A PART OF THE TERRITORY OF REGISTRO IS DISMEMBERED; AND A NEW PRELATURE "NULLIUS" "CHAPADENSIS" IS ERECTED THEREFROM, SUFFRAGAN TO THE METROPOLITAN CHURCH OF CUIABÁ. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 In order that spiritual assistance may be more easily provided to the Christian faithful, it is the duty of the Apostolic See to separate from dioceses which extend over too vast a territory a portion to be entrusted to the governance of another Bishop. Since it is clear to Us that very many of the faithful dwelling in the region of Matto Grosso, who belong to the Churches of Cuiabá, Corumbá and Registro, are so far distant from the seat of their own Bishops that their spiritual needs cannot be adequately provided for, We, desiring to remedy this state of affairs, have determined to establish a new Prelature Nullius in that region. Wherefore, by the counsel of the venerable Brethren of Ours, the Cardinals of the Holy Roman Church presiding over the Consistorial Congregation, having first obtained the vote of the venerable Brother Benedict Aloysius Masella, Archbishop Titular of Caesarea in Mauretania, Our Nuncio to the Brazilian Republic, and with the assent of the Ordinaries under whose jurisdiction that region lies, and having supplied, insofar as it is necessary, the consent of those to whom it pertains or who presume it to pertain to them, We, by the fullness of apostolic power, separate from the archdiocese of Cuiabá, from the diocese of Corumbá and from the Prelature Nullius of Registro, in the proportion pertaining to each, the territory circumscribed by the boundaries hereinafter set forth, and from the territory thus severed We erect a new Prelature Nullius, which We will to be called Chapadense. Its boundaries shall be: On the north, the same boundaries which separate the parish of St. Anne of Chapada from the Prelature Nullius of Adamantina. On the west, a line which runs from the source of the river das Piavas to the point where the river Coxipó-Mirim descends from the high plateau; the extreme limit of this high plateau as far as the small river Madeira; then the left bank of the same river (which lower down takes the names Mutum and Cujalá-Mirim) as far as its mouth in the river Cuiabá; and the left bank of the rivers Cuiabá, St. Lawrence and Paraguay as far as the place where the bank of the river Paraguay divides to form the island called Paraguay-Mirim. On the south, a straight line which extends from the division of the river Paraguay to the point where the river Taquari divides, forming the river Taquarzinho; then the boundary of the right bank of the same river Taquari as far as the line which divides the parish of Corumbá from the parish of Coxim. On the east, the same line as far as the place where the rivers Pequiri and Correntes meet; then the river Correntes as far as the mouth of the river Itiquira; the same river as far as the high plateau from which it flows; finally the same boundaries as exist between the parish of St. Anne of Chapada and the Prelature of Registro. We establish the seat of this new Prelature in the city of St. Anne of Chapada, and the church dedicated to God in honour of St. Anne existing there We raise to the rank and dignity of a Prelatic Church, to which We therefore attribute to the See and Church as well as to the Prelates for the time being of Chapada all the rights and privileges and impose upon them all the burdens and obligations which are attached to other Prelatures and Churches and their Prelates according to the rule of law. We constitute this Prelature Nullius Chapadense as suffragan to the Metropolitan Church of Cuiabá and subject its Prelate to the metropolitan authority of the Archbishop of Cuiabá. As regards the governance and administration of the same Prelature, the election of a Vicar Capitular or Administrator during a vacancy of the see, the rights and burdens of clergy and faithful and other such matters, We command that what the Sacred Canons prescribe in the matter be observed. As regards the clergy in particular, We decree that as soon as these Letters of Ours shall have been put into effect, the clergy shall by that very fact be considered enrolled in the Church in whose territory they legitimately exist. To the endowment of the Prelature itself We assign and attribute the offerings, subsidies