11 § 8. Vogliamo inoltre che ai transunti delle presenti lettere, anche stampati, sottoscritti dalla mano di qualche notaio pubblico e muniti del sigillo di qualche persona costituita in dignità ecclesiastica, sia prestata ovunque in giudizio e fuori la medesima fede che sarebbe prestata alle presenti, se fossero esibite o mostrate;

Dat. die 30 augusti 1622, pontif. an. ii.

Testo inglese

Pius IV issued his aforesaid Constitution from above.
Confirmation and amplification of the constitution of Pius IV issued against priests in sacramental confessions soliciting penitents to shameful acts by Gregory, Pope XV, for perpetual memory of the matter.

1 We, although unworthy, bearing by heavenly disposition the care of all the Lord's flock, are bound to watch over it carefully, so that it may be kept safe from all wicked contagions, and with much greater diligence to provide that all pestilence be turned away from those to whom the office of healing others has been entrusted, lest, as the evangelical writings admonish us, salt that has lost its savour be that wherewith it shall be salted, and it profiteth to nothing, but to be cast out and trodden under foot by men.

2 § 1. Since, however, by the Roman Pontiffs, our predecessors, provision has been made in certain places, that the impious and nefarious crime, which not only ought not to exist among the Christian faithful, but ought not even to be named, be kept far from them, namely, that some priest, appointed to hear sacred confessions, should abuse the most holy Sacrament of Penance by soliciting penitents to shameful acts, and should offer poison instead of medicine, a serpent instead of bread, and from a heavenly physician become an infernal poisoner, from a spiritual father an execrable betrayer of souls; therefore we have deemed it necessary to provide, so far as is granted from on high, that those things which have been salutarily established in certain places for warding off these most pernicious snares of the devil be desired nowhere.

3 § 2. For indeed letters of the following tenor were formerly issued by Pius, Pope IV, our predecessor of happy memory, namely: Pius, Pope IV, to the Venerable brother the Archbishop of Seville, Inquisitor General of heretical depravity in the kingdoms of Spain. [[fn:This Constitution of Pius IV is XXXVII Cum, sicut nuper (in this new edition XL, in vol. VII, page 126). Bull. Rom. — Vol. XII.]] Since recently, etc. (The remainder is omitted, because the cited constitution itself can be read in the note to the rubric).

4 § 3. Therefore, so that the aforesaid letters may be inviolably observed by me and by future Pontiffs in all places and at all times, by our own motion and from certain knowledge, and by mature deliberation of ours, and by the counsel of the venerable brothers our cardinals of the Holy Roman Church, Inquisitors General against heretical depravity, we, by apostolic authority, by the tenor of the present, approve and confirm the aforesaid letters and all and singular things contained in them, and we add to them all and singular the strength of inviolable apostolic firmness, and we command and order that they be firmly and inviolably observed not only in the aforesaid kingdoms of Spain, but in whatsoever parts of the Christian world.

5 § 4. And furthermore, so that in the future there may be no doubt concerning the penalties to be imposed on those delinquent in this matter, and concerning the manner of proceeding against the same, we establish, decree and declare, that all and singular priests, both secular and of whatsoever Orders, institutions, societies and congregations, even in any way exempt and immediately subject to the Apostolic See, regulars, of whatsoever dignity and pre-eminence, or furnished with any privilege, who shall have solicited or attempted to provoke persons, whosoever they may be, to indecent acts, whether among themselves or with others in any manner whatsoever, in the act of sacramental confession, or before or immediately after, or on the occasion or pretext of such confession, even if the confession itself did not follow, or outside the occasion of confession in the confessional or in any place whatsoever where sacramental confessions are heard or chosen for hearing confession, feigning to hear confessions there, or who shall have had with them illicit and indecent conversations or dealings, shall be punished most severely in the office of holy inquisition, as follows. And moreover we appoint all Inquisitors of heretical depravity and the Ordinaries of places of all kingdoms, provinces, cities, dominions, and places of the whole Christian world, in their respective dioceses and territories, by these our letters, even exclusively with regard to all others, specially and perpetually as judges delegated, so that concerning these matters they may diligently inquire and proceed against the aforesaid, jointly or separately, in all respects as in matters of faith (according to the form of the canons, as well as the constitutions, privileges, customs and decrees of such inquisition office); and those whom they shall find culpable in any of such nefarious excesses, they shall decree against them, according to the quality of the crimes and circumstances, penalties of suspension from office, deprivation of benefices, dignities and offices whatsoever, and perpetual incapacity for them, as well as of active and passive voice, if they be regulars, exile, condemnation to the galleys and prisons even in perpetuity, without any hope of pardon, and those also, if for the enormity of the crime they deserve graver penalties, after due degradation, they shall deliver to the secular court to be punished.

6 § 5. We also grant authority to our venerable Cardinals of the Holy Roman Church, general inquisitors, so that so enormous a crime, and one so pernicious to the Church of God, may not remain unpunished on account of a defect of proofs, since proof is difficult, with even singular witnesses concurring, presumptions, indications and other aids, to determine by their judgment that the crime has been proved, and to pronounce that the guilty party is to be delivered to the secular court, as aforesaid.

7 § 6. Notwithstanding all things which the aforesaid predecessor in his aforesaid letters willed not to hinder, and all other things contrary to these in any way whatsoever.

8 1 Erroneously edited. Main. reads officio (r. t.). Authority concerning proofs and penalties is granted to the Cardinals, inquisitors general.

9 Obstantia Colliguntur.

10 § 7. We command all confessors that they admonish their penitents, whom they know to have been solicited by others as aforesaid, concerning the obligation of denouncing those who solicit, namely, as aforesaid, to the inquisitors or the Ordinaries of the places aforesaid: and if they neglect this duty, or teach their penitents that they are not bound to denounce confessors who solicit or deal as aforesaid, the same Ordinaries of the places and inquisitors shall not neglect to punish them according to the measure of their fault.

11 § 8. We will, moreover, that copies of these letters, even printed ones, subscribed by the hand of some public notary and furnished with the seal of some person constituted in ecclesiastical dignity, shall have the same force everywhere in judicial proceedings and outside them as these letters would have if they were exhibited or shown;

12 § 9. And that these same letters, or copies thereof, affixed to the doors of the basilicas of St. John Lateran and of the Prince of the Apostles in the City and in the square of the Campus Florae, shall bind and affect all just as if they had been intimated to each one personally. Given at Rome, at St. Mary Major, under the Fisherman's Ring on the 30th day of August 1622, in the second year of our pontificate. Given on 30 August 1622, pontifical year ii.
