POPE PIUS XI APOSTOLIC CONSTITUTION ON THE PONTIFICAL NEPOMUCENE COLLEGE IN THE CITY PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER
1 As soon as the Czechoslovak Republic was established, it seemed fitting and appropriate to extend to all its dioceses that benefit which Our Predecessor, Pope Leo XIII of happy memory, had already granted to the dioceses of Bohemia through the Apostolic Letters Vicariam potestatem, issued on the first day of January in the year one thousand eight hundred and ninety, by which he founded a College of Bohemian clergy in the City, so that it was permitted to all dioceses of the new republic to send to this beloved City of Ours students distinguished indeed in piety and talent, who, under the very eyes of the Vicar of Christ and in the sight of so many sacred monuments, might apply themselves to ecclesiastical disciplines. Now, since the house situated in the City on the Sixtine Way, which Our Predecessor himself had assigned to the Bohemian College, was not sufficiently suitable for accomplishing this purpose, it was decided to construct more spacious buildings, which would better meet the needs of the times. Wherefore, a broad and most healthful area, not far distant from Our most holy Patriarchal Basilica of the Lateran, was purchased at the expense of the Apostolic See, and a new building was happily erected from its foundations there, constructed partly from Our own resources and from funds offered by the sacred Bishops of Czechoslovakia and the Rulers of the Republic and also by the Christian faithful dwelling in America, and partly from the proceeds of the sale of the old buildings of the Bohemian College and the adjoining houses. Now that the new buildings have been solemnly dedicated, wishing to give to this dwelling place of sacred studies a juridical constitution suited to the changed circumstances of affairs, with the consent of those concerned or of those who presume their interest to be involved, having consulted the venerable assembly of Our Brothers, the Cardinals of the Sacred Congregation for Seminaries and Universities, We derogate, insofar as it is necessary, from the Apostolic Letters Vicariam potestatem mentioned above, by Our supreme authority, and We establish and decree what follows:
2 I. This Institute of clergy, with the name of Bohemian College removed, We will and command that it be called henceforth the Pontifical Nepomucene College, after that most holy man John, who is indeed the glory of the sacred order and the honor of his country; and it shall henceforth receive as students those distinguished in piety and talent, whom the venerable Bishops of the Czechoslovak Republic, Our Brothers, shall send from their own dioceses to Rome, to be instructed there in ecclesiastical disciplines.
3 II. To this Pontifical Nepomucene College We grant all rights and privileges, and We assign to it the possession of movable and immovable goods and their revenues, which the Bohemian College enjoyed, with their nature and purpose religiously preserved; likewise, all offices, burdens, and obligations hitherto attached to the Bohemian College, We will and command to be henceforth discharged by the Nepomucene College.
4 III. The new building mentioned above, constructed on the street commonly called Concordia, near the street called Magna Grecia, together with the adjoining land, We assign as its own to the Pontifical Nepomucene College, as the seat of the Institute.
5 IV. The sacred Bishops of Czechoslovakia shall individually have the same rights and the same offices in the College and shall all consult for it to the best of their ability.
6 V. The Rector of the College shall be appointed by the Supreme Pontiff through the Sacred Congregation for Seminaries and Universities; and he shall exercise the office of pastor in the College, and by that very fact shall be the procurator of the Archbishops and Bishops of the Czechoslovak Republic.
7 VI. The College shall be under the right and power of the same Sacred Congregation for Seminaries, and therefore shall be governed by the laws enacted by it.
8 VII. If for any reason the Pontifical Nepomucene College shall cease to exist, all its possessions, movable and immovable goods, monies, revenues, and other such things shall devolve to the Holy See, so that, as far as it shall be possible, they may be expended for the ecclesiastical education and instruction of students from the dioceses which the Czechoslovak Republic now comprises. We will finally that to copies of these Letters, even if printed, yet subscribed by the hand of some notary public, and furnished with the seal of some man constituted in ecclesiastical dignity or office, the same faith shall be given as would be given to these Letters themselves, if they were exhibited or shown.
9 All things which We have established, decreed, enacted, and commanded through this Our Constitution, We will to remain ratified and firm by Our authority, and We command this, notwithstanding anything whatsoever, even those worthy of special mention.
10 Given at Rome at St. Peter's, in the year of Our Lord one thousand nine hundred and thirty, on the twenty-third day of the month of April, on the feast of St. Adalbert, Bishop and Martyr, in the ninth year of Our Pontificate.
