APOSTOLIC CONSTITUTION OF ST. GERMAIN ON THE DIVISION AND ERECTION OF THE DIOCESE OF GASPÉ. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER
1 Following diligently in the footsteps of Our Predecessors, and destined by the eternal Author of the Church, though unworthy, to govern the Catholic Church, We wish to direct all Our care and solicitude to those matters which We know in the Lord to be more profitable to the better good and salvation of souls.
2 Since therefore the diocese of St. Germain extends very widely in its territorial circumscription and its eastern extremity, which stretches into the Gulf of St. Lawrence, is separated by excessive distance from the episcopal city, it has been repeatedly and earnestly petitioned of the Apostolic See that the aforesaid part of the territory be separated from the same diocese and erected into a new diocese.
3 Wherefore, having obtained, insofar as it is necessary, the consent of those whose concern it is or who presume their concern to be involved, We, from the fullness of Apostolic power, divide the existing diocese of St. Germain into two parts and, reserving the western part to the old diocese of St. Germain, We erect and establish the eastern part into a new and distinct diocese, to be named Gaspé; and We determine that it shall comprise two civil counties called Gaspé and Bonaventure, excepting however five districts which constitute the western part of the county of Bonaventure, namely Assametquaghan, Restigouche, Milmikëk, Métapédia and Patapédia. As regards the newly erected diocese, We establish the episcopal see and cathedral in the town of Gaspé, which We therefore raise to the rank of an episcopal city, granting to it all the privileges and rights which other episcopal cities enjoy by common law, and at the same time We elevate the church of the aforesaid town, which shall remain parochial as before and under the same invocation, to the dignity of a pro-cathedral until other circumstances require otherwise; granting power to the Bishop to appoint diocesan Consultors according to the norm of Book II, Title VIII, Chapter VI of the Code of Canon Law. As regards the endowment, We assign to this diocese of Gaspé all goods and revenues, even those accruing by any means to the episcopal table, and We grant to the Bishop for the time being the faculty of imposing a cathedraticum and of establishing other things according to the sacred canons, at his prudent discretion, by which the necessities of the diocese may be properly provided for.
4 We command moreover that, as regards the governance of the diocese during a vacant see, and the rights and duties of clergy and faithful, and also the erection of a minor Seminary and other such matters, those things which the same Code of Canon Law prescribes shall be duly observed, provided however that the students of the Seminary be sent to some larger Seminary for studies in philosophy and sacred theology.
5 We further command that all documents and acts which concern the new diocese and its clergy and faithful be transferred as soon as possible from the episcopal chancery of St. Germain to the diocesan curia of Gaspé so that they may be carefully preserved in its archive. Furthermore, We assign and attribute the diocese of Gaspé as a suffragan see to the metropolitan Church of Quebec, with power reserved to Us and the Apostolic See to freely make a new circumscription and designation, should this seem expedient in the Lord.
6 Until however the diocese of Gaspé is provided with its own Pastor, We commit its governance to Our venerable brother the Bishop of St. Germain, as Apostolic Administrator, with all the faculties which pertain to this office.
7 Those things which by these Letters, by Apostolic authority, have been decreed by Us, it is permitted to no one at any time to infringe, or to act contrary to them, or in any way to oppose them. If anyone, which God forbid, shall presume to attempt this, let him know that he will incur the penalties established by the sacred canons against those who resist the exercise of ecclesiastical jurisdiction.
8 For the execution of all these things We appoint Our beloved son Louis Nazarius, by title of the SS. Four Crowned Martyrs of the City, Cardinal of the Holy Roman Church Bégin, the present Archbishop of Quebec, and We grant to him the necessary faculties for this business, even to subdelegate another man constituted in ecclesiastical dignity and to pronounce a definitive sentence concerning any difficulty or opposition that may arise; imposing upon him the burden of transmitting to the Sacred Consistorial Congregation within six months an authentic copy of the complete execution of this Our mandate.
9 We decree finally that these present Letters shall be valid, notwithstanding any contrary provisions, even those worthy of special and express mention.
10 Given at Rome at St. Peter's, in the year of Our Lord one thousand nine hundred twenty-two, on the fifth day of the month of May, in the first year of Our Pontificate.
