Bull on the Maronite hospice in Rome and the dissolution of the parish of St. John de Ficocia
to be instructed in the City; and the appointment of a cardinal for its governance; and the assignment of annual revenues for their support.
1 Gregory, bishop, servant of the servants of God, for perpetual remembrance of the matter.
2 Human counsels sometimes turn out so that those things which are established by prudent deliberation from the beginning, it is worthwhile to change afterwards, in hope of better future fruit.
3 § 1. For recently, in order that to the Maronite nation of the Pontiffs, who, dwelling in the mountains of Lebanon, have retained the Catholic faith under the obedience and devotion of the Holy Roman Church for many centuries, and at certain intervals of years are accustomed to send some to visit the threshold of the Apostles and to embrace and acknowledge the Apostolic See, amidst so many surrounding infidel and schismatic sects, a particular place might be provided by our care for the exercise of hospitality towards the natives of the same nation flowing into the City, and so that the devotion of the same nation towards that See might receive continuous increase, and the seeds of faith preserved by so great a father might not wither away, we have perpetually dissolved certain unions, annexations and incorporations formerly made by apostolic authority of the parochial church of St. John of Ficocia, in the region of Trivio of the City, with the parochial church of St. Andrew, of the same region, and at the same church of St. John, with the name, denomination and essence of a parochial church therein also perpetually suppressed and extinguished, and the care of souls of its parishioners, together with the same parishioners and parochial rights, transferred to the said church of St. Andrew, we have likewise perpetually erected and instituted one hospital in which the poor pilgrims of the said nation ought to be received and cared for, and to the hospital thus erected and instituted we have perpetually granted the same church of St. John, rendered without cure, with its houses, buildings, gardens, members and pertinences contiguous thereto and their situation and extent likewise perpetually.
4 § 2. Moreover, by other letters of ours to the same hospital, in order that it might more conveniently bear the burdens incumbent upon it, we assigned an annual pension, in a certain manner and form then expressed, free, immune and exempt and lasting for fifteen years then next following only, of two hundred ducats of the money of those parts, upon the fruits, revenues and proceeds of the episcopal table of St. Agatha, and to the rector or administrator for the time being of the said hospital or its lawful procurator, during the said fifteen years only, through our venerable brother Felician, bishop of St. Agatha, and his successors, the prelates or administrators for the time being of the church of St. Agatha, even if a thousand ducats annually should not remain to them from the aforesaid fruits, revenues and proceeds, to be paid in full in each year, in certain places and terms, and under sentences, censures and penalties, also then expressed, we reserved and constituted and assigned, as is more fully contained in each of the aforesaid letters.
5 § 3. Now indeed, this matter of the erection of the hospital having been more carefully considered, although it be a work of signal piety to them, and more pleasing and convenient to the spiritual welfare of the said nation, yet emulating greater charisms, we judge it would be for greater praise of God and more useful operation for the same nation, if, in place of the said hospital which is still recent in its beginnings, one college should be erected and instituted for receiving and instructing the boys of that nation apt for pursuing good letters. For since in those parts, situated under the heavy yoke and tyranny of the Turks, scarcely any opportunity is given to cultivate the studies of good letters, and hence many are held back from the Catholic faith in eternal darkness, and the simple and rude are easily drawn away from the cultivation of the truth received, we altogether hope that, as time succeeds, the alumni of that college, imbued more abundantly with the odor of piety and true religion, from the cypresses of Mount Sion and the documents of the Holy Roman Church, which alone is the head of others, may pour that into the cedars of Lebanon, and their nation, and sustain and repair the collapsing and troubled faith in their regions by the benefit of God; and thus the aforesaid corporal work, which would have profited only a few in this City, may be converted into a more spiritual utility and salvation of the whole nation.
6 § 4. Wherefore, by a similar motion and from certain knowledge, and from the fullness of apostolic power, in the said hospital the name, denomination and essence of a hospital, and whatsoever burden of hospitality to be exercised therein, we perpetually suppress and extinguish by apostolic authority, by the tenor of these presents, saving and preserving unharmed the dissolution, concession, pension and other matters aforesaid, and we erect and institute it in perpetuity, by the authority and tenor aforesaid, into a college to be called the Maronite College, for the purpose of nourishing the youth of that nation and adorning them with good morals, and instructing them with true piety and sound doctrine and other virtues worthy of a Christian, and we substitute the college thus erected and instituted in place of the said hospital, as regards the church of St. John, and its houses, buildings, gardens, members and appurtenances, and their site and extent, as well as the pension of two hundred ducats of this kind, and the terms of the same pension accrued and unpaid, if any there be, in all respects and entirely, just as if it had specially and expressly emanated from the beginning for the college itself, and not for the hospital, and had been granted and reserved to it.
