Testo inglese

There are declared to be no extension of royal prerogative, four propositions, and the rest enacted by the Clergy of France in and outside the assemblies in the year 1682*.

1 Alexander, Pope VIII, for perpetual memory of the matter.

2 Among the manifold cares of our pastoral office, by which we are continually pressed, we apply ourselves with particular study to this end, that the rights of the Apostolic See and of the universal Church, as well as of individual churches, may everywhere be kept safe and unimpaired, and that we may strive to vindicate them against whatever things by which any harm might be brought upon them, with the power divinely entrusted to us, as, all things having been maturely and duly weighed, we judge to be consonant with justice and reason in the Lord.

3 8 1. Since, therefore, the Most High, by the inscrutable mystery of His divine providence, has placed our humility in the highest seat of the militant Church, among all the matters which have presented themselves to our pontifical solicitude, those have been especially grave and most distressing to us—we who cherish in the bowels of charity our most beloved son in Christ, Louis, the Most Christian King of the French, and his flourishing kingdom—which have occurred either against the rights of the churches of that kingdom or against the authority of the Roman Pontiff and the universal Church, when certain venerable brothers, archbishops, bishops, and other ecclesiastical men of that same kingdom, gathered in the assembly of the French clergy at Paris in the year 1682, both gave their assent to the extension of that right which they call the regalia to all the churches of that kingdom, and subsequently brought forth a declaration containing four propositions concerning ecclesiastical power; and whatever mandates, arrests, confirmations, declarations, letters, edicts and decrees whatsoever followed from those assemblies, issued or published by any persons whatsoever, whether ecclesiastical or lay, exercising any authority and power, as well as whatever else in recent years in that kingdom has been done and perpetrated in any way prejudicial to this Apostolic See and the Roman Church, or to any other churches, monasteries and pious places, and to their respective persons, things, goods and rights, or otherwise to ecclesiastical jurisdiction or immunity or liberty: these matters we, who are constituted by the Lord as defenders of ecclesiastical rights on earth, have pondered day and night in the bitterness of our soul, and have lifted up our hands with tears and sighs to the Lord, beseeching Him with all the affection of our heart that He would stand by us with the aid of His mighty grace, so that we might healthfully execute the difficult parts of the apostolic office committed to us in this matter. And moved by this consideration, and lest we be accused of negligence in the administration entrusted to us when we render account to the supreme Judge of our stewardship, we have omitted nothing, insofar as divine goodness has granted, whereby the prejudicial matters aforesaid might be retracted from the heart by those very ones who perpetrated them. § 2. But in order that more effectively and abundantly provision may be made for the perpetual indemnity of the aforesaid See, the universal Church, and ecclesiastical jurisdiction and immunity and liberty, and of such churches, monasteries and pious places and their aforesaid persons, having heard very many of our venerable brothers the Cardinals of the Holy Roman Church, and certain masters in sacred theology, and also doctors in the decrees specially chosen by us to examine this matter, who have maturely discussed it and set forth the whole matter to us, wishing to provide according to the judgments which are granted to us from on high, and following in the footsteps of our predecessor of happy memory, Pope Innocent XI, who, on the occasion of responding to letters by which the aforesaid archbishops and other ecclesiastical men had informed him of the matters done by them, through certain letters in similar form issued as a Brief on 11 April 1682, disapproved, rescinded and annulled what had been done in those assemblies in the matter of the regalia, with all that followed therefrom, and whatever might subsequently have been attempted, and declared them perpetually null and void, and also regarding the aforesaid assemblies of the year 1682, both concerning the extension of the right of regalia and concerning the declaration on ecclesiastical power, and also all and singular mandates, arrests, confirmations, declarations, letters, edicts, decrees, issued or published by any authority whatsoever, whether ecclesiastical or even lay, and all other matters whatsoever prejudicial in any way to the aforesaid kingdom, done and perpetrated at any time and by any persons whatsoever and for any cause and in any manner, even requiring specific and individual mention and expression by necessity, their tenor and dates, even the more accurate ones, being held by us as fully and sufficiently expressed in these presents and inserted word for word and most exactly specified, by our own motion, and from certain knowledge and mature deliberation, and from the fullness of apostolic power, all and singular things which, both as regards the extension of the right of regalia and as regards the declaration on ecclesiastical power and the four propositions contained therein, were done and perpetrated in the aforesaid assemblies of the French Clergy held in the year 1682, with all and singular mandates, arrests, confirmations, declarations, letters, edicts, decrees, issued or published by any persons whatsoever, whether ecclesiastical or lay, howsoever qualified, exercising any authority and power, even requiring individual expression, as well as all other things whatsoever and of whatever kind, done and perpetrated in that kingdom in any way prejudicial to this Apostolic See and the Roman Church, or to ecclesiastical jurisdiction, immunity or liberty, or otherwise to churches, monasteries and their respective persons, things, goods, privileges, prerogatives and rights whatsoever, with all and singular things whatsoever and howsoever that have followed therefrom and shall follow at any time, we declare by the present to have been and to be null, void, invalid, empty, and utterly and entirely devoid of force and effect from the very beginning, and to be perpetually so, and that no one is bound to their observance or that of any of them, even if fortified by oath, nor has any right, action, or title, even colorable, or cause of possessing or prescribing, been or is acquired by anyone from them, even if possession of the longest and most immemorial time, even without any interruption or cessation, has followed or shall follow, and still less can it be acquired and belong at any time, nor do they make or have made any status, but rather, as if they had never been issued or done, they ought perpetually to be held as non-existent and not done, by the tenor of these presents we declare.
