Christifidelium

Bull on the protection and governance of religious orders

Bull of Pope Innocent XII ·

of the Regular Orders. Innocent, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 It is a matter of concern to us, regarding the Christ-faithful who, spurning the allurements of this fleeting world and its deceptive institutions, have devoted themselves under the sweet yoke of religion to the service of the divine Majesty, to provide for their more wholesome governance and happier progress in the Lord, insofar as it is granted to us from on high. Amid the manifold cares by which we are beset with the variety of matters and affairs that press upon us, we direct our attention also to this matter of our consideration: that those religious Orders, committed to the protection of the cardinals of the Holy Roman Church, may so enjoy the assistance of that protection, that the vigor of claustral discipline remains unimpaired, and the observance of the institutes is preserved intact. And therefore, those matters which pertain to the care of such protectors, and those which pertain to the care and censure of the superior regulars respectively and more fittingly, are to be ordered with appropriate distinction; or rather, those things which with respect to any Order have been known to have been ordained by our Roman Pontiff predecessors concerning this matter are to be established with the protection of our confirmation, and with respect to the same and other Orders, commended to the aforesaid protectors either similarly or dissimilarly, according to one and the same rule, within the limits however of the present, are to be constituted equally.

2 § 1. Indeed, although St. Francis of Assisi in his Rule, confirmed by the Apostolic See, commanded with these words: "By obedience I enjoin upon the ministers that they ask of the Lord Pope one of the cardinals of the Holy Roman Church, who shall be governor, protector and corrector of this fraternity, so that always subject and subjected at the feet of the same Holy Roman Church, we may remain steadfast in the Catholic faith, observing poverty and humility and the holy Gospel of our Lord Jesus Christ, which we firmly promise"; nevertheless some of our Roman Pontiff predecessors deemed it necessary that the faculties of such a protector should be declared, and the limits within which they ought to be confined should be prescribed, and they decreed concerning this in their letters issued.

3 § 2. For when certain of these protectors were said to have extended their power excessively in many matters, from which grave disturbances and scandals had arisen for the brothers of the Order of Minors, our blessed

INNOCENT XII, POPE. 595 A.D. 1694

4 of blessed memory, Gregory Pope XI, our predecessor, by his letters issued on the sixth day before the Kalends of June in the year of his pontificate, among other matters, so that the same Order might remain in its original peace, might proceed from virtue to virtue continually, and, with all hindrances removed and thorns and thistles eradicated, might bear fruit not only customary but also more abundant, desiring to provide for the radical removal of the disturbances and scandals of this kind already arisen, and lest they should arise in the future, and to remove from the protectors existing in the Order for the time being the occasion of transgressing their power, by apostolic authority he strictly forbade the same protectors that they should not presume to infringe, reprobate, correct, suspend or dispense concerning any things ordained, established or disposed, or to be ordained, established or disposed by general or provincial or custodial chapters, or against them, or to alter any of them in any way whatsoever, unless against the aforesaid articles placed in the aforesaid rule, as is aforesaid, there should exist manifest cause; or to place or institute, or to depose, remove or deprive any prelate or official of the said Order, or of any place of the same, by whatever name he might be called, or to suspend him from his office or to impede him in any way in its free exercise; or to promote any brother of the aforesaid Order to a lectureship or any reading or study or degree, or to remove those promoted by them, or even to revoke them; or to send from place to place or to move them, or to grant to any of the brothers permission to go to any monastery, or any other place, or house, or any person; and lest moreover any individual brother of the aforesaid Order be punished for any crime or offense, or be freed from punishment or penance, or that it be diminished, assigned or altered; or even to grant to any brother a place, chamber, cell, books or other things of the said Order, or to assign them to his use; or to remove anyone in any way whatsoever, through the prelates of the same Order or others appointed; nor even to concern themselves in any way whatsoever with the things or correction of the brothers of the said Order, except in the cases aforesaid contained in the aforesaid rule, or any of them, so that the said Order or the brothers of the same Order should in no way be subject to future protectors, except in the case in which the community of the same brothers or general chapter (which God forbid) should have deviated from the aforesaid articles or any of them; otherwise, if they should act otherwise, he decreed that to be null and void. And nevertheless brothers who should have obtained anything contrary to such prohibition, or, after such prohibition, should have made use of things even obtained through others, should be punished with those penalties with which they should be punished for grave faults according to the statutes of the said Order, and nevertheless should be deprived of legitimate acts, and should be suspended from their offices, if they had any, by the very fact. Moreover, the aforesaid Gregory, our predecessor, earnestly exhorted the same future protectors that by the efficacy of their deed they should so procure the effect of their office that the Order itself should not be harmed in any way by them, but rather should be protected by them from adversities, perhaps threatening at any time, or by the opportune shield of defense, and should be preserved from harm: so acting providently, and observing the limits of equity and modesty, so that what was provided for salvation should not be drawn to harm, but from their charitable deeds the aforesaid Order should receive peace and consolation, and the protectors themselves should obtain great reward with God, and on the contrary it should not be necessary for the aforesaid See to apply another remedy.

