Leo XII, Pope

1 For perpetual remembrance of the matter. § 1. Since many things have been most providently established in this Our city by the supreme pontiffs, which pertain greatly to the salvation and benefit of the Christian people, there stands out certainly among them the Roman College, which for the transmission of religion and the liberal arts was erected by the liberality of Gregory XIII of happy memory, by the effort of genius, and most magnificently, and has ever merited from Our predecessors in every age the most honourable testimonies of care and paternal affection. It is indeed remarkable, and worthy to be recounted in honourable commemoration of its glory, what fruits of virtue and honesty have continuously flowed forth from that enclosed garden even to these times; namely, most illustrious men, who, excelling in the sanctity of morals, the splendour of dignities, and the praise of learning, have shone forth from that dwelling-place of the finest arts for the benefit both of sacred and public utility. This college, which St. Ignatius Loyola had originally instituted, the Roman pontiffs entrusted to the regular clergy of the Society of Jesus founded by him, and they managed this care happily, as long as the Society endured, as it was afterwards found to have been conducted by the secular clergy.

2 § 2. But when by the will of Pius VII of happy memory, Our predecessor, through apostolic letters given on the seventh day before the Ides of August in the year one thousand eight hundred and fourteen, the Society of Jesus was restored to its former dignity, chiefly for the reason that it should undertake the instruction of youth in both letters and morals; We, who well knew the opinion of that pontiff concerning the recall of the Society of Jesus to the Roman College, deemed it necessary to deliberate immediately on this matter, having heard a select congregation of Our venerable brothers, the cardinals of the Holy Roman Church, to whom We entrusted the most serious business of the proper instruction of youth, after the most terrible harshness of the times, to be arranged more happily and more suitably throughout Our entire dominion; which We perceive to be one and the most expeditious method of amending the human race.

3 § 3. Wherefore, of certain knowledge, and mature deliberation of Ours, and by the fullness of apostolic power, through these letters to the beloved sons, the regular clergy of the Society of Jesus, and in their name to the beloved son Aloysius Fortis, general superior of the same, We grant, assign, and attribute in perpetuity the Roman College with the church of St. Ignatius, and the adjoining oratory, which they call after Father Caravita, as well as with the museums, library, and observatory tower, and other annexed and pertaining things, on this condition, that they themselves have public schools there according to the old custom, as it was inspected in the year one thousand seven hundred and seventy-three, to which We order to be added chairs of Sacred Eloquence and of Physical Chemistry.

4 § 4. To them moreover by the tenor of the present We commit, that for the study of religion, with which it is fitting that the members of the Society be inflamed, and from the institute of the Society, by which they have devoted themselves to the salvation of souls, they strive to expend not only the greatest effort and industry in carefully imbuing boys and adolescents with pious and liberal disciplines, but also in assisting those in the care of sacred matters in congregations; and likewise they be ready to cultivate the other faithful in the aforesaid oratory, as they had formerly been accustomed to do.

5 § 5. We therefore command that an annual revenue or income of twelve thousand scudi of Roman currency, whole and entirely free from every burden, namely one thousand scudi in each month to be paid from the beginning of the coming October from Our treasury to them in perpetuity, which We decree is to be applied both to the sustenance and support of the members, and to the maintenance of the building and sacred structures, and to any necessities of the college. Moreover, We decree that the rights and privileges of the Roman College, and especially those by which, by the authority of Julius III and Pius IV, it was given to confer the degree in the arts and in the faculty of sacred theology, and likewise to aggregate to the congregation of the Annunciation of the Blessed Virgin Mary called the First and Primary, remain entirely in force. We command moreover that at the appropriate times they publish and make known astronomical observations and other things for the benefit of letters.

6 § 6. These matters thus arranged, to Our venerable brother Bartholomaeus, bishop of Porto and St. Rufina, cardinal of the Holy Roman Church, called Pacca, camerlengo of the same Holy Roman Church, by the force of the present We commit, that at the beginning of the aforesaid month of October he cause the college itself with the church, and oratory, and all things pertaining to them to be delivered to the same general superior, or to another delegated by him, by legitimate right, so that in the following month of November all the schools under the auspices of the Mother of God and the other heavenly saints may again be opened according to the ancient institute and other laws prescribed for the times.

7 § 7. Since we have decreed that a college for noble students be established, to be educated in suitable buildings to be determined, assigned, and delivered within the next six months without fail, as soon as all things necessary for this work are at hand, we also wish the governance of that college to be assumed and conducted by the same clerics regular of the Society of Jesus, nor can anything else be required of them on account of this care. We therefore decree that suburban buildings in the Tiber district, formerly built for the old college of nobles, are to be handed over in the meantime to these members, so that it may be convenient for the aforementioned noble students to spend time there in a more favorable climate, especially during the autumn holidays.

8 § 8. Finally, with humble and earnest prayer we beseech the Father of lights that He himself be propitious and willing to aid Our endeavors, and that He especially instill in those whom We have called to this burdensome and most difficult province the disposition to bear the imposed duty with great courage and ready obedience, mindful of the glory by which they shall shine at the bidding of God like stars unto the eternal ages, when they shall have instructed many unto justice. May He Himself, from whom all good proceeds, by the gift of His grace make the young disciples docile and gentle in character, so that, well instructed in goodness, discipline, and knowledge, they may flourish in the best hope, bringing forth day by day more joyful fruits to this holy See and to the commonwealth, in which they may rejoice to have reaped the most abundant fruits from the well-completed course of their studies.

9 § 9. Decreeing that these present letters are firm, valid, and effective and shall be, and that they benefit the said clerics regular, and are to be inviolably observed by all to whom they pertain and shall pertain in any way in the future; and thus in the foregoing matters by any ordinary judges and delegates, and also auditors of causes of the apostolic palace, and nuncios of the Apostolic See, and cardinals of the Holy Roman Church, even legates a latere, with any faculty and authority of judging and interpreting otherwise removed from them and from each of them, they ought to be judged and decided; and if anything contrary to these should be attempted by anyone whatsoever with any authority, knowingly or unknowingly, it shall be null and void.

10 § 10. Notwithstanding apostolic constitutions and ordinances, and the statutes and customs of the said college, even those strengthened by oath, apostolic confirmation, or any other firmness; all and each of which, even if for their sufficient derogation special, specific, express and individual mention of them and their entire tenors, word for word, and not through general clauses having the same meaning, or any other expression should be had, or any other exquisite form should be observed for this purpose, we, having these tenors as if they were expressed word for word with nothing whatsoever omitted and the form contained in them observed, and inserted in the present as fully and sufficiently expressed and inserted, which would otherwise remain in their force, for the purpose of the foregoing on this occasion only specially and expressly derogate, and to all other things contrary whatsoever.

11 § 11. We will, however, that to copies of the present, even printed ones, and subscribed by the hand of some public notary, and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given in judgment and outside of judgment as would be given to the present themselves if they were exhibited or shown. Given at Rome at St. Peter's under the Fisherman's Ring on the seventeenth day of May in the year one thousand eight hundred twenty-four, in the first year of Our pontificate.