7 § 5. And nevertheless to the same college we assign the church of St. John, together with the houses, buildings, gardens, members and appurtenances thereof, and their site and extent in such manner that it shall be lawful for the protector or rector of the said college for the time being to apprehend and perpetually retain the full bodily possession of all these things, by himself or through another or others, in the name of the same college, by his own authority, freely; and to convert the fruits, revenues and proceeds, rights, emoluments and whatever advantages arising therefrom to the uses and benefit and necessities of the college and church of St. John aforesaid; and likewise to have the church of St. John itself served by one or more priests, even of the said nation, secular or regular, to be appointed and removed at the pleasure of the protector of this college for the time being, and to cause masses and other divine offices to be celebrated, even in the Arabic or Chaldean language, no license being required therefor, we likewise grant in perpetuity by the same apostolic authority and tenor. And the annual pension of two hundred ducats aforesaid, upon the fruits, revenues and proceeds of the aforesaid mensa, to the same college or to its protector or rector for the time being, or to his procurator or steward, having special mandate thereto from the protector or rector himself, during the said fifteen years only, by the aforesaid Bishop Felician and his successors, in each year, in the place and at the terms, and under the sentences, censures and penalties, and with all and singular exemptions, immunities, liberties, decrees and clauses, and otherwise in the manner and form in which it was reserved to the said hospital and ought to be paid, to be paid in full, we reserve, constitute and assign by apostolic authority and similar tenor.
8 § 6. Moreover, the aforesaid college, its rector, stewards, masters, teachers and scholars for the time being existing therein, and their servants, officials and ministers, as well as the movable and immovable goods of the college itself, present and future, of whatsoever quality and quantity existing, and as much in the said City as outside it and elsewhere in whatsoever places situated, from all jurisdiction, dominion, superiority and power of the vicar, senator, conservators and reformators of the said City for the time being, as well as of the rector of the General Studio of the same City, and of the ordinaries of places and other judges and officials whatsoever constituted in the same City or elsewhere.
9 § 7. And likewise the same college, in its own goods and things, and by reason of the said college, the scholars and persons dwelling therein, and others contracting with it, from all and singular duties of gates, mills, flour, three per hundred, and four julii for each measure of wine accustomed to be paid, and other taxes, tolls, revenues, requisitions, and land and sea gabelles, customs, bulletins and whatsoever other burdens, ordinary and extraordinary, hitherto imposed in whatsoever manner and hereafter at any time, for whatsoever occasion or cause, even of necessity to be expressed, to be imposed, even in the manner of exemption of the beloved sons, the clerks of the Apostolic Chamber, even by reason of the Ripa, Ripetta, the land customs, even called the grace of the aforesaid City, as well as of meats, wine, grains, cloths, linen, wool, silk, books, papers and whatsoever other things necessary for human sustenance and clothing, from the whole of our Ecclesiastical State and from whatsoever other places outside the said
10 Exemption from the jurisdiction of whatsoever ordinaries and judges, and from the payment of gabelles and whatsoever tolls is granted;
11 Stallini consistenlibus, ad dictum collegium now by land and by sea and by fresh water and otherwise in any manner whatsoever to be brought, and also already to the City itself brought and existing in it, and for the said college in great or small quantity both in barks and in warehouses and elsewhere anywhere to be purchased, by apostolic authority and by the tenor aforesaid, we exempt and free, and under the protection of Blessed Peter and of the said See and of our own we take up, and to ourselves and to the same See immediately we subject.
12 § 8. To the same college itself, to the rector, subdeacon and household, to the teachers, masters, and to all the officials, ministers, persons and things whatsoever, by all the privileges, exemptions, liberties, faculties, graces and statutes indulged to the same college, which the general studio of the said city, as well as other colleges of the German, English and Greek nations in the same City instituted by us, and their rectors, scholars, teachers, masters, stewards, officials, ministers and persons in any manner whatsoever use, enjoy and are glad, and to use, enjoy and be glad can and will be able in any manner whatsoever in the future, not only in their likeness, but equally principally and uniformly in all things and through all things to use, enjoy and be glad may be able, by the same apostolic authority and tenor, likewise perpetually we concede and indulge, and those things to them we communicate.
13 § 9. Most strictly forbidding to the vicar, to the officials of the Roman Curia and to the City, and to the rector of the Studio, and to all judges and officials of this sort, and also for the time being existing to the camerlengo of the Holy Roman Church, to the presidents and to the aforesaid clerics, and to whatsoever commissaries for the exaction of tithes and of other burdens aforesaid for the time being deputed, lest, under the pretext of any letters whatsoever granted to them under whatsoever tenors and forms, the college of Maronites, and its goods;
14 rector, scholars, teachers, masters, stewards, officials and ministers aforesaid or any of them in the aforesaid matters in any manner whatsoever molest or permit to be molested.