5 confirmed and § 3. By successive memory of long duration it was held. By Pope IV, also our predecessor in the ministry (who, when the care and administration of the aforesaid Order in its minor state had devolved upon him, had perceived that it was most salutary, opportune and necessary for the said Order that protectors should not extend their authority beyond that fixed by the same Order's rule, for he had experienced and seen how great peace, quiet, utility, and how great advantages had proceeded to the aforesaid Order and its brothers from the firm and unshaken observance of the aforesaid letters of the said Gregory likewise his predecessor, and what and how great disturbances, losses, inconveniences, damages and grave scandals had been stirred up in the said Order, whenever its protectors, attempting to exceed the limits of their authority, sought to intermeddle in particular matters and affairs of the said Order and its brothers, and with usurped authority to see, know, judge and decree concerning them), desiring that religion and the aforesaid Order, which he embraced with most affectionate charity, inasmuch as he had been nourished in it from tender years and instructed in doctrine and regular disciplines and morals, should remain in a quiet state and be increased and multiplied in virtues and merits, so that increase of the Catholic faith and Christian commonwealth and manifold and solid foundation might proceed from the works and examples, wisdom, splendor and fruitful studies and preachings of the brothers of the same Order, with most ready and liberal mind, as he deemed worthy and fitting, solidified with the muniment of his approval those things which for the quiet, peace, tranquility and prosperity of the said Order had been providently established and ordained by the Roman Pontiffs his predecessors, interpreted and declared them, as he perceived it to be salutarily expedient for the tranquility of the said Order. Having therefore premised the insertion of the aforesaid letters of the aforesaid Gregory his predecessor, and having made this narrative preamble, the same Sixtus his predecessor, in order that henceforth all occasion of wandering outside religion be taken away from the professors of the said Order, and true obedience to their prelates, in which the true and solid foundation and strength of religion consists, be exhibited, and that the affairs and causes of the aforesaid Order and its brothers be treated, agitated, judged and determined nowhere else and by no others than in the Order itself and through its prelates, being inclined by the supplications of the then existing general minister of the said Order and of the whole general chapter in this part, approved by apostolic authority in the tenor of his letters the inhibition and the aforesaid letters of the aforesaid Gregory his predecessor, and decreed that they ought to obtain the force of perpetual firmness. And through them to the protector aforesaid for the time being, unless in those cases and articles expressed in the rule of the said brothers and declared in the letters of the aforesaid Gregory his predecessor, nor in those, when not all, but some of the professors of the said Order in any number should deviate from the unity of faith and obedience to the most holy Roman Church, or should not observe the aforesaid rule, but concerning the correction or reduction of those deviating and not observing the rule and all other whatsoever causes and affairs of the said Order, it was inhibited to intermeddle, he decreed by the said authority and gave it to the supplicants.

