Decretal on advocates and notaries who assist heretics (Liber Extra 5.7.11)

Decretal of Pope Innocent III ·

Liber Extra (X) 5.7.11
CAP. XI. *
Advocates or notaries, showing favor to heretics or their defenders, or pleading cases under them, and writing documents for them, are infamous, and suspended from that office.
Idem2.

1 If the earth itself should rise up against us, and if the heavens' stars should reveal and make manifest your iniquities and crimes to the whole world, so that not only men, but the very elements themselves should conspire for your destruction and ruin, and should blot you out from the face of the earth, sparing neither sex nor age, so that you should become a reproach unto all nations forever, yet sufficient and worthy vengeance could not be taken upon you. For you neither fear God, nor dread man, nor distinguish between the profane and the sacred, but you put light for darkness and darkness for light, and you call evil good and good evil; you disdain to procure a good name, which fattens the bones, and a good reputation, which is preferred to great riches, and you care not for infamy, since you have become hardened of face and have assumed the shameless countenance of a harlot. For you have rotted in sins, like beasts in their own filth, so that the smoke and stench of your putrefaction have already infected the regions round about, and have, as we believe, provoked the Lord himself to nausea. Indeed you excel all in sins, having become more perfidious than the Jews and more cruel than the pagans. The Jews indeed crucified the Lord once upon the cross, but you, crucifying him continually in his members, lacerate him with insults and contumely; and whereas they believe, albeit under the blindness of sin, that God the Father created all things visible and invisible, many of you believe that visible things were created and made by Lucifer. The pagans raged in slaying and sacrificing the bodies of Christians, but you intend to slay the whole man, secretly robbing the souls of the faithful from Christ and destroying both man at once. Yet neither these nor those knew Christ the Lord, for which reason they seem to have some excuse in their sins; but you, like the sons of Ephraim bending the bow, were marked with the character of Christ, and still wish to be reckoned in public profession of Christianity, yet turning your hearts backward and receding from the faith, you have become a perverse bow, ensnared in the snares of heretics and deformed by their wicked dogmas. Wherefore, truly in you is fulfilled the prophetic word: "The jackals have uncovered their breasts and suckled their whelps." For you have been given to drink not the wine of compunction, but the gall of the dragon, offered to you by heretics in the golden cup of Babylon. Already the waters have inundated you, and your sins have covered your heads, submerged in the abyss of vices. Already the deep has swallowed you up, and the pit of hell presses its mouth upon you. Indeed you have fallen into the lake of despair, since you disdain to rise from the depths. Wherefore, we justly fear lest the wrath of God come upon the sons of faithlessness, and he already sharpen his sword like lightning and execute judgment upon you with his hand, nor in the day of his fury be mindful of his mercy. But we, taking pity on your miseries, wish to meet the impending ruin of your destruction and to block the open way of your extermination, if we are able, beseeching God with prayers and imitating the footsteps of Abraham, who from the Lord, willing to overthrow Sodom and Gomorrah, obtained by multiplied intercessions that he would not destroy all for the sake of ten just men. For we wish to make trial whether any faithful remain among you, who have not bowed their knees to Baal, and who, after the example of the Ninevites, prostrate in sackcloth and ashes, might mitigate the wrath of the Lord and his fury, so that many might be spared for the sake of a few, and not all perish together. If anyone therefore is of God, let him join himself to us, for we wish to bear the sword of Phinees and to imitate the judgment of Moses, and with Mattathias to punish those who sacrifice to demons, so that with the Lord's aid the faithless and unworthy may be eliminated from the temple, and the leaven of heretical wickedness may be healthfully purged from the mass of the Lord's sprinkling. Therefore by apostolic writings we command you and strictly enjoin that, since certain of your fellow citizens, sons of Belial, in hatred of Christ and contempt of the apostolic see and ourselves, after the prohibition made by us, have attempted to elect certain believers in the Patarenes as consuls, and have not feared to institute as camerarius the very heresiarch himself, namely I. Tiniosi, son of perdition, who by reason of his iniquities is already long since bound by our mandate with the bond of excommunication and still persists in his contumacy, you should vigorously rise up against the elected ones themselves and the electors alike and their accomplices, resisting them with magnanimity and power, and attacking them sharply, and labor to frustrate and crush their first attempts, lest they be able to take root with a firm root. But so that with the roots torn out the stump may dry up completely and wither, we more strictly forbid under threat of anathema that anyone presume to swear to them as consuls or rectors or in any other manner. Those truly who are bound to them by any oath, or who have presumed to swear to them after such election, since there can be no fellowship of Christ with Belial, or of light with darkness, and a faithful one who has rashly violated faith with his creator ought in no way to keep faith with an apostate, since this is provided in the canons, we have judged them to be absolved from such an oath. Although many things have been issued and established by us and our predecessors against heretics, and you have no excuse in your sins, as if you had forgotten the commandments of the ancients, and because what is specially enjoined is usually feared more than what is generally commanded: we firmly forbid you advocates and notaries that you render any aid, counsel or favor to the aforesaid heretics, while they remain in their contumacy and error, Patarenes or believers, supporters or defenders of the same, nor provide them your patronage in causes or in matters, or to any litigants under their examination, and do not presume at any time to draw up public instruments for them or to make any writings. But if you should presume to act contrary to this, we decree that you be suspended from your office and subjected to perpetual infamy. Furthermore, lest judges and notaries who have consented to the aforesaid elected ones in such rash presumption glory in their wickedness, since he merits to lose the privilege who abuses the power permitted to him, we judge them to be suspended from their office, decreeing null and void whatever shall have been done or established by them and the aforesaid elected ones. [Sentences moreover etc. Given etc. 1205.]

Iam absorbuit vos profundum, ei urget super vos os suum puteus infernalis. In lacum desperationis siquidem incidistis, quum contemnatis resurgere a profundo.

Dato ecc. 1205.]