and goods of whatever kind which have been or shall be collected for this purpose. Finally, We command that this new Prelature Chapadense also send at its own expense two selected young men, or at least one without interruption, to the Pontifical College Pius Brazilianus of the City, so that under the eyes of the Roman Pontiff they may be trained in hope for the Church. To execute all these things as disposed and constituted above, We have chosen the venerable Brother Benedict Aloysius Masella, whom We mentioned above, Our Nuncio to the Brazilian Republic, and We therefore grant to him the necessary and appropriate faculties, even to subdelegate for the purpose in question any man constituted in ecclesiastical dignity or office, and We impose upon him the duty of transmitting as soon as possible to the Consistorial Congregation an authentic copy of the acts of the execution accomplished. These present Letters and all things contained therein, even from the fact that anyone to whom it pertains, or who presumes it to pertain to him, has not been heard or has not consented to the foregoing, even if they should be worthy of express, specific and individual mention, can never at any time be noted, impugned or called into question on account of any defect of subreption or obreption or nullity, or of Our intention, or any other defect, however substantial and unforeseen; but We will that they, as made and emanated from certain knowledge and the fullness of power, shall remain perpetually valid and shall produce their full and complete effects and obtain them, and shall be inviolably observed by all to whom it pertains; and if it should happen that anyone, by whatever authority, knowingly or unknowingly attempts anything contrary to these things, We will and decree that it shall be entirely null and void; notwithstanding, insofar as it is necessary, the rules established in synodal, provincial, general and universal Councils, general or special Apostolic Constitutions and Ordinances and any other dispositions of Our Predecessors the Roman Pontiffs and all other things to the contrary whatsoever. We finally decree that to copies of these Letters, even printed ones, subscribed however by the hand of some public Notary and sealed with the seal of some man constituted in ecclesiastical dignity or office, the same faith shall be given as would be given to these Letters themselves if they were exhibited or shown. Let no one be permitted to infringe this page of our dismemberment, erection, concession, subjection, statute, mandate, delegation, derogation and will, or to act contrary to it. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul.

1 Affinché ai fedeli cristiani i sussidi spirituali siano più facilmente prestati, è compito della Sede Apostolica separare dalle diocesi, che si estendono su un territorio eccessivamente vasto, una parte da affidare al governo di un altro Vescovo. Poiché dunque a Noi consta che moltissimi fedeli dimoranti nella regione del Mato Grosso, che appartengono alle Chiese di Cuiabá, Corumbá e Registro, distano tanto lontano dalla sede dei loro Vescovi, che non si può provvedere sufficientemente alle loro necessità spirituali, Noi, desiderando rimediare a questa condizione di cose, abbiamo stabilito di costituire nella medesima regione una nuova Prelatura nullius. Perciò, con il consiglio dei venerabili Nostri Fratelli Cardinali della Santa Romana Chiesa preposti alla Sacra Congregazione Concistoriale, avuto il voto del venerabile Nostro Fratello Benedetto Aloisi Masella, Arcivescovo titolare di Cesarea in Mauritania, Nostro Nunzio presso la Repubblica Brasiliana, e con l'assenso degli Ordinari, sotto la cui giurisdizione si trova quella regione, e supplito, per quanto occorra, il consenso di coloro che vi hanno interesse o che presumono di averne, Noi, con la pienezza della potestà apostolica, separiamo il territorio, circoscritto dai confini qui di seguito enunciati, dall'arcidiocesi di Cuiabá, dalla diocesi di Corumbá e dalla Prelatura nullius di Registro, per la rispettiva parte di ciascuno, ed eriggiamo una nuova Prelatura nullius dal territorio così separato, che vogliamo sia chiamata Chapadense. I cui confini saranno: A settentrione gli stessi confini che separano la parrocchia di Sant'Anna di Chapada dalla Prelatura nullius di Adamantina. A occidente