6 INNOCENT XII, POPE

7 597 In the year of our Lord 1601 declared. And he exhorted him who happened to be assumed and appointed to the office of this protection (which then was vacant by the death of Bessarion of blessed memory, bishop of Sabina, protector of the said Order while he lived), and his successors, protectors of the said Order, and to them in virtue of holy obedience strictly commanding, he inhibited, lest, outside the aforesaid articles and cases contained and expressed in the aforesaid rule, nor even in those, when not the whole Order, but some part of it or special persons should err, they should presume in any way to hear the complaints of the said brothers, or to involve themselves in their causes and affairs against these letters and declarations; but they should take care, be vigilant and attend, as was their duty, and as the intention of the said St. Francis and the aforesaid See had been, to preserve and maintain the said Order in a quiet, tranquil and peaceful state, and to protect, defend and guard it from those attacking, molesting and disturbing it, lest, acting otherwise, they should not only not protect, preserve and exalt the aforesaid Order, as they were bound to do, but, to the destruction of their own souls and the detriment and scandal of the said Order, should disturb, destroy and confound it, as is contained in the letters expedited in the year of the same Sixtus his predecessor in the year of our Lord's Incarnation 1572, on the 28th day of January, in the 11th year of his pontificate.

8 Approbation § 4. Which and other aforesaid letters of memorable moderation of Gregory and of Gregory the predecessor, pious and of declaration, and also of Julius of memorable piety, the Pope, even the predecessor of ours, who being constituted in the minor orders, shining with the honour of cardinal, had been protector of the said Order for twenty-six years and more, and bearing the said brothers as peculiar sons in the bowels of charity, desired the same comforts and tranquility with sincere affections, with the previous insertion of both aforesaid letters, approved by his other letters under the date of the year of the Incarnation aforesaid 1508, on the Ides of October, in the fourth year of his pontificate, and fortified them with the patronage of the same his letters.

9 § 5. Desiring therefore and having turned over in our mind many times with attentive consideration to apply the study of apostolic solicitude also in this part, and unwilling to defer further the remedy of salutary provision long since premeditated by us, and also humbly sought by very many regulars of diverse Orders, adhering to the footsteps of the aforesaid Roman Pontiffs our predecessors, by our own motion, from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, and also from the piety, learning, prudence and practical experience of certain venerable brothers of ours of the Holy Roman Church and beloved sons of the Roman Curia, outstanding for this purpose, gathered in Council by our mandate, we approve, confirm and renew the aforesaid letters of the memorable Gregory, Sixtus and Julius our predecessor by the tenor of these presents, and reduce and restore them to their original state and pristine use, and add to them in all things and throughout the strength of perpetual and inviolable firmness.

10 § 6. Moreover, so that in all and each of the Orders of regulars committed to the care of the aforesaid protectors, or customarily committed, there may be and ought perpetually to be one and the same and equal rule and discipline of such protections, all and whatsoever things, both contained in the aforesaid predecessors as aforesaid confirmed, and in our present ones, in all and each whether of St. Francis or of any other rule or institute and in any way erected, reformed or existing, and to be erected, reformed or future and in any way named or to be named Orders, religions, congregations or reformations, both of men and of women, committed to the care of protectors of the Order of which they or those exist, generally commissioned or commissioned, are to be observed, attended to and committed to all manner of execution, by motion, knowledge and fullness of power equal, this constitution valid in perpetuity, we enact and command. And nevertheless, lest such protectors in any matters, causes or things which do not concern the whole Order or the entire body of religion, from any cause, occasion, title or pretext, introduce themselves or interpose in any way whatsoever, we entirely prohibit, establish and decree by the tenor of these presents.

11 § 7. Hence, with the aforesaid facilities retained, confirmed to us and to all Orders of the Council,

12 to concede to regular protectors extended and with the approbation of our letters on this theme) to be congruent and to follow as a consequence, so that the aforesaid protectors should also abstain equally or rather from the cognition and determination of causes, or disputes, or matters concerning the said regulars, or their goods, rights, houses, and other things as set forth particularly; but conversely causes and disputes, instances, petitions or matters of this kind, whether from indults, privileges or apostolic constitutions, or from rules, or statutes, or ordinances of any Orders, or from declarations or decrees of the said Holy Roman Church cardinals in some Congregations placed in charge, or from use or any custom, in some instance, or degree of any appeal or recourse, by the aforesaid protectors or some of them hitherto known, examined, or judged, or could have been known, examined or judged, or should be recognized or claimed: wherefore, so that the mode, form, and order constituted in the aforesaid confirmed and extended and present our letters may obtain their full and like effect also in this part, to all and singular the aforesaid indults, privileges, constitutions, rules, statutes, ordinances, declarations, decrees, uses and customs (the tenors of all and singular of which, as if inserted word for word, we hold to be fully and sufficiently expressed) we most fully and amply, by our own motion, knowledge and fullness of power in like manner, derogate, and will and command that they be derogated, those otherwise remaining in their force; and, removing, taking away, or refusing any instance, or degree of any appeal or recourse before the protectors or to such protectors, any instance as by right and according to the institutes of the Order we leave, and any degree of appeal or recourse, which by these presents we altogether and absolutely take away from each cardinal protector, to the same cardinals together however in the Congregation placed in charge of matters and consultations of bishops and regulars by the tenor of these presents we restore, concede, grant and impart, or rather both or the twofold degree of appeal, which on the aforesaid matters previously devolved to the aforesaid cardinal protectors, and successively or respectively, omitting the intermediate, to the aforesaid Congregation, in the same Congregation we consolidate, annex and unite, and reduce to one degree of cognition or appeal.

