Misericordiarum Pater
Brief approving the rules and constitutions of the Syrian Maronite monks of the Order of St. Anthony Abbot
CLEMENT PP. XII
for perpetual remembrance of the matter.
1 § 1. Father of mercies and God of all consolation, who always, and especially amid the most grave cares and solicitudes of the most sacred apostolate, consoles us in all our tribulation, so that we ourselves, embracing those who are in all distress with paternal charity, may be able to console them, has consoled us by his ineffable goodness in the coming of our beloved son Peter Hataya, a monk expressly professed and first diffinitor of the Order of St. Anthony the Abbot of the Congregation of Syria, called St. Isaiah.
2 § 2. He, coming from Syria, where the orthodox Catholic faith among the adverse sects of superstition and heresy is most purely cultivated and guarded by the Maronite nation, always most devoted to this Holy See, recently caused to be set forth to us on behalf of our beloved sons Simon Hariddi, Abbot General, and Abraham Esaf, Bimini Agia, Peter and Paul Ghiami, diffinitors, and all the monks of the aforesaid Order and Congregation, that, although they themselves observe the same constitutions in certain light matters unchanged, which, by our other letters in similar form of a brief dated 21 March in the year 1632, expedited by us, were approved and confirmed by our beloved sons likewise 1 the Syrian Maronite monks of the same Order of St. Anthony the Abbot, but of the Congregation called of Mount Lebanon, and mention was made of their Congregation of St. Isaiah in our aforesaid letters, nevertheless, in order that they may more eagerly testify the faithful and constant observance and obedience which they profess to the same Holy See, and may strive to obey the decree of the national Synod most recently celebrated on the aforesaid Mount Lebanon, in which it was prescribed that all Maronite monks should have their constitutions approved and confirmed by the aforesaid Apostolic See, desiring the approval and confirmation of such constitutions, as aforesaid, already approved and confirmed for the same Congregation of Mount Lebanon, for their own Congregation of St. Isaiah, they humbly caused supplication to be made to us, that we would deign to provide opportunely for them in the foregoing matters and to grant them indulgence from apostolic benignity.
3 § 3. The constitutions, moreover, are of the following tenor, namely:
4 € Constitutions of the Syrian Maronite monks of the Order of St. Anthony the Abbot of the Congregation called of St. Isaiah of Syria. - First Part. - Chapter I. On obedience. 2
5 § 4. We therefore, being willing to accede favorably, as far as we are able with the Lord, to the wishes of the same Simon the Abbot, and of Abraham, Bimini and Paul the diffinitors and monks in this matter, and absolving them from whatsoever excommunication, suspension and interdict and other ecclesiastical sentences, censures and penalties, whether by law or by man, imposed on any occasion or cause, if they are bound by them in any way whatsoever, for the purpose of obtaining the effect of these presents only, by the tenor of these letters, and holding them to be absolved, inclined to such supplications, we confirm and approve by apostolic authority, by the tenor of these presents, perpetually, all and singular the rules and constitutions aforesaid and whatsoever is contained in them, and we add to them the strength of inviolable apostolic firmness, and we wholly and entirely supply and heal all and singular defects of law and fact, and of any solemnities whatsoever which ought to be observed even of necessity in similar cases, or any other formal and substantial defects whatsoever, if any have intervened or may be said, deemed or alleged to have intervened in the foregoing matters principally, or accessorily, or in any other manner whatsoever.
6 § 5. Decreeing that these same present letters and the rules and constitutions aforesaid shall always be firm, valid and efficacious and shall be, and shall obtain and secure their full and complete effects; and that they shall most fully avail in all respects and through all respects to those to whom it pertains and shall pertain at any time, and shall be inviolably observed respectively by them; and thus in the foregoing matters by whatsoever ordinary judges and delegates, even auditors of causes of the apostolic palace and cardinals of the aforesaid Holy Roman Church even of the side, legates and Nuncios of the Apostolic See and any others whatsoever exercising or about to exercise any preeminence and power, with faculty and authority of judging and interpreting otherwise taken away from them and from each of them, it ought to be judged and defined, and if anything otherwise should be attempted in these matters by anyone whatsoever with any authority, knowingly or unknowingly, it shall be null and void.
7 § 6. Notwithstanding apostolic constitutions and ordinances, and, insofar as it may be necessary, those of the aforesaid Congregation and Order, and any other statutes and customs whatsoever, even fortified by oath, apostolic confirmation or any other firmness, privileges also, indults and apostolic letters, even to the aforesaid Congregation and Order and their superiors, monks and persons under whatsoever tenors and forms of words, and with whatsoever even derogatory clauses of derogatory clauses and other more efficacious, most efficacious and unusual clauses.
APPROBATION
8 By the mandates of His Holiness Father Clement XII, Supreme Pontiff, We have carefully examined the Rules and Constitutions of the Monks of the Syrian Maronite Order of St. Anthony the Abbot of the Congregation of Mount Lebanon contained in the present volume. And since they contain nothing which is contrary to Orthodox Faith, outstanding piety, good morals, and the exact observance of Monastic Institute; We judge that they can be confirmed by apostolic letters in the form of a Brief, and also published by the press of the Holy Congregation for the Propagation of the Faith.
9 Given at Rome, from our residence on 17 January in the year of our Lord 1732.
