ON THE ERECTION OF THE ECCLESIASTICAL SEE OF ADAMANTINA. BENEDICT, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR THE PERPETUAL MEMORY OF THIS MATTER

1 Whenever the opportunity presented itself to establish new ecclesiastical provinces, so that from this the good of the Catholic religion might receive increase and the faithful might receive the more abundant and ready spiritual assistance which they need, the ecclesiastical documents testify that the Supreme Pontiffs have always done this.

2 Since therefore the Apostolic Nuncio in the dominion of Brazil has long been pressing that for the greater spiritual good, whether of Bishops or of the faithful, in the very extensive ecclesiastical province of Mariannensia another ecclesiastical province be established by erecting the diocese of Adamantina into a Metropolitan See, We, having carefully and attentively weighed all the considerations of the matter, have determined that We should proceed to its erection.

3 Wherefore, having consulted the beloved sons, the Cardinals of the Holy Roman Church of the Sacred Consistorial Congregation, with the consent of Our venerable brother the present Archbishop of Mariannensia and of others having an interest therein, and having also supplied, insofar as it may be necessary, the consent of those whose interest it is or who may presume their interest to be involved, by the fullness of apostolic power We decree and establish the following in perpetual manner.

4 Adamantina, a See subject to the Metropolitan jurisdiction of the Archiepiscopal Church of Mariannensia, We by apostolic authority release and exempt; and We raise and elevate it to the rank and dignity of a Metropolitan Church.

5 To this Metropolitan See of Adamantina, thus erected, We fully attribute and assign all and singular the rights, privileges and prerogatives which are customarily and habitually held by Metropolitan Sees in the Brazilian region, and We enhance the venerable brother Joachim Silverius De Sousa, who at present holds the See of Adamantina, with the title, dignity, rights and privileges of Archbishop, together with the faculty of bearing the Cross and Pallium, as do the other Archbishops, provided however that this shall have been requested from and obtained from the Apostolic See in Sacred Consistory. Moreover, the Chapter of the aforesaid Cathedral Church of Adamantina We by like apostolic authority immediately raise to the rank, title and honour of a Metropolitan Chapter, so that from henceforth it shall enjoy all the preeminences, honours, rights and privileges with which other Chapters of this kind in those parts ordinarily are endowed.

6 Furthermore, We exempt and withdraw from the Metropolitan jurisdiction of the Archbishop of Mariannensia the dioceses of Montisclarensis and Arassuahyensis and attribute and enroll them as suffragans to the Metropolitan See of Adamantina and constitute and enroll their Bishops for the time being existing as Suffragans of the Archbishop of Adamantina, who are subject to metropolitan jurisdiction, and We will and command that the clergy and people of the said dioceses of Montisclarensis and Arassuahyensis, just as they are subject to their own Bishops in episcopal matters, so also be subject to the aforesaid Archbishop of Adamantina in metropolitan jurisdiction according to the canonical sanctions. To this Metropolitan See of Adamantina, however, as erected above, for its diocese We assign and assign the same territory and the same region which the Episcopal See of Adamantina obtained for itself as peculiar and proper, the same limits and boundaries which have hitherto formed and constituted the territory and extent of the episcopal diocese of Adamantina, as suppressed in the foregoing, being always preserved. Moreover, We reserve to Ourselves and to the Apostolic See the faculty of freely making new circumscriptions and dismemberments in this new ecclesiastical province, whenever it shall seem more expedient in the Lord, without any need of seeking the consent of the Prelates and Chapters, or of assigning any territorial compensation. Those things which by these Letters, by apostolic authority, have been decreed by Us, it is permitted to no man at any time whatsoever to infringe, or to act contrary to them, or in any way to oppose them. If anyone, which God forbid, shall presume to attempt this, let him know that he shall incur the penalties established by the sacred canons against those who resist the exercise of ecclesiastical jurisdiction. For the faithful execution of all these things We appoint the venerable brother Angelo Hyacinthus Scapardini, Archbishop with the title of Damascus and Apostolic Nuncio in the Brazilian Republic, and We grant to him the necessary and opportune faculties, even of subdelegating, for the purpose in question, another man constituted in ecclesiastical dignity, and especially the venerable brother the present Prelate of Adamantina, and of pronouncing a definitive sentence concerning any difficulty and opposition that may arise, imposing upon him the burden of transmitting to Rome, to the Sacred Consistorial Congregation, within six months, an authentic copy in proper form of the absolute execution of this Our mandate, so that it may be preserved in the archive of the same Sacred Congregation. We finally decree that these present Letters shall be valid notwithstanding any contrary provisions whatsoever, even those worthy of particular and express mention.