13 § 8. Furthermore, since likewise from indults, or new privileges or apostolic constitutions, or from rules, statutes or ordinances, or from uses and customs, or otherwise in any way whatsoever, some authority or faculty for electing or appointing some prelates, superiors, or others in some Orders, or any other faculty or authority whatsoever for managing, committing, mandating, delegating or ordaining, has been attributed, committed, commended, or delegated to the aforesaid protectors or some of them in any manner whatsoever, whether specially or generally, contrary to the form of the aforesaid letters of Gregory and Sixtus our predecessors: hence we reduce such elections or appointments to the limits of the sacred canons or rules and institute, or to the mode and form to be established and to be established by us by apostolic authority, and will and command that they be reduced.

14 § 9. But as to the rest, the faculty...

15 to the same individual cardinal protectors in the aforesaid matters and concerning them we altogether take away, to the Congregations of the same cardinals, according to the faculties of each Congregation, making suitable returns for suitable things, we likewise restore, concede, grant and impart; under that however moderation or declaration, so that the aforesaid Congregations in those only which pertain to such protectors from apostolic constitutions and ordinances, or from statutes, rules or constitutions of each respective Order, not however from use, custom, or otherwise, in place of the same protectors are and are understood to be substituted. § 10. Because indeed very often it happens that in causes or matters which exist...

16 it is permitted to be conceded.

17 to be committed to the aforesaid congregations of cardinals to be proposed, inquiry shall be made concerning the information set forth, and whenever also a vote is given, or the execution of matters resolved is delegated, we command that the same proportion or distinction which we have premised be observed also in this part, namely that in matters concerning the whole Order in the care of protectors committed or left as aforesaid, to those same protectors; but in other cases and matters, to the superior general or the procurator general, and in either or both cases, also to the congregation, whether of assistants, or of definitors, or of consultors, or otherwise named in any way, existing here in the City or in another place of Italy, in which the affairs of the Order are handled or are accustomed to be or ought to be handled, and as regards those Orders in which such a congregation existing together and continuously does not exist, or exists but outside Italy, to the same procurator general, either alone, or together also with certain other superiors or prelates of the same Order, although dwelling in different places in Italy or outside it respectively as aforesaid, always at the discretion of each of the aforesaid cardinal Congregations, according to the qualities and circumstances of matters, places, and persons respectively, the information and vote as aforesaid, as well as the execution of these matters, rendering congruous things to congruous things, and the form proper to each Order being otherwise observed regarding its rule, statutes, or institute, shall be remitted, delegated or committed.

18 § 11. Considering also Christian prudence and ... in religious Orders prelates are to be appointed with integrity of life and morals.

