1 tion and correction of chapters are reserved, and all controversies arising therefrom being suppressed, he commanded that the statutes of the Council of Trent in such matters be observed.1

Sixtus, Pope V, for the perpetual memory of the matter.

2 It befits the Roman Pontiff, constituted by the Lord in the supreme throne of justice and in the fullness of apostolic power, to apply the parts of his office with more ready zeal to those things by which the sanctions of the sacred Council of Trent may be preserved inviolate, and if he perceives anything tending to their depression and to harm, he may revoke it through the ministry of his providence and reduce it to the proper norm.

3 § 1. We have indeed received that in a certain concordance, formerly, by virtue of letters of Pius, Pope II, our predecessor, of blessed memory, dated 1463, on the day before the Kalends of May, between Martin, bishop of Ávila, of good memory, and the dean then existing, and the chapter of the church of Ávila, concerning the jurisdiction, visitation, correction, inquiry and punishment of offences committed by canons and other persons of the said church for the time being, entered into, and judges appointed in the said letters of Pius II, and perhaps confirmed also by some of our other predecessors, it is expressly provided, among other things, that the bishop of Ávila may seize or order to be seized any beneficiary of the said church who shall have committed something for which he ought to be seized, or against whom a complaint shall have been made, and detain him for three days in some honest place, according to the nature of the offence and the person, which thus 1

4 By virtue of the letters of Pius II certain matters were concorded between the bishop and the chapter of Ávila.

5 In them it is stated that the visitation and correction of canons belongs to the bishop, together with the chapter.

6 In the year 1567. If he shall have been seized within the said city and if he shall have been seized outside it, the legitimate impediment ceasing, they shall be brought to it, so that within the said three days he be held with the duty of presenting and notifying him in the said chapter, to the end that, according to the offence, the person by the said bishop, dean and chapter be judged, corrected, punished and chastised, as shall be according to law, yet so that the power of the dean and chapter of taking their meals and of ascribing fault to the delinquents remain safe, as they have from use and custom. And that the benefice of the fifty-seventh of the same church by statute and mandate of similar memory of Alfonso, mandated II, of the same year, formerly bishop of Ávila, and dean then of the chapter without...

7 bishop existing, in the book of statutes of the year of the Lord one thousand five hundred thirty recompiled and written, and by the perpetual memory of Leo, Pope X, also our predecessor, through his letters given in the year one thousand five hundred nineteen, on the day before the Nones of May, and perhaps also confirmed by other predecessors of ours, it is also provided that perpetually and forever, as often as it shall happen that some beneficiary or beneficiaries of the said church quarrel within the church with other beneficiaries of it, or they themselves shall have spoken some injurious words against the chapter and in contempt of it, and against it shall have done something unjust, so that the chapter feels itself injured, and on this account and in effect it is; that the dean and chapter alone, without their prelate, and with him excluded, are able them, if they wish, to imprison in their houses, under grave penalties, lest they go out from them without their mandate; and that, according to their offences, all their prebends shall be withheld for two months, if the offence be such that so great a penalty be worthy, having first had a summary inquiry, how and what sort the guilty parties were; and those found culpable shall have withheld from them for one month from their prebends, or there shall be imposed upon them other or other penalties and penances to them acceptable according to their offences. But if the chapter be negligent in this so that it impose no penalty on the delinquent, in this negligence of the chapter the prelate shall succeed to the case and proceed against such a delinquent together with the dean and chapter in imposing upon them a penalty to them acceptable; and if the offence be grave, so that the aforesaid penalties be not sufficient, that they eat breakfast and breakfasts to them acceptable, until they enjoin upon them a penalty condignal to their offence, as it is accustomed to be done. If however such a beneficiary or beneficiaries have had a quarrel within the cathedral church with others, who are not beneficiaries, chaplains or members of the choir, if the offence be very grave and atrocious, so that it merit to be punished by greater penalties than those aforesaid, and those be not sufficient according to the great atrocity of his offence, such a delinquent shall be chastised, punished and corrected by the said bishop and dean and chapter together, according to his offence. If truly such a beneficiary shall have committed such an offence outside the said church, which be such that it merit to be imprisoned, that the said bishop, when the said bishop shall be able to order him apprehended, may hold him imprisoned honestly in his palace or in a house in the honest city of Avila, and he cannot lead him captive to Bonilla nor to another part outside the same, and that within three days, including the day on which he shall have apprehended him, he is bound to lead and present him in the chapter to the aforesaid dean and chapter; and by all it shall be constituted, if he be a dignitary, in the house of another dignitary, if truly a canon, in the house of another portioner. And that the bishop, dean and chapter aforesaid, by themselves or their commissioners, shall make inquiry of such an offence, hearing the delinquent upon his innocence until the conclusion of the suit, and until sentence be rendered against him and the beneficiary found culpable by the said bishop. The bishop being absent, the aforesaid things shall be executed by his provisor.

