A nessuno dunque... Se qualcuno però...

Testo inglese

1 Clement, bishop, servant of the servants of God, for perpetual memory of the matter. The pious desires of the faithful devotees, especially those which are seen to regard the increase of divine worship and religion, we willingly pursue with apostolic favor, and to them we impart benevolent assent. Indeed, a petition exhibited to us on behalf of our beloved sons Jacob, abbot, and the convent of the monastery of Cluny, of the diocese of Mâcon, contained that formerly of good memory Andrew, cardinal priest of the title of St. Marcellus, formerly abbot of the said monastery, providently considering that in the city of Avignon there was no monastery of black monks, and that it would be very fitting that the order of Cluny should have in the same city some monastery of the same monks, in which twelve monks continuously serving there in divine offices, and another twelve monks of the said order studying in canon law should exist, acquired certain lodgings and gardens, adjoining the great house of the abbot of the said monastery existing at that time in the said city, from goods bestowed upon him by God, so that the monastery itself might be constructed and also founded there, and from certain priories or other benefices of the said order, to be united to the same monastery, for the necessities of the same monks to be placed there and of servants necessary to them, and for supporting other burdens it should be endowed. Wherefore, on behalf of Jacob the abbot and the aforesaid convent, it was humbly supplicated to us, that we should erect the said house into a monastery of the said order, in honor and under the name of St. Martial, bishop and confessor, and establish and ordain that the house itself should henceforth be a monastery of the aforesaid order, in which twelve monks continuously serving the Lord, and another twelve monks of the said order studying in canon law should perpetually reside, and that there a church with a bell tower, bells, cemetery, houses and other necessary offices should be constructed and also built: and that the aforesaid be done more fittingly, and the same noble Jean de Cario, doctor and assessor, Bertrand Astouatidi, Bernard Richieri, Urtice Urtice and Louis Claverie shall be charged with the arrangements to be taken for the establishment of the classes and of the regents, as well as of their honorarium, jointly with monsignor the Cardinal of Nîmes, and that they shall make their report to the council on all of this before taking engagements.

2 UNIVERSITY OF AVIGNON.

3 the monks may be sustained more conveniently, to the same abbot, to unite and incorporate so many priories or other benefices of the said order to the same monastery, such that their fruits, revenues and proceeds may be worth annually one thousand florins of gold, we deigned to grant permission by apostolic benignity. We therefore, highly commending in the Lord the praiseworthy purpose of the said James the abbot and convent in this matter, inclined by these supplications, do by apostolic authority erect and establish the said house as a monastery, and under the name of the said St. Martial, and we also ordain that from now the said house shall be a monastery of the said order and shall be called the monastery of St. Martial, and shall depend upon the said monastery of Cluny, and shall be perpetually ruled and also governed by the monks of the same monastery of Cluny, according to the ordinance of the said James the abbot with the counsel of our venerable brother the archbishop of Arles, our chamberlain, to be made upon this matter. And that in the same newly erected monastery, the number of twelve monks continually serving the Lord therein and of another twelve monks studying in canon law shall perpetually be and exist. And that the same monastery thus erected and of this kind, and others, if perchance there shall be a greater number of monks dwelling in the same monastery for the time being, shall enjoy all the privileges, liberties and immunities, which other monasteries and also the monks of the said order enjoy and have been accustomed to enjoy. And that James the abbot and the aforesaid convent shall be bound to construct and cause to be constructed the church itself with bells, bell-towers, cemetery, houses and other offices aforesaid in the same monastery as is set forth erected, in a place however suitable and fitting for this; concerning which we grant them special power by the tenor of these presents. And moreover to the same James the abbot and convent, to bless and also to consecrate the church and cemetery itself, when they shall have been constructed, by some catholic bishop having the grace and communion of the apostolic see; and nevertheless to the same abbot, to establish and ordain, by the aforesaid authority, with the counsel of the said archbishop, by whom both the monastery itself shall be ruled and also governed, and to make statutes and ordinances which to the same abbot, with the counsel of the same archbishop, concerning the governance of this monastery of monks and its ministers shall seem salutary and also fitting, and also to unite and incorporate, by the aforesaid authority, with the counsel of the said archbishop, to the same monastery as is set forth erected, for bearing such necessities and other burdens, so many priories or other ecclesiastical benefices of the said order, that their fruits, revenues and proceeds do not exceed annually the value of one thousand florins of gold, of proper weight and measure, provided that such priories or benefices shall not have been conventual or of a conventual nature, even if they exist specially or generally reserved to apostolic disposition, with all rights and appurtenances thereof; provided however that, with the priors of the priories to be united as aforesaid ceasing or dying, and those obtaining the aforesaid benefices, it shall be lawful for him who shall preside over the same monastery as aforesaid erected for the time being, to apprehend and obtain corporeal possession of the priories and benefices themselves and to retain them perpetually, the license of the diocesans of those places and of any other not being required, and to perceive and have perpetually the fruits, revenues and proceeds of the priories and benefices themselves, and to convert them to his uses and those of the aforesaid monastery, and to the bearing of burdens and the sustenance of the same monks, and to dispose of them lawfully; notwithstanding any apostolic constitutions and statutes and customs of the aforesaid monastery and order contrary thereto, strengthened by oath, apostolic confirmation and any other firmness whatsoever, or if any persons shall have obtained special or general letters of the apostolic see or its legates concerning provisions to be made to them of such priories or other ecclesiastical benefices in those parts, even if proceedings shall have been had upon them to inhibition, reservation and decree or otherwise in any manner whatsoever; which letters indeed and proceedings had by the same concerning the priories and benefices themselves we will not extend, but no prejudice shall be generated to them thereby regarding the obtaining of other priories and benefices; and by any privileges, indulgences and apostolic letters, general or special, of whatever tenor they may be, by which the effect thereof may be hindered or deferred in any way by these not being expressed or wholly not inserted, and of which and of whose whole tenors special mention shall be had in our letters; provided that the priories and benefices themselves shall not be defrauded of due services, and the customary number of monks and ministers in the same shall in no way be diminished, and divine service shall be performed there laudably, we grant full and free faculty by the tenor of these presents. For we from now decree null and void, if otherwise concerning these things by anyone, by whatever authority, knowingly or unknowingly, it shall happen to be attempted. Let no one therefore... If anyone however...