15 § 10. But in order that for the conservation of the same college of Maronites itself and for its good governance, both in those things which are deputed to instruction and discipline, and which pertain to food, clothing and other such necessities, suitable provision may be made, our beloved son Anthony, of the title of St. Eusebius, presbyter cardinal, called Garaffa, protector and defender of the same college of Maronites, whose counsel and aid all the aforesaid things and whatever else pertains to the same scholars admitted into the college of Maronites and to be retained, and otherwise in any manner whatsoever necessary, may be done, established and ordained, we constitute and depute. And also to Anthony the cardinal and to the protector aforesaid for the time being existing, for the wholesome direction and conservation of the same college of Maronites and of its persons, goods, things and rights, both spiritual and temporal, rectors, teachers, masters, stewards, advocates, procurators, and other ministers and officials to be deputed in it and to be removed, and in place of those removed others to be supplied; and also statutes, ordinances and decrees whatsoever, lawful however and honest and not contrary to the sacred canons and decrees of the Council of Trent, to be made and issued; and those, as often as for their and the times' quality or otherwise expedient shall seem, to be changed, corrected, moderated, reformed, interpreted, and also others from the beginning to be drawn up, which, after they shall have been issued, changed, corrected, moderated, reformed and drawn up, by that very fact by the said apostolic authority confirmed and approved are and are to be deemed, and by all, to whom for the time being it shall pertain, even under penalties in those acting against to be established, to be observed ought, full and free facility we grant.
16 § 11. Decreeing all the aforesaid things and each one and the present letters at no time whatsoever, whether for the reason that the causes, on account of which all these things were done, before the said vicar or any other were examined, verified and approved, and whoever had interest in it were not called to it, nor to the same aforesaid things consented, or otherwise from whatsoever causes, of the vice of subreption or obreption or nullity, or of our intention or of any other defect, to be noted, impugned, retracted, or even revoked, suspended, restricted, limited or into law or controversy called, or to the terms of law reduced to be able; nor anyone to the same present letters in the Camera aforesaid, according to the constitution of Pius Pope V, our predecessor, thereupon issued, or otherwise at any time whatsoever to be presented, intimated and registered to be bound; nor on account of this those to be invalid, but in all respects to be valid, as if the aforesaid constitution and other contrary things in no manner whatsoever had emanated.
17 § 11. Decreeing that all and each of the foregoing matters and the present letters at no time whatsoever, whether because the causes on account of which all these things were done have been examined, verified and approved before the said vicar or any other whatsoever, and whosoever had an interest in the matter has not been called to it, nor have they consented to the same foregoing matters, or for any other causes whatsoever, may be noted, impugned, retracted, or even revoked, suspended, restricted, limited or brought into law or controversy, or reduced to the terms of law; nor shall anyone be bound to present, intimate and cause to be registered the same present letters in the Chamber aforesaid, according to the constitution of Pius, Pope V, our predecessor, issued thereupon, or otherwise at any time; nor on that account shall those letters be null, but shall be valid in every way, as if the aforesaid constitution and other contrary ones had not been issued at all.
18 § 12. And thus by whatever ordinary and delegated judges, even auditors of cases of the Apostolic Palace, and cardinals of the same Holy Roman Church, having been removed from them and from each of them any faculty and authority of judging and interpreting otherwise, it ought to be judged and defined; and likewise null and void, even if invalid, should anything contrary to these things be attempted by anyone whatsoever, by whatever authority, knowingly or unknowingly.
19 § 13. Notwithstanding the foregoing and the Lateran Council last celebrated, perpetual unions, unless in cases permitted by law, being made, and annual pensions on the fruits of episcopal menses, unless from cession or another probable cause, being reserved, and, insofar as it is necessary, our unions being committed to the parties, with those having an interest being called, and the value being expressed even of the benefice to which another is sought to be united, as well as concerning the giving of consent in pensions, and other apostolic constitutions and ordinances; and the statutes and customs of the City and the places and Camera aforesaid, even those confirmed by oath, apostolic confirmation or any other firmness; privileges also, indults and apostolic letters, those to the vicar, senator, conservators, reformators, ordinaries and other judges and officials, as well as to the camerlengo, presidents and clerics aforesaid, and to any whatsoever customs officials, commissaries and other persons appointed from time to time for the exaction of tolls and other burdens of this kind, as well as to our beloved sons the Roman people and the communities, universities and men of any places whatsoever, under whatsoever tenors and forms, and with whatsoever, even derogatory clauses of derogations and other more efficacious and unusual clauses, as well as irritant and other decrees, in general or in particular, even by our own motion, knowledge and fullness of power in like manner, and otherwise in any way whatsoever, even repeatedly, granted, approved and renewed; all of which, even if special, specific, express and individual mention, or any other expression of them and their full tenors word for word, and not by general clauses importing the same, ought to have been made, or some other exquisite form to be observed for this were required, these tenors, as if word for word, nothing whatsoever being omitted, and the form transmitted in them being observed, inserted into these presents, we hold as sufficiently expressed, those otherwise remaining in their force, this time only, we specially and expressly derogate from; as well as from all those things which in the individual letters aforesaid we wished not to stand in the way, and from all other things contrary whatsoever. Let no one therefore etc. But if anyone etc. Given at Rome at St. Peter's, in the year of the Incarnation of our Lord one thousand five hundred eighty-four, on the fifth day before the Kalends of July, in the thirteenth year of our pontificate.

18 § 12.