19 of life and integrity of morals, virtues, merits, and experience in matters, those more excellent and more suitable shall be placed in charge, and to this effect we exhort in the Lord the aforesaid protectors, and earnestly beseech them, and to the electors likewise in the Lord and in virtue of holy obedience we strictly command, or we renew these exhortations, beseeching and commands, that in assemblies, especially general ones, in which it may fall to them to preside over and respectively to be present at the same, not only to be present, and others dwelling within the cloister, but also to external ones themselves, whatever laymen also shining with whatever majesty, preeminence, rank and dignity, they so conduct themselves as a singular specimen and example of their own indifference and sole respect for God's glory and the good of religion, and diffuse such an odor of this right intention and better work, that those on this account, recognizing vexations and importunate recommendations where the Spirit the Paraclete breathes and presides to be useless and incongruous and to be so, abstain or desist from them entirely, and thence with all vexations, recommendations, machinations, and human ends eliminated and rejected both intrinsically and extrinsically, there may remain to the vocales intact, unimpaired and untouched the faculty of electing, and both the superior general and other respective prelates in every way free, best and canonical election shall follow, to which with a vote, if any, and in that manner which belongs to the protector according to the rules, statutes, or otherwise of each Order, having God and His honor and glory alone before his eyes, he may concur. § 12. We do not wish, however, that the votes of the absent, nor of the protector, nor of any other, be supplied to the vocales, nor that other vocales be subrogate, appointed or elected in place or stead of the same absent ones; but the right of electing in those alone according to the rules of law and institute assumed for this effect, and in those designated and at a convenient time, to be consolidated, or otherwise, as is of right, to remain, we wholly will and command.

20 § 13. But so that all and each of the aforesaid things may the more obtain their due effect, and be carried out in execution, and for greater caution or declaration, all and singular things whatsoever, which in the aforesaid confirmed and extended and present letters of ours are in any way explicitly or implicitly forbidden to the aforesaid protectors, we henceforth annul, quash and render void, or rather declare and decree null, quashed, void, void, and of no force and moment by the law itself and by the fact itself in every better manner.

21 § 14. Commanding the same and for the future to those existing in the office of protector and to the superior religious superiors, that they in no way enjoin, cause, command, commit, permit, or tolerate all or any of the aforesaid matters; and likewise to all and singular regulars of both sexes, both superiors, even general ones, and subjects, that they do not obey, comply with, conform to, adhere to, or tolerate all and singular the aforesaid matters as aforesaid, or permit them, whether all or singular of the aforesaid matters whatsoever are done or attempted by sentences or decrees, whether in judicial or extrajudicial form, both by public letters and by private letters or epistles, whether by themselves or by any others, not only by way of precept, command, mandate or commission, but also by way of recommendation, and whether openly or secretly, both in any writings and orally, and both directly and indirectly, mediately or immediately, and in any other whatsoever forms and modes, nothing whatsoever being omitted: burdening the consciences of all the aforesaid from above.

22 Revocation of all faculties. § 15. For this reason we moderate, reform, and reduce to the limits, manner, form and tenor of the present all and singular whatsoever faculties, authorities and jurisdictions, howsoever, in whatsoever manner and howsoever, both in general and in particular, granted and attributed or communicated to all and singular protectors of this kind existing heretofore or now, and both to their persons, rank, office or function, or customarily exercised by them in any way, even worthy of special and individual mention, moderation or revocation, holding the tenors of all and singular of the same as if they had been inserted word for word, as fully and sufficiently expressed in all and singular matters which are contrary to the aforesaid, and we will and decree that they be held, deemed and understood as thus moderated, reformed and reduced, and in like manner, and not otherwise than with the form of the present being observed in all and singular matters contained therein, we will and command that such faculties, jurisdictions and authorities, as well as deputations of the same protectors to be granted, attributed or communicated in the future in any way whatsoever, and respectively to be made, be observed, attended to, understood and executed entirely.

23 Committed to the Congregation and others. § 16. Wherefore to the aforesaid Congregation of the memorated business and consultations of bishops and regulars, to the prepositors of cardinals, and to our beloved Apostolic nuncio, general auditor of the causes of the Apostolic Camera, by apostolic letters in like manner we command, that, all and singular the aforesaid always being saved and remaining in their force, the aforesaid Congregation or auditor shall solemnly publish the present letters in that part which concerns only the aforesaid moderation or limitation of the faculties of these protectors and the nullity or irritation to be done to the contrary by the same protectors, where and whenever it shall be necessary, as often as the aforesaid Congregation or auditor shall have been requested on behalf of any having interest therein, and assisting them with the protection of efficacious defense, shall cause the same present letters in that part only to be firmly observed by our authority, and shall not permit those whom the same letters concern in that part to be molested in any way indebitably, compelling the contradictors by our authority, appeal being set aside.

