MONALDO da CAPODISTRIA. - Canon lawyer, who was certainly a member of the Franciscan Order, died at Capodistria before 1285.
Only scant information remains about him; indeed, he has often been confused with his namesake Monaldo da Ancona or Monaldo Beneventano. In the Order he held various offices and was provincial of Dalmatia. He was the author, among other things, of several sermons, developed with doctrinal apparatus and resembling brief treatises on each individual subject. His best-known work, printed at Lyons in 1516, is commonly called the Summa Monaldina, written around 1274. It has also been called the Summa dorata (perutilis atque aurea) and was formerly confused with a Summa casuum conscientiae, but was generally called Summa iuris canonici, because of its continual references to the Decretali and to legal principles. It has not yet been scientifically established that the work is by this author, but this is highly probable.
