbishop, together with the faculty of requesting, as other Archbishops do, the Cross and Pallium, to be previously sought from the Apostolic See in Sacred Consistory. Likewise We raise the Cathedral Chapter of the Church of Belo Horizonte to metropolitan rank, and We grant and assign to it equally the rights, privileges, honors and preeminences which the other metropolitan Chapters in the Brazilian Republic enjoy. Moreover, We exempt and withdraw from the metropolitan right of the Church of Mariana the dioceses of Aterrado, Guaxupé and Uberaba, which We assign to the metropolitan see of Belo Horizonte as suffragan, and We constitute their respective Bishops, together with the clergy and faithful of their dioceses, as suffragan to the same Metropolitan of Belo Horizonte, whose jurisdiction, according to the norm of the canons, they shall be subject to.

3 Finally, We reserve to Ourselves and to the Apostolic See the faculty of making new circumscriptions and dismemberments in this ecclesiastical province whenever it shall seem expedient in the Lord.

4 But those things which by these Letters, by Apostolic authority, have been decreed by Us, it is permitted to no man, at no time whatsoever, to infringe, or to oppose them, or in any way to contravene. If anyone, which God forbid, shall presume to attempt this, let him know that he shall incur the penalties established by the sacred canons against those who resist the exercise of ecclesiastical jurisdiction. For the execution of these things We appoint the venerable brother Henry Gasparri, Archbishop with the title of Sebastopolis, Apostolic Nuncio in the Brazilian Republic, granting to him the necessary and opportune faculties, even to subdelegate, for the purpose in question, another man constituted in ecclesiastical dignity, and to pronounce a definitive sentence concerning any difficulty or opposition that may arise: imposing upon him the burden of sending to the Sacred Congregation of Consistorial Affairs within six months, to be reckoned from the date of these presents, an authentic copy of the execution of this Our mandate.

5 We decree finally that these present Letters shall be valid notwithstanding any contrary provisions, even those worthy of particular and express mention. Given at Rome at St. Peter's, in the year of Our Lord one thousand nine hundred twenty-four, on the first day of the month of February, in the second year of Our Pontificate.
