BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 The office of the Apostolate committed by divine providence to the Supreme Pontiff demands that He diligently undertake those things which tend toward the increase of the Catholic name and the proven welfare of the Christian people. Moreover, since the Venerable Brother, the Bishop of Goiás in Brazil, has earnestly petitioned that a new diocese be erected for the greater good of souls through the division of the diocese committed to him, and since the Apostolic Nuncio in the Brazilian Republic has commended this petition, We have deemed it fitting to receive the offered prayers with favor. Wherefore, having consulted with the Venerable Brothers Our Cardinals of the Holy Roman Church of the Sacred Consistorial Congregation, using the power reserved to the Roman Pontiff and the Apostolic See in Apostolic letters under lead, whose beginning is Ad universas orbis Ecclesias, given on the third day before the Kalends of May in the year of the Incarnation of Our Lord one thousand eight hundred and ninety-two, We freely decree that a new circumscription of dioceses in Brazil is to be established whenever it shall seem expedient in the Lord, and moreover, supplying, insofar as it may be necessary, the consent of those to whom it pertains or who may presume their interest to be involved, that the diocese of Goiás is to be divided into two parts and a new diocese is to be constituted from its northern part in the manner which follows.

2 All therefore the territory situated to the north of the diocese of Goiás, comprising the following fourteen parishes: the Blessed Virgin Mary of Graces in Porto Nacional, the Blessed Virgin Mary Immaculately Conceived in Boa Vista de Tocantins, St. Peter in Pedro Affonso, the Blessed Virgin Mary of the Canoe, the Holy Spirit of the Fish, St. Anne of the Plateau, the Blessed Virgin Mary of the Nativity, St. Michael and Souls, St. Joseph of the Duro, St. Mary of Taguatinga, the Blessed Virgin Mary of the Conception, St. John the Baptist of the Palm, the Blessed Virgin Mary of Remedies in Arrayas and St. Anthony of the Hat, We, from the fullness of apostolic power, do withdraw and separate from the diocese of Goiás and erect into a distinct diocese in perpetuity and declare erected the diocese to be named Porto Nacional.

3 Moreover, the new diocese of Porto Nacional shall be contained within the following boundaries: to the north by the civil boundaries between the State of Goiás and the States of Maranhão and Pará; to the east by the civil boundaries between the State of Goiás and the States of Maranhão, Piauí and Bahia; to the west by the civil boundaries between the State of Goiás and the States of Pará and Mato Grosso; to the south by the northern boundaries of the parishes commonly called St. Dominic, Flores, Nova Roma, Cavalcanti and Amaro Leite, from which the new diocese is separated from the diocese of Goiás, to which the aforesaid parishes belong. The diocese of Porto Nacional thus circumscribed by boundaries, We establish the episcopal see and cathedral in the city commonly called Porto Nacional, from which the diocese itself takes its name, and We therefore raise it to the rank and dignity of an episcopal city with all the rights and privileges which other episcopal cities enjoy and possess by common law; and the church existing there and dedicated to the Blessed Virgin Mary of Graces, under the same title and invocation and preserving the same parochial character with the care of souls to be exercised as before, We raise and exalt to the status and dignity of a Cathedral, after previous liturgical consecration; and at the same time We grant to it and to its Bishops for the time being the honors, insignia, favors, graces, privileges and rights which other Cathedral Churches in Latin America and their Prelates possess and enjoy both from common law and from legitimate custom, yet not from the title of a burdensome obligation or special indult. Moreover, We assign to the house existing there, which is to be repaired as soon as possible, to serve as the residence of the Bishop of Porto Nacional.

