Providas Romanorum
4 Poiché però, come abbiamo appreso, alcuni non hanno dubitato di asserire e di proclamare pubblicamente che la suddetta pena di scomunica imposta dal Nostro predecessore come sopra detto non ha più effetto, per il motivo che la medesima costituzione qui sopra riportata non è stata da Noi confermata, quasi che per la sussistenza delle costituzioni apostoliche emanate da un predecessore fosse richiesta l'espressa conferma del Pontefice successore;

4 Cum autem sicut accepimus aliqui fuerint qui asserere, ac vulgo jactare non dubitaverint dictam excommunicationis pcenam a praedecessore Nostro ut praefertur impositam non amplius afficeie, propterea quod ipsa praeinserta constitutio a Nobis confirmata non fuerit, quasi vero pro apostolicarum constitutionum a praedecessore editarum subsistentia Pontificis successoris expressa confirmatio requiratur;

25 cap. 20, multoque antea egregie declaraverat imperator Carolus Magnus suorum Capitularium tit. I, cap.

BENEDICT, BISHOP, SERVANT OF THE SERVANTS OF GOD.
1 For perpetual remembrance of the matter.
2 We deem it fitting to strengthen and confirm with new protection of Our authority not only those laws and decrees of Our predecessors, the Roman Pontiffs, whose force We fear may be weakened or extinguished by the lapse of time or the neglect of men, but also those which retain recent force and full vigor, when just and grave causes require it.
3 Indeed, Our predecessor of happy memory, Pope Clement XII, by his Apostolic Letters given in the year of Our Lord's Incarnation one thousand seven hundred and thirty-eight, on the fourth day before the Kalends of May, in the eighth year of his Pontificate, and addressed to all the Christian faithful, whose beginning is In eminenti, did perpetually condemn and prohibit certain societies, assemblies, conventicles, collections, gatherings or aggregations commonly called Freemasons or Francs-Maçons, or otherwise named in certain regions, which were then widely diffused and growing daily, commanding all and each of the Christian faithful under pain of excommunication incurred ipso facto without any declaration, from which no one could be absolved by another save by the Roman Pontiff existing at the time, except at the point of death, that no one should dare or presume to enter into, propagate, or foster such societies, receive, conceal, or be inscribed in, aggregated to, or attend them, or otherwise as is more fully and amply contained in the same Letters, whose tenor is as follows, namely, etc., etc.
4 But since, as We have learned, there have been some who have not hesitated to assert and publicly claim that the aforesaid penalty of excommunication imposed by Our predecessor as aforesaid no longer affects them, for the reason that the aforementioned constitution was not confirmed by Us, as if indeed the express confirmation of a successor Pontiff were required for the subsistence of apostolic constitutions issued by a predecessor;
5 And since also it has been intimated to Us by certain pious and God-fearing men that in order to remove all the subterfuges of those who calumniate and to declare the uniformity of Our mind with the mind and will of that same predecessor, it would be greatly expedient that We should add new support of Our confirmation to the constitution of that same predecessor: We, although hitherto while to many Christian faithful who had truly violated the laws of that same constitution, being penitent and sorrowful, and professing from their hearts that they would completely withdraw from the condemned societies or conventicles and never return to them in the future, We have benignly granted absolution from the incurred excommunication both often before and especially in the past jubilee year, or while We have communicated to the penitentiaries appointed by Us the faculty that they might impart the same absolution in Our name and authority to such penitents who had recourse to them, and while We have not ceased to press forward with solicitous vigilance of care that proceedings be taken by competent judges and tribunals against the violators of that same constitution according to the measure of the offense, which has indeed often been done by them in reality, have given not merely probable but plainly evident and indubitable proofs, from which the sense of Our mind and firm and deliberate will regarding the vigor and subsistence of the censure imposed by the said Clement, Our predecessor, as aforesaid, ought to be sufficiently clearly inferred; and if any contrary opinion concerning Us should be circulated, We can securely despise it and leave Our cause to the just judgment of God almighty, using those words which is known to have been recited of old in sacred rites: "Grant, we beseech Thee, O Lord, that we care not for the reproach of reprobate minds, but trampling upon that same depravity we beseech that Thou suffer us neither to be terrified by unjust lacerations nor to be entangled in captious flatteries, but rather to love what Thou commandest:" as the ancient Missal has it, which is attributed to our predecessor St. Gelasius, and was edited by the venerable servant of God Joseph Mary Cardinal Thomasius in the Mass which is inscribed:
