3 I.

I, cap.

MOTU PROPRIO
ON CERTAIN PRESCRIPTIONS OF THE PIAN CONSTITUTION « VACANTE SEDE APOSTOLICA»
TO BE ALTERED IN SOME RESPECTS.
PIUS
PP. XI

1 Since recently, on the occasion of the Conclave, in which by the secret counsel of Divine Providence, We have been raised to the primacy of the Catholic Church, unworthy though We are, all matters pertaining to the vacant Apostolic See and to the election of the Roman Pontiff were to be directed according to the prescriptions of the Apostolic Constitution which Our predecessor of holy memory Pius X issued on the twenty-fifth day of December in the year nineteen hundred and four, the Venerable Brothers and Fathers, the Cardinals of the Holy Roman Church, in the daily assemblies held, which are called preparatory general Congregations, signified their desire that henceforth some chapter of that Constitution be so altered as the nature of things and times should require. Therefore, having carefully considered the matter, from the fullness of Our Apostolic power, by this Motu Proprio and with certain knowledge, We decree and ordain the following: I. Derogating from those things prescribed in the Constitution of Pius X, Vacante Sede Apostolica, title II, chapter i, n. 33, so that Cardinals who are at a greater distance may have the opportunity to come to the City, We extend the ten days' delay, which after the day of the death of the Supreme Pontiff was given for entering the Conclave, to fifteen full days; and moreover We grant to the Sacred College of Cardinals the power to defer the entrance into the Conclave even for two or three additional days, yet under this condition, that when eighteen days at most have elapsed, the Cardinals, as many as are present, shall immediately enter the Conclave and proceed to the business of election. As regards the novena, observing those things which are read in the aforesaid Constitution, title I, chapter v, n. 26, concerning the funeral rites to be performed with more solemn ceremony on the last three days, the Cardinals, at their first assembly, shall fix the days on which the first six are to be held.

2 II. That which is decreed in the same Constitution, title II, chapter ii, n. 38, We will to be observed in such manner that to each Cardinal, although it be free for him to use two servants, whether clerics or laymen, or one cleric and one layman, it shall nevertheless be permitted to bring with him into the Conclave one layman only. But that which is added concerning servants to be granted to an infirm Cardinal, let that remain entirely unchanged.

3 III. The law concerning Communion to be made by the Cardinals, which is contained in that Pian Constitution, title II, chapter v, n. 54, We so renew that it shall be permitted to each Cardinal to celebrate Mass; but he who, for whatever reason, shall abstain from celebrating Mass, let him approach the sacred Synaxis in the designated chapel at the customary Mass.

4 We command moreover that these Our Letters given by Motu Proprio be read before all the Cardinals of the Holy Roman Church present, at the first general Congregation which shall be held after the death of the Supreme Pontiff. Notwithstanding anything to the contrary whatsoever.

5 Given at Rome at St. Peter's on the day of the month of March, in the year nineteen hundred and twenty-two, in the first year of Our Pontificate.