8 If the chapter be to be visited, the visitation by the bishop and two beneficiaries, yet the penalty to the guilty shall be enjoined by the bishop and chapter.

9 Such things gave occasion for very many controversies between the bishop, dean and chapter.

10 All causes being avoked to himself, and perpetual silence imposed upon the parties,

11 and the dean and chapter, and that the one without the others cannot bear it. Which if the bishop be absent from the city, in his place his provisor shall assist in the aforesaid matters, and that the sentence to be rendered against him be fulfilled by the same bishop, dean and chapter, and that it be executed. And that this order be observed when the bishop shall wish to visit the dean and chapter, and the said chapter with the same bishop shall depute two beneficiaries to make the said visitation; yet that the punishment and penalty be enjoined by all, as it is said, and in the concordance and statute aforesaid it is more fully contained.

12 § 2. Since however, as we have also received, concerning the concordance and statute aforesaid and their confirmations aforesaid and the observance thereof, diverse suits and controversies between our venerable brother Peter, bishop of Avila, and perhaps his predecessors, the prelates of the same church, as well as the modern and for the time being existing dean and chapter aforesaid, both in the Roman Curia and outside it, before diverse judges, even auditors of causes of the Apostolic Palace, have arisen, and, being taken up, are in force and pending undecided:

13 § 3. We, considering that such concord and statute so restricts the episcopal jurisdiction over the capitular persons of the said church, and as it were circumscribes them with certain barriers, that an easy way is opened to anyone, even to the guilty party of the most atrocious crime whatsoever, to elude it and to obtain impunity for his misdeeds, and that very many other inconveniences follow, to the mockery of episcopal dignity and to the diminution of his ordinary jurisdiction, and that the ministry of the reform due and enjoined by the Council of Trent is impeded, and therefore wishing to remedy such abuses and inconveniences, and also to extricate the aforesaid bishop and dean and chapter from further entanglements of litigation and expenses, and to provide for their peace and tranquility, and otherwise to interpose the parts of our office salutarily in the premises, having the status and merits of the same litigations and causes, and the names and surnames of the judges and litigating parties, and their and any others' claims, titles and rights, as well as the tenors of the processes formed thereupon and of sentences perhaps rendered and thence of any centuries, considered as sufficiently expressed in these presents, by our own motion, not at the instance of any petition offered to us on this matter, but from our certain knowledge and from the fullness of apostolic power, after prior cognition of such cause and causes, and having taken mature deliberation with the Cardinals of the Holy Roman Church, deputed over consultation and the business of the prelates, before whom also the business, with the parties heard on both sides by voice and in writing, was fully discussed, we by the tenor of these presents advocate to us the aforesaid cause and all causes whatsoever, with all and singular their dependencies, emergencies, annexations and connections, pending before whatsoever judges, ordinary and delegated, and also the aforesaid auditors, and also the nuncio of the Apostolic See in the kingdoms of Spain, in the said curia or outside it and anywhere whatsoever, in whatsoever state, terms and instances they are found, and we utterly and entirely extinguish them; and moreover over all and singular the premises, as much to the bishop existing in modern times and for the time being, as to the dean and chapter and capitular and other aforesaid persons and others having or claiming interest in any way whatsoever, we impose perpetual silence; and to the auditors and other judges in virtue of holy obedience we strictly command and forbid that they presume to take cognizance of the merits of the cause and causes of this kind, or to proceed in it or in them to further acts, and much less to admit the litigating parties of this kind, or those acting for them, to the prosecution of the aforesaid suit and causes, or to hear anyone thereupon.

