PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR A PERPETUAL MEMORIAL OF THE MATTER

1 : • The care of all the Churches committed to Us by divine providence demands that the boundaries of dioceses be so arranged that the governance of the Christian faithful may be rendered easier and more suitable. Since therefore the diocese of St. Charles of Pinhal extends very widely, We, at the petition of Our venerable brother Joseph Marcondes Hörnern, Bishop of that Church, have determined that the territory of the same diocese is to be divided and new dioceses are to be erected from it. Having therefore consulted with Our venerable brothers the Cardinals of the Holy Roman Church presiding over the Sacred Consistorial Congregation and having obtained the favorable vote of Our venerable brother Benedict Aloysius Masella, Archbishop with the title of Caesarea in Mauretania and Apostolic Nuncio to the Brazilian Republic, and having supplied, insofar as it is necessary, the consent of those to whom it pertains or who presume it to pertain to them, by the fullness of Apostolic power, We divide the territory belonging to the same diocese of St. Charles of Pinhal into three distinct parts, in one of which We restrict and circumscribe the diocese itself of St. Charles of Pinhal, and in the other two parts We erect new dioceses, namely that of Jaboticabal, to be named from the city of Jaboticabal, and that of Rio Preto, to be named from the city of Rio Preto. The new diocese of Jaboticabal shall be circumscribed by a line which, beginning at the river Rio Grande at the mouth of the river Rio Turno, ascends through the same river to the mouth of the river Rio da Onça; it proceeds through this and through the Corrego das Anhumas to its principal source in Fumas, on the western part of the property commonly called the "Gloria" estate, thence to the principal source of the river Corrego Rico, on the southern part of the aforesaid property or estate "Gloria"; it descends through the river Corrego Rico to its mouth in Rio Mogy Guassù; it proceeds finally through the rivers Mogy Guassù, Pardo and Grande to the mouth of the river Turno. The same diocese thus circumscribed shall be constituted of sixteen parishes, namely: Jaboticabal, Barretos, Bebedouro, Pitangueiras, Viradouro, Monte Alto, Monte Azul, Tayassù, Tayuva, Olympia, Collina, Cajoby, Irupy, Piranjy, Guaracy and Severino. The other diocese of Rio Preto shall have its boundaries by a geographical line which, proceeding from the river Rio Grande at the mouth of the river Rio Turro, ascends through that river to the mouth of the river Rio da Onça; it proceeds through this and through the river Corrego das Anhumas to its principal source in Fumas, on the western part of the property or estate "Gloria", and proceeding along the boundary which leaves to the right the waters of the river Corrego das Anhumas and to the left the waters of the rivulet Ribeirao da Jurema to the highest mountain Morro da Broa, it descends through Corrego Jurema Mirim and the rivulets Ribeirao Jurema and Ribeirao dos Porcos to the mouth of the rivulet Ribeirao do Ururahy, on the southern part of Ururahy, thence it ascends through this rivulet to its principal source and from this to the source of the river Rio Barra Mansa or Cubatao, between the southern and western part of Pindorama, it proceeds through the rivulet Ribeirao Cubatao or Barra Mansa to its mouth in the river Rio Tietè, then through this river to its mouth in Rio Paraná; likewise through that river to the mouth of the river Rio Grande and finally through this river to the mouth of the river Rio Turvo, from which the line of this circumscription takes its beginning. This diocese shall comprise these fifteen parishes: Rio Preto, Ibirà, St. Adelia, Tabapuam, Mirasol, Nova Granada, Monte Aprazivel, Tanaby, Ariranha, Catanduva, Potyrendaba, Ignacio Uchôa, Cedrai, José Bonifacio and Fernando Prestes. The seat and episcopal cathedral of these new dioceses of Jaboticabal and Rio Preto We establish respectively in the cities of Jaboticabal and Rio Preto, from which they take their names, in perpetuity; We therefore raise them to the rank of episcopal cities, together with all the rights and privileges which other episcopal cities in Latin America enjoy. The parish churches, dedicated to the Most Holy Virgin of Mount Carmel in the city of Jaboticabal and to St. Joseph in the city of Rio Preto, which shall exist under the same titles, We respectively raise to cathedral dignity, and at the same time We grant to them and to their Bishops for the time being the rights, honors, insignia, favors, graces and privileges which other cathedral churches and their Prelates in Latin America possess by common law, together with all the burdens and obligations attached to the same. We moreover constitute these same cathedral churches suffragan