DELL'EREZIONE DELLA CHIESA ADAMANTINA. BENEDETTO VESCOVO SERVO DEI SERVI DI DIO A PERPETUA MEMORIA DELLA COSA

1 Tutte le volte che si è presentata l'occasione di istituire nuove province ecclesiastiche, affinché da ciò derivasse il maggior bene della religione cattolica e i fedeli ricevessero più abbondanti e pronti i sussidi spirituali di cui hanno bisogno, i documenti ecclesiastici attestano che i Sommi Pontefici l'hanno sempre fatto.

2 Poiché dunque il Nunzio Apostolico nel dominio brasiliano da tempo insisteva affinché, per il maggior bene spirituale sia dei Vescovi sia dei fedeli, nella vastissima provincia ecclesiastica Marianense fosse costituita un'altra provincia ecclesiastica erigendo in sede Metropolitana la diocesi Adamantina, Noi, dopo aver diligentemente e attentamente considerato tutti i motivi della questione, abbiamo ritenuto opportuno procedere alla sua erezione.

3 Perciò, di concerto con i diletti figli Cardinali della Sacra Congregazione Concistoriale, con il consenso del venerabile fratello attuale arcivescovo Marianense e degli altri interessati, e inoltre, per quanto sia necessario, supplito il consenso di coloro che vi hanno interesse o che presumono di avervi interesse, dalla pienezza della potestà apostolica abbiamo stabilito di decretare in perpetuo quanto segue.

4 La sede Adamantina, per diritto metropolitico dell'Arcidiocesi Marianense, con autorità apostolica la sciogliamo e l'esoneriamo; e la eleviamo e la innalziamo al grado e alla dignità di Chiesa Metropolitana.

5 A questa Sede Metropolitana così eretta, Adamantina, attribuiamo e assegniamo pienamente tutti e singoli i diritti, i privilegi e le prerogative che solito e consueto è che abbiano le Sedi Metropolitane nella regione brasiliana, e il venerabile fratello Gioacchino Silverio De Sousa, che attualmente possiede la sede Adamantina, lo aumentiamo del titolo, della dignità, dei diritti e dei privilegi di Arcivescovo, insieme con la facoltà di portare la Croce e il Pallio, come gli altri Arcivescovi, dopo però che questo sia stato richiesto alla Sede Apostolica nel Sacro Concistoro e ottenuto. Inoltre il Capitolo della suddetta Chiesa Cattedrale Adamantina lo eleviamo immediatamente al grado, al titolo e all'onore di Capitolo Metropolitano con la medesima autorità apostolica, affinché da allora in poi esso stesso goda e fruisca di tutte le preminenze, gli onori, i diritti e i privilegi di cui ordinariamente godono gli altri Capitoli di questo genere in quelle parti.

6 Inoltre dal diritto metropolitico dell'Arcivescovo Marianense esoneriamo e sottraiamo le diocesi di Montes Claros e di Araçuaí e le attribuiamo e le iscriviamo come suffraganee alla Sede Metropolitana Adamantina e i loro Vescovi pro tempore esistenti li costituiamo e li iscriviamo come Suffraganei dell'Arcivescovo Adamantino, che siano soggetti al diritto metropolitico, e vogliamo e ordiniamo che il clero e il popolo delle suddette diocesi di Montes Claros e di Araçuaí, così come riguardo all'autorità episcopale sono soggetti ai loro Vescovi, così riguardo alla giurisdizione metropolitana siano soggetti al predetto Arcivescovo Adamantino secondo le sanzioni canoniche. Se qualcuno, che Dio non voglia, presumesse di tentare ciò, sappia che incorrerà nelle pene stabilite dai sacri canoni contro coloro che si oppongono all'esercizio della giurisdizione ecclesiastica.
