Cum sacrosanctam
Bull on the dress and tonsure of clerics holding ecclesiastical benefices
CXLI.
Concerning the habit and tonsure of clerics and of soldiers holding ecclesiastical benefices.
Sixtus, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 Since the most holy Church of God, which our Saviour acquired for himself as a spouse by his most precious blood and entrusted to us, though unworthy, to guard, we ought to preserve her without spot, without blemish, and pleasing in all her members, so that in her all things may be found ordered, each thing distinct, all things breathing forth piety and devotion both inwardly and outwardly, and so that, adorned with ineffable variety, she may appear beautiful in his sight, as much as, with God's favour, we are able—we have decreed to execute this same duty.
2 § 1. Wherefore, observing that those who are called to the lot of the Lord for the constitution and adornment of his Church, and who have obtained from this the name of clerics, and who live by ecclesiastical revenue, ought to be distinguished by some particular sign from the rest of the people, lest it be said to any of them, How camest thou in hither not having a wedding garment? and directing our attention to this very matter, lest their blood be required at our hand, we have found with great sorrow of heart that many are justly to be rebuked by the aforesaid sentence of the Lord. For many of them, neglecting clerical honour, proceeding in lay garments, have rendered themselves unworthy of this wonderful privilege. Wherefore, although by the sacred canons, general councils and apostolic constitutions a certain mode is prescribed concerning the habit, age and other qualities of those who are to be marked with the clerical character, and a penalty is imposed against clerics not proceeding in clerical habit and tonsure, namely that they shall not enjoy the graces, immunities and other clerical privileges; yet since, through the injury of the times and perhaps through the negligence of pastors, the enemy has sown the deadly tares of transgression.
3 § 2. We therefore, moved by these and other reasonable causes, lest through the negligence or carelessness of pastors or times, or through sloth and impunity, abuse should be made of these matters to the dishonour of the Church and religion and to the loss of their own salvation, by this our constitution, to endure perpetually, we command and enjoin all and each of the clerics, not only those in sacred orders, but also those in the other minor orders and marked only with clerical tonsure, and not only those now and for the time holding any ecclesiastical benefices, even simple ones, and those having or having a right to them, but also those receiving pensions upon any fruits, revenues or proceeds of any patriarchal, primatial, metropolitan, cathedral and other churches whatsoever, or abbatial, capitular and conventual monasteries, as well as monasteries, prepositorships, prepositorates, priorships, preceptorships, hospitals, canonicates, prebends, dignities, personates, administrations, offices and benefices whatsoever, whether secular or of any regular orders, or their daily distributions and all rights, emoluments and perquisites, reserved to themselves, or receiving the fruits themselves or lands or ecclesiastical goods assigned or assigned to them in place of pensions from any apostolic concession or dispensation, even if married, especially if these same married clerics, according to the constitution of Boniface VIII, of pious memory, our predecessor, renewed in the Council of Trent, wish to use clerical privileges, whether dwelling in the Roman Curia or constituted outside it in any lands and places whatsoever, so that they and each of them, howsoever exempt they may be and enjoying any privilege or immunity whatsoever, with any delay or evasion set aside, ought altogether—those present in the City within fifteen days, those this side of the mountains within four months, those finally beyond the mountains within eight months from the day of publication of these present letters in the Roman Curia—to assume and continually to wear the tonsure and clerical habit, namely talars garments, or soldiers hereinafter mentioned, to whom pensions or fruits or other ecclesiastical goods are reserved, a habit befitting their soldiery, with any excuse whatsoever removed. In future, however, benefices, whether ecclesiastical and simple, shall be conferred or commended only upon clerics actually proceeding in clerical habit and tonsure, and upon soldiers hereinafter mentioned proceeding in military dress proper to their soldiery or any other ecclesiastical benefices, or pensions, fruits or ecclesiastical goods shall be reserved.

The string "r»e per cieiimia sive pastorum sive temporum mdullero defere.i." does not form coherent Latin. If you have access to the original document or a clearer scan, please provide that instead.