to the metropolitan Church of St. Paul in Brazil, and We subject their Bishops for the time being to the metropolitan authority of the same Archbishop of St. Paul. Since however the circumstances of the present time do not permit that canonical chapters be instituted in these new dioceses in the usual manner, We grant that in the meantime diocesan Consultors be elected in place of canons according to the norm of law. We further will and command that as soon as it can be done at least a small diocesan seminary be erected in each of the two new dioceses according to the prescriptions of the Code of Canon Law and the norms handed down by the Sacred Congregation for Seminaries, and likewise that each of the dioceses of Jaboticabal and Rio Preto at their own expense send two chosen young men, or at least one, to the Pontifical Pius Latin American Seminary of the City, without interruption in turn, so that under the eyes almost of the Roman Pontiff they may be trained in hope for the Church. As regards the governance and administration of these dioceses, the election of a Vicar Capitular or Administrator, sede vacante, the rights and duties of clergy and faithful and other such matters, We command that the sacred canons be observed as they decree. As for what pertains especially to the clergy, We establish that, as soon as the erection of the aforesaid dioceses has been made, by that very fact the clergy shall be considered ascribed to that Church in whose territory they legitimately exist. The episcopal mensa of these new dioceses shall be constituted by the revenues of the curia and other offerings which are customarily provided by the faithful, for whose benefit these dioceses have been erected, apart from those which have already been collected for this purpose. Moreover, all documents and acts concerning these new dioceses and their clergy and faithful shall be transferred as soon as it can be done from the chancery of the diocese of St. Charles of Pinhal respectively to the chanceries of the new dioceses, so that they may be preserved in their own archives. Finally, We reserve to Ourselves and to the Apostolic See the faculty of freely determining a new dismemberment of these dioceses, whenever it shall seem opportune in the Lord.

2 Therefore, with these decrees and dispositions as aforesaid, we appoint to carry all the same into execution our venerable brother Benedict Aloisi Masella, Archbishop titular of Caesarea in Mauretania, Apostolic Nuncio to the Brazilian Republic, and we grant to him the necessary and opportune faculties, even to subdelegate for the purpose in question any man constituted in ecclesiastical dignity or office, and to remove all controversies arising in any way in the course of execution, imposing upon him the burden of transmitting to the Sacred Consistorial Congregation within six months, to be reckoned from the date of these Letters, an authentic copy of the execution completed. Moreover, these present Letters and whatever is contained in them, even from the fact that anyone concerned, or who presumes his interest to be concerned, has not been heard and has not consented to the foregoing, even if worthy of express, specific and individual mention, can never at any time be noted, impugned or called into question on account of the vice of subreptiousness or obreption or nullity, or of Our intention, or any other defect however substantial and unforeseen; but they shall exist as perpetually valid and shall be, as made and emanated from certain knowledge and fullness of power, and shall obtain and secure their full and complete effects, and ought to be inviolably observed by all to whom it pertains, and if otherwise anything contrary to these should happen to be attempted by anyone, by whatever authority, knowingly or unknowingly, we will and decree that it be wholly null and void and of no effect. Finally, we will that to copies of these Letters, even printed ones, subscribed however by the hand of some public notary and furnished with the seal of some man constituted in ecclesiastical dignity or office, the same faith be given as would be given to these Letters if they were exhibited or shown in the original. Notwithstanding, insofar as it may be necessary, the rules established in synodal, provincial, general and universal councils, general or special apostolic constitutions and ordinances, and any other dispositions of the Roman Pontiffs, our predecessors, and all other things to the contrary whatsoever. Let no one be permitted to infringe these Our Letters of dismemberment, erection, evection, concession, statute, derogation, mandate and Our will, or to act contrary to them. If anyone, however, shall presume to attempt this with rash boldness, let him know that he will incur the indignation of almighty God and of the Blessed Peter and Paul, his apostles. ...