24 §17. We decree that these same present letters and whatever is contained in them, even from the fact that all and each of the aforesaid, and any others whatsoever of any status, rank, order, condition, preeminence or dignity, or otherwise worthy of specific and individual mention and expression, having or claiming to have any right or interest in the aforesaid matters in any way, have not consented to the same aforesaid, nor have been called upon or heard concerning them, although by virtue of their indults or privileges they ought to have consented or been called upon and heard once or many times in any manner whatsoever, or from any other juridical, privileged and reasonable cause and occasion, or such as would necessarily need to be expressed for the effect of the validity of the aforesaid, under color, pretext, title, even onerous, and head, even in the body of closed law, at no time whatsoever by any defect of subreption1 or nullity, or of our intention or the consent of those having interest or any other defect whatsoever, even the greatest, substantial, essential and formal or unforeseen, be noted, impugned, infringed, invalidated, retracted, rescinded, called into controversy, reduced to the terms of law, or against them any remedy of opening of the mouth, restitution in full, or any other remedy whatsoever of law, fact or grace be attempted or obtained, or even by our motion, knowledge and fullness of power equally granted anyone in judgment or outside it be able to use or avail himself in any way, but these same present letters and whatever is contained in them shall always and perpetually be firm, valid and efficacious and shall be able to produce and obtain their full and complete effects, and shall be inviolably and firmly observed by all to whom it pertains and for the time whenever and in whatever manner it shall pertain, thus and not otherwise, by whatever ordinary and delegated judges, even auditors of causes of the apostolic palace, and whatever nuncios and cardinals, even legates a latere, as well as whatever congregations of the same cardinals, and any others exercising and about to exercise any authority, preeminence and power, with all facility of judging and interpreting otherwise removed from them and from each of them, ought to be judged and determined, and whatever is attempted contrary to these things by anyone whatsoever, by any authority, knowingly or unknowingly, shall be null and void.

§ 18.

25 Notwithstanding all and singular the aforesaid, and, insofar as it is necessary, our and the Apostolic Chancery rules, and especially that concerning not taking away acquired right, and another that cardinals are not comprehended in constitutions and rules to be issued by us unless those concern the favor of the same cardinals or the constitutions to be issued shall have been issued by their or the greater part of their counsel, and any and all others whatsoever, even in general, provincial and synodal councils issued, general or special, constitutions and ordinances, even apostolic, as well as the institutes, rules, statutes, decrees and ordinances whatsoever of any and all of the Regular Orders, religions, congregations or reforms, even at the threshold of erection, foundation or reform, even in general chapters made in any manner whatsoever, and uses, styles and customs whatsoever, even centennial and immemorial, privileges also and indults and apostolic letters whatsoever, under whatsoever tenors and forms, and with whatsoever derogations of derogations, and other more efficacious, most efficacious and unusual clauses, and irritant and other decrees, in general or in special, even by our motion, knowledge and fullness of power similar, even consistorially, and otherwise in any manner whatsoever granted, issued, confirmed and approved contrary to the aforesaid, and renewed many times and as many times as you wish; all and singular of which, even if for their sufficient derogation special, specific, express, individual mention of them and their whole tenors, and word for word, not however through general clauses importing the same, ought to be made or any other exquisite form to be observed for this, the tenors, forms, causes and occasions of all and singular, as if word for word, nothing whatsoever omitted, and the form transmitted in them being observed, were expressed and inserted, these same presents having them as fully and sufficiently expressed, inserted, observed and specified respectively, otherwise remaining in their force, for the effect of the aforesaid, by the tenor of these, specially and expressly we derogate, and we will and command that they be derogated; and all other things contrary whatsoever.

§ 19.

26 We will, however, that transcripts or copies of these same present letters, even printed, subscribed by the hand of some public notary, and fortified by the seal of a person constituted in ecclesiastical dignity, shall have the same faith in judgment and outside it as would be had if these were exhibited or shown.

§ 20.

27 Let no one whatsoever be permitted to infringe upon this page of Our approbation, confirmation, innovation, reduction, reintegration, sanction, mandates, prohibition, statute, decrees, derogations, wills, removals, restitutions, concessions, consolidation, annexation, union, exhortation, entreaty, precept, renewal, annulment, cassation, irritation, declaration, imposition, moderation and reform, or to dare to act contrary to it with rash presumption: if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.

INNOCENZO XII PP. 595 An. C. 1694

6 INNOCENZIO XII PP.

7 597 An.