6 § 3. Otherwise, we deprive them and each of them, who, as regards wearing the clerical habit, collar and military dress aforesaid, after the expiration of such time fixed for each of them, as stated above, shall not have obeyed our command and mandate herein and in the future for perpetual times with effect, besides other penalties inflicted against them, also of whatsoever dignities, administrations, offices, canonicates and prebends and benefices, even simple ones, and prestimonia held by each of them in title, commenda or otherwise for the time being, as well as pensions and fruits, lands and ecclesiastical goods reserved to them in any manner whatsoever or to be reserved, and every right competent to them in them or to them in any way, by this present document, from our certain knowledge and from the fullness of apostolic power, we deprive them, and without any other admonition, citation, decree of judge or ministry, we declare them deprived by the fact itself, and we decree that both the benefices themselves by such privation are to be vacant and freely conferred on others, and also the pensions are to be cancelled and extinguished, and the reservations of fruits or other things are to cease, and no one is henceforth to be bound to their payment, and by non-payment no one is able to or ought to incur censures and penalties, and we reserve the dignities, personates, administrations, offices as well as canonicates and prebends and benefices thus vacant for the time being perpetually to our collation, provision and disposition and that of the Roman Pontiff existing for the time being.
7 § 4. Decreeing thus in the foregoing matters universally and individually through whatsoever judges and commissioners, even auditors of causes of the Apostolic Palace and cardinals of the Holy Roman Church, with the faculty of judging and interpreting otherwise taken away from them and from each of them, that in any cause and instance it ought to be judged and decided; and moreover that whatever is otherwise attempted concerning these things by anyone, by whatsoever authority, knowingly or unknowingly, is to be null and void.
8 § 5. Moreover, soldiers of whatsoever military orders under some approved rule canonically instituted or other officials of the Roman Curia, who, not as clerics but rather as soldiers, according to privileges and apostolic dispensations granted to them in general or in particular by us or by our predecessors by name, and under the constitution of our predecessor of happy memory, Pope Pius V, which begins Sacrosanctum, etc., which is perhaps revocatory of such privileges, not at all comprehended, obtain the regular benefits of the military order which they have professed, or pensions upon whatsoever fruits, revenues and proceeds ecclesiastical, even of the aforesaid churches and secular benefices, or perceive or obtain or shall perceive in the future the fruits themselves reserved to them, whether they are marked with the clerical character or not; those indeed who are clerics, even if at the beginning of the time of the reservation of pensions or fruits of this kind they had not yet assumed the regular habit, nor were enrolled in the military offices of the Roman Curia, but after reservations made to each of them, before or after the publication of the present constitution became soldiers, we do not wish to comprehend under the aforesaid command and mandate concerning the wearing of clerical habit and tonsure, but we permit them to use the regular habit of the military order which they have professed, or if they themselves are soldiers and officials of the Roman Curia, who perceive pensions or fruits or other lands or ecclesiastical goods from apostolic dispensation or privilege, the military habit written above, without incurring any ecclesiastical censure or penalty, lawfully; and nevertheless they retain both the regular benefits of their military order and also perceive pensions upon the fruits of the aforesaid churches and benefices, even secular, or goods or the aforesaid fruits reserved to them for the time being.
9 § 6. Notwithstanding apostolic constitutions and ordinances, as well as customs, even observed for the longest and immemorial time, which are to be esteemed rather as abuses and corruptions; also notwithstanding privileges, indults and apostolic letters, of whatsoever tenor they may be, all of which we do not wish to avail anyone against the foregoing in any way.
10 § 7. We command moreover to all and each of our venerable brothers the patriarchs, archbishops, bishops and other prelates and ordinaries of places, that each in his own churches, cities and dioceses take care that these present letters and copies thereof be published and inviolably observed.
11 § 8. And lest anyone be able to excuse himself by ignorance of the present letters, we impose a penal sanction.
12 those at the doors of the basilicas of St. John Lateran and of the Prince of the Apostles in the City, and in the open space of the Campus Florae, and in the Apostolic Chancery to be affixed and published, and copies thereof affixed there to be left, and then in the same Apostolic Chancery, in a book called a quire, among other perpetual constitutions to be described and registered. We decree that the publication in the aforesaid basilicas and in the open space of the Campus Florae being made, after the lapse of the time prescribed above to bind and affect each one of the aforesaid persons just as if these present letters had been personally intimated to individual persons aforesaid.
13 9. We also wish that of the same present letters, transcripts, etc.