1 : • La Sollicitudo omnium Ecclesiarum a Noi divinamente affidata esige che le circoscrizioni diocesane siano ordinate in modo tale che il governo dei cristiani fedeli risulti più facile e più conveniente. Poiché dunque la diocesi di S. Carlo di Pinhal si estende vastissimamente, Noi, su istanza del venerabile fratello Giuseppe Marcondes Hörnern, Vescovo della medesima Chiesa, abbiamo stabilito che il territorio di questa diocesi sia diviso e che da esso siano erette nuove diocesi. Pertanto, consultati i venerabili nostri fratelli Cardinali della Santa Romana Chiesa preposti alla Sacra Congregazione Concistoriale e ottenuto il favorevole voto del venerabile fratello Benedetto Aloisi Masella, Arcivescovo titolare di Cesarea in Mauritania e Nunzio Apostolico presso la Repubblica Brasiliana, supplito, per quanto occorra, il consenso di coloro che vi hanno interesse o che presumono di averne, con la pienezza della potestà apostolica, dividiamo il territorio appartenente alla medesima diocesi di S. Carlo di Pinhal in tre parti distinte, nella quale una restringiamo e circoscriviamo la diocesi stessa di S. Carlo di Pinhal, e nelle altre due parti erigiamo ex novo diocesi, cioè Jaboticaballense dal nome della città Jaboticabal e Riopretense dal nome della città Rio Preto. La nuova diocesi Jaboticaballense sarà circondata da una linea che ha inizio dal fiume Rio Grande alla foce del fiume Rio Turno, risale per lo stesso fiume fino alla foce del fiume Rio da Onça; prosegue per questo e per il Corrego das Anhumas fino alla sua fonte principale in Fumas, nella parte occidentale della proprietà volgarmente chiamata «Gloria», da qui alla fonte principale del fiume Corrego Rico, nella parte meridionale della medesima proprietà o fazenda «Gloria»; scende per il fiume Corrego Rico fino alla sua foce nel Rio Mogy Guassù; prosegue infine per i fiumi Mogy Guassù, Pardo e Grande fino alla foce del fiume Turno. L'altra diocesi Riopretense avrà i suoi confini per una linea geografica, che procedendo dal fiume Rio Grande alla foce del fiume Rio Turro, risale per questo fiume fino alla foce del fiume Rio da Onça; prosegue per questo e per il fiume Corrego das Anhumas fino alla sua fonte principale in Fumas, nella parte occidentale della proprietà o fazenda «Gloria», e continuando per il confine che lascia a destra le acque del fiume Corrego das Anhumas e a sinistra le acque del ruscello Ribeirao da Jurema fino alla sommità del monte Morro da Broa, scende per il Corrego Jurema Mirim e i ruscelli Ribeirao Jurema e Ribeirao dos Porcos fino alla foce del ruscello Ribeirao do Ururahy, nella parte meridionale di Ururahy, da qui risale per questo ruscello fino alla sua fonte principale e da questa alla fonte del fiume Rio Barra Mansa o Cubatao, tra la parte meridionale e occidentale di Pindorama, prosegue per il ruscello Ribeirao Cubatao o Barra Mansa fino alla sua foce nel fiume Rio Tietè, poi per questo fiume fino alla sua foce nel Rio Paraná; inoltre per questo fiume fino alla foce del fiume Rio Grande e infine per questo fiume fino alla foce del fiume Rio Turvo, dal quale inizia la linea di questa circoscrizione. Questa diocesi comprenderà quindici parrocchie: Rio Preto, Ibirà, S. La sede e la cattedra episcopale delle nuove diocesi Jaboticaballense e Riopretense le costituiamo perpetuamente rispettivamente nelle città di Jaboticabal e Rio Preto, dalle quali esse traggono il nome; le eleviamo perciò al rango di città episcopali, insieme con tutti i diritti e i privilegi di cui godono le altre città episcopali in America Latina. Le chiese parrocchiali, dedicate alla Santissima Vergine del Monte Carmelo nella città di Jaboticabal e a S. Giuseppe nella città di Rio Preto, che continueranno a sussistere sotto questi medesimi titoli, le eleviamo rispettivamente alla dignità di cattedrali, e al contempo ad esse e ai loro Vescovi pro tempore attribuiamo i diritti, gli onori, gli insegni, i favori, le grazie e i privilegi di cui godono le altre chiese cattedrali e i loro Presuli in America Latina secondo il diritto comune, insieme con tutti gli oneri e gli obblighi ad essi annessi. Costituiamo inoltre le medesime chiese cattedrali suffraganee della Chiesa metropolitana di S. Paolo in Brasile e sottoponiamo i loro Vescovi pro tempore alla giurisdizione metropolitica dello stesso Arcivescovo di S. Paolo. Poiché però le circostanze del presente tempo non permettono che nei nuovi capitoli canonicali