4 As for buildings for the ecclesiastical Curia, the diocesan Seminary, and likewise for the diocesan patrimony to be established in a stable manner, We most earnestly commend this, so that it may be accomplished more quickly, to the generosity of the faithful and to the zeal and industry of the new Bishop. We constitute this diocese thus erected as suffragan to the Metropolitan Church of Mariana, until otherwise provided, and We subject its Bishop and his successors in office to the metropolitan authority of the same Archbishop of Mariana. Moreover, those things which are arranged to be established in the aforesaid Apostolic Letters under lead, given on the fifth day before the Kalends of May in the year of Our Lord's Incarnation one thousand eight hundred and ninety-two, concerning the honors, graces, privileges, indults, favors, endowment of new dioceses in the Brazilian region and concerning the power, authority, attributions, and taxation of new Bishops; likewise concerning the institution, governance and administration of the Cathedral Chapter or at least a College of Consultors and Seminary, concerning the election of a Vicar Capitular or Administrator during a vacant see, concerning the rights and duties of the clergy themselves and of the Christian faithful, concerning the delivery of documents and other such matters, all are to be carefully observed according to the path of the sacred Canons and especially of the Council of Trent, insofar as they pertain to the newly erected diocese of Port National. Furthermore, so that the Bishops of this new diocese and their successors may be able to protect the dignity of their office and provide for the sustenance of the clergy and meet the expenses of divine worship and other necessities of the diocese, We in perpetuity assign and attribute to the new episcopal see the emoluments of the ecclesiastical Curia, the revenues established by common law or legitimate custom, and the other offerings of the faithful for whose spiritual good this new diocese has been erected. Since, however, there exists in the City the Pius Latin-American College, in which chosen preachers of the Gospel and rectors of souls are trained under the very eyes of the Roman Pontiffs, We command that, just as from the other dioceses of Latin America according to those things which were decreed in the plenary council of Latin America celebrated at Rome in the year one thousand eight hundred and ninety-nine, so also from now on from the newly founded diocese of Port National and at its expense, as soon as it can be done, at least two chosen young men be sent hither, not omitting the turn, who may usefully communicate to their fellow citizens the knowledge of religion acquired in this very center of truth. But so that provision may be made more stably both for the sustenance of these Clerics and for the endowment of the Pius Latin-American College, We earnestly desire that through the care and effort of the Bishop for the time being of the new diocese, as soon as it can be done, so many goods be conferred as are necessary so that from their revenues the two aforementioned students, or at least one of them, may be sustained, and We in perpetuity attribute those revenues, as soon as they are received, to the Pius Latin-American College of the City. Those things which by these Apostolic Letters have been decreed by Us by apostolic authority, it is permitted to no man, at any time whatsoever, to infringe or to oppose or to contravene in any way. If anyone, which God forbid, shall presume to attempt this, let him know that he will incur the penalties established by the sacred canons against those who resist the exercise of ecclesiastical jurisdiction. To mandate the execution of these things, We appoint the Venerable Brother Joseph Aversa, titular Archbishop of Sardis and Apostolic Nuncio in the dominion of Brazil, and We grant him the necessary faculties for this business, even to subdelegate another man constituted in ecclesiastical dignity and to pronounce a definitive sentence concerning any difficulty or opposition that may occur, with the burden imposed of transmitting to Rome to the Sacred Congregation of the Consistory within six months an authentic document in proper form of the absolute execution of this Our mandate. We finally decree that these present Letters shall be valid, notwithstanding any contrary provisions, even those worthy of particular and express mention.

1 L'ufficio dell'Apostolato, divinamente affidato al Sommo Pontefice, esige che Egli diligentemente provveda a quelle cose che tendono all'incremento del nome cattolico e all'accertata utilità del popolo cristiano. Ora, poiché il Venerabile* Fratello Vescovo di Goiás nel Brasile ha insistentemente chiesto che per il maggior bene delle anime fosse eretta una nuova diocesi mediante la divisione della diocesi a lui affidata, e poiché il Nunzio Apostolico nella Repubblica Brasiliana ha raccomandato tale istanza, Noi abbiamo ritenuto di dover accogliere benignamente le preghiere presentate. 3 La nuova diocesi di Porto Nacional sarà contenuta entro i seguenti confini: a settentrione entro i confini civili tra lo Stato di Goiás e gli Stati di Maranhão e di Pará; a oriente entro i confini civili tra lo Stato di Goiás e gli Stati di Maranhão, Piauí e Bahia; a occidente entro i confini civili tra lo Stato di Goiás e gli Stati di Pará e di Matto Grosso; a meridione entro i confini settentrionali delle parrocchie volgarmente dette S. Domingos, Flores, Nova Boma, Cavalcanti e Amaro Leite, dalle quali la nuova diocesi è separata dalla diocesi di Goiás, alla quale le ricordate parrocchie appartengono. La diocesi di Porto Nacional così circoscritta entro questi confini, costituiamo che abbia la sede e la cattedra episcopale nella città volgarmente detta Porto Nacional, dalla quale la diocesi stessa trae il nome, * elevandola perciò al grado e al fastigio di città episcopale con tutti i diritti e i privilegi, di cui le altre città episcopali godono e fruiscono per diritto comune; la chiesa poi ivi esistente e dedicata alla Beata Maria Vergine Gratiarum, conservando lo stesso titolo e l'invocazione e mantenendo la medesima parrocchialità con la cura delle anime da esercitarsi come prima, l'eleviamo e l'esaltiamo allo stato e alla dignità di Cattedrale, previa la consacrazione liturgica; e contemporaneamente al Vescovo di essa e ai suoi successori attribuiamo gli onori, gli insegni, i favori, le grazie, i privilegi e i diritti, di cui le altre Chiese Cattedrali in America Latina e i loro Presuli godono e fruiscono tanto per diritto comune quanto per legittima consuetudine, non però per titolo oneroso o particolare indulto. Inoltre la casa ivi esistente, che dovrà essere al più presto riparata, Noi l'attribuiamo come residenza del Vescovo di Porto Nacional.