14 § 4. Moreover, adhering to the decrees of the aforesaid council, we decree that the same Peter, bishop, and the chapter and the bishop in his place and his successors of the said church, the prelates or administrators for the time being, existing from now henceforth, for perpetual future times, all and singular holding dignities, as well as canons, whole and half portionists and beneficed chaplains, singers, sacristans, ministers and persons of the said church, according to and in accordance with the form and disposition of the same Council of Trent in chapter iv, beginning Capitula Cathedralium, session vi, and in chapter vi beginning Statuit Secunda Synodus, session xxv, may freely and lawfully visit, correct and punish; nor under the pretext of this or of other whatsoever statutes of the said church which the aforesaid...

15 statutes, immunities or privileges, exemptions, indults, rescripts and apostolic letters granted to the same church and its capitular and other persons by whatsoever Roman Pontiffs, our predecessors, and the said See or its legates, even by motion, knowledge and fullness of power similar, in whatsoever manner, nor of concordances, conventions and transactions entered into thereupon between the prelates and the dean and chapter of this kind, and of confirmations and apostolic approvals following thereupon, be able to impede, but all those things ought entirely to be reduced to the form and disposition of the decrees of the Council of Trent of this kind, by apostolic authority, by the tenor of these presents, we establish, ordain and declare and reduce.

16 § 5. And nevertheless to Peter the bishop and his aforesaid successors full, free and complete faculty over all and each of the dignitaries holding office, canons, portionarii of their stipends, both whole and divided portions, chaplains, beneficiaries, singers, successors, sacristans, ministers and persons of the said church now and for the time being existing, according to the form of the decrees of the council, in chapters and sessions of this kind to visit, correct and punish, we grant and enlarge by the authority and tenor aforesaid; and whatsoever oaths by Peter the bishop and the aforesaid dean and chapter as well as by any others in the aforesaid matters and on their occasion under whatsoever form of words have been taken, we release to them and to each of them, and we will that they and their successors be in no way bound by the aforesaid oaths and promises and obligations made thereupon, nor held to their observance, and by reason of non-observance of this kind we will that they incur in no way the guilt of perjury or any note of infamy or penalty whatsoever.

17 § 6. And all and singular concordias, statutes, transactions, conventions, privileges, exemptions, letters and indults of this kind, even armed with whatsoever oaths, promises, bonds, cautions, obligations, renunciations and apostolic confirmations, and other safeguards and securities, even beyond the memory of men, from the longest and whatsoever time, even continuously observed, and introduced, granted, approved and even renewed many times from whatsoever causes, however great, most urgent and burdensome; which in any way contradict or are adverse to the aforesaid decrees of the council in this matter, as regards the correction, punishment and visitations aforesaid, the tenors, causes and effects of all of which we have present for expressed and inserted, by whatsoever formulas they may have been conceived, as well as strengthened by irritant and other decrees, we revoke, annul, declare null and void and abolish, abrogate, and evacuate of force and effect, and they are to be held as revoked, annulled, null and void, abolished, abrogated, and evacuated of force and effect, nor are they to be attended to any longer, nor to avail anyone, and still less to be expedited in any way thereupon in judgment or outside of judgment.

18 § 7. Moreover these present letters at no time and for no reason on account of the vice of subreption or obreption or nullity or defect of our intention or sufficient knowledge or any other defect whatsoever, and because the aforesaid litigants and others having or pretending to have interest in the aforesaid matters were not called to them, nor consented to them, or from any other cause, however legitimate and most just, are to be noted, impugned, retracted, invalidated, or even reduced to the terms of law on account of enormous or most enormous injury or any other pretext and color, or the matter revoked to controversy, or any remedy of law, fact or grace whatsoever to be obtained against them, or obtained by another or others, or even by our motion, knowledge and fullness of power similar ones to be granted to be used; nor are these same present letters to be comprehended under whatsoever revocations, suspensions, modifications, limitations or other contrary dispositions of similar or dissimilar graces, special or general, even by way of law, statute perpetual, contract, or constitution to be made by us and our successors the Roman Pontiffs and the aforesaid See or its legates at any time for the time being, or always excepted from them; and as often as those shall emanate, so often into the pristine and that state in which they were before in any way, restored, reposited and fully, even under the date to be chosen by the bishop aforesaid existing for the time being at any time, reintegrated, always valid and efficacious existing, and their full and complete effects to be produced and obtained, nor to be further derogated from by whatsoever apostolic letters, even any clauses, special or general, even derogatory of derogations, and more efficacious and unusual ones, as well as irritant and whatsoever other decrees, under whatsoever form and expression of words containing in themselves, nor to be deemed derogated, unless the whole tenor of those from word to word, nothing whatsoever omitted, shall have been inserted, and such derogations consistorially, with the counsel of the cardinals of the Holy Roman Church, and with prior cognition of the cause and mature deliberation had thereupon, made, and by three distinct and separate letters containing the same tenor, three distinct times, with as many intervals of time, to the bishop existing for the time being legitimately intimated and insinuated, and express assent of them shall have been obtained; and derogations made otherwise shall in no way avail.