di queste diocesi siano istituiti nel modo dovuto, concediamo che nel frattempo i Consultori diocesani siano eletti secondo le norme del diritto al posto dei canonici. Vogliamo inoltre e ordiniamo che al più presto possibile sia eretto in ciascuna delle due nuove diocesi almeno un piccolo Seminario diocesano secondo le prescrizioni del Codice di diritto canonico e le norme trasmesse dalla Sacra Congregazione dei Seminari, e che inoltre ciascuna diocesi Jaboticaballense e Riopretense mandi a proprie spese due giovani scelti, o almeno uno, al Pontificio Seminario Pio Latino Americano dell'Urbe, senza interruzione, affinché sotto gli occhi quasi del Romano Pontefice siano formati nella speranza della Chiesa. Per quanto riguarda il governo e l'amministrazione di queste diocesi, l'elezione del Vicario capitolare o dell'Amministratore, sede vacante, i diritti e gli oneri del clero e dei fedeli e altre cose simili, ordiniamo che siano osservati i sacri canoni. Quanto poi riguarda il clero, stabiliamo che, non appena sia avvenuta l'erezione delle predette diocesi, i chierici siano considerati eo ipso ascritti a quella Chiesa nel cui territorio legittimamente si trovano. La mensa episcopale di queste nuove diocesi sarà costituita dai proventi della curia e dalle altre oblazioni, che sono solite essere offerte dai fedeli, nel cui bene le diocesi stesse sono state erette, eccetto quelle che già sono state raccolte a questo fine. Inoltre tutti i documenti e gli atti riguardanti queste nuove diocesi, il loro clero e i loro fedeli siano trasmessi al più presto possibile dalle cancellerie della diocesi di S. Carlo di Pinhal rispettivamente alle cancellerie delle nuove diocesi, affinché siano conservati nei loro archivi propri. A Noi infine e alla Sede Apostolica riserbiamo la facoltà di disporre liberamente una nuova smembrazione di queste diocesi, tutte le volte che ciò nel Signore sarà sembrato opportuno.

2 Pertanto, con questi decreti e disposizioni come sopra, incarchiamo della loro esecuzione il venerabile fratello ^Benedetto Aloisi Masella, Arcivescovo titolare di Cesarea in Mauritania, Nunzio Apostolico presso la Repubblica del Brasile, al quale attribuiamo le facoltà necessarie e opportune, anche di subdelegare a tale effetto qualunque uomo costituito in dignità o ufficio ecclesiastico, e di dirimere tutte le controversie che in qualsiasi modo sorgessero nell'atto dell'esecuzione, imponendogli l'onere di trasmettere alla Sacra Congregazione Concistoriale entro sei mesi, computati da quando queste Lettere saranno date, una copia autentica dell'esecuzione compiuta. Queste Lettere presenti e tutto ciò che in esse è contenuto, anche per il fatto che chiunque ne sia interessato, o presuma di esserlo, non sia stato ascoltato e non abbia consentito alle premesse, anche se degno di menzione espressa, specifica e individuale, non potranno in nessun tempo essere notati, impugnati o messi in controversia per vizio di surrezione, di obbrezione o di nullità, o per difetto di Nostra intenzione, o per qualsiasi altro difetto, anche sostanziale e inaspettato; ma rimangono perpetuamente valide come emanate da Nostra certa scienza e dalla pienezza del Nostro potere, e devono sortire i loro pieni e interi effetti e ottenerli, e devono essere inviolabilmente osservate da tutti coloro a cui spetta; e se da chiunque, con qualsiasi autorità, consapevolmente o inconsapevolmente, fosse tentato il contrario, vogliamo e decretiamo che sia del tutto nullo e vano. Vogliamo infine che ai transunti di queste Lettere, anche se stampati, purché sottoscritti dalla mano di qualche Notaio pubblico e muniti del sigillo di qualche uomo costituito in dignità o ufficio ecclesiastico, sia attribuita la medesima fede che sarebbe attribuita a queste Lettere, se fossero esibite o mostrate nell'originale. Non ostante, per quanto occorra, le regole emanate nei concili sinodali, provinciali, generali e universali, le costituzioni e ordinazioni apostoliche generali o speciali, e qualsiasi altra disposizione dei Romani Pontefici, Nostri predecessori, e tutte le altre cose contrarie. A nessuno sia lecito infrangere queste Nostre Lettere di dismembrazione, erezione, evazione, concessione, statuto, deroga, mandato e Nostra volontà, o contravvenirvi. Se qualcuno invece, con temerario ardimento, presumesse di tentare ciò, sappia che incorrerà nell'indignazione di Dio onnipotente e dei Beati Pietro e Paolo, suoi apostoli. ...