4 Quanto agli edifici per la Curia ecclesiastica, il Seminario diocesano, nonché quanto al patrimonio diocesano da costituirsi stabilmente, ciò, affinché avvenga più celermente, raccomandiamo vivamente alla liberalità dei fedeli e all'industria, allo zelo del nuovo Vescovo. Una tale diocesi così eretta la costituiamo suffraganea della Chiesa Metropolitana Marianense, finché diversamente non sia provveduto, e il suo Vescovo e i successori nel munere lo sottoponiamo al diritto metropolitico dello stesso Arcivescovo Marianense. Quanto poi è disposto nelle ricordate Lettere Apostoliche munite di piombo, date il quinto giorno delle calende di maggio dell'anno dell'Incarnazione del Signore milleottocentonovantadue, circa le cose da costituirsi riguardanti gli onori, le grazie, i privilegi, gli indulti, i favori, la dotazione delle nuove diocesi nella regione brasiliana e la potestà, l'autorità, le attribuzioni, la tassazione dei nuovi Vescovi; parimenti circa l'istituzione, il governo e l'amministrazione del Capitolo Cattedrale o almeno del Collegio dei Consultori e del Seminario, l'elezione del Vicario Capitolare o dell'Amministratore in sede vacante, i diritti e gli uffici degli stessi chierici e dei cristifedeli, la consegna dei documenti e altre cose di tal genere, tutto sia ritenuto da osservarsi accuratamente secondo il sentiero dei sacri Canoni e soprattutto del Concilio Tridentino, per quanto riguarda la nuova diocesi eretta di Porto Nazionale. Inoltre, affinché i Presuli della nuova diocesi e i successori possano tutelare il decoro della loro dignità e provvedere al sostentamento dei chierici e alle spese del culto divino e alle altre necessità della diocesi, Noi nella dote della nuova sede episcopale e nella mensa perpetuamente assegniamo e attribuiamo gli emolumenti della Curia ecclesiastica, i proventi stabiliti dal diritto comune o dalla legittima consuetudine, e le altre oblazioni dei fedeli per il cui bene spirituale questa nuova diocesi è stata eretta. Poiché inoltre esiste in Roma il Collegio Pio-Latino-Americano, nel quale i predicatori del Vangelo e i rettori delle anime, scelti appositamente, sono formati sotto gli occhi dei Romani Pontefici, ordiniamo che, come dalle altre diocesi dell'America Latina secondo quanto è stato decretato nel plenario concilio dell'America Latina celebrato a Roma nell'anno milleottocentonovantanove, così anche dalla diocesi ora costituita di Porto Nazionale e dalle sue risorse, non appena sarà possibile, siano mandati qui almeno due giovani scelti, con regolarità, i quali acquisita la scienza della religione nel medesimo centro della verità, la comunichino utilmente poi con i loro concittadini. Affinché però sia provveduto più stabilmente sia al sostentamento di questi Chierici sia alla dotazione del Collegio Pio-Latino-Americano, desideriamo vivamente che con la cura e lo studio del Presule pro tempore della nuova diocesi, non appena sarà possibile, siano conferiti tanti beni, quanti sono necessari affinché dai loro redditi i due ricordati alunni, o almeno uno, possano essere sostentati, e questi redditi, non appena siano percepiti, perpetuamente attribuiamo al Collegio Pio-Latino-Americano di Roma. Quanto poi è stato decretato da Noi con autorità apostolica in queste Lettere, a nessun uomo, in nessun tempo mai, sia lecito infrangere o contravvenire o in alcun modo opporsi. Se qualcuno, che Dio non voglia, presumesse di tentare ciò, sappia che incorrerà nelle pene stabilite dai sacri canoni contro coloro che si oppongono all'esercizio della giurisdizione ecclesiastica. Per l'esecuzione di queste cose deputiamo il Venerabile Fratello Giuseppe Aversa, arcivescovo titolare di Sardi e Nunzio Apostolico nel dominio brasiliano, e gli attribuiamo le facoltà necessarie per questo affare, anche di subdelegare un altro uomo costituito in dignità ecclesiastica e di pronunciare sentenza definitiva su qualsiasi difficoltà o opposizione che si presenti, con l'obbligo di trasmettere a Roma alla Sacra Congregazione Concistoriale entro sei mesi la fede, redatta in forma autentica, dell'assoluta esecuzione di questo Nostro mandato.