la linea, che dal sorgente del fiume das Piavas decorre fino al punto dove il fiume Coxipó-Mirim si precipita dall'alta pianura; l'estremo limite di questa alta pianura fino al piccolo fiume Madeira; quindi la riva sinistra dello stesso fiume (che più in basso prende i nomi di Mutum e Cuiabá-Mirim) fino alla sua foce nel fiume Cuiabá; e la riva sinistra dei fiumi Cuiabá, San Lorenzo e Paraguay fino al luogo dove la riva del fiume Paraguay si divide per formare l'isola chiamata Paraguay-Mirim. A meridione la linea retta, che dalla divisione del fiume Paraguay giunge al punto dove il fiume Taquari si divide, formando il fiume Taquarzinho; quindi il limite della riva destra dello stesso fiume Taquari fino alla linea, che divide la parrocchia di Corumbá dalla parrocchia di Coxim. Questa Prelatura nullius Chapadense costituiamo suffraganea della Chiesa Metropolitana di Cuiabá e il suo Prelato sottoponiamo al diritto metropolitico dell'Arcivescovo di Cuiabá. Per quanto riguarda il governo e l'amministrazione della medesima Prelatura, l'elezione del Vicario Capitolare o dell'Amministratore, sede vacante, i diritti e gli oneri del clero e dei fedeli e altre cose di tal genere, ordiniamo che si osservino le prescrizioni dei Sacri Canoni. Per quanto riguarda il clero in particolare, stabiliamo che non appena queste Nostre Lettere saranno mandate ad effetto, per ciò stesso i chierici siano considerati ascritti a quella Chiesa nel cui territorio legittimamente si trovano. Alla dote della medesima Prelatura assegniamo e attribuiamo le offerte, i sussidi e i beni qualunque che a questo fine siano già stati raccolti o siano da raccogliersi. Ordiniamo infine che anche questa nuova Prelatura Chapadense a sue spese mandi due giovani scelti, o almeno uno senza interruzione, al Pontificio Collegio Pio Brasiliano dell'Urbe, affinché sotto gli occhi quasi del Romano Pontefice siano formati nella speranza della Chiesa. Per l'esecuzione di tutte queste cose come sopra disposte e costituite, abbiamo scelto il venerabile Fratello Benedetto Aloisi Masella, che sopra abbiamo ricordato, Nostro Nunzio presso la Repubblica Brasiliana, e gli attribuiamo perciò le facoltà necessarie e opportune, anche di subdelegare a questo effetto qualunque uomo costituito in dignità o ufficio ecclesiastico, e gli imponiamo l'onere di trasmettere al più presto alla Sacra Congregazione Concistoriale una copia autentica degli atti dell'esecuzione compiuta. Queste Nostre Lettere e tutto ciò che in esse è contenuto, anche per il fatto che chiunque vi abbia interesse, o presuma di averne, non sia stato ascoltato, o non abbia acconsentito alle premesse, anche se degno di menzione espressa, specifica e individuale, non possano in nessun tempo essere notate, impugnate o messe in controversia per vizio di surrezione o di obreptione o di nullità, o per difetto di Nostra intenzione, o per qualunque altro, benché sostanziale e inaspettato, difetto, ma rimangano perpetuamente valide e siano e rimangono come emanate da certa scienza e dalla pienezza della potestà, e sortiscano e ottengano i loro pieni e interi effetti, e debbano essere inviolabilmente osservate da tutti coloro a cui spetta, e, se per caso da chiunque, con qualunque autorità, consapevolmente o inconsapevolmente, si tentasse di agire diversamente su queste cose, vogliamo e decretiamo che sia completamente irritum e vano e rimanga tale; non ostante, per quanto occorra, le regole edite nei Concili sinodali, provinciali, generali e universali, le Costituzioni e le Ordinazioni Apostoliche generali o speciali e qualunque altra disposizione dei Nostri Predecessori Romani Pontefici e tutte le altre cose contrarie qualunque. Stabiliamo infine che ai transunti di queste Lettere, anche se stampati, sottoscritti però da mano di qualche Notaio pubblico e muniti del sigillo di qualche uomo costituito in dignità o ufficio ecclesiastico, sia attribuita la medesima fede che sarebbe attribuita a queste Lettere se le medesime fossero esibite o mostrate. A nessuno sia lecito infrangere questa pagina di separazione, erezione, concessione, soggezione, statuto, mandato, delegazione, deroga e della Nostra volontà, o contravvenirvi. Se qualcuno invece presumesse di tentare ciò con temerario ardimento, sappia che incorrerà nell'indignazione di Dio onnipotente e dei beati Apostoli Pietro e Paolo.
