Bull on the correction and printing of the Corpus Iuris Canonici
ANT. BUCCAPADULIUS. GREGORY POPE XIII. TO FUTURE MEMORY OF THE MATTER.
1 Since we have it as our principal concern, given the pastoral office imposed upon our shoulders, to ensure with all study and diligence that all the faithful of Christ, especially in these so grave and calamitous times, remain steadfast in the right and Catholic faith, and for this reason it is incumbent upon us first and foremost to act and provide that we remove from all every occasion of straying from it; for a long time now, for the execution of this matter, having employed certain of our brothers, Cardinals of the holy Roman Church, joined also by the study of men distinguished in learning and piety, we have entrusted the care of reviewing, correcting and expurgating the Decretum Gratiani, so called, without glosses, and likewise the same Decretum Gratiani together with the Decretals of Gregory, our predecessor, Pope Gregory IX, the Sixth, the Clementines and the Extravagants, not only with the ancient authors of glosses (to whom, since they were pious and Catholic men, it seems pardon ought to be given, if they spoke somewhat more freely either through error in these matters, or because many things had not yet been settled by the sacred councils,) but also with those things which impious writers had inserted both outside in the margins and also within, contrary to Catholic truth, we have entrusted the care of reviewing, correcting and expurgating. Since now the Decretum itself without glosses has already been wholly amended and corrected by those appointed by us and illustrated with certain annotations, and its greater part has been received and approved by our beloved son Paul Constabili, then Master of our sacred Apostolic Palace, together with the said Decretals of Gregory IX, our predecessor of happy memory, already printed, but the remainder of the same Decretum together with the aforesaid annotations both without glosses and the whole itself with glosses, the Sixth and the Clementines together with the Extravagants, to be reviewed and approved by our beloved son Sixtus Fabri, Master of the same our Apostolic Palace, in the workshop of the Roman people, which was erected for this purpose, that sacred books might be faithfully and uncorruptedly printed therein, we have ordered to be printed and, once printed, to be divulged; and so that for the greater convenience of the faithful of Christ everywhere, both within and outside Italy, on this side and beyond the Mountains dwelling, this Body of Canon Law faithfully and uncorruptedly according to the copy here printed at Rome by Catholic printers, by the Roman people, or by those elected by it or to be elected by it for the time being, might be able to be printed: We, wishing to provide opportunely, that this Canon Law thus expurgated may reach all...
LXXXXI ON THE ROMAN EDITION,
2 everywhere the faithful may reach it intact, and that it be not lawful for anyone to add anything to the same work, or to change it, or to corrupt it, or to attach any interpretations to it, but that, as it has now been printed in our City of Rome, it shall always and perpetually be preserved whole and uncorrupted: By our own motion and from certain knowledge of ours, and from the fullness of Apostolic power, to all and each of those dwelling in our and the holy Roman Church's domain subject to us and to the same Roman Church mediately or immediately, or coming to it under any pretext whatsoever, and also to those existing anywhere outside the said domain, printers and workers in the printing trade and booksellers, and to any other persons of either sex, of whatever dignity, status, grade, order or condition they may be, in virtue of holy obedience and under the penalty of excommunication latae sententiae, and as of now and for the time being those dwelling in the said our and the Roman Church's domain subject mediately or immediately, even beyond the foregoing under the loss of books and one thousand gold ducats of the Camera, one part namely to the office of the Inquisition of heretical depravity, and another to the accuser, and the remaining third part to the judge executor irremissibly to be applied, and other penalties at our discretion to be incurred by the very fact and as often as it shall be contravened, and by anyone contravening it, by Apostolic authority by the tenor of these presents we inhibit and interdict, that the Decretum of Gratian with annotations, and the same with glosses, the Decretals of Gregory IX our predecessor, the Sixth, the Clementines and the Extravagantes, as aforesaid, henceforth for the space of ten years from the date of these presents under any title elsewhere than in our City and in the same printing office of the said Roman people, and to those to whom by the same Roman people and by it for this purpose appointed for the people, both in Italy and outside Italy anywhere the faculty and license for the said time shall have been granted thereupon, as we to the same Roman people and to those appointed by it for this purpose, as such license and faculty both in Italy and outside Italy anywhere to anyone and to any of the same Roman people or those appointed for it for the time being shall seem and please, and for the time being to the same people and its appointees shall seem fit, having first signified to us and approved the person, grant, and that so granted, as and when it shall please them, freely and lawfully revoke, we permit, the printed and to be printed to hold, sell, give, donate, or otherwise in any way to have or transfer; nor also shall the same without express license even in writing of the same Roman people and those appointed by it print the said Decretum of Gratian with the same annotations, and the same with glosses, the Decretals of Gregory IX our predecessor, the Sixth, the Clementines and the Extravagantes, as aforesaid, nor for the said ten years from them or others, except from the said Roman people and those appointed by it, or from their license, as aforesaid, printed and to be printed otherwise to have or hold, or also to sell or donate, or to be printed, held, sold, donated, or otherwise transferred by themselves or another or others, publicly or secretly, directly or indirectly under any sought color or device dare or presume: so that also to no one at all of mankind both in the City and all Italy, and outside anywhere in the lands, kingdoms, regions, and provinces of the whole world it be lawful to add anything to such books of the said Canon Law thus, as aforesaid, by our mandate recognized, corrected and expurgated, to detract or change or corrupt, or to attach any interpretations, but as this work has now been printed at Rome, always and perpetually whole and uncorrupted shall it be preserved, we establish, enact and ordain: commanding all and each of the venerable brothers Patriarchs, Archbishops and Bishops and the other Ordinaries of places and their Vicars in spiritual and temporal matters, and in the temporal state of the holy Roman Church also Legates, Vice-legates of the Apostolic See, and the same state's Governors, Potestates and Lieutenants, that as often as on behalf of the said Roman people and those appointed by it, or those having license and faculty from the same, as aforesaid, for the time being, they shall have been requested, or any of them shall have been requested, to the same people and appointees, and to those having license and faculty from the same, with the aid of effective defense assisting them: being ready at every request of the Roman people and those appointed by it aforesaid having license or faculty against the disobedient and rebellious, even through ecclesiastical censures, even frequently aggravated and through other remedies of law by Apostolic authority to be executed, invoking also for this, if it be necessary, the aid of the secular arm. And moreover because it would be very difficult for these letters to be carried to any place: We will and by the same Apostolic authority decree, that transcripts and copies of them subscribed by the hand of a public notary, and furnished with the seal of the court or of a person constituted in ecclesiastical dignity, and also in the same printed works full and the same complete faith everywhere both in judgment and outside judgment to be had, which would be had in these presents: notwithstanding the constitutions and ordinances Apostolic, and of any places whatsoever, gymnasia and universities, even of general studies sworn to, confirmed by Apostolic confirmation or by any other firmness strengthened statutes and customs privileges and indults and Apostolic letters even those and of those, and any other persons whatsoever, under whatsoever tenors and forms even by motion, knowledge and fullness of power similar and otherwise in the contrary in any way whatsoever granted and approved, and in the future to be granted and approved. All which, even if special mention ought to be made of them, their tenors in these presents as expressed having, otherwise in their force remaining, this time only specially and expressly we derogate, contrary to anything whatsoever. Or if to any commonly or severally by the same see it has been granted that they cannot be interdicted, suspended or excommunicated by Apostolic letters not making full and express and word for word mention of such indult. ANT. BUCCAPADULIUS. GREGORIO PAPA XIII.
LXXXXI DELL'EDIZIONE ROMANA,
