ON THE OFFICE
of the Writers of the Sacred Apostolic Penitentiary.
BENEDICT POPE XIV.
By Motu Proprio Thus,
1 ALTHOUGH from the year of the Incarnation of the Lord one thousand six hundred and forty-four, on the Ides of April, Apostolic Letters under Lead have been issued by Us, whose beginning is: Apostolicae Poenitentiariae Officio, and which have been printed in Our Bullarium, Vol. II, no. XCVI, and in them Laws and Ordinances have been providently established by Us to be observed by all Officials and Ministers of the Office of the Penitentiary, and namely by its Procurators or Secretaries, and by Writers both ordinary and extraordinary; yet since We have judged that something pertaining to the Offices of such Ministers ought still to be added, to fulfill the duties of Our Apostolic ministry with equal diligence and by similar Motu Proprio, etc.; We have decreed to approve and confirm anew all and each of the matters disposed and contained in the aforesaid Our Letters and also in others given on the same day concerning the faculties of the Major Penitentiary and of the Office of the Penitentiary itself, beginning Pastor Bonus, and printed in Our aforesaid Bullarium, Vol. II, no. XCVII, and to issue and establish these further mandates, and to strengthen them by the force of the present Schedule; which Schedule We order to be preserved in the Archive of the Penitentiary itself for perpetual memory of the matter. Commanding Our beloved Son Joachim, of the Title of the Holy Cross in Jerusalem, Presbyter of this Holy Roman Church, Cardinal by Our election and appointment of this day, Major Penitentiary, and his Successors for the time being, that acting according to its tenor and content, they shall henceforth observe exactly Our will in these matters, and shall cause it to be observed inviolably and with effect by others to whom it pertains. —— Indeed, since among other duties and offices committed and entrusted to Us formerly when in minor orders by Our Roman Pontiff Predecessors, We also exercised that of Doctor of Decrees in the aforesaid Office of the Apostolic Penitentiary for many years, from that very use and experience We have sufficiently ascertained how great is the importance of the Office of Procurator or Secretary of the same Penitentiary, and how impossible it is for anyone to become a suitable Procurator or Secretary who has not previously served long in the Office of Writer; since for acquiring the necessary skill in such a Procurator, it is by no means sufficient to have acquired knowledge of Canon Law or even of Moral Theology, but it is altogether necessary to be versed in the style and practice of the Office of the Penitentiary itself; which can only be obtained from long exercise in the duty of Writer, whether ordinary or extraordinary, unless
2 . Wherefore, since it has come to Our knowledge from certain trustworthy reports that there are some who, devoted to the private service of others, aspire to the offices of such Writers, whether ordinary or extraordinary, or otherwise having been admitted to them, thereafter contend to retain them; whence it happens or can happen that these men, occupied in the service of others, are by no means able to provide the due assistance to the Apostolic Penitentiary Procurators or Secretaries; and that they themselves, however perhaps endowed with excellent gifts of mind, never become apt and experienced Writers; and consequently, if ever they were to be promoted to the offices of Procurators, could be found far less capable and suitable for exercising them; with public inconvenience and grave detriment to souls resorting to the Penitentiary Office being observed, since the expeditions of that Office, entrusted to such Writers devoted to alien service, are improperly protracted, and often fail in time of greater necessity. — [Hence it is] that We, moved by these and other just causes affecting Our mind, to the aforesaid Joachim, Presbyter Cardinal, and to his Successors in the aforesaid Office of Major Penitentiary in perpetuity, do strictly command that henceforth they select or admit no one to such offices of Writers, whether ordinary or extraordinary, who is known to be devoted to the assiduous service of any person whatsoever of any rank, order, or dignity, even to be individually specified by name, or to be continuously occupied in the exercise of another Office or duty; willing that if anyone be found at present among such Ministers of the Penitentiary bound by the tie of alien service or incompatible Office, he shall indeed by no means be expunged from the Catalogue of such Ministers; yet during such tie he shall not be able to be promoted to the higher ministries of the same Penitentiary. Moreover in Our aforesaid Bulls, which We have issued concerning the Officials of the Apostolic Penitentiary and their duties, adhering to the older Constitutions of Our Predecessors, We have willingly established that both the offices of Procurators and of ordinary Writers shall always be conferred after previous competition, decreeing that all such conferrals of offices, which might perhaps be made otherwise, even by the Roman Pontiff himself, shall be null and void: which indeed was established by the aforesaid Predecessors and by Us for no other reason than that such duties and offices be conferred, as far as is fitting, upon worthier and more suitable persons; Wherefore to all to whom it pertains, or shall pertain in the future, to interpose their judgment in such competitions, again and again do We strictly enjoin that, having regard to no consideration of offices or recommendations, according only to the greater suitability of persons, they cast the prerogative of their votes: And to the Cardinal himself, Major Penitentiary, and to his Successors, do We command that they bind the extraordinary Writers by express law that they do not fail frequently to be present to the Procurators or Secretaries; so that they may become most skilled in the practice and style of the Penitentiary; knowing that they are not to be admitted in any way to future competitions in vacancies of ordinary Writers or Procurators or Secretaries, nor to any ordinary subsidy, or otherwise, unless, having given proof of the assiduity enjoined upon them and legitimate testimonies to the Major Penitentiary existing at the time, they be also to be dismissed from these offices if, after they have been admonished once and again concerning the frequenting of the Procurators' Offices as aforesaid, they shall still have contemned this command of Ours. And finally, after they have been admitted by competition, as is premitted above, to the duty of ordinary Writer, they are not to be exempt from the burden of visiting the Procurators not rarely, both for preserving and for advancing acquired skill. We do not, however, will that these Our aforesaid ordinances shall be binding unless such
3 Let it be done P.
4 We will that both Our aforesaid Letters and the present Schedule of Our Motu proprio, with all and singular things contained in them, be always and perpetually firm, valid, and effective, and be inviolably observed by all and singular to whom it pertains, with faculty removed from anyone, even from the Major Penitentiaries existing at the time, to ordain otherwise, and to interpret or dispense; Notwithstanding all those things which in Our said Letters We have decreed not to stand in the way; and all other things contrary whatsoever.