6 Against the Disobedient. However, lest anything might be said to have been passed over by Us without due consideration, by which We might easily furnish fuel to mendacious calumnies and close the mouths of the wicked, having first heard the counsel of certain of Our Venerable Brethren, Cardinals of the Holy Roman Church, We have decreed to confirm by these presents the same constitution of Our predecessor, inserted above word for word as aforesaid in specific form, which is held to be of the broadest and most efficacious kind, just as We do confirm, strengthen and renew it by the tenor of these present Letters from certain knowledge and the fullness of Our apostolic authority in all things and through all things, as if it had been first issued by Our own motion, authority and name, and We will and decree that it shall have perpetual force and efficacy. "Moreover, among the gravest causes of the aforesaid prohibition and condemnation set forth in the constitution inserted above, one is that in such societies and conventicles of whatsoever religion and sect men associate with one another, from which it is sufficiently evident how great a harm might be inflicted upon the purity of the Catholic religion. Another is the close and impenetrable bond of secrecy by which those things which are done in such conventicles are concealed, to which therefore that opinion may rightly be applied which Caecilius Natalis brought forward in Minucius Felix in a matter indeed of a different kind: — Honest things always rejoice in public; crimes are secret. — A third is the oath by which they bind themselves to keep such secrecy inviolably, as if it were lawful for anyone to shield himself from the obligation of a promise or oath lest, when interrogated by legitimate authority, he be bound to confess all things whatsoever are inquired into in order to ascertain whether anything be done in such conventicles which is contrary to religion or to the state of the commonwealth and its laws. A fourth is that such societies are known to be opposed no less by civil than by canonical sanctions, namely, since by civil law all colleges and associations formed without public authority are prohibited, as may be seen in the Pandects, book XLVII, title 22, concerning illicit colleges and corporations, and in the celebrated letter of C. Pliny Caecilius Secundus, which is number XCVII, book X, in which he says that by his edict, according to the commands of the emperor, it was forbidden that there be associations, that is, that societies and assemblies be held and maintained without the authority of the prince. A fifth is that already in many regions the aforesaid societies and associations of lay persons have been proscribed and eliminated by the laws of princes. Finally, the last is that among prudent and upright men the same societies and associations are held in ill repute, and by their judgment whosoever gives his name to them incurs the mark of depravity and perversion.
7 Finally, that same predecessor in the aforesaid constitution exhorts Bishops and superior Prelates, and other Ordinaries of places, that for its execution, if need be, they do not fail to invoke the aid of the secular arm.
8 "All and each of these things are not only approved and confirmed by Us, and respectively commended and enjoined upon the same ecclesiastical Superiors, but We ourselves also, in fulfillment of Our apostolic solicitude, by means of these present Letters invoke and earnestly require the aid and assistance of Catholic princes and all secular powers for the accomplishment of the aforesaid matters, since they themselves, as supreme princes and powers, are chosen by God as defenders of the faith and protectors of the Church, and therefore it is their duty to ensure by every suitable means that due obedience and complete observance be rendered to apostolic constitutions, which the Fathers of the Council of Trent recalled to their memory in sess. 25 cap. 20, and which the Emperor Charlemagne had declared most excellently long before in his Capitularies tit. I, cap. 2, where, after commanding all his subjects to observe ecclesiastical sanctions, he added these words: — For in no way can we acknowledge that they can be faithful to us, who have appeared unfaithful to God and disobedient to His priests. — Wherefore, enjoining upon all the governors and ministers of his dominions that they compel all and each to render due obedience to the laws of the Church, he also imposed the gravest penalties against those who should neglect to do this, adding among other things: — But those who in these matters (God forbid!) shall be found negligent and disobedient to them, let them know that they shall retain neither honors in our empire, even though they be our sons, nor place in the palace, nor any society or community with us or with ours, but rather shall suffer punishment under strict and harsh discipline."
9 We will, moreover, that to the same transcripts of these present letters, even when printed, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given entirely as would be given to the original letters themselves, if they were exhibited or shown. Let it therefore be lawful for no one to infringe this page of Our confirmation, renewal, approbation, commission, invocation, requisition, decree and will, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
10 Given at Rome at St. Mary Major, in the year of Our Lord's Incarnation one thousand seven hundred and fifty-one, on the fifteenth day before the Kalends of April, in the eleventh year of Our Pontificate.