19 § 8. And thus and in no other way in all and singular the aforesaid matters by whatsoever judges, whether secular, ordinary or delegated, even the aforesaid auditors, nuncios and cardinals, the faculty and authority of judging and interpreting in any other manner being taken away from them and from each of them, everywhere and in any cause and instance it ought to be judged and determined; and whatsoever otherwise concerning these matters, by whatsoever authority, knowingly or unknowingly, shall be attempted, we decree to be null and void.

20 § 9. Wherefore to our beloved sons and the Apostolic See's nuncio for the time being existing with the most Catholic king, and to our venerable brothers the bishops of Salamanca and Segovia, and their officials, with equal gentleness, knowledge and fullness of power, we command that they themselves, or two or one of them, by themselves or through another or others, these present letters and whatsoever is contained in them, where and when it shall be necessary, as many times as they shall be required on behalf of Peter the bishop and his aforesaid successors, solemnly publishing, and assisting them in the aforesaid matters with the protection of effective defense, shall cause these present letters of our authority and the matters contained in them to be inviolably observed by all to whom it pertains and shall pertain for the time being; and shall permit Peter the bishop and his aforesaid successors peacefully to enjoy and exercise these things, not permitting them or any of them to be molested, disturbed or disquieted in any way by the dean and chapter and canons and other such persons or any others whatsoever concerning this; and compelling any contradictors and rebels by sentences, censures and ecclesiastical penalties, and other appropriate remedies of law and fact, appeal being set aside; and also, legitimate processes being observed concerning these matters, aggravating the same sentences, censures and penalties even repeatedly, invoking also for this, if it be necessary, the aid of the secular arm.

21 § 10. Notwithstanding the aforesaid and the constitutions of Boniface, Pope VIII, likewise our predecessor, of one kind, and those issued in a general council of two kinds, provided that no one be drawn to judgment by authority of these presents beyond three days; and also, insofar as it be necessary, our constitution concerning not taking away acquired right, and other apostolic constitutions, and those issued in provincial and synodal councils, whether special or general; and also the aforesaid and other statutes of the same church, even confirmed by oath, apostolic confirmation, even from certain knowledge and with cognition of cause or any other firmness, customs, concordances, transactions and conventions, even observed from time immemorial, and penalties imposed in them against those not obeying; privileges also, indults and apostolic letters granted to the same church of Avila, and to its prelate, chapter and persons, under whatsoever tenors and forms, and with whatsoever, even derogatory clauses of derogatory clauses, and other more efficacious and unusual clauses, and also irritant and other decrees by the aforesaid and whatsoever other Roman Pontiffs our predecessors and ourselves and the said See, even by motion, knowledge and fullness of power similar, or also at the instance of the emperor, kings, queens, dukes and other princes, or their contemplation, regard, in general or in particular or otherwise in any manner whatsoever, even repeatedly, granted, approved and renewed, and to be granted, approved and renewed. All of which, even if, for their sufficient derogation, otherwise special, specific, express and individual mention of them and their whole tenors, and word for word, and not by general clauses importing the same, or any other expression, or some other exquisite form to be observed for this were required, these tenors, and as if word for word, nothing whatsoever being omitted, and the form transmitted in them being observed, inserted, we hold as sufficiently expressed in these presents, those otherwise remaining in their force, this time only, we specially and expressly derogate, notwithstanding anything to the contrary. Or if to the dean and chapter and canons and other aforesaid persons or any others commonly or severally it has been indulged by the same See that they cannot be interdicted, suspended or excommunicated by apostolic letters not making full and express and word for word mention of this indult.
